It is generally assumed that electronic cryptography benefits democracy because it can be instrumental in protecting free speech, which is considered a cornerstone for democracy. The author argues, however, that a close look at some aspects of democratic theory suggests that matters are not really as clear-cut. The fact that encryption can be abused in many ways also poses a threat to democracy. This paradox is examined in detail.

El artículo aborda la Teoría de la Constitución de Carl Schmitt, atendiendo a su doble acepción de teoría general de la constitución moderna y cuerpo de doctrina acerca de la constitución de Weimar. El primer apartado presenta la sistemática de la teoría positiva de la constitución moderna, reponiendo sus dos elementos estructurantes: la forma política resultante de la aplicación de los principios político-formales de identidad y representación, y las formas de legislación y gobierno propias del Estado de derecho burgués. La (...) segunda parte se centra en el cuerpo de doctrina acerca de la constitución de Weimar que Schmitt desarrolla apelando a las categorías presentadas en la primera parte. En especial, se analizan sus implicancias para comprender la posición de Schmitt respecto a los principales desafíos doctrinarios de la época, contrastando sus posiciones con las de otros grandes juristas contemporáneos. Finalmente, se recapitulan las conexiones de sentido entre los criterios que informan la teoría general de la constitución moderna y la doctrina de la constitución de Weimar, destacando las peculiaridades del esfuerzo de Schmitt por subrayar la integridad de la constitución frente a los diversos modos de relativización que atribuye tanto al positivismo jurídico como a ciertas posiciones políticas de su época. Most students of politics are familiar with Carl Schmitt’s definition of politics as a friend–enemy distinction. Yet, only few know of alternative conceptions of politics in interwar Germany that emphasize cooperation and legality over confrontation and decisionism. To unlock such views, this article examines the work of Hermann Heller, a social-democratic constitutional theorist, and takes a close look at his conceptualization of politics as a sphere, activity and discipline. For Heller, ‘the political’ consists in turning human conflict into social cooperation. (...) For him, the political may be conflictual, but is also conditioned by shared norms and agreed rules. By consequence, to act politically means to order the antagonistic social relations that are typical of every human society. In this sense, politics is a purposeful activity, but one which leaves the content of every decision unconfined and the potentialities that follow endless. Like politicians, politics scholars must reflect on ethical and legal principles, while remaining focused on context-specific political problems. The study of politics cannot be disconnected from the study of law, ethics and social reality. Heller’s work showed that the way we conceive of politics is directly related to the way we study politics and vice-versa. (shrink)

De acordo com as interpretações mais conhecidas (por exemplo, Hofmann, Strauss, Löwith ou Kuhn), o pensamento jurídico e político de Carl Schmitt mantém distância de Aristóteles. Este artigo tem a intenção de mostrar que a concepção de direito de Schmitt, apesar de ser desenvolvida em um contexto diferente, contém semelhanças significativas com o entendimento de direito em Aristóteles. Para mostrar essa proximidade, considera-se especialmente a noção de totalidade presente no conceito aristotélico de polis, que implica que a unidade política é (...) o principal modo de se realizar o direito. According to mostly known interpretations (e.g.: Hofman, Strauss, Löwith or Kuhn), the legal and political thought of Carl Schmitt keeps distance from Aristotle's. This article intends to show that Schmitt's concept of law, despite developed in a different context, holds significant likelihood with Aristotle's comprehension of law. With the Purpose of building this proximity, the notion of entirety present in the Aristotelic concept of polis implies that political unit is the main way to accomplish law. (shrink)
