What would it mean to have a suitably ‘realistic’ account of political liberty? On the one hand, I don’t think we can properly understand liberty without an underlying account of personhood or agency.2 In making sense of liberty, we need to ask: What kind of agency does it presuppose or promote? What kind of independence do we care most about? What does it mean to exercise control, or to be self-guiding, in the kind of world we live in today? At (...) the same time, a conception of moral and political personhood needs to be appropriately ‘realistic’: It shouldn’t be over-idealized (or over-simplified), nor demand more than can be reasonably expected, given the kind of creatures we are. In order to develop a deep and detailed reflection on global norms, international law scholars need to pay more attention to insights supplied by the discussions on the philosophical problem of universals. Using the examples of the discussion on universals in Leibniz and Hobbes, the paper demonstrates the importance of the philosophical problem of universals to discussions on the possibility of global norms. In particular, the comparative study of Leibniz and Hobbes demonstrates that a world divided in states mostly presupposes (...) a denial of universals and thus an impossibility of truly global norms. Although in such a world cooperation and agreement between states is desirable and possible, the resulting agreement does not reach the threshold of normativity required under this view. On the other hand, truly global norms become possible if one accepts the existence of universals following Leibnizian tradition. However, in this case, the nature of normativity changes. Moreover, while states do not need to disappear, their role changes significantly and the main unit of consideration becomes the individual human being. Under this view, a wide variety of actors at the international arena are accorded equal importance. Based on lessons learned from this discussion, the article demonstrates how the questions raised by an explicit inclusion of the philosophical problem of universals into debates about global norms have continuing relevance today. Este trabajo se propone contribuir al proyecto de atribuirle a Hobbes una teoría autónoma de la política, la cual defiende la existencia de cuestiones políticas que no pueden ser subordinadas lógicamente a otras esferas como la moral o la religión. Según esta posición los conflictos políticos no pueden ser meramente atribuidos, por ejemplo, a la inmoralidad o irreligiosidad de los involucrados, sino que incluso personas completamente morales y religiosas podrían llegar a verse envueltas en conflictos políticos.

Fear, which has always been one of the most powerful of human passions, has grown in importance during modernity. First with Machiavelli and later especially with Hobbes, fear has become one of the foundational ideas of modern political philosophy. If fear, especially fear of death, does indeed occupy a central place in the foundation of modern politics, then it is necessary to study carefully the implications and consequences of the transhumanist attempt to overcome death. Among the main aspirations of transhumanism (...) is the search for almost infinite longevity and, eventually, the total abolition of aging. Therefore, it is necessary to understand the specific role that fear of death has played in modern political philosophy to understand the possible effects that an eventual overcoming of death would have, albeit partial, as wanted by transhumanists. While the possibility of achieving immortality seems unlikely, this doesn’t mean that we shouldn’t study what’s behind this transhumanist aspiration. In this way, transhumanism seems the final consequence of modern development, since it’s in continuity with the modern attempt to respond to the fear of death, but it does so by trying an ultimate solution to it through the elimination of death, at least by sickness and old age. In this paper, we will review the role of fear of death in the founding of modern political philosophy by Machiavelli and Hobbes, and then we will analyse the transhumanist attempt to overcome death as a consequence of this fear and its possible political effects. Why do human beings make and accept promises? What human interest is served by this procedure? Many hold that promising serves what I shall call an information interest, an interest in information about what will happen. And they hold that human beings ought to keep their promises because breaches of promise threaten this interest. On this view human beings take promises seriously because we want correct information about how other human beings are going to act. Some such view is taken (...) for granted by most philosophical accounts of promissory obligation.1 I agree that human beings do want such information and that they often get it by accepting promises. But I doubt that promising exists because it serves this information interest. (shrink)

This paper has two main sections. First, I argue that Hobbes was capable of providing a convincing model of political authority that strengthened the absolutist monarchy, due to two main factors: on the one hand, Hobbes’ conceptualization of freedom, which allowed him to offer a new light upon the relationship between obedience, obligation, freedom and servitude; on the other hand, Hobbes’ redefinition of sovereignty via the concept of representation. I show how Hobbes was aware of the intrinsic tension derived from (...) the attempted convergence of these two distinct logics and I question the kinds of political rupture that are possible under Hobbes’ design, in such a way that would keep a democratic instinct and impulse in political life. After I revisit the relationship between freedom, power and civil disobedience, by looking at the relationship between the sovereign’s and the subjects’ capacity of judgment and by reflecting upon contemporary democratic challenges. This paper critically assesses the possibility of moral enhancement with ambient intelligence technologies and artificial intelligence presented in Savulescu and Maslen (2015). The main problem with their proposal is that it is not robust enough to play a normative role in users’ behavior. A more promising approach, and the one presented in the paper, relies on an artifi-cial moral reasoning engine, which is designed to present its users with moral arguments grounded in first-order normative theories, such as Kantianism or utilitarianism, (...) that reason-responsive people can be persuaded by. This proposal can play a normative role and it is also a more promising avenue towards moral enhancement. It is more promising because such a system can be designed to take advantage of the sometimes undue trust that people put in automated technologies. We could therefore expect a well-designed moral reasoner system to be able to persuade people that may not be persuaded by similar arguments from other people. So, all things considered, there is hope in artificial intelli-gence for moral enhancement, but not in artificial intelligence that relies solely on ambient intelligence technologies. (shrink)

The essay is a discussion of Christian Wolff’s attempt to justify morality on rational grounds and provide an adequate response to the free will controversy, securing freedom against determinism. It is shown that Wolff failed to deliver a satisfactory solution to this issue. His position known as a “half-determinism” does not provide a philosophical truce between freedom and determinism. Instead, it leads to a series of mistakes and philosophical implications that indicate an unresolved philosophical problem.

Cyber warfare has changed the scenario of war from an empirical and a theoretical viewpoint. Cyber war is no longer based on physical violence only, but on military, political, economic and ideological strategies meant to exploit a state’s informational resources. This means that a deeper understanding of what cyber war is requires us to adopt an informational approach. This approach may enable us to account for the two-dimensional nature of cyber war, to revise the notion of violence on which war (...) is premised and to understand to what extent the traditional ideas of ‘just war’ may apply to the scenario of cyber warfare. This point is crucial, since it concerns whether a cyber war is meant to restore a broken international political and legal order or to participate in its construction. (shrink)

Hobbes repeatedly expressed concerns about moral and political language, e.g., about the bad consequences of various uses and misuses of language. He did not simply focus on the consequences though. He also attempted to understand the problems, using the central semantic notion in his philosophy of language, signification. Hobbes, in both the Elements of Law and Leviathan, argues that a wide variety of terms – including ‘good’, ‘bad’, and the names of virtues and vices – have a double and inconstant (...) signification. This paper explores and explains that theory of Hobbes's. (In the course of the discussion, two other interpretations of Hobbes's claims are discussed: Pettit’s discussion in terms of indexicals, and Alexandra’s in terms of sense and reference.) This phenomenon is, Hobbes thinks, pervasive in our use of moral and political language. Indeed he says his analysis applies to all “names of such things as affect us, that is, which please, and displease us” (Leviathan 4.24), which seems a very broad category indeed. This inconstancy of signification has considerable potential to cause confusion and conflict. Given those practical consequences, it is of some importance for Hobbes to find a solution to this problem. The paper examines several possible Hobbesian solutions to the problem. There is, however, reason to think that these suggested solutions cannot completely solve the problem. The paper concludes, then, by arguing that double and inconstant signification would always be a danger, even in a properly constituted Hobbesian commonwealth. (shrink)

This commentary contends that Larry May’s Hobbesian argument for limitations on sovereignty and lawmaking in Limiting Leviathan does not succeed. First, I show that Hobbes begins with a plausible instrumental theory of normativity. Second, I show that Hobbes then attempts, unsuccessfully—by his own lights—to defend a kind of non-instrumental, moral normativity. Thus, I contend, in order to successfully “limit the Leviathan” of the state, the Hobbesian must provide a sound instrumental argument in favor of the sovereign limiting their actions and (...) lawmaking. But, I argue, neither Hobbes nor May provides such an argument. (shrink)

In this article I discuss the main theses of the realist political philosophy developed in recent years by Raymond Geuss and embodied in his famous Philosophy and Real Politics. Once the motivations behind Geuss’ project identified and its similarities and differences with the other great realistic philosophical-political project of our days, that of Bernard Williams, pointed out, I critically expose Geuss’ theses and his objections to the Kantian and Rawlsian ways of doing political philosophy. Feminist metaphysics is simultaneously feminist theorizing and metaphysics. Part of feminist metaphysics concerns social ontology and considers such questions as, What is the nature of social kinds, such as genders? Feminist metaphysicians also consider whether gendered perspectives influence metaphysical theorizing; for example, have approaches to the nature of the self or free will been conducted from a masculinist perspective, and would a feminist perspective yield different theories? Some feminist metaphysicians develop metaphysical theories with the aim of furthering certain social goals, (...) such as gender equality. Despite these and other intriguing research projects, feminist metaphysics faces challenges from two flanks: one might argue that "feminist metaphysics" is not metaphysics, or one might argue that it is not feminist. Recently, Elizabeth Barnes has made the case that, since contemporary accounts of the nature of metaphysics focus primarily on the fundamental, they have the problematic implication that feminist metaphysics is not, properly speaking, metaphysics. However, less emphasis has been paid, of late, to the idea that major strands of feminist thought also problematize feminist metaphysics. I will briefly assess the metaphysician's case against feminist metaphysics in Section 2 of this chapter. Then, in Section 3, I will examine in more detail possible feminist concerns over metaphysics. In Section 4, I sketch a different conception of metaphysics that avoids both mainstream and feminist challenges to feminist metaphysics. (shrink)

The aim of this text is to elucidate the concept of citizenship of Jean-Jacques Rousseau. This conception of citizenship can be denominated like Republican. For this, the concept of citizenship in Rousseau is addressed in three fundamental principles: freedom, equality and fraternity. Some traditional political conceptions of contractualism as Hobbes and Locke are considered, especially in relation to their conceptions of citizen. Following this, those fundamental aspects of the anthropology conceived by Rousseau are realized. Those allow to reach at the (...) construction of his idea of republic. In addition, the three fundamental principles, that characterize citizenship in the republican sense, are developed. And so the conclusion is the formulation of a truly democratic state from the perspective of Rousseau, inspired by the republican state of the ancients and where the people is properly the legislator of this. Gender greatly impacts access to opportunities, potential, and success in corporate leadership roles. We begin with a general presentation of why such discussion is necessary for basic considerations of justice and fairness in gender equality and how the issues we raise must impact any ethical perspective on gender in the corporate workplace. We continue with a breakdown of the central categories affecting the success of women in corporate leadership roles. The first of these includes gender-influenced behavioral factors, such as the (...) requirements and expectations of gendered verbal and nonverbal communication styles as well as appearance. We move on to address the impact of family on corporate leadership opportunities and success, discussing the asymmetrical evaluation of an individual’s potential, authority, and competence based on gender stereotypes of familial obligations and expectations. Finally, we address how gender impacts access to networking and sponsorship opportunities and the long-term effects of systematic limitations on women’s inclusion in the upper echelons of corporate leadership. We conclude with a summary of the questions and issues raised by our discussion and direct individuals to consider how different ethical systems and moral requirements might influence their interpretations of gender and leadership in the corporate workplace. In the international sphere, sovereignty and fundamental rights are often at odds, giving these rights little space for action and, in general, only after crisis has led to tragedy, and tragedy to disgrace. International Law, on the other hand, consistently succumbs to forms of domination and power, and its scope of action is often limited to certain codifications which are frequently suspended by political exception. Sixteenth century Dominican theologian, Francisco de Vitoria, established the principles for a Law of the people, (...) based on secular civil power that, while still exercising internal sovereignty, could defend and privilege the “rights of all men” over the exercise of power and private interest. This article focuses on this dispute to show Vitoria’s position, who long preceded the great declarations of human rights of the 18 th century, presenting an original doctrine within the framework of an emerging globalization and based on the defense of fundamental rights. For well over a century the dominant narrative covering the major thinkers and themes of early modern British philosophy has been that of “British Empiricism”, within which the great triumvirate of Locke-Berkeley-Hume are taken to be the dominant figures. Although it is now common to question this schema as a way of analyzing and understanding the period in question, it continues to command considerable authority and acceptance. (One likely reason for this is that no credible or plausible alternatives structures or (...) schemas of analysis have suggested themselves.) Be this as it may, the analysis of the rival systems of Clarke, Berkeley and Hume makes clear that this narrative, however deeply entrenched it may be, is wholly misleading and both distorts and obscures key themes and figures in the period in question. David Hume has been largely read as a philosopher but not as a scientist. In this article I discuss his work exclusively as a case of science; in particular as a case of early modern science. I compare the moral psychology of self-interest, sympathy and sentiments of humanity he argues for with the moral psychology of universal self-interest from Bernard Mandeville, presenting the controversy between the two as a case of theory choice.

Este trabajo analiza el argumento acerca de la aprioridad de la soberanía de la voluntad del pueblo en la sección El derecho público de la Doctrina del derecho. Allí Kant, más que presentar una tesis absolutamente original, como en la sección El derecho privado, en donde llega a la necesidad de la voluntad general legisladora a través del concepto de reciprocidad; sigue ideas de Rousseau y se centra en la libertad jurídica como dependencia de la ley que uno mismo se (...) ha dado. Sostendré que, por motivos sistemáticos, Kant lleva a cabo una idealización normativa de la volonté générale rousseauniana. No obstante, la distinción fundamental entre respublica noumenon y respublica phaenomenon no implica que, desde una perspectiva práctica, el ideal republicano esté completamente escindido del ámbito fenoménico. Muy por el contrario, la república pura ejerce una fuerza normativa sobre la praxis política. (shrink)

In much of the literature on Hobbes, he is considered a proto-liberal, that is, he is seen as setting up the apparatus that leads to liberalism but his own authoritarian streak makes it impossible for liberals to completely claim him as one of their own. In this paper, I argue that, far from being a precursor to liberalism, Hobbes offers a political theory that is implicitly anti-liberal. I do not mean this in the conventional sense that Hobbes was too conservative (...) for liberalism. On the contrary, I will argue that in his writing, Hobbes evinces a concept of collective interpretation, theories of individualism and the nature and possibilities for democratic politics, that is radical and offers a completely developed alternative to liberalism even as it eschews conservative and reactionary models as well. I focus in particular on the idea of individualism and how the model offered by liberals and conservatives offers far less in terms of individual choice and justice than Hobbes’s own theory does, however paradoxical this may seem. In the following article we will discuss the methodology and presentation of arguments to prescribe a theory of better governance exposed by two eminent thinkers of politics as they were James Harrington and Thomas Hobbes. Then, we contrast the theoretical development of both authors under the conceptions of political philosophy and political science exposed by Giovanni Sartori and Norberto Bobbio. We conclude with a critique of a seated prejudice in some academic circles of political science.

RESUMEN Este artículo se ocupa de la doctrina del reconocimiento que Hobbes dejó claramente insinuada a lo largo de sus escritos políticos. Para ello, aborda la exposición sistemática del canon de "leyes naturales" que elaborara Hobbes en obras como Elementos de Derecho Natural y Político, Tratado sobre el Ciudadano y Leviatán. Nuestra tesis de fondo es que la exposición de estas leyes, llamadas también por Hobbes "leyes morales", lleva al autor a postular la idea de que la "igualdad natural" de (...) los hombres, por la cual entiende la igualdad de derechos, no ya la igualdad de poder, solo se ve asegurada en la medida en que los individuos se reconozcan intersubjetivamente como portadores de los mismos derechos que, en tanto que hombres, les pertenecen. La tesis señalada pretende evidenciar que, contrario a lo que expone la lectura tradicional de Hobbes, que se concentra en la índole absolutista del poder, Hobbes remonta la posibilidad misma de la vida civil y política, no ya a mediación del Estado absoluto y su poder coercitivo, sino al reconocimiento intersubjetivo de los derechos, el cual obtiene su fuerza normativa de la conciencia moral de cada hombre. Este artículo se propone mostrar que con su postulado Hobbes logra esbozar una protomoral del reconocimiento que repercutiría en el discurso filosófico de la modernidad. Este propósito es uno con el de mostrar las dificultades, las tensiones y los límites del planteamiento hobbesiano. ABSTRACT This paper deals with the doctrine of recognition that Hobbes clearly implied throughout his political writings. To this end, it deals with the systematic exposition of the canon of "natural laws" that Hobbes elaborated in works such as Elements of Natural and Political Law, Treatise on the Citizen and the Leviathan. Our underlying thesis is that the exposition of these laws, also called "moral laws" by Hobbes, leads the author to postulate the idea that the "natural equality" of men, by which he understands equality of rights, not equality of power, is only assured to the extent that individuals are intersubjectively recognized as bearers of the same rights that, as men, belong to them. This thesis seeks to show that, contrary to the traditional reading of Hobbes, which concentrates on the absolutist nature of power, Hobbes traces the very possibility ofcivil and political life, not to the mediation of the absolute State and its coercive power, but to the intersubjective recognition of rights, which obtains its normative force from the moral conscience of each man. The present article intends to show that with its postulate, Hobbes manages to outline a protomoral of recognition, which would not remain without repercussion in the philosophical discourse of modernity. This purpose is one with the one to show the difficulties, the tensions and the limits of the Hobbesian approach. (shrink)

This dissertation discusses the work of Thomas Hobbes, and has two main themes. The first is Hobbes's materialism, and the second is Hobbes's relationships to other philosophers, in particular his place in the mechanist movement that is said to have replaced Aristotelianism as the dominant philosophy in the seventeenth century. -/- I argue that Hobbes does not, for most of his career, believe the general materialist view that bodies are the only substances. He believes, rather, that ideas, which are our (...) main mechanism for thinking about the world, allow us to understand many bodies, but not to understand every thing we recognize to exist. The incomprehensible things include God---and, early in Hobbes's career, the human mind. Discussing materialism and our knowledge of God leads me to engage with the debate over Hobbes's alleged atheism. I argue that the evidence for Hobbes's atheism is weak at best. Hobbes is a sincere theist, though his view is sometimes unusual. -/- My discussion of Hobbes's relationships to other philosophers has three parts. In chapter five I argue that Hobbes's views about method are in important ways similar to Zabarella's. In chapter six I look at Hobbes's rejection of the view, held by some scholastic Aristotelians, that accidents can sometimes exist without inhering in substances. Thus we see two sides of Hobbes's interaction with the Aristotelian tradition. Sometimes that interaction is just rejection, but at other times Hobbes takes over views from that tradition. Then in chapter seven I consider whether, and in what sense, Hobbes is a mechanist. I argue that the narrative of mechanism and Aristotelianism is a less powerful explanation than it has seemed to some to be, because it is hard to see what mechanists have in common. (shrink)

David Hume has been largely read as a philosopher but not as a scientist. In this article I discuss his work exclusively as a case of science; in particular as a case of early modern science. I compare the combined moral psychology of self-interest and sympathy he argues for with the moral psychology of universal self-interest from Bernard Mandeville, presenting the controversy between the two as a case of theory choice under the normative methodology of the vera causa from the (...) eighteenth century, using inductive support, experimentum crucis and simplicity as criteria. On all three criteria I conclude that Mandeville’s theory of universal self-interest wins the controversy. (shrink)

Starting with his analysis of Carl Schmitt’s Concept of the Political and its critique of liberal “neutralization and depolitization”, Strauss posits an affirmation of the (...) problem of natural right, for which it is a fundamental first step to study the political philosophy of Hobbes. In contrast with Schmitt and Hobbes, Strauss´ thought points towards a consideration of classical natural right as a riposte to the political nihilism or apolitical cosmopolitanism of late-modernity, both products of radical historicism as well as methodological positivism. Strauss considers the search of natural right qua representation of the idea of justice a distinct alternative to the affirmation of the will through sovereign power. This study seeks to critically explore the link between sovereignty, violence and war in Giorgio Agamben’s Homo Sacer series and Thomas Hobbes’s Leviathan. From a brief rereading of Leviathan’s main arguments that explicitly revolves around the Aristotelian distinction between actuality/ potentiality, it will conclude that Hobbesian pre-contractual violence is primarily based on what Hobbes terms “anticipatory reason” and the problem of future contingency. Relying on Foucauldian insights, it will be emphasized that the assumption of certain potentialities suffices in leading to (...) Hobbes’s well-known conclusion that the state of nature is a “condition of Warre.” In a second step, this study considers some of Agamben’s arguments to account for how pre-contractual violence as envisioned by Hobbes cannot be rendered impotent through the integration of a sovereign. In specific, Agamben’s claims shed light on an irreducible, inextricable entwining between the state of nature and the state of law as “Siamese twins” (Virno). On a meta-level, Agamben thus implicitly shows how the “Hobbesian problem” cannot be merely reduced to a “problem of order” (Parsons). With regard to the current functioning of the stratagems of financial markets and the mechanisms of future-colonization underpinning global politics, this study finally argues that Hobbes ought to be reevaluated in particular regarding the problem of the future in his account. Partly responding to Agamben’s critical investigations, I suggest that a careful exploration of what will be coined “the prospects of an actualization of the potentiality not-to-be” might serve as a first theoretical step towards a productive form of criticism. Hutcheson fonde sa théorie morale sur un « sens moral ». Ce sens nous permet de faire des distinctions morales. Cette théorie donnera lieu à un débat sur la réalité des valeurs morales. Selon certains commentateurs, nos distinctions morales portent sur des faits moraux réels que l’on peut connaître empiriquement grâce à notre sens moral. Inversement, certains soutiendront que le sens moral ne produit pas de connaissance morale. Les jugements moraux issus de ce sens sont des réponses émotionnelles plus ou (...) moins fiables que l’on ressent face à des motivations qui nous semblent être vertueuses. Nous montrerons que, selon Hutcheson, nos jugements moraux sont bien des réponses émotionnelles, mais qu’ils ont néanmoins un critère d’objectivité. Notre sens moral, grâce à la Providence divine, a pour fonction de préserver le bien-être de l’humanité. Cette fonction du sens moral sert de critère pour évaluer le bon fonctionnement de ce sens moral. (shrink)

Per meglio comprendere la rilevanza della posta in gioco – le condizioni effettive di democratizzazione delle nostre democrazie – è opportuno svolgere alcune considerazioni sul problema generale della legittimità del potere politico, che possiamo ricapitolare in tre punti: ciò che viene reputato legittimo (l’oggetto), 2. chi decide della legittimità (il soggetto) e 3. il criterio che la definisce (l’argomento) . A seconda delle risposte ne discendono diverse visioni della politica. Nel ricostruire il tema introdurremo dei concetti fondamentali – politica, potere, (...) effettività, legittimità, legalità, giustizia, libertà, etc. – e ci avvarremo del contributo di alcuni autori che Norberto Bobbio identificava come “classici”, non secondariamente, per la capacità di elaborare delle categorie generali di cui non si possa fare a meno per interpretare la realtà storico-sociale, anche quella differente dal contesto di genesi e d’uso della loro opera (I). Da ultimo, in maniera assai provvisoria, dovremo chiarire la prospettiva storico-evolutiva, di matrice habermasiana, che orienta l’analisi di Ampola sui modelli di legittimazione degli odierni stati democratici di diritto. Le diverse giustificazioni del potere politico possono essere non solo esaminate e comparate dal punto di vista dei concetti fondamentali e della logica argomentativa e neppure solo documentate storiograficamente nelle loro forme compiute o distorte di istituzionalizzazione. Sullo sfondo della riflessione sulla democratizzazione c’è l’assunto che la costellazione dei problemi si collochi nel quadro di uno sviluppo normativo discontinuo delle società umane di cui la teoria dell’evoluzione sociale può ricostruire la logica e la dinamica (II). In this work I argue an interpretation on Thomas Hobbes’s thought and its relation with international law. Several scholars argue that Hobbes reject the international law. Nevertheless, I will prove that it is possible to find a legal theory on international law in his works, if it takes to account the historical context and the peculiarities of global order in the Modern Age. In this way it is possible to understand why Carl Schmitt said that Hobbes was one of the (...) founders of Ius Publicum Europaeum, sentence that the German jurist did not prove. My aim is to locate Thomas Hobbes into the History of Legal International Ideas. (shrink)
