Sobocinski in his paper on Leśniewski's solution to Russell's paradox (1949b) argued that Leśniewski has succeeded in explaining it away. The general strategy of this alleged explanation is presented. The key element of this attempt is the distinction between the collective (mereological) and the distributive (set-theoretic) understanding of the set. The mereological part of the solution, although correct, is likely to fall short of providing foundations of mathematics. I argue that the remaining part of the solution which suggests a specific (...) reading of the distributive interpretation is unacceptable. It follows from it that every individual is an element of every individual. Finally, another Leśniewskian-style approach which uses so-called higher-order epsilon connectives is used and its weakness is indicated. (shrink)

Following an idea first proposed by Jerzy Wróblewski, this paperexamines the usefulness of formal logic for comparative legal analysis. Subject of the comparison are the doctrines of mistake and attempt in Germanand English criminal law. These doctrines are distinguished by the interaction of deontic, epistemic and alethic modalities. I propose a purely extensional logic which is based on Leśniewski’s substitutional interpretation ofquantification to analyse differences in the logical structure of the variouscriminal law doctrines.

The paper is Part III of the large research, dedicated to both the revision of the system of basic logical categories and the generalization of modern predicate logic to functional logic. We determinate and contrapose modern Fregean logistics and proposed by the author ultra-Fregean logistics, next we describe values and arguments of functions, arguments of relations, relations themselves, sets (classes), and subsets (subclasses) as derivative categories (concepts) of ultrafregean logistics. Logistics is a part of metalogic, independent of semantics. Fregean logictics (...) is a metalogical theory, based on the quadruple <particular (individual), predicate, equality, sequence>; it generates predicate logic. Ultrafregean logictics is based on the quadruple <particular, function, representation, sequence>, where the notion of a function is a generalization of the notion of a predicate and the notion of representation is a generalization of the notion of equality; this logictics generates functional logic. For the completely correct denotation of the functional values, we need the Churchian symbolics with parenthesis. Predicates are usually identified with relations. A relation is the derived and even definable category of ultra-Fregean logictics. Namely, relations are representations by functions (of one of their arguments). We show that Frege could really establish this definition and the notion (category) of representation but, unfortunately, rejected this course of thought. Next, we show that every n-ary relation can be resolved for some of its arguments via some (n-1)-ary function. A set, or class, is a derived and not definable category of ultra-Fregean logistics. The universal way to introduce the sets is Frege’s abstraction principle. We formulate this principle for functional logic and show that the notion of a set is quantified, so there is the dual existential notion of a nonempty subset, involved by the same abstraction principle. La storia della nascita, utilizzo e declino delle notazioni scientifiche costituisce un’area di indagine importante che può aiutare le nostre analisi del pensiero scientifico e la sua evoluzione. […] this history constitutes a mirror of past and present conditions in mathematics which can be made to bear on the notational problems now confronting mathematics. The successes and failures of the past will contribute to a more speedy solutions of the notational problems of the present times.Questa storia, ovviamente, coinvolge anche le (...) notazioni della logica. Il presente contributo intende proporre un nuovo insieme di simboli per una particolare teoria logica: la Mereologia Formale, in considerazione del fatto che questa teoria, pur avendo avuto trattazioni sistematiche, non ha allo stato attuale ancora raggiunto un sistema di notazioni condiviso dagli studiosi. Tale stato dell’arte è espressione, da un lato, di un legame della teoria al suo nascere con la notazione polacca, e del suo confronto con la Teoria Assiomatica degli Insiemi; dall’altro, del fatto che essa ha ricevuto solo in tempi recenti sistematiche applicazioni alle scienze.94 In tale prospettiva ho ritenuto necessario definire in primo luogo dei criteri attraverso cui procedere alla costruzione del sistema di simboli.
