Rawls theorizes principles of justice as defining a ‘pact of reconciliation’ between diverse conceptions of the good. What does fulfillment of this pact entail when reasonable pluralism is recognized as having an environmental dimension? Fair acknowledgment of the plurality of citizens’ relationships with the natural world challenges the neutrality of aims conventionally used to justify ecocide, including the promotion of economic growth and development. This paper explores how ecocide constitutes a violation of equal basic liberties and state neutrality as per (...) Rawlsian political liberalism. Wie müsste eine faire Lösung des Klimaproblems aussehen? Wie sollten wir Pflichten und finanzielle Lasten der nötigen CO2-Reduktionen verteilen, wenn es dabei gerecht zugehen soll und keiner übervorteilt werden darf? In meiner Antwort auf diese ethischen Fragen stütze ich mich auf einen Grundsatz, den Angela Merkel formuliert hat: Jeder Mensch hat das Recht, genauso viel CO2-Emissionen zu verursachen wie jeder andere. Anders als die Bundeskanzlerin, die den Grundsatz nur langfristig in die Tat umsetzen will, plädiere ich dafür, dass die Gleichberechtigung (...) aller in Sachen CO2-Ausstoß schon unter dem Nachfolge-Regime des Kyoto-Vertrags gelten soll. In einem ersten Schritt soll die Steigerung der weltweiten CO2-Emissionen angehalten werden. Um das auf gerechte Weise zu bewerkstelligen, werden in feiner Stückelung Rechte zum CO2-Ausstoß (die sog. Mikro-Zertifikate) ausgegeben, und zwar zunächst für genau so viel CO2, wie die Menschheit zur Zeit insgesamt pro Jahr in die Luft bläst. Wer CO2 emittieren will, gleichgültig wo, wie und wozu, darf das nur gegen Entwertung einer entsprechenden Anzahl an Mikro-Zertifikaten, sonst macht er sich strafbar. Die Mikro-Zertifikate werden auf einer weltweiten Börse gehandelt; ihr Preis ergibt sich aus Angebot und Nachfrage. Mein Vorschlag unterscheidet sich in zweierlei Hinsicht von den Versteigerungen der CO2-Zertifikate, wie sie bislang konzipiert und organisiert worden sind. Einerseits sollen am Ende alle Emissionen klimaschädlicher Gase in den Handel mit Mikro-Zertifikaten einbezogen werden. Andererseits wird das Geld, das durch die Versteigerung der Mikro-Zertifikate zusammenkommt, in regelmäßigen Abständen und ohne Abzüge an jeden einzelnen Menschen ausgezahlt. Das ist einfach, fair und transparent. In einem zweiten Schritt sind die weltweiten CO2-Emissionen drastisch zu verringern: Nach einer siebenjährigen Verschnaufpause (in der sich Produzenten und Verbraucher auf die erforderlichen Anpassungen vorbereiten können) beginnen die sieben dürren Jahre der CO2-Politik: Jahr für Jahr werden 10% weniger Mikro-Zertifikate ausgegeben. Am Ende dieser Durststrecke haben sich die weltweiten CO2-Emissionen halbiert, und die Klima-Investitionen sind dahin geflossen, wo sie dem Klima am stärksten nutzen und wo das am wenigsten Kapital verschlingt. This dissertation is a contribution to the debate about ‘climate justice’, i.e. a call for a just and feasible distribution of responsibility for addressing climate change. The main argument is a proposal for a cautious, practicable, and necessary step in the right direction: given the set of theoretical and practical obstacles to climate justice, we must begin by making contemporary development practices sustainable. In times of climate change, this is done by recognising and responding to the fact that emissions of (...) greenhouse gases, with climate change as their result, are an immanent threat to any reflectively embraced development project. In the universal pursuit of progress, basic needs of both present and future people are put at risk. Even so, a political stalemate and business-as-usual prevail. The situation is locked up by an uncertainty about the exact impacts of choices made and by the reasonable disagreement of modern societies. The result is passiveness, and the passing on of a slowly and indiscernibly growing problem to future generations. This dissertation brings out a crucial message about the need to make our development sustainable. Instead of delaying action through trying to resolve the intractable epistemic and normative uncertainty fully, the focus should be on vindicating already shared points of practical convergence. On the constructivist method here adopted, the task is to characterise the agent and the situation faced from a practical and first-person point of view. More specifically, to specify the practical problem climate change gives rise to; the moral importance of needs (chapter three); how a principled priority of basic needs can be defended (chapter four), intergenerationally (chapter five) and internationally (chapter six); and what natural and social limits there are to development (chapter seven). These conceptions narrows the practice of development in the present context: it can be concluded that development must not risk the basic needs of anyone implicated. This common ground brackets off disagreement irrelevant to the urgent need to act, and so brings together otherwise deeply divided agents. A sufficientarian basic needs-principle, as the focus of an overlapping consensus, is practicable and anticipatory in the disuniting moral conundrum of climate change. (shrink)

Imagine that only the state can meet the need for housing but decides not to do so. Unsurprisingly, participants in a vignette experiment deem this scenario unjust. Hence, justice ratings increase when the living situation improves. To a lesser extent, this also holds beyond the need threshold, understood as the minimum amount necessary for a decent life. Surprisingly, however, the justice evaluation function is highly convex below this point. The resulting S-shaped curve is akin to the value function in prospect (...) theory, with the need threshold providing the point of reference and inflection. A control treatment without needs-information supports this interpretation. Needs-information furthermore compresses the perceived injustice of arbitrary inequality. As in prospect theory, such reference dependency suggests biases in judgment and decision making. A consequence may be that the lot of the poorest in society does not receive the attention it would otherwise get. (shrink)
