Este artigo tem a intenção de mostrar que a concepção de direito de Schmitt, apesar de ser desenvolvida em um contexto diferente, contém semelhanças significativas com o entendimento de direito em Aristóteles. Para mostrar essa proximidade, considera-se especialmente a noção de totalidade presente no conceito aristotélico de polis, que implica que a unidade política é (...) o principal modo de se realizar o direito. According to mostly known interpretations (e.g.: Hofman, Strauss, Löwith or Kuhn), the legal and political thought of Carl Schmitt keeps distance from Aristotle's. This article intends to show that Schmitt's concept of law, despite developed in a different context, holds significant likelihood with Aristotle's comprehension of law. With the Purpose of building this proximity, the notion of entirety present in the Aristotelic concept of polis implies that political unit is the main way to accomplish law. (shrink)

Drawing upon the thought of Giorgio Agamben, this essay focuses upon the potential of a single act to change a political order. Agamben’s writings retain the possibility for a paradigmatic gesture that opens a space for a politics not founded on a form of belonging grounded in a particular property, such as national identity. To illustrate this event this essay turns to Agamben’s construction of whatever-being, which is constructed hyper-hermeneutically. This term is chosen deliberately. Whatever-being retains a hermeneutic structure, but (...) is constructed through singular paradigmatic examples. These examples are evidence for whatever-being’s existence as a pure singularity, unable to be reduced to a particular quality. Such examples are gestures that allow future modes of belonging to separate themselves from oppressive foundations and dominating constructions of political existence, through revealing the possibility of a new way of being that does not require a revolutionary “zero hour” to be brought about. The philosophies of Søren Kierkegaard and Albert Camus have typically been considered as inverted images of each other. Kierkegaard turns to faith in God as a path of redemption from meaninglessness while Camus rejects faith as a form of intellectual suicide and cowardice. I argue that an analysis of key terms of contest—faith and lucidity, revolt and suicide, Abraham and Sisyphus, despair and its overcoming—serves to blur the lines of contrast, making Kierkegaard and Camus much closer in their views of (...) what sort of life we should live in face of the forsakenness of our condition than they seem at first glance. Thomas Flynn's work on Sartre and Foucault, the first of a two-volume project, offers a unique opportunity for examining an existential theory of history. It occasions rethinking existential-social categories from the vantage point of the poststructuralist turn. And it contributes to developing existential variants of critical theory. The following questions guide me in each of the three above areas. First, how is human history intelligible, given not only our finite sense of ourselves but also claims that we have reached the (...) end of history? Second, with the poststructuralist eclipse of dialectics, can we render existential categories in social terms and vice versa? Third, critics decry grand theorizing even in fallibilist reason, e.g., of Habermas, while others are worried by the normative deficits of poststructuralist nominalism, e.g., of Foucault. Can existential variants of critical social theory, anticipated before Sartre by Marcuse, split the difference? (shrink)
