L’une des tâches de la phénoménologie transcendantale, que Husserl lui-même définit comme une science éidétique des phénomènes transcendentalement réduits, est de découvrir des lois a priori matérielles d’un type spécial : des lois éidétiques descriptives établies sur la base de concepts descriptifs purs. Cet article s’attache d’abord à préciser la notion husserlienne d’essence au le sens large, définie comme une fonction d’état-de-choses (Sachverhaltsfunktion) ; une telle fonction noématique est le corrélat « objectif » de cette fonction propositionnelle (...) que nous appelons « concept » et qui est une partie de la proposition, c’est-à-dire de la visée-d’état-de-choses (Sachverhaltsmeinung) par laquelle on projette un état-de-choses. En revanche, par essences au sens étroit ou strict on entend ces essences pures que Husserl appelle « Eide ». Le concept d’essence pure propre à l’éidétique descriptive phénoménologique est ainsi clarifié par une explication de la notion husserlienne de « concept descriptif pure », dans le but de montrer comment ces concepts, qui sont des pures concepts de types, se distinguent des concept descriptifs impures, et notamment des concepts dénotant des genres naturels. Fondées exclusivement sur des concepts descriptifs purs, les lois éidétiques descriptives (Wesensgesetze) possèdent des conditions de vérités particulières et nécessitent de modalités d’examen tout autant spécifiques. La place propre à la méthode appelée « variation éidétique » est justement celle de examiner, falsifier ou justifier des lois éidétiques descriptives présumées. A partir de cas exemplaires d’états-de-choses familiers confirmant les lois présumées, la variation libre, qui opère dans la pure imagination, a pour tâche de construire des contre-exemples possibles dont le but est de falsifier la loi éidétique présumée. La propriété d’être falsifiable par des contre-exemples construits dans la pure imagination permet de distinguer les lois empiriques des lois éidétiques descriptives de l’éidétique husserlienne. La possibilité de falsifier par des contre-exemples fictionnels ou factuels montre que la phénoménologie transcendantale est une entreprise scientifique ouverte à l’examen intersubjectif, et cela justement en raison de son caractère éidétique. Many current abortion regulations represent an over-medicalization of abortion or a corruption of abortion's true medical nature, with disproportionate consequences to women with lower incomes and lesser means. This article explores the effects of unnecessary and harmful abortion restrictions on women living in poverty. A brief summary of the major abortion rights cases explains how the Constitution, as currently interpreted, vests the government and sometimes the medical profession with the power to protect women's health, rather than granting this power to (...) women themselves. The article then argues for a new approach for protecting women's health and respecting their dignity by reframing reproductive rights as health rights that women themselves can assert. (shrink)

Increasingly the body is a possession that does not belong to us. It is bought and sold, bartered and stolen, marketed wholesale or in parts. The professions - especially reproductive medicine, transplant surgery, and bioethics but also journalism and other cultural specialists - have been pliant partners in this accelerating commodification of live and dead human organisms. Under the guise of healing or research, they have contributed to a new 'ethic of parts' for which the divisible body is severed from (...) the self, torn from the social fabric, and thrust into commercial transactions -- as organs, secretions, reproductive capacities, and tissues -- responding to the dictates of an incipiently global marketplace. Breaking with established approaches which prioritize the body as 'text', the chapters in this book examine not only images of the body-turned-merchandise but actually existing organisms considered at once as material entities, semi-magical tokens, symbolic vectors and founts of lived experience. The topics covered range from the cultural disposal and media treatment of corpses, the biopolitics of cells, sperm banks and eugenics, to the international trafficking of kidneys, the development of 'transplant tourism', to the idioms of corporeal exploitation among prizefighters as a limiting case of fleshly commodity. This insightful and arresting volume combines perspectives from anthropology, law, medicine, and sociology to offer compelling analyses of the concrete ways in which the body is made into a commodity and how its marketization in turn remakes social relations and cultural meanings. All farmers have their own version of what it means to be a good farmer. For many US farmers a large portion of their identity is defined by the high input, high output production systems they manage to produce food, fiber or fuel. However, the unintended consequences of highly productivist systems are often increased soil erosion and the pollution of ground and surface water. A large number of farmers have conservationist identities within their good farmer identity, however their conservation goals (...) often need to be activated to rebalance the production-conservation meanings they give to their roles in society. In this paper we analyze US Cornbelt farmer interviews and surveys to trace how the performance-based environmental management process can be used to influence the farmer social identity and shift the overall good farmer identity towards a stronger conservationist standard. We find the continuous feedback loop in performance-based environmental management mimics the hierarchically organized feedback control processes of identity verification and can be used to help farmers activate their conservationist farmer identities at the person, role, and social levels to establish new norms for the practice of more sustainable agriculture. We explore the extent to which Boards use executive compensation to incite firms to act in accordance with social and environmental objectives (e.g., Johnson, R. and D. Greening: 1999, Academy of Management Journal 42(5), 564-578; Kane, E. J.: 2002, Journal of Banking and Finance 26, 1919-1933.). We examine the association between executive compensation and corporate social responsibility (CSR) for 77 Canadian firms using three key components of executives' compensation structure: salary, bonus, and stock options. Similar to prior research (McGuire, J., (...) S. Dow and K. Argheyd: 2003, Journal of Business Ethics 45(4), 341-359), we measure three different aspects of CSR, which include Total CSR as well as CSR Strengths and CSR Weaknesses. CSR Strengths and CSR Weaknesses capture the positive and negative aspects of CSR, respectively. We find significant positive relationships between: (1) Salary and CSR Weaknesses, (2) Bonus and CSR Strengths, (3) Stock Options and Total CSR; and (4) Stock Options and CSR Strengths. Our findings suggest the importance of the structure of executive compensation in encouraging socially responsible actions, particularly for larger Canadian firms. This in turn suggests that executive compensation can be an effective tool in aligning executives' welfare with that of the "common good", which results in more socially responsible firms (Bebchuk, L., J. Fried and D. Walker: 2002, The University of Chicago Law Review 69, 751-846; Zalewski, D.: 2003, Journal of Economic Issues 37(2), 503-509). In addition, our findings suggest the importance of institutional context in influencing the association between executive compensation and CSR. Availability of external funding influences the viability and structure of scientific fields. In the 1980s, structural changes in the manner in which external funds became available started to have an impact on materials science and engineering in the United States. These changes colluded with the search for a disciplinary identity of this research field inside the university. The solutions that arose were intended to find a mediating structure between external demands and resources and disciplinary orientation. Interviews with seventeen scientists in (...) seven universities revealed the impact in local university settings. The rise of research centers as new organizational units in universities can be linked to two periods. In the 1960s, expensive instruments stimulated unit formation; in the 1980s, the increase in application-related funding forced new administrative ways. It is shown that organizational changes also have an impact on disciplinary identity as witnessed by a strong increase in interdisciplinary materials Ph.D.s awarded. (shrink)

As Anthony Tol explains in his general introduction to (his translation of) Vollenhoven's 1926 inaugural address, the Reformed epistemology that Vollenhoven espouses here is essentially three-layered. Most basic is the intuition - the starting point of all knowing. It starts with discerning. Then there is knowledge. At this point language, communication, and judgments are relevant. The third layer is thought. Thought may disclose and renew or criticize and correct against the background of what we know. Thought is also central to (...) concept formation. The factor that runs through these three layers is truth, taken realistically. It has its seat in the intuition of discerning. It is central to knowledge, for the essence of knowledge is said to be "possessing truth." And in connection with thought, or more particularly in concept formation, the latter is described as "truth grasped in a form." Apart from advocating his own understanding of epistemology in this inaugural address, Vollenhoven takes issue with how epistemology is generally understood. Peu a peu s'est dessinee une reponse a cette question: comment les Peres voient-ils l'homme? Quelle est, pour eux, sa nature, son essence? Ces etudes ont beaucoup d'importance pour tous ceux qui veulent aborder le probleme de la loi naturelle chez les Peres. La seconde partie (...) etudiera d'une maniere approfondie la loi naturelle selon l'eveque de Milan. Puisque le concept nature est polyvalent, il est clair que celui de loi naturelle le sera aussi. THE FIRST EXHAUSTIVELY SCIENTIFIC, speculative inquiry into the notion and nature of essence in the Western philosophical tradition is found in Aristotle's Metaphysics. In contrast to the earlier Greek philosophers and Plato, after considering the problem of being and change Aristotle reached the conclusion that the essential identity of material phenomena, or ousia, is an immanent and inseparable quality that forms the identity of each particular phenomenon. In Aristotle's concept, however, which constitutes the original form of phenomenal realism, ousia is (...) not "it"-self some-thing or some it. For though its presence may certainly be speculatively implied, "it" is not. Following Aristotle, though, and for reasons extraneous to the theme of this present article, the speculative inquiry into the nature of essence and phenomenality deviated from the orientation that Aristotle initially imputed to that study, evolving in a philosophical milieu whose theoretical propensity was predominantly transcendental. This article, then, focuses on the problematic of essential identity in the Western transcendental tradition, and, more particularly, seeks to contrast and compare the essence of the transcendental philosophers against the ousia of Aristotle's metaphysic. It is widely asserted that we are now living in a post-truth society. What that means, this book argues, is that the contemporary global world is thoroughly infested not only with trickster figures but an entire and operational trickster logic; or, that we now live in a Trickster Land - an argument advanced by the claim that in modernity liminality has become permanent; or that modern life is patently absurd. The second part goes on to discuss five main regions of Trickster Land: art, thought, the economy, politics, and society. This last, central chapter of the book contrasts trickster logic with the basic, foundational logic of social life, presented as gift-giving by Marcel Mauss and as sociability by Georg Simmel, and which is expressed here, combining Heraclitus and Plato with the Gospel of John, by three basic terms of ancient Greek culture, as arkhé charis logos: meaningful social life originally and in its essence is animated by the power of kind benevolence. Study on Hinduism; with a special reference to the world religions and science.

Purpose. The aim of the article is to clarify the content of the concept of culture as an explication of vitality within the philosophy of life and its further modifications in current problems of contemporary. The analysis performed standing from the point, that contrasting of nature and culture is irrelevant, since culture does not contradict natural determinants and patterns, but rather qualitatively alters them. So, are justified the idea of culture as a phenomenon that exist accordingly and in proportion to (...) nature, need to form its potential and content and not contradict the axioms and values of life. Theoretical basis. In the theoretical field of philosophy of life, the local development of the problem of culture as an explication of vitality produces grounds for analytical and prognostic activity concerning meaningful transformations in a separate historical and social horizon. The fundamental categories of culture: spirit, value, symbol, freedom, justice and harmony receive the requested content and meaning. The idea of the constancy and super-naturality of cultural universals is illusory and dangerous. The consequences of such a "non-cosmological" justification of freedom and will, and the assertion of values, that contradict the logic of life, are the global environmental, economic and social crisis of our time. Originality. The originality of the authors’ thought lies in the interpretation of the essence of culture as an explication of vitality, as a logical and natural extension of life. In this formulation of the problem of culture, the possibility of reconciling the natural, social and value determinants of human life is formed. Theorists of the philosophy of life substantiated the primacy and supremacy of the values of life over the values and meanings of culture. The position of authors position consists in the need to understand culture as an environmentally appropriate and dimensional phenomenon, the content and strategies of which are determined by a single ontology. Conclusions. The analysis let authors understand the voluntarily chaotic element of life. Culture in its philosophical analysis took on a clearer anthropomorphic dimension: the immanent logic of being in substantiating the essence and purpose of man and the value of his being localized the universe of transcendence in the concept of "living world", "inhabited space", "human, too human". Accordingly, the range of cultural evaluations has been polarized: from the approving statement of its vital essence, to the disparaging calls for its reform. The chaotic state of voluntarily acts is transformed into cultural codes and stereotypes by rationalization. The modern global nature of crisis phenomena, both in the worldview, in the social, and in the ecological dimension, requires reformatting the understanding of culture as a continuation of nature, and not its antipode. Quantitative comparison of human language and natural animal communication requires improved conceptualizations. We argue that an infrastructural approach to development and evolution incorporating an extended interpretation of the distinctions among illocution, perlocution, and meaning can help place the issues relevant to quantitative comparison in perspective. The approach can illuminate the controversy revolving around the notion of functional referentiality as applied to alarm calls, for example in the vervet monkey. We argue that referentiality offers a poor point of quantitative comparison across (...) language and animal communication in the wild. Evidence shows that even the newborn human cry could be deemed to show functional referentiality according to the criteria typically invoked by advocates of referentiality in animal communication. Exploring the essence of the idea of illocution, we illustrate an important realm of commonality among animal communication systems and human language, a commonality that opens the door to more productive, quantifiable comparisons. Finally, we delineate two examples of infrastructural communicative capabilities that should be particularly amenable to direct quantitative comparison across humans and our closest relatives. Recent findings suggest that multiple event properties contribute to shape the phenomenology of episodic future thoughts, but the specific role of each property is not yet fully understood. This study shows that different phenomenological features are predicted by distinct event properties. The vividness of an episodic future thought largely depends on the familiarity of its constitutive elements , while the visual perspective adopted is instead related to the temporal distance of the imagined event. Cognitive feelings such as the sense of (...) pre-experiencing the future depend on sensory–perceptual qualities, and are further modulated by the personal importance attributed to the event. These findings suggest that the essence of episodic future thought—the sensation of mentally visiting one’s personal future—lies, in part, in the relevance of imagined events with respect to personal goals. It examines the relationship between the phenomenon of alienation, technological progress and moral dilemmas they cause in modern society. In addition to the emergence of new moral and existential issues that arises as the consequence of the direct “collision” of a person and technologies as a result of their widespread introduction into our lives, we consider moral (...) dilemmas arising from technological progress in such areas of life as politics, economics and education. Each of them poses a deeper problem for the person - an alienation from other people, from the species essence and from oneself, which allows us to designate this question not only as social problem, but also affecting existential questions. On one reading, twentieth century Christian personalists such as Max Scheler, Dietrich von Hildebrand, or Edith Stein merely translate into Christian terms a set of modern concerns that arise apart from and are at odds with the historical Christian tradition. According to this reading, modern philosophy makes a fundamental break with previous thinking when it turns inward to examine the interior, personal dimension of existence. A person who favors this inward turn will see the Christian personalists as vainly attempting to (...) salvage traditional Christian categories while trying to keep up with the times. For example, someone who favors twentieth century existentialism or psychoanalysis may sympathize with a Christian personalist account of the interiority and irreplaceable uniqueness of each person but despise the larger religious framework of grace and salvation. Someone who favors traditional metaphysics, by contrast, may see these personalists as falling prey to modern errors when they should have kept the faith. Such a traditionalist may think, for example, that an emphasis on the personal is an infiltration into Christianity from secular political philosophies of individualism and that this has been thinly covered over with traditional Christian language. -/- Both perspectives, however, ignore the historical roots of personalism much further back in the history of philosophy than Descartes and Kant. Central to this history is the idea that each person uniquely realizes an incommunicable dimension of his existence, irreducible to the category of nature or essence. While we are in nature and while we *are* a nature, our nature as nature remains purely general, describing *what* we are in common with every other member of our species. As particular persons exercising our freedom and spiritual existence, however, each of us concretizes that purely general nature in a unique, personal way. For many centuries, Christians have called the dimension that concretizes nature ὑπόστασις: each ὑπόστασις is a distinct realization of a general nature. When this notion is first introduced into Christian discourse during the second half of the fourth century, the uniqueness of persons as opposed to the uniqueness of individual pebbles or horses does not come fully into focus. Nevertheless, a thick conception of ὑπόστασις develops in order to speak precisely about Trinitarian and Christological theology, and this context gives it a distinctly personalist character, especially when it is translated into Latin as *persona*. In order to speak of God as three ὑποστάσεις or *personae* in one essence and to speak of Christ as one ὑπόστασις or *persona* in two natures, the category of ὑπόστασις must be irreducible to the category of nature. Along this irreducible dimension persons are irreplaceable *someones* in relationship with other someones rather than merely *somethings*, specimens of a kind more or less interchangeable with any other such specimen. Some Millian theories are profligate: it suffices for believing that Clark flies that you assent to some way of taking that proposition. But Lois no more believes that Clark flies than she fails to believe that Superman flies. An abstemious Millianism requires for believing that Superman flies that you not refrain from assenting to any way of taking that proposition. Profligate Millianism gives subjects beliefs they do not seem to (...) have. Abstemious Millianism takes from subjects beliefs they seem to have. John Locke holds that matter is solid, the soul thinks, and for all we know the soul may be a material substance divinely endowed with a power to think. Though he openly admits to nothing stronger than the bare possibility of thinking matter, Locke grants that what thinks in us occupies a definite spatial location to the exclusion of other souls. Solidity is the quality that prevents other things from occupying a spatial location. Locke’s general criterion for identity is spatiotemporal (...) exclusion of other things of the same kind. To meet these conditions for identity, souls must be solid. Although Locke refuses to declare that souls really are material things, taking the solidity of souls to be a condition for their identity is consistent with the following of Locke’s other important commitments: nominalism about the essences by which substances are classified, agnosticism about the underlying reality of what supports such “nominal essences,” and the identity of persons is distinct from the identity of any substance. Locke ignores the implication that souls are solid because the solidity of souls is irrelevant to those three aims. Nevertheless he could allow for the solidity of souls without giving up on any of his other important and explicitly held commitments. There is therefore no need for Locke’s commentators to refrain from employing solidity in their accounts of Locke’s general criterion for identity from fear of attributing to Locke the position that souls would be solid. In his Consciousness and Fundamental Reality (2017) Philip Goff defends his anti-physicalist argument against what he calls the "Dual Carving" objection—the idea that two representations of the very same fact could both be conceptually independent and "transparent," that is, revealing of the essences of the entities in question. His defense invokes a thesis he calls "Minimal Rationalism." I explore exactly how Minimal Rationalism is supposed to turn aside the objection and argue that the formulation of Minimal Rationalism on offer is (...) ambiguous between stronger and weaker readings. Goff needs the stronger reading to use it in defense of his argument, but only the weaker reading is warranted by the considerations he brings to bear in favor of his rationalism. His minimal rationalism is, in sum, insufficiently minimal. The upshot is not only that Goff is deprived of a way of turning back an important objection to his case against physicalism; we also gain a better sense of what kind of rationalist thesis is properly invoked in metaphysics. The paper gives an analysis of the problem of character, which goes beyond the limits of the traditional ethics of virtue and which aims at the resolution of the essential dilemma - namely the role of determinism in the play of human fortune. The author focuses on two important French authors, whose conceptions of character were based on Kant's philosophy and on its criticism at the same time. Whereas Mounier defends the idea that the constitution of character is shaped by (...) the fundamental self-affirmation, Sartre's approach consists in accepting all the consequences of his own thesis of "the existence preceding the essence". In this context a distinctive character exists only as a transcendental meaning of every particular empirical choice. On the other hand, the author tries to show, that the understan_ding of the moral character as a dynamic form of motion oriented towards future does not keep these authors from defending certain essential tenor of a character, by which each particular decision participates in the construction of the overall picture of the concrete human being and his life objectives. The computer has increasingly become the principal model for the mind, which means our most basic experience of ""reality"" is as mediated through a screen, or stored in a cloud.
