This article examines where Kant stands on the question of the redistribution of wealth and income both nationally and globally. Kant is rightly seen as a radical reformer of the world order from a political standpoint seeking a republican, federative worldwide system; can he also be seen as wanting to bring about an equally dramatic shift from an economic perspective? To answer this question we have first of all to address the question of whether he is an egalitarian or an (...) inegalitarian at the national level. Certainly there are certain social and material inequalities within a civil society Kant is prepared to accept and there are some he is not. This would imply that he would affirm certain inequalities at an international level and that there are others upon which he would recommend action. Thus the question arises as to whether or not it is appropriate for Kantians to regard the current enormous inequalities in wealth and income between individuals living in different parts of the globe as scandalous and in need of change. The paper throughout relates the problem of distributive justice within the state to the problem of distributive justice amongst states, arguing that this approach is warranted by Kant's own method. Particular attention is paid to how Kant's own approach to political philosophy may be deployed to underpin a change to a distinctive type of international distributive justice. (shrink)

Kant’s theory of citizenship replaces the French revolutionary triptych of liberty, equality and fraternity with freedom (Freiheit), equality (Gleichheit) and civil self-sufficiency (Selbständigkeit). The interpretative question is what the third attribute adds to the first two: what does self-sufficiency add to free consent by juridical equals? This article argues that Selbständigkeit adds the idea of interdependent independence: the independent possession and use of citizens’ interdependent rightful powers. Kant thinks of the modern state as an organism whose members are agents possessed (...) of rightful (productive) powers, whose interdependent mode of exercise independently of unilateral permission matters for right. The empirical form of that ideal, according to Kant, is a republic of independent commodity producers. I will show that this reading of Selbständigkeit can consistently explain Kant’s disenfranchisement of women, wage labourers and landless farmers; that it offers a robust alternative to influential republican, libertarian and proprietarian interpretations of the Kantian state; and that it can buttress an original account of community as productive interdependence. Contrary to much Kant interpretation, this article argues that Kant's moral philosophy, including his account of charity, is irrelevant to justifying the state's right to redistribute material resources to secure the rights of dependents (the poor, children, and the impaired). The article also rejects the popular view that Kant either does not or cannot justify anything remotely similar to the liberal welfare state. A closer look at Kant's account of dependency relations in “The Doctrine of Right” reveals an argumentative structure (...) sufficient for a public institutional protection of dependents and evidence that Kant identifies concerns of economic justice as lying at the heart of the state's legitimacy. The paper defends that it is possible to offer a Kantian argument for justifying the introduction of Universal Basic Income (UBI). It first briefly presents Philippe van Parijs’ argument for UBI based on the concept of real freedom for all. In doing so, it will focus on its general structure and central insight, without entering too much into other issues like the economic feasibility of UBI. It second briefly presents Kant’s concept of external freedom and especially focuses on some of (...) its components to assess whether there is some closeness to van Parijs’ concept of real freedom. It further considers whether UBI is not only compatible with a Kantian position, but can be justified from such a position because it represents a tool for concretely realizing external freedom as presented in the _Doctrine of Right_ and for attaining the ethical ideal of virtuosity presented in the _Doctrine of Virtue_. Este trabajo tiene por objetivo evaluar los distintos argumentos que se han elaborado para explicar el deber de asistencia a los pobres en la filosofía política kantiana. En primer lugar, nos concentraremos en desarrollar, puntualizar y criticar los intentos de justificación de dicho deber a partir de concepciones minimalistas del Estado, consideraciones instrumentales o apelaciones al valor de la dignidad humana. Acto seguido, examinaremos los principales argumentos de corte republicano que se han elaborado a los mismos efectos. Dado que unos (...) y otros se muestran insatisfactorios, intentaremos esbozar la estructura de un argumento más robusto en favor del deber de asistencia a los pobres a partir del concepto de “posesión común originaria del suelo”. We often make a distinction between what we owe as a matter of repayment, and what we give or offer out of charity. But how shall we describe our obligations to fellow citizens when we are in a position to be charitable because of a past injustice on the part of the state? This essay examines the moral implications of past injustice by considering Immanuel Kant's remarks on this phenomenon in his lectures and writings. En este trabajo intento hacer algunos aportes al diálogo entre María Julia Bertomeu y Nuria Sánchez Madrid publicado en Con-Textos Kantianos en 2019. Me interesa establecer que la teoría kantiana de la propiedad es una teoría crítica que no justifica los derechos de propiedad privada y las relaciones de propiedad existentes sino que sirve para señalar el carácter no absoluto de los derechos de propiedad privada y la necesidad normativa de modificar las relaciones de propiedad existentes.

While there are many points of opposition between the political philosophies of Marx and Kant, the two can greatly benefit from one another in various ways. Bringing the ideas of Marx and Kant together offers a promising way forward for each view. Most significantly, a powerful critique of capitalism can be developed from their combined thought: Kant’s political philosophy offers a robust idea of freedom to ground this critique, while Marx provides the nuanced understanding of social and political power structures (...) under capitalism that allows this idea of freedom to be properly applied. This paper concentrates on the way Kant's distinction between duties of right and duties of virtue operates at the interstate level. I argue that his Right of Nations (V ölkerrecht) can be interpreted as a duty to establish a kind of interstate distributive justice (that is, as a duty to secure states in their independence and territorial possessions), which is called for to secure domestic distributive justice and to protect individuals' freedom and private property. Or at least this is 'ideal (...) theory' for, as I specify, this cosmopolitan linkage is compromised by Kant's endeavour to accomodate the existence of non-republican states. (shrink)

The main purpose of this article is to bring into relief the difficulties faced by generous interpretations of the Kantian problem of poverty and to propose an alternative interpretation which (a) agrees with some generous interpretations that Kant's juridical treatment of poverty is to be understood by analogy with his juridical treatment of slavery, but which (b) departs from generous interpretations in general by arguing that this analogy is not to be understood in terms of “dependence” as such, but in (...) terms of “depersonification.” More specifically, it argues that what makes slavery and poverty unjust for Kant is not that they entail a human being finding herself (completely) dependent on the choice of another human being, but that they entail a human being being deprived of her juridical personality. The Kantian problem of poverty is ultimately a problem of juridical depersonification, and this problem of juridical depersonification does not arise in all (complete) dependence relations. (shrink)

The broader notion of citizen as cohabitant allows for the changing relationship a citizen will have with her citizenship rights and accommodates individuals who are not self-governing but who, nonetheless, share a democratic space.

The coercive authority of the Kantian state is rationally grounded in the ideal of equal external freedom, which is realized when each individual can choose and act without being constrained by another's will. This ideal does not seem like it can justify state-mandated economic redistribution. For if one is externally free just as long as one can choose and act without being constrained by another, then only direct slavery, serfdom, or other systems of overt control seem to threaten external freedom. (...) Yet Kant endows the freedom-based state with considerable powers of economic redistribution. I argue that recent commentary has misunderstood both Kant's account of why poverty is a form of freedom-threatening dependence and the extent of the Kantian state's powers for remedying poverty. Criticizing Arthur Ripstein and the Kantianism of the “Toronto-School,” I argue that the most salient notion of dependence at issue within the Kantian framework is not the direct control of the choice-making capacities of another but asymmetrical influence in a power relationship. For Kant, poverty is fundamentally a problem of structural disempowerment. (shrink)

I have two goals in this paper. First, I want to determine whether Kant’s justification for state programs for poverty relief in The Doctrine of Right is based on 1) Kantian duties of virtue, 2) Kantian duties of right, or instead merely on 3) instrumental arguments regarding the preservation of a State as such. I claim that the last alternative is the correct one. Second, I will argue, against Kant himself, that even his merely instrumental arguments for public programs for (...) poverty relief are ruled out by his doctrine of right. My conclusion is that, perhaps surprisingly, the only genuinely Kantian way to provide poverty relief is privately, just as Libertarians have argued. (shrink)

En este artículo intervengo en la discusión sobre si es posible encontrar en la filosofía política de Kant una fundamentación de los derechos sociales básicos. Me centraré en primer lugar en dar sentido a la idea de una doctrina metafísica del derecho. En segundo lugar, trataré de mostrar dónde se encuentran los límites de la doctrina metafísica del derecho de Kant a la hora de debatir sobre la forma en que la sociedad debe o debía organizarse (en los tiempos actuales, (...) pero también en la época de Kant). Por último, esbozaré rutas alternativas para usar el enfoque metafísico de Kant con el fin de abordar cuestiones de justicia social, en particular, el tema de la pobreza. (shrink)

En el presente trabajo se analizan tres concepciones de la igualdad de oportunidades que G. A. Cohen presenta en ¿Por qué no el socialismo?, a saber, la acepción liberal burguesa, la liberal de izquierdas y la socialista. Este trabajo pretende exponer y discutir estas tres concepciones de la igualdad de oportunidades a través de la filosofía jurídica y política de Kant y al proyecto de una crítica de la economía política de Marx.

Durante décadas, los teóricos interesados en la discusión de Kant sobre el bienestar han estudiado la postura de Kant sobre la cuestión de la redistribución de bienes en la sociedad. Lo han hecho tanto para aclarar su postura como para una fuente de inspiración para problemas conceptuales actuales, frente a filósofos políticos contemporáneos que intentan reconciliar el ideal de la libertad igualitaria con la necesaria interferencia asimétrica para la redistribución y la provisión social. En este artículo, comienzo por la breve (...) discusión kantiana sobre el estado del bienestar en la Doctrina del derecho e identifico cuatro premisas que Kant afirmó con claridad como características de su postura. Posteriormente, propongo las cinco vías interpretativas principales en la interpretación de la obra de Kant, las evalúo y las ordeno. La interpretación más acertada de la justificación kantiana del bienestar, que llamo la postura “genuinamente kantiana” no llega a explicar, sin embargo, la naturaleza del deber del bienestar que propone. Propongo una solución, retrotrayéndome en los textos kantianos, que unida a otras consideraciones y cuestiones, se puede entender como el punto de partida de una nueva vía de interpretar este tema.
