This article explores contemporary biopolitics in the light of Michel Foucault's oft quoted suggestion that contemporary politics calls `life itself' into question. It suggests that recent developments in the life sciences, biomedicine and biotechnology can usefully be analysed along three dimensions. The first concerns logics of control - for contemporary biopolitics is risk politics. The second concerns the regime of truth in the life sciences - for contemporary biopolitics is molecular politics. The third concerns technologies of the self - for (...) contemporary biopolitics is ethopolitics. The article suggests that, in these events, human beings have become `somatic individuals': personhood is increasingly being defined in terms of corporeality, and new and direct relations are established between our biology and our conduct. At the same time, this somatic and corporeal individuality has become opened up to choice, prudence and responsibility, to experimentation, to contestation and so to a politics of `life itself'. This article challenges the urge within Actor-Network Theory, posthumanism, and the ontological turn in sociology and anthropology to dissolve analytical distinctions between subject and object, society and nature, and human and non-human. It argues that only by acknowledging such distinctions and applying a realist ontology can exploitative and unsustainable global power relations be exposed. The predicament of the Anthropocene should not prompt us to abandon distinctions between society and nature but to refine the analytical framework through which we can distinguish (...) between sentience and non-sentience and between the symbolic and non-symbolic. The incompatibility of posthumanist and Marxist approaches to the Anthropocene and the question of agency derives from ideological differences as well as different methodological proclivities. A central illustration of these differences is the understanding of fetishism, a concept viewed by posthumanists as condescending but by Marxists as emancipatory. (shrink)

This article is a plea for the idea of society in sociological theory. Even though the industrial national societies no longer exist, the successive crises that we have encountered show that we need a general concept to account for social life. Thus sociology should be enabled to remain a moral and political philosophy.

From ‘connecting the dots’ and finding ‘the needle in the haystack’ to predictive policing and data mining for counterinsurgency, security professionals have increasingly adopted the language and methods of computing for the purposes of prediction. Digital devices and big data appear to offer answers to a wide array of problems of (in)security by promising insights into unknown futures. This article investigates the transformation of prediction today by placing it within governmental apparatuses of discipline, biopower and big data. Unlike disciplinary and (...) biopolitical governmentality, we argue that prediction with big data is underpinned by the production of a different time/space of ‘between-ness’. The digital mode of prediction with big data reconfigures how we are governed today, which we illustrate through an analysis of how predictive policing actualizes between-ness as hotspots and near-real-time decisions. Foucault introduced the concept ‘governmentality’ to refer to the conduct of conduct, and especially the technologies that govern individuals. He adopted the concept after his shift from structuralist archaeology to historicist genealogy. But some commentators suggest governmentality remains entangled with structuralist themes. This article offers a resolutely genealogical theory of govermentality that: echoes Foucault on genealogy, critique, and technologies of power; suggests resolutions to problems in Foucault’s work; introduces concepts that are clearly historicist, not structuralist; and opens new areas of (...) empirical research. The resulting genealogical theory of governmentality emphasizes nominalism, contingency, situated agency, and historicist explanations referring to traditions and dilemmas. Many actors mobilize the cognitive, legal and technical tool-box of data protection when they discuss and address controversial issues such as digital mass surveillance. Yet, critical approaches to the digital only barely explore the politics of data protection in relation to data-driven governance. Building on governmentality studies and Actor-Network-Theory, this article analyses the potential and limits of using data protection to critique the ‘digital age’. Using the conceptual tool of dispositifs, it sketches an analytics of data protection and the emergence (...) of its configuration as ‘data protection by design and by default’. In Between Facts and Norms, Jürgen Habermas works out the legal and political implications of his Theory of Communicative Action (1981), bringing to fruition the project announced with his publication of The Structural Transformation of the Public Sphere in 1962. This new work is a major contribution to recent debates on the rule of law and the possibilities of democracy in postindustrial societies, but it is much more. The introduction by William Rehg succinctly captures the special nature of the work, (...) noting that it offers a sweeping, sociologically informed conceptualization of law and basic rights, a normative account of the rule of law and the constitutional state, an attempt to bridge normative and empirical approaches to democracy, and an account of the social context required for democracy. Finally, the work frames and caps these arguments with a bold proposal for a new paradigm of law that goes beyond the dichotomies that have afflicted modern political theory from its inception and that still underlie current controversies between so-called liberals and civic republicans. The book includes a postscript written in 1994, which restates the argument in light of its initial reception, and two appendixes, which cover key developments that preceded the book. Whether this satirical inscription on a Dutch innkeeper's sign upon which a burial ground was painted had for its object mankind in general, or the rulers of states in particular, who are insatiable of war, or merely the philosophers who dream this sweet dream, it is not for us to decide. But one condition the author of this essay wishes to lay down. The practical politician assumes the attitude of looking down with great self-satisfaction on the political theorist as a (...) pedant whose empty ideas in no way threaten the security of the state, inasmuch as the state must proceed on empirical principles; so the theorist is allowed to play his game without interference from the worldly-wise statesman. Such being his attitude, the practical politician — and this is the condition I make — should at least act consistently in the case of a conflict and not suspect some danger to the state in the political theorist's opinions which are ventured and publicly expressed without any ulterior purpose.
