In this paper Section 1 distinguishes between two modes of interpreting legal rules: rehearsal and discourse, arguing that the former takes priority over the latter in law, as in many other contexts. Section 2 offers two arguments that following a legal rule in the rehearsing mode presents a riddle. The first argument develops from law, and submits that legal rules do not tell us anything, because they are tautological. The second one develops from philosophy (Wittgenstein's later works), confronting us with (...) the paradox that incompatible courses of action may be derived from any rule. My solution presents a theory of rules as icons (Section 3). I use “icon” rather than “picture,” partly to avoid confusion with what is known among philosophers as “the picture theory of meaning.” Interpretation in the rehearsing mode hinges on imagination: imagining oneself in the space of reasons for action rather than reasoning oneself. In this act of imagination, we project ourselves into the rule in ways that are similar to the way we grasp the sense of paintings, music, stories, or poems. Finally (Section 4) I will defend the position that my view solves the puzzles in the second section, by arguing (a) that it is a better account of what Wittgenstein wrote than two competing theories (intuitionism and conventionalism), and (b) that it provides a more satisfactory account of how lawyers deal with legal rules in actual practice. In this text, Heidegger's notion of the event is understood as a rupture on an ontological level. From this follows the aporia of whether the event concerns the coming about of being itself, or of beings. To address the ontological as well as the ontic aspect of the event, the article suggests to understand the event in a subjective framework, in line with transcendental conditions of experience, specifically as a "receptivity" to the event. The main part of the article considers (...) existing phenomenological approaches to the event and the possibility or impossibility of a receptivity to the event expressed therein. In conclusion, the article suggests that the subjective event can be conceived as a rupture within subjective experience, as being tied to the necessary coming about of experience. (shrink)

The modern conception of enactive cognition is under discussion from the standpoint concerning the notions of nonlinear dynamics and synergetics. The contribution of Francisco Varela and his precursors is considered. It is shown that the perceptual and mental processes are bound up with the “architecture” of human body and nonlinear and circular connecting links between the subject of cognition and the world constructed by him can be metaphorically called a nonlinear cobweb of cognition. Cognition is an autopoietic activity because it (...) is directed to the search of elements that are missed; it serves to completing integral structures. (shrink)

Phenomenological, process-based and post-Marxist approaches have stressed the immanent nature of the ontogenesis of our world. The concept of performativity epitomizes these temporal, spatial and material views. Reality is always in movement itself: it is constantly materially and socially ‘performed’. Other views lead to a pre-defined world that would be mostly revealed through sensations. These transcendental stances assume that a subject, although pre-existing experience, is the absolute condition of possibility of it. In this paper, we develop another view of performativity, (...) one that re-introduces transcendence in the analysis but sees in it something dialogical to the process itself. We draw from the notions of visibility-invisibility and continuity-discontinuity in order to show how everyday activity both performs and makes visible the world. From that perspective, modes of visibility appear as conditions of possibility of performativity itself. We draw some implications for the conceptualization of management practices. (shrink)

In recent years, a central debate in the philosophy of mind and cognitive science concerns the role of the body in perception and cognition. For many contemporary philosophers, not only cognition but also perception is connected mainly with the brain, where the processing of input from the senses takes place; whereas for the proponents of ‘embodied cognition’ other aspects of the body beyond the brain, including the environment, play a constitutive role in cognitive processes. In terms of perception, a new (...) theory has emerged which stresses perception’s active character and claims that the embodied subject and the environment, with which it interacts, form a dynamic system. Supporters of ‘enactive perception’ such as Susan Hurley and Alva Noë maintain that the physical substrate or the supervenience basis of perceptual experience and phenomenal consciousness may include besides the brain and the nervous system other bodily and environmental features. Yet, it will be argued in this paper that the interaction between the subject and the environment forms a system of causal relations, so we can theoretically interfere in the causal chains and create hallucinations, which cannot be distinguished from veridical perception, or a virtual reality as in the film Matrix (1999). This kind of argument and its related thought experiments aim to stress the primacy of the brain in determining phenomenal states, and show that the body and certain interactions with the environment have a causal, but not a constitutive or essential role, in forming phenomenal consciousness. En varias oportunidades, el filósofo francés Maurice Merleau-Ponty plantea que hay una "carne del lenguaje" que se puede entender como la comprensión paradójica de sí y del otro en el seno mismo del lenguaje; esta "carne" está en relación con el desarrollo de la vida humana y da testimonio del cambio en los individuos que, observándose a sí mismos, quieren ser individuos nuevos a cada momento. Siguiendo a Merleau-Ponty, el presente ensayo se propone reconocer la condición del ser reinventado continuamente (...) por la expresión del lenguaje. On several occasions, the French philosopher Maurice Merleau-Ponty says there is a "flesh of language" that can be understood as a paradoxical understanding of self and the other within the same language. This "flesh" is related to the development of human life and bears witness to the change in individuals, observing themselves, who want to be new individuals each time. Following Merleau-Ponty, this essay proposes to recognize the condi-tion of being continually reinvented by the expression of language. (shrink)
