Striving for Clarity About theLamarckianNature of CRISPR-Cas Systems.Sam Woolley, Emily C. Parke, David Kelley, Anthony M. Poole & Austen R. D. Ganley - 2019 - Biology and Philosophy 34 (1):11.
Koonin argues that CRISPR-Cas systems present the best-known case in point for Lamarckian evolution because they satisfy his proposed criteria for the specific inheritance of acquired (...) adaptive characteristics. We see two interrelated issues with Koonins characterization of CRISPR-Cas systems as Lamarckian. First, at times he appears to confuse an account of the CRISPR-Cas system with an account of the mechanism it employs. We argue there is no evidence for the CRISPR-Cas system beingLamarckianin any sense. Second, it is unclear whether the mechanism is moreLamarckianthan many other forms of genetic change already well-characterized in Darwinian terms. We present three conceptually distinct senses in which the mechanism of IAC may be considered Lamarckian and argue that only the strongest sense of goal-directed IAC would be difficult to accommodate in a Darwinian account. As the CRISPR-Cas mechanism does not qualify asLamarckianin this strong sense, we argue there is no conceptual value in calling itLamarckian”. Finally, we suggest that CRISPR-Cas systems do hold the potential for genuinely non-Darwinian, directed evolution in a way that Koonin did not discuss, involving their potential use as a human gene-editing tool. Punitive Damages: Court Orders Two-Thirds to Go to State University Cancer Research Program.Meleah A. Geertsma - 2003 - Journal of Law, Medicine and Ethics 31 (2):308-312.
On December 20, 2002, the Ohio Supreme Court issued an opinion in Dardinger v. Anthem Blue Cross & Blue Shield granting a landmark punitive damages award against the (...) defendant-insurer for breach of contract and bad faith in its coverage of a cancer patient. The court directed that the punitive damages award of $30 million, should it be accepted by the plaintiff, be apportioned between the plaintiff and a cancer research fund to be established in the name of the plaintiff's deceased wife, Esther Dardinger. In so doing, the court broke new ground in the scope and social purpose of punitive damages in health care litigation, as well as the courtsrole in distributing those damages. After being diagnosed with metastatic brain tumors in October 1996, Esther began intra-arterial chemotherapy treatments at the recommendation of her physician, Dr. Newton. IAC is a targeted form of chemotherapy in which an arterial catheter is threaded through a cranial artery near the tumor and into the brain. (shrink)
