The Last Gift is an observational HIV cure-related research study conducted with people with HIV at the end of life (EOL) at the University of California San Diego. Participants agree to voluntarily donate blood and other biospecimens while living and their bodies for a rapid research autopsy postmortem to better understand HIV reservoir dynamics throughout the entire body. The Last Gift study was initiated in 2017. Since then, 30 volunteers were enrolled who are either (1) terminally ill with a concomitant (...) condition and have a prognosis of 6 months or less or (2) chronically ill with multiple comorbidities and nearing the EOL.Multiple ethical and logistical challenges have been revealed during this time; here, we share our lessons learnt and ethical analysis. Issues relevant to healthcare research include surrogate informed consent, personal and professional boundaries, challenges posed conducting research in a pandemic, and clinician burnout and emotional support. Issues more specific to EOL and postmortem research include dual roles of clinical care and research teams, communication between research personnel and clinical teams, legally required versus rapid research autopsy, identification of next of kin/loved ones and issues of inclusion. Issues specific to the Last Gift include logistics of body donation and rapid research autopsy, and disposition of the body as a study benefit.We recommend EOL research teams to have clear provisions around surrogate informed consent, rotate personnel to maintain boundaries, limit direct contact with staff associated with clinical care and have a clear plan for legally required versus research autopsies, among other recommendations. Critics have maintained that John Rawls’s theory of justice is unrealistic and undemocratic. Using the principles of John Rawls' theory of justice, this book offers an alternative political vision; one which describes a mode of governance that will enable communities to implement a sustainable and socially just future. Rawls described a theory of justice that not only describes the sort of society in which anyone would like to live but that any society can create a society based on just institutions. While philosophers have demonstrated that Rawls's theory can provide a (...) framework for the discussion of questions of environmental justice, the problem for many philosophical theories is that discussions of sustainable development open the need to address questions of ecological interdependence, historical inequality in past resource use and the recognition that we cannot afford to ignore the limitations of growth. These ideas do not fit in comfortably in standard discourse about theories of justice. In contrast, this book frames the discussion of global justice in terms of environmental sustainability. The author argues that these ideas can be used to develop a coherent political theory which reconciles cosmopolitan arguments and the non-cosmopolitan or nationalist arguments concerning social and environmental justice. This book is the first detailed reconstruction of the late work of John Rawls, who was perhaps the most influential philosopher of the twentieth century. Rawls's 1971 treatise, A Theory of Justice, stimulated an outpouring of commentary on 'justice-as-fairness,' his conception of justice for an ideal, self-contained, modern political society. Most of that commentary took Rawls to be defending welfare-state capitalism as found in Western Europe and the United States. Far less attention has been given to (...) class='Hi'>Rawls's 2001 book, Justice as Fairness: A Restatement. In the Restatement, Rawls not only substantially reformulates the 'original position' argument for the two principles of justice-as-fairness but also repudiates capitalist regimes as possible embodiments. ABSTRACT Welfare states are often urged to secure a social minimum for citizens—a level of material well‐being beneath which no‐one should be permitted to fall. This paper examines the justification for such a claim. It begins by criticising John Rawls's rejection of the social minimum approach to justice in A Theory of Justice: the argument Rawls uses to justify the Difference Principle, based on what he calls ‘the strains of commitment’ in the ‘original position’, actually provides a better (...) justification for a social minimum principle. The paper then examines the substance of that argument outside the context of Rawls's contractarianism, showing that there is a general case for seeing to it that desperate need does not go unmet in a liberal society. At a time when ethical and political philosophy were thought passé, John Rawls gave serious attention to ethical questions, providing them with a renewed academic legitimacy. This helped fields of practical ethics such as bioethics become established in higher education and in public affairs. This essay addresses the influence Rawls has had on bioethics through both the style and the substance of his ethical argumentation. The essay argues that his distinctive rhetorical strategy and tone attempted to rein in (...) the scope of normative commitments in order to make an equilibrium between refined understandings of freedom and equality possible and sustainable. Bioethics has been strongly influenced by this approach to maintaining social stability in a liberal society that has become highly stratified and culturally diverse. Bioethics continues to echo the Rawlsian call for a calmly reasoned political life but finds that call increasingly difficult to answer. (shrink)

For the first time in print, this article reports passages from John Rawls’s graduate papers and annotations on books and manuscripts from his personal library. The analysis of this material shows the historical inaccuracy of the widespread assumption that Rawls’s philosophy owes very little to American pragmatism. Peirce’s notion of truth, as well as the holistic critique of pragmatism thatMortonWhite began in the late 1940s, prove significant at the very beginning of Rawls’s philosophical enterprise. In the light (...) of this material, it might be argued that Rawls’s elaboration of ‘reflective equilibrium’ started at least in part as an attempt to overcome the pending problems of pragmatism. There is identity of interests because social cooperation makes possible for everyone a life that is much better than one outside of society. There is a conflict of interests because people all prefer a larger to a smaller share of the benefits of social cooperation, and people have ideological differences. John Rawls shares the Enlightenment's commitment to finding moral and political principles which can be reflectively endorsed by all individuals autonomously. He usually presents reflective autonomy in Kantian, rationalist terms: autonomy is identified with the exercise of reason, and principles of justice must be constructed which are acceptable to all on the basis of reason alone. Yet David Hume, Adam Smith and many other Enlightenment thinkers rejected such rationalism, searching instead for principles which can be endorsed by all on (...) the basis of all the faculties of the human psyche, emotion and imagination included. The influence of these sentimentalists on Rawls is clearest in his descriptive moral psychology, but I argue that it is also present in Rawls's understanding of the sources of normativity. Although this debt is obscured by Rawls's explicit "Kantianism," his theory would be strengthened by a greater understanding of its debts to the sentimentalist Enlightenment. (shrink)

To what extent does John Rawls’ theory of international justice meet the normative challenges posed by climate change? There are two broadly compatible Rawlsian ways of addressing climate change. The first alternative is based on the two principles that Rawls applies to the domains of international and intergenerational justice. The second alternative starts from Rawls’ general theory of international justice, in particular his idea of a Society of Peoples, which is an idealized vision of a peaceful and (...) stable association of peoples that are internally well-ordered, and share a desire to respect and uphold international law. Given the statutes peoples are willing to observe, the defining characteristics of peoples, and the fact that Rawls indicates that his own rendering of international law is incomplete, there may be grounds for proposing an additional statute, or an amendment, to The Law of Peoples, that pertains to climate change and that does not contradict, but rather follows from, the general framework of the theory. The latter alternative provides a more viable account of climate justice than critics has hitherto acknowledged. (shrink)

Scholarship historicizing John Rawls has put paid to the view that his work was without precedent. This article sets out to find out why, then, A Theory of Justice stirred such philosophical excitement, even among British philosophers in a position to recognize its antecedents. I advance the view that his work is helpfully understood as fulfilling the promise of the “naturalist” revival in ethics begun at Oxford by Philippa Foot and Elizabeth Anscombe. After briefly surveying the development of analytic (...) philosophy, I argue that Rawls's contribution was to reconceive ethics so that it was an investigation neither of an independent ethical reality nor of the logic of moral language. Rather, it was concerned with a class of facts about ourselves. Rawls's practice of ethics adopts as its central focus the ongoing human practice of justification. I place Rawls's turn from religious faith to justification between persons alongside similar shifts in Plato's Euthyphro and in the biographies of Kant and Sidgwick. I try to show the distinctiveness of Rawls's focus by contrasting his search for human self-understanding with the project of R. M. Hare, his most prominent non-naturalist critic, who charged Rawls with offering an inadequate account of the authority of ethics. (shrink)

A cooperação equitativa é um conceito central da filosofia de John Rawls e possui uma estreita relação com as noções de racionalidade, razoabilidade e tolerância. Portanto, faz-se necessário ressaltar que tais temas são fundamentais para uma adequada compreensão da teoria rawlsiana de justiça. Rawls elege a justiça como virtude primária e princípio norteador na construção da sua teoria. Em virtude disso, a preocupação de Rawls é a resolução das desigualdades sociais que ocorrem nos sistemas políticos democráticos. A (...) noção de justiça como equidade faz-se indispensável frente à necessidade de eleger a liberdade enquanto preocupação com o justo equilíbrio e ao “consenso nas sociedades plurais”. É a partir da concepção de cooperação equitativa que Rawls tenta resolver o impasse contemporâneo da convivência de diferentes doutrinas abrangentes razoáveis sejam elas, religiosas, filosóficas ou morais. Dessa forma, a teoria rawlsiana de justiça tem como proposta a “coexistência pacifica” ante essa pluralidade de doutrinas compreensivas. Assim posto, a justiça como equidade, pode plausivelmente, ser a forma mais viável de coexistência pacífica que agrupamentos sociais poderiam seguir ou se pautar. Sob essa ótica, acredita-se que a noção de cooperação equitativa rawlsiana será uma via de justiça que enfatiza os direitos individuais sem desmerecer aquilo que é próprio do coletivo. Abstrac t: Fair cooperation is a central concept of J. Rawls´s philosophy and keeps a close relationship with the the notions of rationality, reasonability, and tolerance. Thus it is important to claim that these notions are necessary for a correct comprehension of rawlsian theory of justice. Rawls claims justice as the primary virtue and main principle of his theory. The aim of Rawls is to solve the social inequalities that occur in democratic political systems. The concept of justice as fairness is essential before the need of electing the liberty as concerning to the just balance and to the “consensus in the plural societies”. By starting from the conception of fair cooperation Rawls tries to solve the contemporary problem of different comprehensive doctrines sharing the same political and social space, no matter they are religious, philosophical or moral ones. The rawlsian theory of justice claims to propose as “pacific cohabitation” among that plurality of comprehensive doctrines. In this way, justice as fairness may plausibility be the most viable form of pacific cohabitation that social groups can follow or be ruled. Under this perspective, we believe that the rawlsian concept of fair cooperation will be a way of justice that focus on individual rights without deprive the significance of collective. John Rawls was what we might call a “frenemy” to Stanley Cavell. Time and again, Cavell states his admiration for Rawls's political philosophy but criticizes it for two reasons. First, he believes that Rawls too hastily dismisses a perfectionist tradition that is essential for a flourishing liberal democracy. Second, he attacks certain aspects of Rawls's theory of justice as moralistic and legalistic. The first half of this article examines Cavell's critique of Rawls and argues that (...) the two authors are more closely aligned than suspected. It begins by reconstructing Cavell's critique of Rawls, and using archival materials from Harvard University, presents for the first time Rawls's interpretation of this critique. The second half of the article highlights perfectionist themes in Rawls's A Theory of Justice. The contribution of this article is to reevaluate the relationship between two of the most important moral philosophers of the twentieth century and also to provide a more expansive theory of liberalism that incorporates the psychological depth, moral subtlety and political hopefulness of moral perfectionism. Those who criticize as well as those who nowadays defend constructivism in metaethics consider John Rawls’s constructivism to be incomplete. According to them, his ontological agnosticism makes evident this incompleteness; I question this widely accepted charge. I propose an alternative interpretation, according to which Rawls’s agnosticism is the effect of his metaethics rather than a lack of metaethics. Thanks to this interpretation, I question the originality and attractiveness of Rawls’s metaethics. My first personal encounter with John Rawls was nearly thirthy years ago, in the early spring of 1974. I say “personal encounter” because of course, by then, we had all been reading A Theory of Justice, even undergraduate philosophy majors at the University of Illinois. I was a senior that year, and applying for graduate school. Jack was chair, and so it fell to his lot to telephone the students who had been accepted by Harvard, to tell us the (...) good news and ask if we had any questions. But in those days Jack stuttered, and he was worried that his stutter might make him difficult to understand over the phone. I mention that, because it explains how it came about that one day the telephone in my dorm room rang, and I answered it, only to hear the world’s greatest living moral philosopher say “This is John Rawls. Paul Weithman offers a fresh, rigorous, and compelling interpretation of John Rawls's reasons for taking his so-called "political turn.".

This thesis argues for an unorthodox interpretation of John Rawls's egalitarianism as a hybrid of ‘actual contractualism’ and ‘modal contractualism’. It also offers a defence of the theory so understood. According to actual contractualism, a system of political institutions and norms is just only if each person over whom it claims authority actually accepts it in some sense. Actual contractualists stand in contrast with modal contractualists, who take justice to require that no one could reasonably reject the institutions and (...) norms in question. Rawls is standardly read as a modal contractualist, but I argue that his view includes an significant element of actual contractualism. The thesis is divided into three parts. The first part describes actual contractualism and contrasts it with modal contractualism. It goes on to consider the possibility of a hybrid theory, which appeals to modal contractualist reasons to justify an actual contractualist test for justice. I suggest that this is an attractive view. In the second part I go on to argue that a careful understanding of Rawls’s theory view reveals it to be hybrid contractualist. I elaborate Rawls’s strategy of ‘political constructivism’ in the light of this interpretation, and attempt to show that it is very much in the Lockean actual contractualist tradition. The final part of the thesis concerns the justification of specifically Rawls’s egalitarianism. I contend that Rawls’s argument for justice as fairness can be seen as a detailed effort to explain why his egalitarianism is, in the relevant sense, actually accepted by each person, and I argue that as such it succeeds. I then contrast the Rawlsian view with left-libertarianism, another attempt to marry actual contractualism and egalitarianism. I argue that Rawls’s is the more thoroughgoing, unified view, and should be preferred on that basis. (shrink)

His account of political liberalism addresses the legitimate use of political power in a democracy, aiming to show how enduring unity may be achieved despite the diversity of worldviews that free institutions allow. She surveys the range of issues canvassed by feminist readers of Rawls, as well as critics’ wide disagreement about the value of Rawls’s corpus for feminist purposes. The eight essays that follow testify (...) to the continuing ambivalence among feminist readers of Rawls. From the perspectives of political theory and moral, social, and political philosophy, the essayists address particular aspects of Rawls’s work and apply it to a variety of worldly practices relating to gender inequality and the family, to the construction of disability, to justice in everyday relationships, and to human rights on an international level. The overall effect is to give a sense of the broad spectrum of possible feminist critical responses to Rawls, ranging from rejection to adoption. Aside from the editor, the contributors are Amy R. In many countries, people are denied rights to free speech, to participate in political life, or to pursue a career, because of their gender, religion, race or other factors, while their fellow citizens enjoy these rights. In many societies, what best predicts your future income, or whether you will attend college, is your parents’ income. -/- To many, these facts seem unjust. A successful theory of justice must explain why clear injustices are unjust and help us resolve current disputes. -/- John Rawls (1921-2002) was a Harvard philosopher best known for his A Theory of Justice (1971), which attempted to define a just society. The secondary literature on Rawls is vast, but little of it is historical. Relying on the archival materials he left to Harvard after his death, we look at the historical contexts that informed Rawls's understanding of political philosophy and the changes in his thinking up to A Theory of Justice. We argue that Rawls's classic work reveals positivist aspirations that were altered and frayed by various encounters with postanalytic naturalism. So, we begin in the 1940s, showing the (...) influence of other positivist projects, such as those of Popper and Ducasse. Thereafter, we explore how Rawls's encounter with Wittgenstein and Quine in the 1950s and 1960s led him to introduce the post-analytic features evident in A Theory of Justice. Our historical narrative challenges commonplace folk-understandings that portray Rawls as either wholly committed to positivism or as its principal slayer. (shrink)

ABSTRACT This essay challenges the view that John Rawls's recently published undergraduate thesis A Brief Inquiry into the Meaning of Sin and Faith provides little help in understanding his mature work. Two crucial strands of Rawls's Theory of Justice are its critique of teleology and its claims about our moral nature and its expression. These strands are brought together in a set of arguments late in Theory which are important but have attracted little sustained attention. I argue that (...) the target of Rawls's undergraduate thesis is a form of Christianity which rests on assumptions Rawls later came to think were fundamental to teleological views, and that the thesis defends an alternative form of religiosity that anticipates what Rawls says in Theory about the expression of our nature. Those sections of Theory also provide resources Rawls could have used to respond to a number of prominent and recurrent criticisms of his account of moral motivation. Seeing the continuities between Brief Inquiry and Theory of Justice shows how long Rawls wrestled with problems he took up in the neglected sections of Theory and thereby shows their importance to Rawls's thought. Nach dem Besuch einer privaten und einer öffentlichen Schule in Baltimore wechselte Rawls an die religiöse Kent School im Bundesstaat Connecticut. Wie sein älterer Bruder Bill studierte Rawls in Princeton, wo er 1943 sein Studium mit einem Bachelor of Arts abschloss. In seiner Senior Thesis Über Sünde, Glaube und Religion beschäftigte sich der zu dieser Zeit streng religiöse Rawls mit dem Problem (...) des Bösen, auf das er durch Veranstaltungen von Norman Malcom gebracht wurde. When John Rawls’ A Theory of Justice was published in 1971, it brought a strong, inspiring, and refreshing creative impetus in Anglo-Saxon philosophy. Since then, Rawls’ work has been criticized on several grounds, mainly related to its Kantian formalism. However, ideas and theories are not born and do not exist in a social and political vacuum. Read in different historical contexts they can reveal new meanings and deliver specific messages, which are tailored to specific audiences and political cultures. (...) I argue in my paper that, reflecting this reality and my own life experience, Rawls’ conception of justice and of a well-ordered society always remains actual. An important part of this actuality is revealed in the manner in which the theory inspired Romanian society in its post-communist search for models of citizenship. It is also revealed by the message it delivers to today’s divided and polarized societies, where solidarity has been corroded by neoliberalism and a sense of fairness and reasonableness has been weakened by an increasingly noxious agonistic spirit. In his political philosophy, John Rawls has a normative notion of reasonable behaviour expected of citizens in a pluralist society. We interpret the various strands of this idea and introduce them to the discourse on stakeholder dialogue in order to address two shortcomings in the latter. The first shortcoming is an unnoticed, artificial separation of words from actions which neglects the communicative power of action. Second, in its proposed new role of the firm, the discourse of political CSR appeared (...) to offer a promising synthesis of deliberation and action. However, the discourse has been criticized for its shortcoming in failing to provide a regulatory environment for corporation—stakeholder dialogue. Through our interpretation of Rawls’ notion of reasonableness in citizens, the article makes two important theoretical contributions to the debate on stakeholder dialogue. First, we transfer Rawls’ injunction in insisting that dialogues between business corporations and their weaker stakeholders must be understood as consisting of both verbal exchanges and actions. Second, we propose that the coercive power of government ought to provide a necessary context for stakeholder dialogue, and that by doing so, it can provide a way forward for the discourse of political CSR. We illustrate the usefulness of this contribution from Rawls in an analysis of BP’s behaviour towards thousands of victims following the Deepwater Horizon blowout in 2010. (shrink)

(In German.) The book addresses Rawls's post-1985 political liberalism. His justification of political liberalism -- as reflected in his arguments from overlapping consensus -- faces the problem that liberal content can be justified as reciprocally acceptable only if the addressees of such a justification already endorse points of view that suitably support liberal ideas. Rawls responds to this legitimacy-theoretical problem by restricting public justification's scope to include reasonable people only, while implicitly defining reasonableness as a substantive liberal virtue. (...) But this virtue-ethical grounding of political liberalism is itself unreasonable. The phenomenon of disharmony of practical reason gives the reasonable reasons to take it that political legitimacy does not obtain if and where moral-political principles are acceptable from their point of view only.
