Emphasis is placed in the need of taking persons seriously instead of only taking their rights seriously. Accordingly human well-being (physical, psychological and moral) is a «trump» against any sort of consideration about alleged rights that could go counter human development and well-being. Instead of current talk about classical rights such as liberty, freedom and dignity, too formal and too abstract, the paper deals with three main rights that prove to be more promising: 1) The right to be considered as (...) a being whose suffering is to be minimized. 2) The right to a free, full personal development. and 3) The right to receive care and sympathy. Against current theories of rights a plea is made for enlightened and enlarged sympathy as the foundation of rights and ethics, thus avoiding the partiality that infects Dworkin's and many other's theories of private ethics. Más recientemente, Ronald Dworkin y Will Kymlicka han desarrollado argumentos similares. En el caso del primero, contra ciertas políticas paternalistas; en el del segundo, en apoyo de la tesis liberal de la neutralidad estatal. Mi propósito en el presente artículo es analizar la plausibilidad (...) de dichos argumentos concebidos como una defensa de la tesis de la neutralidad estatal. Intentaré demostrar que ambas versiones del argumento fracasan. En la sección II, cuestionaré la capacidad de los argumentos para respaldar las conclusiones que aspiran establecer, sin objetar la plausibilidad de las premisas involucradas. En la sección III, desarrollaré tres objeciones contra la concepción del bienestar crítico que constituye el corazón de ambas versiones del argumento. Globalization focuses on the development of new productive, trade, and economic techniques. However, this process, evolutionary technologically, has involved, paradoxically, an involution in important roles of our political, social, and cultural life, basically, about the misinformation in administrative procedures, the lack of legal security, and an atomization of the individual wills. That’s Ulrich Beck has called “the global risk society”. A society where organized irresponsibility and power relations of some international actors with political and enterprise weight govern important financial and (...) economic resources for their own benefit. “The risk society” has imposed its own political rules of control and loss of control, defining new ways of organization -out of citizens or politicians- governed by those economic forces. In this new scenario, the past does not determine the present events but the future, uncertain and fearsome, makes conditional on the present courses of action. A kind of prevision or precaution on impending disasters determines our future which nowadays does not depend on us but on those in economic and technological control. The new precautionary scenario begins with threats and ends with the demolition of social gains made in recent decades. The outcome of this risk society is the systematic destruction of public values like solidarity, trust, or common good, and their replacement by the primacy of economics over politics and the consideration of the market as the only effective means of allocating resources. Some resources, public in many cases, that are managed in a totally private way, and whose benefits are given up from traditionally considered public goods: education, health care, dwelling, social services, pensions, and indeed justice. Against this, the most consistent solution, most daring and the most difficult passes to reassign new powers to the states, to reinstate the sovereignty of citizens in decisions that affect us, and to share goods and public resources with parameters of ethics and social justice. A task that is not limited to simple political choice of our representatives, but in a personal involvement in all areas of our political, economic and social life. (shrink)

This study investigates the impact of fraud/lawsuit revelation on U.S. top executive turnover and compensation. It also examines potential explanatory variables affecting the executive turnover and compensation among U.S. fraud/lawsuit firms. Four important findings are documented. First, there was significantly higher executive turnover among U.S. firms with fraud/lawsuit revelation in the Wall Street Journal than matched firms without such revelation. Second, although on average, U.S. top executives received an increase in cash compensation after fraud/lawsuit revelation, this increase is smaller than (...) that of matched non-fraud/lawsuit firms. Third, fraud/lawsuit firms were more likely to change top executive when chief executive officer (CEO) was not the board chairman and CEO had been on the board for a short time. Fourth, fraud/lawsuit firms were more likely to reduce their executive cash compensation when profitability was low, firms were involved in fraud, the compensation committee size was small, and the board met more often. These findings indicate that although, in general, U.S. fraud/lawsuits firms did not reduce their executive cash compensation, those involved in fraud were more likely to reduce their executive cash compensation than to change their top executives. The finding, that ethical standards is not a significant factor for U.S. executive turnover nor compensation reduction, suggests that ethics appears to play no part in the board’s decisions, and that U.S. firms may have ethical standards in writing but they do not implement nor enforce the standards. I have little to say on this passage, where it seems necessary to maintain the vulgate notwith standing its obvious defects. My only reason for discussing it is to call attention to the strangeness of Jebb's proceeding when seeking to support Hermann's conjecture παλλλοιν which he admits into the text. The objection to Hermann's view is that, as he himself admits, there is no evidence that πáλληλος could be used in the sense of λληλιφóνος. For that, I suppose, is the (...) meaning of ‘mutual hands,’ which both Jebb and Campbell suggest as a translation, although ‘mutual violence’ would be better. But the chief purpose of this note is to protest against the mode of interpretation applied to Philo de Mose 3. 36. II. p. 175 M. διà τàς ν δασι καí πνρì γνιμéνας συνχς καì παλλλονς φθορáς Turnebu s rightl yrenders ‘alternas interneciones,’ and why Jebb supposes him to have meant ‘mutual’ I do not know. Anyhow he admits that Philo used the word in its ordinary sense of successive, and proceeds to paraphrase ‘owing to the continuous and rapid succession of calamities by flood and fire’ . All this is quite beside the mark, for the reference is to the alternate destruction of the world at the κπρωσις by fire and at the ξγρωσιςby water. I must take leave to refer to the evidence collected in my book on Zeno and Cleanthes, p. 253, to which should be added a most instructive passage of Origen : περì τν κακν λóγος ο μνóντων ì ν τατᾦ διà τν τοι τηροσαν τà πì γ$$$ς πρóνοιαν κατακλνσμο καì κπνρ03CE;σσι καθαíρονσαν.Add the passages from Lucan quoted by Mr. Heitland in his Introduction, p. xliii. Panichas, longtime editor of the conservative quarterly Modern Age, brings to a conclusion a critical trilogy, really a tetralogy, which includes The Reverent Discipline, The Courage of Judgment, and The Critic as Conservator. The unusual title is inspired by Plato’s Phaedrus, with Panichas writing at one point—concerning literary scholar Austin Warren’s “open celebration of great ideas, great writers, great souls”—that, “Literary greatness for him meant spiritual greatness, this is, the kind of greatness that gives (...) us guidance and helps to orient us towards the good, or, as Plato puts it, to make us ‘grow wings to overcome gravity’”.
