This paper tries to prove the existence of a profound internal incoherence within the Hart’s legal thought. It examines some of the central concepts in his theory of law, such as the internal point of view, the rule of recognition, the open texture of law, and the judicial discretion. All these concepts point at the same direction, claiming that the legal system is open to other normative orders, such as morality. Contradicting this inherent tendency in his theory of law, Hart always disclaims the existence of any necessary connection between law and morals. This is also the main thesis of legal positivism, a movement that Hart has tenaciously embraced, but, because of that latent contradiction in his thought, he has left it deeply weakened
