In this paper, I identify and distinguish different modes of thinking at work in Hannah Arendt’s Denktagebuch and letters. In the Denktagebuch, her thinking is dialogical, as she engages with herself in a dialogue of thought, while her writing is a product of poetic thinking. In the letters, her dialogical thinking is not only with herself, but with friends and correspondents, and poetic thinking takes the form of the material letter itself. Arendt engages in a dialogue of thought both with (...) herself, who is a friend, and her correspondents, who are also friends. Arendt’s personal writings, that is, her letters and her Denktagebuch reveal a close relationship between private, solitary thinking, and thinking and writing that appear in public. (shrink)

This article takes the theme of Pope Benedict’s Post-Synodal Apostolic Exhortation, Africae Munus, on reconciliation, justice and peace in Africa as its starting point. It analyses how the commitments of African Christians at the Second African Synod can be realized through a transformative missional theological praxis. This theological approach is proposed as a deeper concern on how to bring about the fruits of the eschatological harvest of God’s kingdom to bear on the present complex African social context. This article proposes (...) two ways of doing this: The first is a socio-theological analysis of Africa’s social context, and the second is showing how to mine the spiritual, religious, cultural, human, and material resources of Africa. People enroll in medical research for many reasons ranging from decisions regarding their own or family members' health situation to broader considerations including access to health and financial resources. In socially vulnerable communities the choice to participate is often based on a risk-benefit assessment that goes beyond the medical aspects of the research, and considers the benefits received. In this qualitative study, we examined the motivations of Rwandan women to participate in a non-commercial collaborative research study examining the safety, acceptability, (...) and adherence of a contraceptive vaginal ring in Rwanda juxtaposed with the perceptions of the research within the community. 351 women attended the screening visit, four were excluded because they were not able to complete the assessment of understanding. The remaining participants' ages ranged from 17 to 38 and 80% had primary level of education or below. 120 were enrolled. Findings highlighted motivations for joining the study that were relayed both formally by the clinic and informally by the community including the positive aspects of the ring. There were also some negative rumors circulating regarding the research site, likely from excluded participants who faced potential stigma based on that exclusion. It was understood by most participants that they were enrolled in a research study and participants actively sought out enrollment in the research for a variety of reasons. The experiences demonstrate that although inequalities in access to health care may create conflicting situations around the study, it is possible to form partnerships between a research center and participants/their partners, for research about reproductive health. Within the research community, it is generally accepted that consent processes for research should be culturally appropriate and tailored to the context, yet researchers continue to grapple with what valid consent means within specific stakeholder groups. In this study, we explored the consent practices and attitudes regarding essential information required for the consent process within hospital-based trial communities from four referral hospitals in Vietnam. We collected surveys from and conducted semi-structured interviews with study physicians, study nurses, ethics committee members, and (...) study participants and family members regarding their experiences of participating in research, their perspectives toward research, and their views about various elements of the consent process. In our findings, we describe three interrelated themes related to the consent process: words and regulation; reimbursement, suspicions, and joining; and responsibilities. In general, stakeholders had highly varied perspectives of nghiên cứu and researchers used varying levels of detail regarding all aspects of the study in the consent process to build trust with and/or promote potential research participants’ choices about taking part in research. Findings additionally highlight how researchers felt that offering financial reimbursements in a hospital setting, where payment for services was routine, would be unfamiliar to participants and could raise suspicions about the research. Participants, however, focused their discussions on reimbursement or alternative reasons for joining the study, such as health related benefits or altruism. Finally, participants often relied on their physician to help them decide about joining a study or not. Further research is needed to understand how researchers and participants make sense of and practice consent, and how that impacts participants’ decision-making about research participation. To promote valid consent within this context, it is important to engage with hospital-based trial communities as a whole. The data from this study will inform future research on consent, guide the revisions of consent related policies within our research sites and point to several larger issues surrounding researcher-participant expectations, communication, and trust. BackgroundThe informed consent process in clinical trials has been extensively studied to inform the development processes which protect research participants and encourage their autonomy. However, ensuring a meaningful informed consent process is still of great concern in many research settings due to its complexity in practice and interwined socio-cultural factors.ObjectivesThis study explored the practices and meaning of the informed consent process in two clinial trials conducted by Oxford University Clinical Research Unit in collaboration with the Hospital for Tropical Diseases in (...) Ho Chi Minh City, Vietnam.MethodsWe used multiple data collection methods including direct observervations, in-depth interviews with study physicians and trial participants, review of informed consent documents from 2009 to 2018, and participant observation with patients’ family members. We recruited seven physicians and twenty-five trial participants into the study, of whom five physicians and thirteen trial participants completed in-depth interviews, and we held twenty-two direct observation sessions.ResultsWe use the concept “fragmented understanding” to describe the nuances of understanding about the consent process and unpack underlying reasons for differing understandings.ConclusionsOur findings show how practices of informed consent and different understanding of the trial information are shaped by trial participants’ characteristics and the socio-cultural context in which the trials take place. Spirituality is a topic of recent interest. Mindfulness, for example, a concept derived from the Buddhist tradition, has captivated the imagination of clinicians who package it in convenient intervention programs for patients. Spirituality and religion have been researched with reference to potential health benefits. Spirituality can be conceptualised as the alignment of the individual with the whole, experientially, motivationally and in action. For spirituality to unfold its true potential it is necessary to align this new movement with the mainstream of (...) science, and vice versa. Hence, both a historical review, and a systematic attempt at integration is called for, which we are trying to give here. It is useful to go back to one of the roots: parapsychology. Parapsychology was founded as a counter movement to the rising materialist paradigm in the 19th century. Adopting the methods of the natural sciences, it tried to prove the direct influence of consciousness on matter. After 125 years this mission must be declared unaccomplished. Surveying the database of parapsychological research it is obvious that it will not convince sceptics: Although there are enough exceptional findings, it has in general not been possible to reproduce them in replication experiments. This is, however, a characteristic signature of a category of effects which we call effects of generalised entanglement, predicted by a theoretical model analogous to quantum theory. Using this perspective, parapsychological effects can be understood, and the original aim of the founding fathers can be recovered, as well as a new, systematic understanding of spirituality be gained. Generalised entanglement is a formal and scientific way of explaining spirituality as alignment of an individual with a whole, which, according to the model, inevitably leads to non-local correlations. International institutions such as the International Labour Organization (ILO) have been examined from various industrial relations viewpoints. This article seeks to discuss the ILO from the standpoint of moral philosophy. Traditionally, philosophy has not been concerned with industrial relations (IR) and IR writers have not engaged with ethics either. Nonetheless, all IR agents and institutions, international or otherwise, are moral agents. Being part of the United Nations (UN), the ILO follows the Universal Declaration of Human Rights (1948). In philosophical terms, (...) the ILO carries connotations of the German moral philosopher Kant's (1724-1084) concept of universalism. Ethical universalism is also the core of American psychologist and philosopher Laurence Kohlberg's developmental model that allows an assessment of moral values and ethical behaviours. To ascertain the ILO's morality, an empirical study (n=121) was conducted at a regional University. The study indicated that most respondents (68%) saw the ILO as a reflection of the morality of " defending everyone's right to justice and welfare, universally applied while applying well-thought principles and being ready to share and debate these openly and non-defensively with others". In line with the ILO's self-understanding, survey respondents also viewed it as a thoroughly moral agent committed to the advancement of humanity as a whole. Respondents also thought that the ILO goes beyond the confinements of the standard industrial relations framework, actively engaging with the universality of all people. The overall conclusion is that the way the ILO is perceived to act along the scale of Kohlberg's text matches the ILO's actual existence and work. For the first time, the ILO's moral status has been tested using Kohlberg's scale of morality. This provides a significant contribution to our understanding of the morality of a very important universal institution that has virtually all countries as members. (shrink)

Freedom of association operates as an organizational "meta-norm," appreciated both as an independent value and as a touchstone for the institutional design of the International Labour Organization . Despite the renewed interest of the ILO in various aspects of the norm, its understanding of freedom of association lacks a comprehensive normative framework. This article presents such a conceptual framework and a critical in-depth analysis of current ILO freedom of association jurisprudence. Freedom of association should be understood in terms of equitable (...) dialogue , a term offered and developed herein, as an understanding that is already partly embedded in ILO jurisprudence. Global supply chains (GSCs) present the International Labour Organization (ILO) with a challenge that goes to the heart of its founding mandate and structure, one built on the prominence of nation states and national representatives of employers and workers. In February 2020, discussions in the ILO on the rise of GSCs reached deadlock. To fully understand why the ILO has been unable to address decent work deficits in GSCs greater attention needs to be paid to contestation, power and legitimacy in (...) the deliberation of labour governance. Drawing on the concept of agonistic pluralism we examine the evolution of the ILO’s attempt to establish a new labour standard on GSCs under three empirical phases between 2002 and 2020. We argue that shifting power asymmetries between the tripartite constituents of governments, employers and workers, increased counter-hegemonic contestation, and intensified questioning of the deliberative legitimacy of the adversaries, explain the dissensual relations at the ILO. This article contributes to the literature on labour standards in GSCs in demonstrating how and why contestation underpins the evolution of labour governance over time. (shrink)

Unemployment is not just an economic category but is constituted by governmentality, most evidently by the increase of interventions into the lives of the unemployed through Active Labour Market Policies. Furthermore, the International Labour Organization definition of unemployment as being without work, available for work and seeking work is a shifting classification which categorises unemployment on multiple temporal horizons, with the passive element of being without work increasingly superseded by the emphasis on seeking work. Through biographical interviews with unemployed in (...) Ireland, spanning from 2012-2018, we trace this transformation of temporality empirically and conclude that governmentality constitutes multiple, contradictory, indefinite forms of time. Particularly, we offer an imaginative reading of two overlapping temporalities: Kairos, waiting, enduring, suffering nothingness in anticipation of transformation by getting a job, and Cronos, not cyclical time, but the devouring of time, where the days and leisure of the unemployed people are deliberately consumed by job-seeking. Ironically, states implement ALMPs in the kairotic hope of transforming their economy, yet these policies do little but make the experience of unemployment even harder to endure. (shrink)

The last decade has witnessed renewed attempts to regulate the conduct of transnational corporations. One way to do this is via global ethics codes. This paper examines seven such codes (the Sullivan Principles, UN Center for Transnational Corporations’ Draft Code, OECD Guidelines, ILO's Tripartite Declaration, the Caux Round Table Principles for Business, Global Compact, and the United Nations Norms) to determine their coverage of human rights and concludes that if these initiatives succeed, particularly the more recent codes, transnational corporations may (...) emerge as a major force in promoting human rights globally. The Report of the National Academy of Sciences Monitoring International Labor Standards: Techniques and Sources of Information shows that assessing compliance can be carried out in a thorough, transparent fashion, allowing alternative evaluators to identify where they disagree in assessment. Drawing on the Report and written by the Chair of the Committee that produced it, this paper offers a short overview of the principal challenges in assessing compliance with the ILO core labor standards, and offers a simple framework for investigating (...) compliance. Asbestos-related illnesses contribute to the deaths of more than 100,000 people worldwide (ILO 2006) and the plight of sufferers of these illnesses has become a global ethical issue. A leading, Australian building products corporation, James Hardie, created a complex corporate structure that included the establishment of a “Victims Compensation Fund”, and moved its corporate headquarters to the Netherlands to reduce its liabilities. Hardie claimed that this move was tax minimization (Haigh 2006). In this study case, a number of ethical issues (...) provides the opportunity to discuss many business-society questions. These include the duties of the company towards a wide range of stakeholders affected in some way by Hardie’s earlier production of asbestos-related products and its subsequent responses to the question of compensation. The purpose of this research is to adapt to the monopsony theory and disregard the neoclassical economic theory with regard to minimum wage policy. The other purposes of this study are to analyze the present minimum wage policy in Bangladesh. Is minimum wage system really effective? If so, what should be the standard for effective application of minimum wage legislation? The methodology of this study is qualitative. I have created a theoretical debate and developed hypotheses in this scholarship. The hypothesis (...) developed from the debate of neoclassical theory clarified that the minimum wage law might not have an adverse effect. Instead, a standard minimum wage law, along with an appropriate implementation process, may have a positive effect on society. This study finds inadequate mechanisms to implement minimum wage provisions under the Bangladesh labor legislation. Therefore, the present minimum wage policy has not been implemented to its fullest as required to protect workers’ right in Bangladesh. This paper also shows that a minimum wage policy will have an effect if strict adherence to the standard of ILO Conventions is complied with. This study also creates a balancing test between neoclassical theory and monopsony theory on the application of the minimum wage system. Finally, this manuscript has taken a stanch with monopsony theory favoring the application of minimum wage law in the garment manufacturing industry. It is an original research paper. The strength of this type of research is that it benefits the practitioner and the pertinent stakeholder to gain new insight. (shrink)

The issue of same-sex marriage continues to be controversial in the United States. Opponents of same-sex marriage offer a variety of objections in defense of their position. One such objection (which I identify as the Inability to Love objection, or ILO) is that legalizing same-sex marriage would promote a counterfeit good (homosexual marriage) as a genuine good (heterosexual marriage), since homosexuals are incapable of genuine, full erotic love. Proponents of ILO argue that homosexuals are incapable of genuine erotic love because (...) all homosexual relationships lack genuine sexual and affective complementarity. Relying on the arguments of Gareth Moore, I argue against ILO, claiming that it rests on an erroneous conception of desire. Once this conception of desire is corrected, the mythof “homosexual desire” is debunked and along with it the main argument in support of the claim that homosexuals are incapable of love. (shrink)

Two famous negative results about da Costa’s paraconsistent logic ${\mathscr {C}}_1$ (the failure of the Lindenbaum–Tarski process [44] and its non-algebraizability [39]) have placed ${\mathscr {C}}_1$ seemingly as an exception to the scope of Abstract Algebraic Logic (AAL). In this paper we undertake a thorough AAL study of da Costa’s logic ${\mathscr {C}}_1$. On the one hand, we strengthen the negative results about ${\mathscr {C}}_1$ by proving that it does not admit any algebraic semantics whatsoever in the sense of Blok (...) and Pigozzi (a weaker notion than algebraizability also introduced in the monograph [6]). On the other hand, ${\mathscr {C}}_1$ is a protoalgebraic logic satisfying a Deduction-Detachment Theorem (DDT). We then extend our AAL study to some paraconsistent axiomatic extensions of ${\mathscr {C}}_1$ covered in the literature. We prove that for extensions ${\mathcal {S}}$ such as ${\mathcal {C}ilo}$ [26], every algebra in ${\mathsf {Alg}}^*({\mathcal {S}})$ contains a Boolean subalgebra, and for extensions ${\mathcal {S}}$ such as,, or [16, 53], every subdirectly irreducible algebra in ${\mathsf {Alg}}^*({\mathcal {S}})$ has cardinality at most 3. This book examines the labour standards provisions in a number of Regional and Bilateral Trade Agreements, and assesses the potential of using the relevant clauses in these trade agreements as a benchmark for a multilateral approach. Based on the lessons learned from the Regional model, the book proposes a Global Labour and Trade Framework Agreement (GLTFA) combined with a joint ILO/WTO enforcement mechanism to resolve the contentious issue of the link between the CLS and international trade. The history of the (...) linkage between the Core Labour Standards (CLS) and international trade dates back roughly 150 years, and has recently become one of the most vexing issues facing policy-makers. At the heart of the debate is the question whether or not trade sanctions should be imposed on countries that do not respect the CLS as embodied in multilateral conventions administered by the International Labour Organization (ILO). Concretely, this would entail inserting a social clause in the World Trade Organization (WTO) rules, and would trigger the imposition of sanctions on those countries that do not adhere to the CLS. This comment on Brian Langille's article agrees with Langille's claim that inter-state competition should not be viewed as the main challenge to the global efforts to regulate labor rights. The comment suggests, however, that there is another type of competition that poses a challenge, namely a transnational competition which takes place among sub-state actors. Focusing on this "transnational conflict paradigm," the ILO has the tools to engage domestic constituencies in an effort to promote labor rights within the respective member states.

This Paper suggests that the answer to the question “what is domestic labor law for?”—commonly regarded as securing “justice against markets” or a justified tax on market activity—has informed the search for the answer for the question “what is international labor law for.” This is reflected in what this Paper refers to as P2, which provides that “the failure of any country to adopt humane conditions of labor is an obstacle in the way of other nations which desire to improve (...) the conditions in their own countries.” P2 envisions a “race to the bottom” by rational states trapped in a Prisoner’s Dilemma game. The author maintains that this cannot be the objective of ILO which cannot stop “the race” given its deficient enforcement mechanisms to ensure compliance. This Paper suggests an alternative raison d’etre for the ILO, which is called P1, namely social justice: “universal peace can only be established if it is based upon social justice.” P1 reflects what states actually seek to achieve. Following Sen, this Paper suggests that there is no tradeoff between social justice and economic efficiency. Therefore the promotion of labor rights by the ILO will contribute both to social justice and to economic success. Thus the ILO should promote international labor law so as to lead member states to pursue their self-interest which is consistent with the collective goal of humanity. (shrink)

This article is contextualized within the recent evolution of household employment in Spain. In the context of the strong demand for personal care services – due to rapid population ageing, mass incorporation of women into the labour market and insufficient collective provision of care services – the growth of domestic work is closely related to the overall social organization of care and specific migration policies that have eased, both implicitly and explicitly, the labour supply of foreign women into Spanish households. In line with ongoing debates in the academic literature as well as in the political sphere, this article seeks to explain the extent to which domestic work can or should be considered as any other job in terms of social and employment rights and obligations. To that end, it evaluates changes in the regulation of household employment in Spain since the creation of the Special Regime for Household Employees in 1969 until the most recent 2011 reform. Following the recommendations of the ILO Convention for Domestic Workers, this latest reform puts domestic workers on equal footing with other dependent employees. It thus implies a sea change in relation to the discriminatory treatment embedded in previous legal frameworks. The main hindrance to the effective transposition of the norm however remains the strong presence of the informal economy and a dubious political commitment to ensure its application. (shrink)

Se accettiamo l’ipotesi di Nietzsche, ampiamente sviluppata da Heidegger, che prevede l’affermarsi planetario di un’epoca in cui il senso della vita sarà completamente assente, un solo compito si offre alla filosofia e, nella sua accezione più larga, alla cultura: “DARE UN SENSO – questo il compito che resta assolutamente da assolvere”. Di là dal nichilismo, scrisse Nietzsche, la creazione di un senso permette al caos, nascosto in fondo all’uomo così come ai confini dell’universo, di trasformarsi in stella. In un testo (...) del marzo 1888, il pensatore chiede all’uomo di “costringere il suo caos a diventare forma; a diventare logico, semplice, univoco, matematica, legge. È questa qui la grande ambizione”. Il canto poetico di Zarathustra annuncerà, analogamente, l’imperativo di una cultura che dà all’esistenza la sua legge: “Riesci a costringere le stelle a ruotare intorno a te?”. E tale insegnamento è così precisato: “Bisogna che ancora si porti dentro di sé un caos per potere far nascere una stella danzante”. L’immagine della stella evoca per Nietzsche l’origine del mondo e l’esplosione della vita: ma allora, è l’oblio della stella a fondare il nichilismo. Questo termine, reso popolare da Turgenev e Paul Bourget prima di Nietzsche, deriva dal latino ne hilum, l’assenza di “ilo”, la cicatrice lasciata sul seme dalla rottura del funicolo. Questa giuntura, attraverso cui scorrono i succhi nutritivi della pianta, è fonte di vita e, metaforicamente, donazione di senso. Quando il condotto della vita è chiuso o nascosto, non è possibile nessun orientamento e la fine scompare insieme con il senso che ad essa conduceva. Se applichiamo questo termine al nostro presente malessere, possiamo vedere che il significato di una cultura è legato costantemente alla sua comparsa e al suo scopo. L’epoca della completa assenza di senso è dunque quella in cui l’origine di una cultura, nel suo abbrivio o nella sua genealogia, è sistematicamente negata, al punto da occultare il suo fine, inteso come punto d’arrivo e, insieme, come destinazione. Che si tratti di scienza, di filosofia, di politica o di arte, le attività umane e i prodotti che ne risultano abdicano, così, ad ogni pretesa di senso e si limitano, a costo di rinunciare a costruire un mondo, alla immersione nel circolo del consumo. Nel presente lavoro si tenta di definire una direzione del pensiero che consenta alla filosofia di uscire dal nichilismo. In questo senso, si vi si pone a tema quel capitolo della filosofia che va sotto il nome di “post-nichilismo”, che non è, però, da intendere come una semplice e, probabilmente, perdente avversione empirica o sentimentale al clima generale dell’“insensata” nostra epoca. Kant aveva riconosciuto a David Hume il merito di averlo risvegliato dal “sonno dogmatico”; pare necessario cogliere nel nichilismo teoretico un’occasione analoga. Il “sonno” che ha colto l’Occidente risiede nella volontaria chiusura dello sguardo di fronte alla “catastrofe” che si annuncia e che non investe solo il pensiero. La filosofia, in un ultimo risveglio, non può che tentare di mostrare il panorama che si aprirebbe alla nostra vista, se solo si avesse l’ardire di orientare lo sguardo verso la nostra originaria destinazione per illuminare il nostro apparentemente ineluttabile futuro. The rate of Occupational injury and work-related diiseases in Indonesia is considered to be t he highest in South East Asian Region. International Labor Organization (ILO) reported the level of competitiveness regarding Occupational and safety performance in Indonesia was 98 out of 100 countries. Previous studies have reported that the major causes of occupational injury and work - related diseases primarily influences by the workers behavior. The aim of this study is to identify the relationship between perception and occupational injury (...) and work-related diseases. A cross sectional study was conducted among 200 workers in plywood company in West Kalimantan. The independent variables were perceived of susceptibility, perceived of severity, perceived of benefit and perceived of self efficacy , whereas the dependent variable s are occupational injury and work-related diseases . Multiple linier regression was employed to examine the relationship of the variables. This study found that perceived of susceptibility, perceived of severity, perceived of benefit and perceived of self efficacy were significantly associated with occupational injury and work-related diseases (p=0,000). The strongest predictor variables to occupational injury and work-related diseases are are perceived of benefit (t=2,087 and 4,189), perceived of self efficacy (t=2,370) and perceived of susceptibility (t=1,637). On the basis of a stakeholder typology of the investor and of the chosen topic of interaction, namely compliance with the core ILO labour conventions, the paper formulates 10 expectations about management reactions to the concerns raised by investors. These expectations cover responsiveness, acknowledgment of positions and general attitude. The expectations are then related to the factual discourse by management (...) responding to such concerns raised by investors. Based on data obtained from the Portfolio21‐correspondence, which is a joint initiative of European investors, it is found that management is very willing to discuss cases but at the same time denies the truth‐value of the allegations. The global surge in academic misconduct during the COVID-19 pandemic, exacerbated by remote teaching and online assessment, necessitates a comprehensive understanding of the multidimensional aspects and stakeholders' perspectives associated with this issue. This paper addresses the prevalent use of answer-providing sites and other types of academic misconduct, underscoring the challenge of detecting all or most of the student misconduct. Exploring factors such as faculty inexperience in remote teaching and assessment, the paper advocates for proactive measures to preserve integrity in education. (...) Emphasizing the need for a culture of integrity beyond traditional classrooms, the paper reviews existing models, then details steps to create a framework using the International Labour Organization (ILO)’s TREE training method. It presents the IEPAR framework (Inspiration, Education, Pedagogical considerations, Assessment design, Response and Restorative practice), and assesses its effectiveness. Incorporating faculty feedback, the paper concludes with evidence-based findings, positioning the IEPAR framework as a robust approach for addressing academic misconduct and fostering a culture of academic integrity in higher education through responsible training of all stakeholders. The International Labor Organization is not an effective force for raising labor standards in the developing world and could become considerably more effective by taking account of two of the most important and interrelated recent theoretical developments in understanding labor standards. First, countries derive no comparative advantage in the global trading system from most very low labor standards. The ILO should therefore concentrate its energies on lifting these, rather than concentrating on labor standards that are a source of comparative advantage, (...) the elimination of which is resisted strongly and effectively. Second, the tools of game theory may be used to identify the collective action problems that prevent countries from lifting their own labor standards, and create a role for a transnational agency that may assist them. Corporate social responsibility (CSR) is a comprehensive concept that aims at the promotion of responsible business practices closely linked to the strategy of enterprises. Although there is no single accepted definition of CSR, it remains an inspiring, challenging and strategic development that is becoming an increasingly important priority for companies of all sizes and types, particularly in Europe. Promotion of well-being at work is an essential component of CSR; however, the link between CSR, working conditions and work organisation is still (...) found to be unfamiliar to stakeholders. As CSR is strategic and is regarded by many companies and corporate leaders as an important development, it offers opportunities for psychosocial risk management, an area that is currently among the top priorities in working environment and well-being at work debates. However, the link between CSR and psychosocial risk management has not been addressed clearly before. This paper aims to explore the potential role of CSR in promoting well-being at work through the development of a framework for the management of psychosocial risks. As part of the research, key stakeholders [including the World Health Organization (WHO), the International Labour Organization (ILO), the European Agency for Safety and Health at Work (EU-OSHA), the European Commission (EC), employers’ associations, trade unions and other policy experts] across Europe participated in a survey, interviews and focus groups to assess and clarify the link between CSR and psychosocial risk management. On the basis of the findings, a CSR-inspired approach to the management of psychosocial issues at work is proposed. Such an approach can be a useful tool in contexts where, up until now, expertise and tradition in dealing with psychosocial issues have been lacking. (shrink)

In the seventy-five years since the end of World War II, pairs of countries have entered into over a thousand bilateral labor agreements to regulate the cross-border flow of workers. These agreements have received little public or academic attention. This is likely, in part, because there is limited data or easily available information on BLAs. This Article hopes to change that by introducing three new resources: a dataset documenting the formation of over 1,200 BLAs; a corpus including the texts of (...) over 800 BLAs; and a dataset coding whether over 500 BLAs mention twenty topics that the ILO has identified as best practices for these agreements. Using this data, we show that, unlike some other forms of bilateral agreements, the rate of BLAs being signed has remained relatively high during the first two decades of the twenty-first century. Additionally, we also show evidence that, although many BLAs were formed during this period, relatively few agreements include various worker protections advocated for by activists, scholars, and NGOs. Freedom of association for trade union has been generally accepted as part of basic human rights in Islam. Freedom of association, which include the right to join and participate in trade union activities, can be susceptible to disputes between employers and employees as well as trade unions. Islam provides freedom of association in labour relations and also mechanisms to settle disputes pertaining to such freedom. Conciliation (sulh) and arbitration (tahkim) are both used methods in the inception of Islam, which have (...) similarities with the modern sense. We shall discuss in this article the right to dispute resolution between employers and trade unions in the context of freedom of association in labour relations as based on Shari’ah law and using modern legal systems of Islamic countries such as Iran, Malaysia and Saudi Arabia as examples. In 2009, a small group of domestic workers joined FNV Bondgenoten, the largest Dutch trade union in the private sector and affiliated with the Dutch trade union confederation FNV. The group that joined consisted mainly of women immigrant workers, many of whom did not have a residence permit. FNV’s policy is that we organize workers and do not ask for passports. Still, a group like this brought to light several problems for FNV, both practical and fundamental. The Article identifies three (...) types of problems. The first set of problems concerns the invisibility of domestic workers. Domestic workers work in private houses and are leery of talking to strangers if they don’t have residence permits. This demanded new organizing tactics from the sector, like asking women to bring a friend to a meeting and joining churches. A cash payment of membership fees system was devised, its administration done by handwriting. At the same time, the public debate on immigration toughened; immigrants without residence permits in particular were depicted as somewhere between a profiteer and the devil. This debate also took place within FNV. The second set of problems is defined by the traditional views in Dutch society on domestic work. The group chose to become union members, since they wanted to better their position in the labor market. Dutch law on domestic work excludes them from full protection of labor and social security law. The inclusion of domestic work in labor and social security law is contrary to cultural and historical traditions and views and therefore contentious. The third set of problems is caused by the connectedness of labor and social security law and immigration law. Domestic workers in the Netherlands work in the shadows in two ways: by not having a residence permit, and by not being protected by labor and social security law. The result of our campaign is that a group of publicly financed care workers will be better protected, but the group of domestic workers that fought for ILO Convention 189 will still be excluded from our labor and social security law and not be able to qualify for a residence permit. This chapter focuses on the implications of economically self‐interested behavior by voters and lobbyists, rather than important issues of irredentism, demagoguery, and security. It also focuses on the political problems of liberalizing migration between poor and wealthy states. Economists often support temporary migration in order to guard against potential adverse effects of brain drain. International organizations can serve to engage in surveillance, communication, and adjudication in order to enforce rules. Responsibility for international economic migration could be assigned to an existing (...) organization or to a new organization. The chapter addresses the possible features of a new international organization addressing migration. It also describes the present migration‐related functions of the International Organization for Migration (IOM), International Labor Organization (ILO), and World Trade Organization (WTO). The ILO has broad experience in a variety of labor and migration issues, and its tripartite structure facilitates negotiations that involve the concerns of industry and labor. (shrink)
