The article analyses the concept of indirect discrimination, arguing first that existing conceptualisations are unsatisfactory and second that it is best understood as equal treatment that is disadvantageous to the discriminatees because of their group-membership. I explore four ways of further refining the definition, arguing that only an added condition of moral wrongness is at once plausible and helpful, but that it entails a number of new problems that may outweigh its benefits. Finally, I suggest that the moral wrongness of (...) indirect discrimination is best accounted for in terms of the harm it does to discriminatees, and sketch three ways in which it may do so. I conclude that the analysis provides both a clearer understanding of the concept of indirect discrimination as well as indirect support for a harm-based account of the wrongness of discrimination, while suggesting that our moral obligations qua non-discrimination may be more extensive than is frequently assumed. Uno de los debates más recientes referentes a la innovación tecnológica entre los especialistas en ética es aquel sobre la mejora humana, el cual ha surgido a raíz de la posibilidad de modificar los límites de la naturaleza humana usando el poder de la ciencia. Muchos filósofos nos han avisado del peligro de modificar técnicamente nuestra naturaleza humana. Otros, por contra, defienden que no existe diferencia moral relevante alguna entre las nuevas técnicas biomédicas de mejora y las tecnologías aceptadas como (...) habituales por los seres humanos. Este artículo pretende examinar críticamente tal argumento. El fin de este análisis crítico será doble, primero, mostrar que los autores que defienden esta posición poseen visiones sesgadas y prejuiciosas de la realidad y, segundo, que es necesario establecer una definición más precisa y acotada del término “mejora”. But we add a new argument that we believe places the moral burden on those who favor doping in sports. We also defend our position against some important concerns that might be raised against it. This article aims to develop a ground for freedom of speech that combines two justifications – democratic participation and autonomy. First, it is argued that consequentialist justifications, such as discovery of truth and personal development, are far from providing a strong justification for free speech due to their reliance on uncertain empirical validation. Second, it is claimed that a stronger and better ground for free speech can be constructed by articulating two non-consequentialist justifications for free speech – democratic participation and (...) autonomy. This articulation, which I call the double-grounded non-consequentialist justification for free speech, considers autonomy and democratic participation as complementary principles. In this sense, a double-grounded justification engages justification as autonomy and democratic participation in a dialogue in order to provide remedies for the specific weaknesses of these two positions.
