Call the norms of inquiry zetetic norms. How are zetetic norms related to epistemic norms? At first glance, they seem quite closely connected. Aren't epistemic norms norms that bind inquirers qua inquirers? And isn't epistemology the place to look for a normative theory of inquiry? While much of this thought seems right, this paper argues that the relationship between the epistemic and the zetetic is not as harmonious as one might have thought and liked. In place of the traditional epistemological view of knowledge as justified true belief we argue that artificial intelligence and law needs an evidence-based epistemology according to which scientific knowledge is based on critical analysis of evidence using argumentation. This new epistemology of scientific evidence (ESE) models scientific knowledge as achieved through a process of marshaling evidence in a scientific inquiry that results in a convergence of scientific theories and research results. We show how a dialogue interface of argument from expert (...) opinion, along with its set of critical questions, provides the argumentation component of the ESE. It enables internal scientific knowledge to be translated over into a wider arena in which individual nonexpert citizens and groups can make use of it. The external component shows how evidence is presented and used in a legal procedural setting that includes fact-finding, weighing the credibility of expert witnesses, and critical questioning of arguments. In this paper, the Carneades argumentation system is extended to represent a procedural view of inquiry in which evidence is marshalled to support or defeat claims to knowledge. The model is a sequence of moves in a collaborative group inquiry in which parties take turns making assertions about what is known or not known, putting forward evidence to support them, and subjecting these moves to criticisms. It is shown how this model of evaluating evidence in an inquiry is based on (...) a defeasible logic using forms of argument that admit exceptions. It is contended that reasoning from absence of knowledge is as important to inquiry as positive reasoning from evidence to knowledge. The philosophical conflict between this view of reasoning about knowledge and the true-belief-plus view is explored by airing objections and replies on both sides. (shrink)

Epistemic nihilism for inquiry is the claim that there are no epistemic norms of inquiry. Epistemic nihilism was once the received stance towards inquiry, and I argue that it should be taken seriously again. My argument is that the same considerations which led us away from epistemic nihilism in the case of belief not only cannot refute epistemic nihilism for inquiry, but in fact may well support it. These include the argument from non-existence that there are no non-epistemic reasons for (...) belief; the linguistic argument that epistemic norms of belief are needed to capture the semantics of ordinary epistemic talk; and the argument from theoretical roles that epistemic norms are needed to play key theoretical roles for rational belief. I conclude by sketching an alternative Gibbardian picture on which norms of inquiry are all-things-considered norms governing action. (shrink)

Peirce is often credited with having formulated a pragmatic theory of truth. This can be misleading, if it is assumed that Peirce was chiefly interested in providing a metaphysical analysis of the immediate conditions under which a belief or proposition is true, or the conditions under which a proposition or belief is said to be madetrue. Cheryl Misak has exposed the subtleties in Peirce's discussion of truth, especially showing the difficulties faced by any ascription to him of an analytic definition (...) of truth. In this paper I follow Misak in urging that Peirce's contribution to the philosophical discussion about the nature of truth was not of that kind. What makes his pragmatic approach distinctive is that rather than attempting to state the nature of truth per se, it attempts to uncover the beliefs and expectations we commit ourselves to when we make specific claims that such and such is true or is the case.
