Este artigo tem o objetivo de apresentar e desenvolver as críticas feministas à Teoria da Justiça de John Rawls, especialmente por meio do diálogo e das contribuições de Martha Nussbaum e Susan Okin para um liberalismo feminista. Para tanto, discutimos três pontos centrais no debate entre essas duas filósofas feministas e Rawls: a) a noção de família como uma instituição básica da sociedade; b) a distinção entre doutrinas morais abrangentes razoáveis e não razoáveis; e c) a concepção de pessoa política (...) com autonomia plena. As críticas à teoria rawlsiana feitas por feministas demonstram a riqueza e a profundidade de Rawls para o liberalismo contemporâneo, ao mesmo tempo em que apontam para os problemas que teorias que tradicionalmente não desenvolvem um olhar crítico para a situação generificada dos sistemas democráticos encontram ao abordar a situação da cidadania das mulheres. As demandas do feminismo liberal, relacionadas à situação de mulheres ao redor do mundo, são muito bem-articuladas por Nussbaum a partir de sua crítica interna ao liberalismo rawlsiano, enfatizando que algumas das disposições teóricas desse autor não parecem ser radicais o suficiente para garantir a disponibilidade integral dessas capacidades para mulheres e crianças. Da mesma forma, o diálogo de Nussbaum com as críticas de Okin aprofundaram o debate sobre os limites da teoria da justiça rawlsiana. (shrink)

Taking a largely thematic approach, this reflection aims to demonstrate the richness of Julia Kristeva’s theoretical work in relation to questions of justice and injustice. Injustice becomes primary because a definition of justice continues to be open to debate, whereas injustice as incarnate in the scapegoat as depicted by René Girard is far less so, if at all. Through her analyses of the work of Mallarmé and the Paris of the Dreyfus affair, Céline and abjection and anti-Semitism, the ‘need to (...) believe’ as a key component of subjectivity, the foreigner as the other in ourselves, Dostoyevsky and forgiveness, a vista is opened up onto injustice and how it might be combatted. Drawing on the scholarship of Critical Religion, this article shows how the modern category “religion” operates through a gender code which upholds its discursive power and enables the production of religious—and therefore racial—hierarchies. Specifically, it argues that mentioning religion automatically makes gender present in discourse. Acknowledging religion as an inherently gendered category in this way gives further insight into the discursive power and functioning of the religious label. With the example of the Westphalian production of the “myth of religious violence” (...) and the employment of “religion” in colonial contexts, I demonstrate how a gender code upholds and enables the discursive power of religion. Religion is both gendered and gendering. Acknowledging the multiple ways in which religion is gendered and gendering, then, has important bearings on the analysis of religion’s racializing function which is upheld and aided by the gender code through which religion is spoken. Abstract Feminists have interpreted Rousseau's attitudes to women as characteristic of a patriarchal ideology in which passion, nature and love are associated with the feminine and repressed in favour of masculine reason, culture and justice. Yet this reading does not cohere with Rousseau's adulation of nature, nor with the repression of writing and culture in favour of natural speech which Derrida finds in his texts. This paper uses Rousseau's accounts of his personal experiences to resolve this conflict and to develop (...) a more complex understanding of Rousseau's attitudes to women. The reading emphasizes that Rousseau operated with a triadic picture in which reason, the passions of the heart and the passions of the body are distinguished. The discussion of Derrida's reading of Rousseau gives rise to some reflections on the relationship of speech and writing to subjectivity, autonomy and women's oppression. (shrink)

Carol Gilligan heard a ‘distinct moral language’ in the voices of women who were subjects in her studies of moral reasoning. Though herself a developmental psychologist, Gilligan has put her mark on contemporary feminist moral philosophy by daring to claim the competence of this voice and the worth of its message. Her book, In a Different Voice, which one theorist has aptly described as a best-seller, explored the concern with care and relationships which Gilligan discerned in the moral reasoning of (...) women and contrasted it with the orientation toward justice and rights which she found to typify the moral reasoning of men. Women's access to health and medicine in developed countries has been characterized by a range of inconsistent inclusions and exclusions. Health policy has been asymmetrically interested in womens reproductive capacities and has sought to regulate, control, and manage aspects of womens reproductive decision making in a manner unwitnessed in relation to men's reproductive health and reproductive decision making. In other areas, research that addresses health concerns that affect both men and women sometimes is designed so as not to yield data (...) relating to the ways in which women's physiology and gendered location may affect their experience of the condition and its response to treatment, despite a literature on the significance of sex and gender differences in health research. This paper draws on the situation in Australia to explore the ethical significance of these inconsistencies as failing the ideals of high-quality medical research and evidenced-based health care. ABSTRACT There are three kinds of bonds between human beings: biological and natural; legal and artificial; social and voluntary. Marriage can be seen as an artificial and legal means of shifting the loose bonding of the third category of relationship into the deep and inescapable bonding of the first. The desire to create bonds of this type is widespread, but non‐bonding, too, has been recommended either as good in itself—a way of achieving peace of mind or personal emancipation through wider (...) relationships—or as necessary self‐denial for some higher cause. In the latter case, the bonds of family are seen as a positive good, a view shared, though for different reasons, by religious and political conservatives and by revisionist feminists. In contrast to this, three philosophical conceptions which would favour unbonding, or detachment from emotional ties, are categorised here as (a) the Stoic, (b) the Existentialist and (c) the Feminist. Within the Feminist ideal, it is radical, rather than liberal or socialist feminism that has most in common with Stoic or Existentialist ideals. These ideals are considered, together with various alternatives to marriage, and are judged not to override the need for deep personal bonds between human beings. These personal bonds of love and commitment are compared with the alternative bonds of religion and politics and it is concluded that, whatever forms they take, personal bonds have fundamental moral priority in the lives of human beings. In this article, I present the arguments of three republican women philosophers of eighteenth-century France, focusing especially on two themes: equality (of class, gender, and race) and the family. I argue that these philosophers, Olympe de Gouges, Marie-Jeanne Phlipon Roland, and Sophie de Grouchy, who are interesting and original in their own right, belong to the neo-republican tradition and that re-discovering their texts is an opportunity to reflect on women’s perspectives on the ideas that shaped our current political thought.

InLe Bonheur Primitif, Olympe de Gouges takes on Rousseau's account of the evolution of human society in his first twoDiscourses, and she argues that primitive human beings were not only happy, but also capable of virtue. I argue that in that text, Gouges offers a contribution to the eighteenth-century debate on human progress that is distinct from Rousseau's in that it takes seriously the contribution of women and families to human happiness and progress. I show how the concept of emulation (...) plays an important role in Gouges's analysis, both in her account of primitive societies and of the theater, and argue that she uses it to bridge the gap between primitive happiness and future progress. Traditionally inscribed at the margins of moral and political theory, it is time, after centuries of ongoing debates originated and grounded in Modernity’s values, to reflect on the status of Feminist Theory. Defined basically as critical theory —apostille of the mainstream theory—, feminist thought can be defined as theory tout court, in so far as the egalitarian discourses are central parts of moral and political thought and feminism is philosophical. This paper addresses the ambivalent relation between feminist theory and moral-political (...) theory with a critical view that upholds an integral vision that incorporates the dimension of care into the male-stream, and takes into account gender differences as well as the division between the public and private spheres.
