In this article, the author argues that complexity theories have limited use in the study of society, and that social processes are too complex and particular to be rigorously modeled in complexity terms. Theories of social complexity are shown to be inadequately developed, and typical weaknesses in the literature on social complexity are discussed. Two stronger analyses, of Luhmann and of Harvey and Reed, are also critically considered. New considerations regarding social complexity are advanced, on the lines that simplicity, complexity (...) that can be modeled, and incondensible complexity permeate society simultaneously. The difficulty of establishing complexity models for processes involving ongoing interpretation is discussed. It is argued that the notions of system and environment need recasting in social studies. Existing social studies and literature, it is argued, reflect a polymorphous, contextual, contingent, labyrinthine, dramatic and political face to social complexity. The article focuses on the problem of constitutional symbolism in functionally differentiated societies and its relevance to legal, political, and moral systems. The first part analyses differences between the three systems and their constitutional context. The second part concentrates on the moral symbolic function of modern constitutions and its temporal dimension. It shows that the “good/bad” moral code of constitutions draws on expressive symbolism and transforms it into evaluative symbolism and dogma of morality. The final part analyses the prospective character (...) of modern constitution‐making and its symbolic selectivity regarding the past. The paper concludes by emphasising the systemic pluralisation effect of constitution‐making and the impossibility of constituting systems of “pure” law, morality, and politics. (shrink)

The standard account in whistleblowing research fixes the birth of the whistleblowing concept in the early 1970s. Surprisingly, there are no efforts to discuss why whistleblowing emerged as a distinct new action repertoire at this particular moment in time. Whistleblowing is a historical latecomer to an ethos of field transgression, which includes well-established forms of intervention such as watchdog journalism and political activism. Whistleblowing has strong affinities with these practices, but also holds its own unique place in ethics and democracy. (...) We can only appreciate these qualities in full if we trace the historical origins of the concept. The article argues that the concept of whistleblowing crystallized at the intersection of a set of trends that picked up speed in the 1960s–1970s: individualization, changing perceptions of loyalty, declines in authority trust, new participation patterns, and a growing awareness of the dangers and complexities in human production and organization. This is not simply an exercise in disciplinary history. Whistleblowing is on the rise in these years, just as digitalization creates a whole new range of opportunities for disclosure. It takes an increasingly steady hand to isolate the distinct ethical-democratic contribution of whistleblowers within this complex reality. To achieve this, we need to be able to place whistleblowing on a broader sociological and historical map. (shrink)

Across the globe, education has recently been through a major semantic shift, where new notions such as ‘learning’, ‘competences’, ‘projects’ came to replace or complement an older, more established, educational vocabulary. The political approach to education has also evolved, as many authors have underlined, from established national forms of governing to global, transnational forms of governance. These evolutions, often abbreviated to shifts ‘from teaching to learning’ and ‘from governing to governance’ have resonated globally and attracted the attention of researchers. Most (...) sociological accounts of such evolutions attribute them to the development and primacy of a preponderant logic, generally politics/power, culture or the economy. Niklas Luhmann’s systems theory, on which we draw in this article, suggests to start from a different, opposite, premise: not the predominance but instead the lack of any predominant logic characterizes modernity. The functional differentiation of modern society into a multiplicity of—specific yet universal—systems should therefore be the pivotal point that helps make sense of these transformations. We argue that the very coexistence of such systems, their simultaneous and therefore uncoordinated existences, increases the complexity of the social world tremendously and leaves them with an uncertain future. The so-called turns to governance and to learning, we argue, should be understood, respectively, as political and educational attempts to deal with this loss of direction. (shrink)

This article compares political clientelism and datafied campaigning as two modes of relating politicians/parties and voters that are centred around voter surveillance. It contributes to the discussion on consequences of Big Data by showing similarities of datafied campaigns with a type of electoral politics that pre-dates the advent of mass media and is usually regarded as deficient. It thus departs from the predominant perspective on datafication and surveillance, which draws on Foucault, in order to identify the particular challenges that datafication (...) poses in the realm of democratic electoral politics. They are related to four major aspects in which datafied campaigning resembles political clientelism, as opposed to the combination of ideology, issue-based campaigning and media appeal that characterized Western European party politics in the second half of the 20th century. It personalizes the relationship between politicians and voters with the help of intermediaries; it is based on an asymmetric and iterative monitoring of voters; it implies a strong particularism and an affinity with populist appeals; and it is ambivalent with regard to the volition of voters. The identification of these similarities renders general concerns about the consequences of datafied campaigning for democracy more concrete. It offers a mirror in which seemingly novel practices are revealed to have implications that are well known to be problematic for the quality of democracy. (shrink)

A new form of contracts has emerged between public administration and the single citizen within the last 15 years. The present article will attempt to situate citizens' contracts in a larger systemic framework, in order to understand more fully an increasingly complex public administration that is making new and contradictory demands on public managers. Citizens' contracts emerge naturally as a form in which the individual can undertake a reconnaissance of communication. The contracts are able to connect the codes of law, (...) care, and economy because they can be constructed differently from the perspective of their different codes without losing its character of unity. The semantic incommensurability of the systems of communication that are coupled through the contract is constitutive for the test of will of the single citizen which function a premise making machine of help and support decisions. Law’s regulation of transboundary hydropower dams is a field of study brimming with paradoxes. The most notable being the paradox of a hydropower dam solving one problem and creating another. From a logical perspective, such a paradox would typically be viewed as an obstacle to be avoided because it brings everything to a standstill. But from a social perspective, paradoxes are not necessarily negative, as managing them also potentially enlightens and transforms planning systems. The latter perspective, which brings to analysis (...) a kind of dynamism, is employed in this text. In order to work out the reoccurring patterns under which law might productively make use of paradoxes, this text therefore proposes the methodological tools of exposing and building upon paradoxes. Exposing paradoxes sets out to make more visible some of the unthought limitations, self-deceptions and self-contradictions which arise in modern planning practices, while building upon paradoxes attempts to open up headways towards a more adequate conceptualisation of the solutions which law can offer. The overall intention here being to offer a Luhmannian-inspired theoretical framework which illuminates the value of social systems theory as a methodological tool for describing the communicative challenges facing law’s regulation of transboundary hydropower power dams. The article combines the research strategies developed by Bruno Latour and Niklas Luhmann to problematize how we interpret the world when discussing globalization. Two previous approaches – global modernity and global consciousness – interpret the world as completely objective (nature transcends culture). Another approach – global governmentality – interprets the world as completely subjective (culture transcends nature). Against these approaches, this article proposes a new one: the symmetrical anthropology (or sociology) of globalization. Inspired by Latour’s variable ontologies, it considers multiple (...) descriptions of the world and multiple descriptions of society simultaneously. It considers globalization as one description of society and searches for the description of the world corresponding to it. It distinguishes three descriptions of the world: (1) the world as natural order; (2) the world as external object; and (3) the world as levels of organization. It is argued that the description of the world that is the most closely connected with globalization is the third one. (shrink)

ABSTRACTThe pragmatist reform and opening-up in 1978 has revolutionised the way China communicates internally and engages with the outside world. Firmly embedded within this broader historical context, the interpreter-mediated and televised Premier-Meets-the-Press conferences are a high-profile institutional event in China. At this discursive event, the Chinese premier – ranked second in China’s political hierarchy – is put in the international media limelight, answering journalists’ questions on a range of topics. The section involving the interpreters’ rendering of journalists’ questions is triadic (...) and dynamic and represents a particularly interesting site of ideological contestation, which can be conceptualised profitably using Bakhtin’s concept dialogised heteroglossia. Drawing on a corpus containing 20 years’ press conference data between 1998 and 2017, this CDA study interrogates the interpreters’ agency, particularly in constructing the Chinese government’s image when rendering journalists’ questions. Despite the commonplace assumptions of interpreters being impartial with little agency, the government-affiliated interpreters are found to actively engage in facework and image construction. This leads to a discursive pattern described in Van Dijk’s ideological square, which involves further emphasising and foregrounding the positive elements yet de-emphasising and mitigating the negative elements about Beijing. While nationalism as a mental model that can be represented in text and talk, it has not been sufficiently examined in discourse studies. This study examines the discourse of nationalism in spoken texts of an elite cohort of Chinese speakers at the World Economic Forum. Through methodological integration of nationalism with the socio-cognitive approach anchored in critical discourse analysis, this study examines the structures of ‘national-We’ and ‘foreign-Others’ pervading discourse and linguistic levels with reference to China-specific origins of nationalistic ideology. By scrutinising appraisals, referential nouns/pronouns and value-laden metaphors as linguistic realisations, this study reveals three nationalistic discourses: an economic-leadership discourse for Self, a deterrent/delegitimisation discourse regarding Others’ threatening actions/views, and a common-community Self discourse that aims to solidify more countries with China in a common community with shared interests and future. The study suggests there is value in integrating sociology-oriented conceptual/theoretical tools with the socio-cognitive approach in disclosing latent ideological configurations. (shrink)

This article shows that the concept of choice is central to Isaiah Berlin’s liberalism. It argues that his valuing of choice is anchored in a particular conception of human nature, one that assumes and presupposes free will. Berlin’s works sketch a metaphysics of choice, and his reluctance to situate himself openly in the debate on free will is unconvincing. By introducing the theory of autopoiesis, this article further suggests that there is a way to take Berlin’s value pluralism seriously, by (...) considering sets of values as autopoietic conscious systems. Drawing on the works of Maturana and Varela in biology and Luhmann in sociology, autopoiesis strengthens value pluralism and acts as a critique of liberalism. By putting objectivity in parenthesis, autopoiesis finally allows for value systems to coexist side by side in a stronger sense than Berlin’s liberalism ever could. (shrink)

At a time when ideas of crisis and critique are at the forefront of public discourse, this article seeks to understand moments of crisis vis-à-vis critique as a key feature of critical social theory. It addresses Jürgen Habermas’s strong claim that this relationship accounts for a ‘model of analysis’ concerned with grasping the ‘diremptions’ of social life. To elaborate this reading, the article pays attention to the main problems Habermas identifies in conventional ways of understanding the concepts of ‘crisis’ and (...) ‘critique’ in social theory. The aim is to examine the mode in which he reconsiders each of these terms and then reasserts the dialectical link between them. I reconstruct this relationship by taking as cases two of his most substantive works of social theorizing: The Theory of Communicative Action, and Between Facts and Norms. Based on this interpretation, I suggest that though Habermas contributes to resituating the practice of critique as a communicative translation of objective crisis, he does not adequately account for another key movement: when critique actually initiates, enacts and furthers the moment of crisis. The mass theory of the Austrian novelist and philosopher Hermann Broch has been virtually ignored in social theory. However, the recent theoretical interest in crowds makes it pertinent to scrutinize this part of his work. This article presents and examines the fundamental architecture of Broch's Massenwahntheorie, its historical context and how it may contribute to contemporary social theory. Specifically, Broch's insistence on the irrational dimensions of human behaviour is analysed as well as his emphasis on psychological anxiety in modern society. (...) This study is an attempt to analyze the factors that have contributed towards the success of the Democratic Party of Albania. It seeks to introduce new dimensions in measuring the success of a political party. The study rejects the elements of ‘office-holding’ and ‘policy – or performance-based’ measures of success, because they are determined by a complex array of economic, political, social and institutional factors. The concept of “party success” is defined in terms of: ‘breadth’ and ‘durability’. At the same (...) time the study aims at ‘emancipating’ the political parties from the past and macro-institutional factors, to which very often are ascribed the reasons for the perceived failure of politics in Albania. The approach used in this study has regarded the political parties as the real political actors that as such should assume the responsibility for the perceived failures. Neither the lack of political culture, nor the communist system, are the main factors to shape the activity and development of political parties in Albania. Both macro-institutional and historical structural approach has limited explanatory power for the success of the Democratic Party. Its success is a direct consequence of the decisions that the political parties themselves, including Democratic Party as one of the key actors, have taken. The research showed that the Democratic Party of Albania has been successful because and when its elite have been able to craft inclusive ideological programs and because of its extensive penetration in the country, which it owes to its structure as a mass party. The party has established patronage linkages with its sympathizers, the rank and file and militants and consequently has ensured their loyalty and maintained an extensive electoral penetration in country. In this thesis I outline a view of primary legislation from a systems perspective. I suggest that systems theory and, in particular, autopoietic theory, as modified by field theory, is a mechanism for understanding how society operates. The description of primary legislation that I outline differs markedly from any conventional definition in that I argue that primary legislation is not, and indeed cannot be, either a law or any of the euphemisms that are usually accorded to an enactment by a (...) parliament. I cite two reasons for such a conclusion. The primary reason for my conclusion is that I see primary legislation as being an output of a particular subsystem of society, while the law is the output of another subsystem of society. I argue that these outputs are the discrete products of separate subsystems of society. I argue that primary legislation should be viewed as a trinity. The first state of this trinity is that, upon enactment, primary legislation is a brute fact in that it is but a thing and the only property of this thing is that of being a text. The second state of this trinity is that following the act of enactment, the thing enacted will be reproduced and this reproduction is a separate thing that will sit in some repository until used. The third state of this trinity is that, upon use, this thing that is primary legislation will be transformed into an object and the user will attribute such functions and attributes to that object as are appropriate to the context within which the object is used. The thing has therefore become an object and an institutional fact. The second reason for my conclusion that primary legislation is not a law relates to the fact that the thing that is primary legislation is a text and the only function of a text is that it is available to be read. That is to say, of itself, a text is incapable of doing anything: it is the reader who defines the status of the text and attributes functions and attributes. Upon use, primary legislation thus becomes a censored input for future action and one of these actions may be some statement by a court of law. I assert that the view of primary legislation that has been accepted within the body politic is the product of the discourse of a particular subsystem of society that I have designated 'the legal practice', and I outline why and how this has occurred. Outlining a view about primary legislation also necessitates outlining a view as to the nature of the law. I assert that the law is a myth and I see this myth as a product of the discourse of the legal practice. I have asserted that although it is the judges that state the law, such statements flow from the discourse of those who practise the law. (shrink)
