First-order normative theories concerning what’s right and wrong, good and bad, etc. and metanormative theories concerning the nature of first-order normative thought and talk are widely regarded as independent theoretical enterprises. This paper argues that several debates in metanormative theory involve views that have first-order normative implications, even as the implications in question may not be immediately recognizable as normative. I first make my claim more precise by outlining a general recipe for generating this result. I then apply this recipe (...) to three debates in metaethics: the modal status of basic normative principles, normative vagueness and indeterminacy, and the determination of reference for normative predicates. In each case I argue that certain views on each issue carry first-order normative commitments, in accordance with my recipe. (shrink)

This paper argues against Boydian synthetic moral naturalism by way of a critical examination at metasemantic issues. I first show that the Boydian metasemantics delivers determinate but wrong reference, building on an analysis by Schroeter and Schroeter. I then propose a diagnosis which says that the problem occurs due to an overly simple way of understanding externalist metasemantics, and that a proper understanding requires us to pay heed to the higher-level constraints set by the speakers’ deferring pattern. That in turn (...) is restricted by what I call reference defeaters, which are essentially some central beliefs held by the speakers and are so called because they have the power to defeat reference of a term to certain things. Applying the notion to moral discourse, I argue that the entrenched is/ought distinction held by the ordinary speakers defeats the reference of the moral predicates to natural properties, that is, synthetic moral naturalism is not true. Metaethical realists disagree about the nature of normative properties. Naturalists think that they are ordinary natural properties: causally efficacious, a posteriori knowable, and usable in the best explanations of natural and social sciences. Non-naturalist realists, in contrast, argue that they are sui generis: causally inert, a priori knowable and not a part of the subject matter of sciences. It has been assumed so far that naturalists can explain causally how the normative predicates manage to refer to normative properties, whereas non-naturalists (...) are unable to provide equally satisfactory metasemantic explanations. This article first describes how the previous non-naturalist accounts of reference fail to tell us how the normative predicates could have come to refer to the non-natural properties rather than to the natural ones. I will then use the so-called qua-problem to show how the causal theories of reference of naturalists also fail to fix the reference of normative predicates to unique natural properties. Finally, I will suggest that, just as naturalists need to rely on the non-causal mechanism of reference magnetism to solve the previous problem, non-naturalists, too, can rely on the very same idea to respond to the pressing metasemantic challenges that they face concerning reference. Per the standard reading of his view, Hart held that the legally valid norms of any legal system are those identified as such by the criteria of validity effectively accepted in common by the system's officials. Here, I focus on the presupposition underlying this Hartian account of legal facts – namely, that the officials of any legal system share a perspective that fixes the identity of their system's legally valid norms. Below, I hope to establish the appeal of this presupposition (...) and the attendant Hartian project of providing an account of the identity of the legally valid norms of any legal system. Nonetheless, as I explain, the phenomenon of disagreement that Ronald Dworkin describes threatens Hart's crucial presupposition, thereby posing a mortal threat to his account of legal facts. Moreover, as I hope the following survey illustrates, the phenomenon of disagreement similarly threatens many other contemporary theories of law, for these theories join the project of providing a Hartian account of legal facts. A final objective of this survey is to highlight two mutually exclusive strategies for responding to the phenomenon of disagreement: rejecting the Hartian presupposition and commitment to legal facts or affirming this Hartian project by explaining how officials share a legal fact-fixing perspective despite disagreeing about their system's criteria of validity. According to the orthodox account of meaning and translation in the literature, meaning is a property of expressions of a language, and translation is a matching of synonymous expressions across languages. This linguistic account of translation gives rise to well-known skeptical conclusions about translation, objectivity, meaning and truth, but it does not conform to our best translational practices. In contrast, I argue for a textual account of meaning based on the concept of a TEXT-TYPE that does conform to our best (...) translational practices. With their semantic function in view, text-types are Archimedean points for their respective disciplines. The text-type of philosophy is no exception. Culture-transcendent conceptual analysis can proceed on firm footing without having to deny the reality of radical cultural and linguistic difference by treating components of text-types as the concepts to be analyzed. Analyses of central philosophical concepts are provided as a means of adjudicating philosophical controversy. (shrink)

According to the eligibility theory of meaning, often attributed to David Lewis, the referent of a predicate is the property that best balances the twin constraints of charity and eligibility, where eligibility is a function of metaphysical naturalness. This sort of metasemantics, which is motivated by its ability to resolve problems of indeterminacy and secure shared reference between disputing parties, can be somewhat friendly towards revisionary theories, since highly natural properties can act as “reference magnets,” securing our reference despite some (...) mismatch with usage. In this paper, I apply these considerations to normative ethics and argue that the theory of rule utilitarianism achieves a high balance of charity and eligibility. I proceed by comparing rule utilitarianism to two of its well-known rivals, act utilitarianism and Rossian pluralism. I show how the former achieves a high degree of eligibility but only at a significant cost of charity, while the latter does the opposite, fitting very nicely with our considered judgments but at the price of very low eligibility. Rule utilitarianism, on the other hand, strikes a good balance between these extremes; it assigns to our core moral term a relatively natural property without doing too much damage to our moral convictions. Thus, rule utilitarianism should be regarded as a promising moral theory by any philosopher who takes seriously considerations of eligibility and naturalness. (shrink)

Normative realists might be assumed to have few worries about semantics. After all, a realist might initially hope to simply adopt the best semantic theory about ordinary descriptive language. However, beginning with the non-cognitivist appropriation of the open question argument, a number of philosophers have posed serious objections to the realist’s ability to offer a plausible semantic theory. This paper introduces the two most influential semantic challenges to normative realism: the open question argument, and the Moral Twin Earth argument. There was a time when meta-ethical expressivism seemed to be the only game in town for meta-ethical non-representationalists. In recent years, though, meta-ethical inferentialism has emerged as a promising non-representationalist alternative. So far, however, inferentialists lack something that would really allow them to draw level with expressivists. This is an explanation for the distinctive difference between normative and descriptive vocabulary when it comes to disagreement—something expressivists can explain in terms of the difference between representational and desire-like states and which constitutes (...) one of the primary motivations for expressivism. This paper develops a novel and distinctive account for this difference on behalf of inferentialists, based on the different functions of these two vocabularies. Not only does this account help inferentialists, it also shows how non-representionalist accounts can capture the relevant disagreement phenomena without appealing to the sorts of desire-like states expressivists tend to appeal to. Normative naturalism holds that normative properties are identical with, or reducible to, natural properties. Various challenges to naturalism focus on whether it can make good on the idea that normative concepts can be used in systematically different ways and yet have the same reference in all contexts of use. In response to such challenges, some naturalists have proposed that questions about the reference of normative terms should be understood, at least in part, as normative questions that can be settled through (...) normative inquiry. In this paper I have two goals. First, I argue that these naturalist proposals do not yet allow for radical disagreement on normative matters, or at least do not explain how such disagreement is possible. Secondly, I argue that, in order to account for radical disagreement, naturalists should not only treat normative reference as a normative issue but also adopt a non-representationalist account of normative concepts, on which such concepts are individuated through their practical role. I illustrate this point by showing how a view that combines naturalism and expressivism about normative discourse can vindicate the elasticity of normative concepts, their referential stability, and the objectivity of normative truths.
