It is generally assumed that electronic cryptography benefits democracy because it can be instrumental in protecting free speech, which is considered a cornerstone for democracy. The author argues, however, that a close look at some aspects of democratic theory suggests that matters are not really as clear-cut. ABSTRACTMost students of politics are familiar with Carl Schmitt’s definition of politics as a friend–enemy distinction. Yet, only few know of alternative conceptions of politics in interwar Germany that emphasize cooperation and legality over confrontation and decisionism. To unlock such views, this article examines the work of Hermann Heller, a social-democratic constitutional theorist, and takes a close look at his conceptualization of politics as a sphere, activity and discipline. De acordo com as interpretações mais conhecidas (por exemplo, Hofmann, Strauss, Löwith ou Kuhn), o pensamento jurídico e político de Carl Schmitt mantém distância de Aristóteles. Este artigo tem a intenção de mostrar que a concepção de direito de Schmitt, apesar de ser desenvolvida em um contexto diferente, contém semelhanças significativas com o entendimento de direito em Aristóteles.
