The article outlines a general epistemological theory of argument: a theory that regards providingjustified belief as the principal aim of argumentation, and defends it instrumentalistically. After introducing some central terms of such a theory, answers to its central questions are proposed: the primary object and structure of the theory, the function of arguments, which is to lead to justified belief, the way such arguments function, which is to guide the addressee's cognizing, objective versus subjective aspects of argumentation, designing different types (...) of argument. Then the notion of ' valid argument' is defined and criteria for the adequate use of such arguments are introduced. Finally, this conception is justified as, among others, leading to more true beliefs than competing conceptions. (shrink)

This article addresses the issue of linguistic phenomena which, as a legacy of the centuries-old tradition of the Roman Empire, are rooted in Polish jurisdictional texts. The study focused on foreign-language expressions and short texts in Latin, used in judicial decisions. The aim of the study was to determine the function of Latinisms as foreign-language expressions in judicial decisions and how their use influences the communicativeness and persuasiveness of argumentation. During the analysis, it was noticed that Latinisms in jurisdictional texts (...) are used on four levels, including: legal maxims, terminology equivalence, linguistic ornaments and the description of taboo phenomena. On the basis of the identified categories, efforts were made to determine the extent to which Latin strengthens or weakens the power of persuasion of judicial decisions. (shrink)

Some proponents of epistemological approaches to argumentation assume that it should be possible to develop non-relative criteria of argument evaluation. By contrast, this paper argues that any evaluation of an argument depends on the cognitive situation of the evaluator, on background knowledge that is available for this evaluator in a certain situation, and --in some cases--on the belief-value-system this person shares.

The article develops and justifies, on the basis of the epistemological argumentation theory, two central pieces of the theory of evaluative argumentation interpretation: 1. criteria for recognizing argument types and 2. rules for adding reasons to create ideal arguments. Ad 1: The criteria for identifying argument types are a selection of essential elements from the definitions of the respective argument types. Ad 2: After presenting the general principles for adding reasons (benevolence, authenticity, immanence, optimization), heuristics are proposed for finding missing (...) reasons, for deductive arguments, e.g., semantic tableaux are suggested. Arguments which in their premises or warrants touch basic norms and values of a cultural community can be defined as culture sensitive. The paper will demonstrate how insensitivity to the cultural backgrounds of audiences may spoil an argument, and identify which kinds of arguments prove particularly open to cultural sensitivity. It will define the areas on which cultural communities may differ and determine how this bears on problems of globalization and political correctness.

In a 2006 paper I claimed that the virtue arguments or inferences must have is not that they be truth-preserving, but that they be entitlement-preserving. I offered two reasons there why such a conception of argument virtue is needed for a satisfactory treatment of defeasible arguments and inferences. This paper revisits that claim, and assesses the prospects for a more thorough defence than was offered in that paper.

A variety of theoretical and epistemological perspectives on the notion of argument has contributed towards the development of numerous text analysis systems in contemporary argumentation research, making the selection of an analytic model for the description and evaluation of arguments in natural language contexts a complex task for researchers. Not surprisingly, Western scholars have overwhelmingly relied on Anglo- and Euro-centric models of argumentation as normative references of argument structure and quality in a variety of research contexts, disregarding plurality of practice (...) within socio-cultural contexts. I will discuss how the findings of my own research, in which I examine the rhetorical styles of Australian and Japanese students’ academic writing in English, have led me to suggest an approach towards argument analysis that accommodates the variety of rhetorical styles found in my studies of academic writing and contributes towards a useful account of the functions and structures of academic argument in contemporary tertiary texts.
