La legitimidad del juez constitucional

Abstract
Two questions are raised by the recognition of the creative function of the judge, specially the constitutional one, whose decisions put in question the normative capacity of the legislative power itself, even to the extent of anulling laws it has passed. The first consists in establishing the background to why judicial power is power. The second tackles the specific power of the constitutional judge with the aim of understanding the central problem of all power, that of its legitimacy confronting, patently in this case, the democratic legitimacy of the legislator
