Investigates the resolution of contradictions and ambiguous derogations in a code, by means of the imposition of partial orderings. The Right and the Good, a classic of twentieth-century philosophy by the eminent scholar Sir David Ross, is now presented in a new edition with a substantial introduction by Philip Stratton-Lake, a leading expert on Ross. The Concept of Law is the most important and original work of legal philosophy written this century. First published in 1961, it is considered the masterpiece of H.L.A. Hart's enormous contribution to the study of jurisprudence and legal philosophy. Its elegant language and balanced arguments have sparked wide debate and unprecedented growth in the quantity and quality of scholarship in this area--much of it devoted to attacking or defending Hart's theories. Principal among Hart's critics is renowned lawyer and political philosopher (...) Ronald Dworkin who in the 1970s and 80s mounted a series of challenges to Hart's Concept of Law. It seemed that Hart let these challenges go unanswered until, after his death in 1992, his answer to Dworkin's criticism was discovered among his papers. In this valuable and long-awaited new edition Hart presents an Epilogue in which he answers Dworkin and some of his other most influential critics including Fuller and Finnis. Written with the same clarity and candor for which the first edition is famous, the Epilogue offers a sharper interpretation of Hart's own views, rebuffs the arguments of critics like Dworkin, and powerfully asserts that they have based their criticisms on a faulty understanding of Hart's work. Hart demonstrates that Dworkin's views are in fact strikingly similar to his own. In a final analysis, Hart's response leaves Dworkin's criticisms considerably weakened and his positions largely in question. Containing Hart's final and powerful response to Dworkin in addition to the revised text of the original Concept of Law, this thought-provoking and persuasively argued volume is essential reading for lawyers and philosophers throughout the world. We present a mathematical approach to defeasible reasoning based on arguments. This approach integrates the notion of specificity introduced by Poole and the theory of warrant presented by Pollock. The main contribution of this paper is a precise, well-defined system which exhibits correct behavior when applied to the benchmark examples in the literature. It aims for usability rather than novelty. We prove that an order relation can be introduced among equivalence classes of arguments under the equi-specificity relation. We also prove (...) a theorem that ensures the termination of the process of finding the justified facts. Two more lemmas define a reduced search space for checking specificity. In order to implement the theoretical ideas, the language is restricted to Horn clauses for the evidential context. The language used to represent defeasible rules has been restricted in a similar way. The authors intend this work to unify the various existing approaches to argument-based defeasible reasoning. A study in the logic of theory change, examining the properties of maxichoice contraction and revision operations.

This paper extends earlier work by its authors on formal aspects of the processes of contracting a theory to eliminate a proposition and revising a theory to introduce a proposition. In the course of the earlier work, Gardenfors developed general postulates of a more or less equational nature for such processes, whilst Alchourron and Makinson studied the particular case of contraction functions that are maximal, in the sense of yielding a maximal subset of the theory (or alternatively, of one of (...) its axiomatic bases), that fails to imply the proposition being eliminated. In the present paper, the authors study a broader class, including contraction functions that may be less than maximal. Specifically, they investigate "partial meet contraction functions", which are defined to yield the intersection of some nonempty family of maximal subsets of the theory that fail to imply the proposition being eliminated. Basic properties of these functions are established: it is shown in particular that they satisfy the Gardenfors postulates, and moreover that they are sufficiently general to provide a representation theorem for those postulates. Some special classes of partial meet contraction functions, notably those that are "relational" and "transitively relational", are studied in detail, and their connections with certain "supplementary postulates" of Gardenfors investigated, with a further representation theorem established. In this book the author gives a broad overview of different areas of research in nonmonotonic reasoning, and presents some new results and ideas based on his research. The guiding principles are: clarification of the different research activities in the area, which have sometimes been undertaken independently of each other; and appreciation of the fact that these research activities often represent different means to the same ends, namely sound theoretical foundations and efficient computation. The book begins with a discussion of (...) the various types of nonmonotonic reasoning, their applications and their logics. Theorem proving techniques for these logics are also described. The following chapters deal with formulations of nonmonotonic inheritance, and nonmonotonic reasoning based on nonmonotonic rules. The final chapter discusses the achievements in the field in the light of the Yale shooting example. Law and legal reasoning are a natural target for artificial intelligence systems. Like medical diagnosis and other tasks for expert systems, legal analysis is a matter of interpreting data in terms of higher-level concepts. But in law the data are more like those for a system aimed at understanding natural language: they tell a story about human events that may lead to a lawsuit. Statements of the law, too, are written in natural language and legal arguments are often arguments about (...) what that language means or ought to mean.This study is one of the few research efforts in this fertile area. It is unique in developing a computational model for analyzing legal problems in a way that brings these strands of AI research together and makes sense from a jurisprudential perspective as well.Gardner first analyzes several positions in Anglo-American jurisprudence and their relevance for work in artificial intelligence.
