This essay has two purposes—first, to identify Adam Smith as intervening in the debate between Montesquieu and Hume regarding the nature, age, and robustness of English liberty. Whereas Montesquieu took English liberty to be old and fragile, Hume took it to be new and robust. Smith disagreed with both: it was older than Hume supposed, but not fragile in the way Montesquieu claimed. The reason for this was the importance of the common law in England’s legal history. Seeing this enables (...) the essay’s second purpose: achieving a more thorough and nuanced understanding of Smith’s account of liberty. This requires us to go beyond repeating Smith’s famous claim that modern liberty was the result of the feudal barons trading away their wealth and power for inane status goods. As I demonstrate, this is only one part of a much wider story: of liberty requiring, and also being constituted by, the rise of the regular administration of justice, and ultimately the rule of law. Although Smith’s history of the English courts and common law has been almost entirely neglected by scholars, it is indispensable to understanding both his reply to Montesquieu and Hume and his wider political theory of modern freedom. This paper examines Hume’s comments on and claims about ancient philosophy. A clear and consistent picture emerges from doing so. While Hume is a lover of ancient literature, he holds ancient philosophy in very low regard, as passage after passage discloses, with one qualification and one important exception. Hume appropriates the mantle of ‘Academic’ sceptic for himself; but in fact his Academic (or ‘mitigated’) scepticism has only minimal affinity with the ancient school of this name, having more in common with (...) early modern sceptical positions. The exception is found in the ‘painterly’ depictions of character and other features of moral life, where Hume holds many of the ancients in very high regard, seeing them as superior to the moderns. The bases of these respective views of Hume’s are explored, with an interpretation which construes Hume’s ‘anatomist’/’painter’ contrast as meant non-ironically. On the anatomist or theoretical side, Hume nonetheless – rightly or wrongly, and contrary to the views of a number of his prominent readers – sees a radical, dramatic break between early modern ‘scientific’ philosophy, and anything which preceded it. Apesar de ter sofrido influência da escola moderna de direito natural, Hume rompe com ela num ponto fundamental - na recusa da noção de pessoa como ponto de partida para pensar a gênese social do ordenamento jurídico-político. ABSTRACT This paper aims to bring together Hume and Machiavelli by taking both of them as exponents of a certain nonjusnaturalistic current, formed at the beginning of the modern age, which had its own way of thinking the nature of law and, in a broad sense, legal-political normativity. Despite being influenced by the modern school of natural law, Hume breaks with it in a fundamental point - in the refusal of the notion of person as a starting point to think the social genesis of the legal-political order. Abstract Inspired by Rawls?s admission that his twentieth?century contract theory builds in the parochial horizon of modern constitutional democracy, this essay critically examines two truisms about seventeenth?century contract theory. The first is the stock view that the English case is irrelevant to the logic of Leviathan and the Second Treatise. To the contrary, I argue that their political conclusions depend on introducing constitutional and legal ?facts?, in particular, facts about the constitution of the English monarchy. Second, I challenge the Whiggish (...) characterization of contract theory as an important step in the development of democratic sovereignty. I draw on Hume?s famous critique of the genre to make the case that seventeenth?century contract theory addressed a peculiarly ancien?regime issue ? namely, resistance to legitimate rulers. In both respects, Hobbes?s and Locke?s social contracts are properly regarded as ancien?regime theories of politics. They are, as Rawls would put it, ?political not metaphysical? theories. (shrink)

Our goal in this article is first to give a broad outline of some of Hume’s major positions to do with justice, sympathy, the common point of view, criticisms of social contract theory, convention and private property that continue to resonate in contemporary political philosophy. We follow this with an account of Hume’s influence on contemporary philosophy in the conservative, classical liberal, utilitarian, and Rawlsian traditions. El objetivo de este trabajo es revisar las posturas de Pierre Bayle y David Hume en torno al problema del mal, para determinar si la postura de Hume se reduce a la de su predecesor o si existen diferencias más profundas entre ambos. Bayle propone una solución fideísta, declarando que se trata de un misterio que está por encima de la razón al que debemos adherir a partir de la creencia, mientras que Hume se limita a suspender el juicio al (...) respecto. En primer lugar, se reconstruye el planteo del problema del mal y sus consecuencias sobre la moral en los dos autores. Luego, se revisan sus críticas a la teología racional y el papel que juega el escepticismo respecto de la religión. Se concluye que la influencia de Bayle sobre Hume está centrada en mostrar las limitaciones de la razón humana para abordar el problema, y que el aporte original de este último se vincula con la defensa de la filosofía como un tipo de especulación autónoma. This thesis investigates Hume’s philosophy of external existence in relation to, and within the context of, his philosophy of scepticism. In his two main works on metaphysics – A Treatise of Human Nature (1739–40) and the first Enquiry (first ed. 1748) – Hume encounters a predicament pertaining to the unreflective, ‘vulgar’ attribution of external existence to mental perceptions and the ‘philosophical’ distinction between perceptions and objects. I argue that we should understand this predicament as follows: the vulgar opinion is our (...) natural and default belief for Hume, but causal reasoning reveals it to be false, and the philosophical alternative is a confabulation that we cannot permanently believe and is devoid of justification. Hume uses the fact that we cannot have a satisfactory account of belief in external existence as a sceptical consideration to motivate his wider philosophical scepticism. Hume’s response to his predicament about external existence is found in the context of his confrontation with other sceptical worries (Treatise 1.4.7 and Enquiry 12), in which Hume also reflects generally on the nature and implications of scepticism. I argue that we should characterise Hume’s position as residually sceptical. This means that, while Hume accepts the unanswerability of some sceptical problems, he denies that it is possible to eradicate all belief as a result (and denies that it is practically useful to even try) and instead uses sceptical problems as a motivation to adopt a moderately sceptical position. While we inevitably return to entertaining the vulgar belief, there is no solution to the sceptical predicament; Hume does not endorse the vulgar belief, or the philosophical system, or indeed any alternative system of the external world that might extinguish the predicament. Sceptical doubt, for Hume, does not derail intellectual pursuits, but rather modifies our attitudes in those very pursuits. (shrink)

This thesis presents an interpretation of David Hume’s essay ‘Of the Standard of Taste’. The most distinguishing feature of this interpretation is the emphasis placed on the significance of Hume’s general philosophical position in a faithful reading of this philosophical classic. The success of this interpretation will show that Hume’s essay should be read as an integral part of his system of philosophy. There are three parts in this thesis. The first part is an overview of some key aspects of (...) Hume’s philosophy which are relevant to my interpretation. Unlike many contemporary philosophers in the analytic tradition, Hume is a systematic thinker. A faithful reading of his works should take his general philosophical framework seriously. Therefore, this overview of his system serves as the general background of the next two parts. The second part is a discussion of Hume’s aesthetic thought. More specifically, it provides an exposition of his view on beauty and judgements of beauty. This part completes the stage-setting for the development of my interpretation, by helping the reader form a more specific conceptual framework for understanding Hume’s essay. The third part develops an interpretation of ‘Of the Standard of Taste’ according to what has been provided in the previous two parts. It starts with an outline of the essay, which indicates Hume’s aim in writing it. After that, a few sections are devoted to some central elements of the essay. The last section of this part discusses four controversies concerning Hume’s essay. These discussions establish the strength of this interpretation, or at least, the fruitful prospect of an interpretative project that integrates Hume’s essay into his whole system. (shrink)
