Yavuz [Altıntaş], Miyase. İctihadın Modern Müslüman-Çoğunluklu Ülkelerin Aile Hukuku Reformlarındaki Rolü: Fas Örneği. Bu çalışmanın temel amacı ictihadın modern dönemdeki kavramsallaştırma ve hukuki temellendirmelerini analiz ederek İslam hukukunun modern Müslüman-çoğunluklu ülkelerde uygulanmasındaki rolünü araştırmaktır. Bu araştırmada ictihadın hukuk reformlarında neden ve nasıl kullanıldığı meselesinin yanı sıra uygulama esnasında hangi motivasyonlar, teknikler, formlar ve muhakeme usullerinin benimsendiği incelenmektedir. Aynı zamanda (...) ictihadın birincil kaynaklara, yani Kur ’an ve S ünnet ’e d önülerek mi yoksa klasik İslam hukuk bilimi içerisinde var olan hukuki görüşlerden seçmek suretiyle mi yapıldığı analiz edilmektedir. Son olarak klasik İslam hukuk teorisi kuralları ve prensiplerinin ne derece itibar gördüğü ve bunların günümüzde ictihad vasıtasıyla ger çekleştirilen reformlarda ne derece takip edildiği araştırılmaktadır. Tezin ana odak noktasını modern Müslüman-çoğunluklu ülkelerde İslam hukukunun en yaygın uygulanan yönü olması sebebiyle aile hukuku teşkil etmektedir. 2004 Fas Aile Kanunu reformlarıictihada dayanılarak uygulamaya konduğundan dolayı özellikle incelenmiştir. Tezin ana argümanı ictihadkavramının klasik ana akımdaki anlayıştan tanım, kapsam ve ictihadetme yetkisi açısından farklılık gösterse de modern dönemdeki ictihadkavramsallaştırmaları ve uygulamalarının İslam hukuku içerisinde yer alması gerektiğidir. Nitekim kavramsal bir analiz yapıldığında özellikle tarihi bağlamın sosyo-politik değişikliklerinin zemin hazırladığı çeşitli ictihadanlayışlarının ve uygulamalarının İslam hukuk tarihi içerisinde var olduğu görülmektedir. Modern dönem ictihaduygulamalarına bakıldığında çoğunun genel olarak klasik İslam hukuk teorisinin detaylı kural ve prensiplerini sıkı bir şekilde takip etmediği görülmektedir. Bununla birlikte bu uygulamalar hukuki temellendirmelerden mahrum değildir ve bazıları klasik İslam hukuk bilimi içerisinde kaynağını bulabilmektedir. Fas Ahvâl-i Şahsiyye Kanunu üzerinde 2004 yılında yapılan reformlarla birlikte Fas Aile Kanunu (Müdevveneh), İslam dünyasındaki en eşitlikçi kanunlardan biri olarak kabul edilmektedir. Söz konusu reformlar, Fas'ta onlarca yıldır devam eden uzun soluklu kamuoyu tartışmalarının bir ürünü olarak ortaya çıkmıştır. Ahmed el-Hamlîşî 1980'lerin başından itibaren bu tartışmalara aktif olarak katılmış ve Ahvâl-i Şahsiyye Kanunu'nun yoruma açık insan yapımı bir kanun olduğunu ve revizyonunun ictihad yoluyla yapılması gerektiğini savunmuştur. Kral 6. Muhammed tahta çıktıktan kısa bir süre sonra, 2001 yılında, (...) Fas Ahvâl-i Şahsiyye Kanunu'nda reform yapmak üzere Kraliyet Danışma Komisyonu'nu oluşturdu. Kral 6. Muhammed komisyonu, Şeriat'ın temel hedeflerini (makâsıdü'ş-Şeria) gözeterek ve aynı zamanda ictihad yoluyla zamanın ve toplumun ihtiyaçlarına cevap vererek Ahvâl-i Şahsiyye Kanunu’nda önemli değişiklikler yapmakla görevlendirdi. Bununla birlikte, komisyon üyelerini kamu yararını göz önünde bulundurmaya ve önerilen her türlü değişiklikte uzlaşma ve ılımlılık için çaba göstermeye teşvik etti. Komisyon üyeleri önerilen değişiklikler üzerinde yaklaşık iki buçuk yıl çalıştı ancak birçok konuda uzlaşmaya varamadı. Bu bağlamda, üyelerin komisyon içinde oluşan iki ana gruptan reformist ve gelenekçilerden birine, az ya da çok, meylettiği söylenebilir. Ahmed el-Hamlîşî, Kraliyet Danışma Komisyonu'nun üyelerinden biriydi. Komisyon üyeleri arasında reformist grubun değişiklik tekliflerini destekleyen ama aynı zamanda bunu gelenekçilerin benimsediği dili kullanarak yapan etkili ve önemli bir isim oldu. Nitekim, el-Hamlîşî İslam hukuku çerçevesi içinde kalan eleştirel ama ılımlı görüşleriyle aile hukukunun reformunu talep eden gruplar için bir referans noktası haline geldi. Bu çalışmada, Ahmed el-Hamlîşî’nin fıkhi temellendirme ve delillendirme açısından Fas 2004 aile hukuku reformlarının arkasındaki isim olduğu savunulmaktadır. Veri analizi yönteminin uygulandığı bu çalışmada, öncelikli olarak Hamlîşî'nin eserleri, çeşitli mecralardaki mülakatları ve konuşmaları kullanılmıştır. Hamlîşî’nin anlayışındaki farklılık ve benzerlikleri ortaya çıkarmak için literatüre başvurulmuş ve benzer görüşlerle karşılaştırmalar yapılmıştır. Fas Ahvâl-i Şahsiyye Kanunu’nun reformuna dair kısa bir arka plan açıklamasının ardından bu makale, Hamlîşî'nin metin ve bağlam arasındaki arabulucu rolünü, aile hukuku reformları tartışmasındaki yerini ve dolayısıyla Şeriat-devlet ilişkileri konusundaki duruşunu incelemektedir. Daha sonra, ictihad kapısının kapanması meselesi, müctehid olabilmenin şartları, müctehidin nitelikleri ve Kraliyet Danışma Komisyonu tarafından uygulandığı şekliyle kolektif ictihad türü (cemâʿî ictihad) hakkındaki görüşlerine atıfla Hamlîşî’nin ictihad anlayışına odaklanılmaktadır. Çocuk evliliği, tarih boyunca farklı toplumlarda bilinen ve uygulanan sosyal bir olgu olsa da son zamanlarda, modern duyarlılıkları giderek daha fazla rahatsız eden bir hal almıştır. Son iki asır öncesine kadar, Avrupa hukuki düşüncesinde çocuklar yargı önünde farklı bir muamele görmelerine imkan veren istisnai bir statüye sahip değildi. Diğer taraftan, İslam hukukunun çocuklara, özel bir hukuki statü kazandırma konusunda bazı öncü adımlar attığını söyleyebiliriz. Nitekim, en eski İslam hukuku kitaplarının bile, insanın fiziksel ve zihinsel gelişim aşamalarına ve (...) her bir aşamada ortaya çıkan hukuki hükümlere dair son derece teknik ayrıntılarla dolu olduğunu görebiliriz. Ancak çocuk hakları konusundaki bu erken farkındalığa rağmen, çocuk evliliği olgusu hem İslam toplumlarında hem de İslam hukukunda kendini gösterebilmiştir. Çünkü, İslam çocuk hukuku, ilk ortaya çıktığı dönemin kültürel şartlarından ciddi şekilde etkilenmiştir. Üstelik bu kültürel şartlar, İslam dünyası boyunca İslam çocuk hukukunun temel zemini olma işlevini sürdüre gelmiştir. Bu çalışma, alimlerin çocuk evliliğini delillendirmek üzere yapageldikleri bazı aşırı yorumları ortaya koymaya ve konuyla ilgili âyetleri metinsel bağlamıyla daha uyumlu bir şekilde okumaya çalışmaktadır.Özet: Her bağlam için geçerli olabilecek, standart bir çocuk tanımı yapmak göründüğünden daha güçtür. Bu nedenle çocuk araştırmaları sahasında çalışan akademisyenlerin, muhtelif sosyal disiplinler tarafından yapılacak herhangi bir çocuk tarifi konusunda memnuniyetsizlik içinde olması doğaldır. Diğer yandan, İslam hukukunda baştan beri ayrıntılı bir çocuk hukuku teorisi mevcuttur. İslam hukuk düşüncesinde, insanlar doğum ile yetişkinlik arasındaki gelişim döneminde üç aşamadan geçerler: Çocukluk (küçüklük), buluğ ve rüşt. Bütün fıkıh mezhepleri, insanın doğumu ile ergenliği arasındaki dönemde küçük çocuk sayılacağı kanaatindedirler. Bu çocukların mallarının en iyi şekilde idare edilebilmesi için yasal temsilcileri bulunmak zorundadır. Fakîhler çocuğun velisinin, özellikle de baba veya baba tarafından dedenin, velâyeti altındaki küçük çocuklar üzerinde mücbir bir yetkisi olduğu (velâyet-i mücbire) konusunda geniş bir fikir birliğine sahiptirler. Buna göre veliler, velâyetleri altında bulunan çocukları uygun gördükleri kişilerle evlendirme yetkisine de sahiptirler. Fakat zaman zaman beşik kertmesi olarak da anılan bu uygulama bir ön sözleşmeden ibarettir. Yani bu sözleşme doğrudan doğruya fiziksel boyutları da olan müşterek bir evlilik hayatını meşru kılmamaktadır. Çünkü cinsel hayatın ancak buluğdan sonra gerçekleşmesi ön görülmektedir. Modernite öncesi İslam tarihi boyunca, İbn Şubrume (ö. 144/761), Ebû Bekr el-Esamm (ö. 200/816) ve Osman el-Bettî (ö. 143/760) gibi bir kaç fakih dışında küçük çocukların evlenmesine kategorik olarak karşı çıkan kimselere pek rast gelinmemektedir.Hanefi mezhebinde, herhangi bir zihinsel özrü olmaksızın buluğa eren erkek ve kız çocuklar evlilik konusunda mücbir velâyetin kapsamı dışına çıkarlar. Bu, evlilik sözleşmelerini bizzat gerçekleştirebilecekleri anlamına gelmektedir. Fakat veli, uygunsuz bulduğu evliliğe karşı dava açarak bunu yargı yoluyla geçersiz kılma yoluna gidebilir. Diğer üç Sunnî mezhep ise erkek ve kız çocuklar arasında bir ayrım yapar: Buluğa eren erkek kendi evlilik akdini yapabilme hakkını elde ederken aynı durumdaki kız çocuklar velâyet altında kalmaya devam ederler. Şâfiʿî mezhebine göre, velâyeti gerekli kılan illet (bekaret) hâlâ geçerliliğini korumaktadır. Dolayısıyla veli, kızları evlendirme konusundaki icbâri yetkisini elinde tutmaya devam etmektedir. Bu durumda kızın rızasının alınması, akdin geçerliliği için şart olmaktan ziyade sadece nezaket gereğidir. Rüşte ulaşmak veya fizyolojik olgunlaşma sürecini tamamlamak ise İslam hukukunda evlilik için şart görülmemiştir.Modern zamanlara kadar geleneksel İslam hukukunun erken evlilik lehinde gösterdiği bu yaklaşımda herhangi bir değişiklik olmamıştır. 1917 yılında çıkan Hukuk-ı Aile Kararnamesi daha önce benzeri görülmemiş bir dizi düzenleme getirmiştir: İlk olarak, evlilik yaşı erkek için on sekiz kız için ise on yedi olarak belirlenmiştir. On sekiz yaşın altındaki erkeklerin hakimden evlenme izni alması; on yedi yaşından küçük kızların ise hem veli onayı hem de hakim iznine sahip olması zorunlu hale getirilmiştir. On iki yaşın altındaki erkekler ile dokuz yaşından küçük kızların ise asla evlendirilemeyeceği kararlaştırılmıştır.Mantıkî bağlam ve sentaktik yapı elverişli olmamasına rağmen fakihler çocuk evliliğini desteklemek üzere bazı Kur’ân âyetlerine (Nisâ 4/3-6, Nisâ 4/127, Talâk 65/4) referansta bulunmuşlardır. Makale içeriğinde detaylı şekilde açıklandığı üzere zorlama yorumlamalarda bulunmuşlardır. Bu makale, söz konusu âyetlere daha tutarlı bir yorum getirmeye çalışmaktadır. Aynı şekilde, Kur’an’ın çocuk evliliğini kolaylaştırıcı bir tavır içerisinde olmadığını, çocukların evlendirilebilmesi yönündeki yaklaşımların tarihsel ve kültürel şartlara bağlı olarak yapılan bazı zorlama yorumlara dayandığını ileri sürmektedir.Hz. ʿÂişe’nin Hz. Peygamber ile oldukça erken bir yaşta evlendiğine dair nakledilen rivâyet de konuyla ilgili olarak ileri sürülen başka bir argümandır. Bu rivâyetin sahih olduğuna inanılmaktadır. Buna rağmen ilginç bir şekilde bu rivâyet çok az fakih tarafından kullanılmıştır. Bunun sebebi, fakîhlerin Hz. Peygamberin mahremiyetinden bahsetmek istememeleri olabilir. Rivâyetin hücciyeti konusuna kuşkuya kapılmış olmaları da mümkündür. Söz konusu rivâyete daha yakından bakıldığında, ifadedeki menfi üslup hemen dikkat çekmektedir. Çünkü rivâyette Hz. ʿÂişe, Hz. Peygamberle evlendiği günü anlatırken sürekli olarak fizyolojik ve psikolojik açıdan olumsuz koşullardan bahsetmektedir. Nitekim Hz. ʿÂişe birden bire oynamakta olduğu salıncaktan alınmakta ve kendisinin de bilmediği bir yere doğru götürülmektedir. Rivâyet, sadece çocuk evliliğinin cevazını ortaya koymakla yetinmemekte, sanki aynı zamanda çocukların uygunsuz koşullardaki evlilik taleplerine bile itaatkar olmaları gerektiğini salık vermektedir. İçerik yanında teknik olarak bakıldığında bu rivâyet, haber-i vâhiddir. Çünkü rivâyet, sadece Hz. ʿÂişe tarafından bilinebilecek detayları içermektedir. Tarihî açıdan bir öneme sahip olmasına rağmen dinî hükümlere kanıt olma niteliğinden yoksundur. Çünkü bu rivâyette, râvi konuyla ilgili Hz. Peygamber’e ait resmi bir açıklamayı nakletmemekte; sadece kendi zaviyesinden maruz kaldığı bir durumdan bahsetmektedir. (shrink)

This paper presents rational and unanimously agreeable norms in (a) governance, (b) economic policy, (c) constitution and (d) religious and scientific beliefs for civilized coexistence. The basis of unanimous agreeability is that individuals do not prefer to have their wealth (including life) robbed, even surreptitiously. This preference is unanimous because even robbers do not want to be robbed. I argue that unanimously agreeable norms are necessary for civilized co-existence of humans and are consistent with the ancient philosophy (Hindutva), which originated (...) in India more than 3000 years BC and is reflected in Gita, https://en.wikipedia.org/wiki/bhagavad_gita. Gita is considered by Courts of India as a philosophical document. The basic ethos of Gita is explicit and transparent: the state (King Dhristarastra) must not allow anyone (including privileged princes like Duryodhan) to take away others' (Pandavas') property even surreptitiously (through Sakuni's rigged game of Pashakhel). The modern constitution ordains freedom through rights to property, liberty and pursuit for happiness of individuals. But it has tacitly allowed establishment of a system (rules) of governance to facilitate surreptitious robbery. Individuals accumulate property like home and retirement savings with a hope to attain freedom, eventually, which they cannot achieve if they are robbed, even surreptitiously. The ancient philosophy of Gita prohibits robbery of any kind and, thus, guarantees hope for individual freedom. The modern philosophy—underlying the established system (rules) tacitly allowing surreptitious robbery—cannot, however, achieve individual freedom. Widespread or inclusive economic prosperity can be attained only if the constitution and rules of law are unanimously agreeable which will be consistent with ancient ethos but not modern philosophy. Much of modern technology critique inherits Heidegger’s ontico-ontological distinction. In this paper, following Stiegler’s linking of the ontic to the transgenerational, I argue that Heidegger leaves the materiality of technics as a potential site for difference in the wake. Put differently, Heidegger “declines the gift of the ontic,” instead constructing an order of an imagined Graeco-German inheritance—a culturally and linguistically specific “saving-power” against the ills of modern technology. Through Derrida’s inheritance of Heidegger’s work—marked by a different language and positionality—I reconsider (...) ontico-ontological difference as an opening to a co-constitutive productivity of world and thing, where the passing on of mnemonic inheritance features multiplicities of languages and cultural techniques that preempt Heidegger’s “Graeco-German monolingualism.” This calls for a central positioning of the politics of memory and inheritance within modern technology critique, thereby attending both to the material realities as well as the cultural differences of technics. Once these similarities are delineated—that both philosophers are for the subject and against knowledge—Chalier’s central preoccupation is to analyze and assess differences. Central among them is Kant’s rejection of heteronomy and Levinas’s wholehearted acceptance of it. In this, Levinas proceeds similarly to Heidegger and many ancient Greek philosophers, but with a difference that Chalier highlights: Levinas, like Kant, does not seek to ground morality in a knowable order external to the subject such as the cosmos, being, nature, or society. Kant (...) seeks an internal disposition, the good will, and an internal categorical principle. This makes the principle of his ethics outside of knowledge but internal to the subject. Levinas, by contrast, seeks an “anarchic” ethics—anarchic, according to Chalier, because its arche or principle is outside the subject and outside of knowledge. Chalier describes, then, two very different philosophies of the subject beyond knowledge, one in which the subject is utterly autonomous and morality stems not from will in accord with a knowable order but from good will; another in which the origin of the subject and of moral obligation is unknowable but outside the subject. Considered by many to be one of the major influences on modern Humanistic Judaism, Felix Adler (1851-1933) was a professor of political and social ethics and a social reformer who founded the Ethical Culture movement. First published in 1903 "Life and Destiny" contains quotations from Adler's lectures for the New York Society for Ethical Culture in its early years. It covers such things as the meaning of life, religion, immortality, moral ideas, the ethical outlook, and related topics.

In the Bhagavadgītā, Kṛṣṇa’s injunction is to act without desire in many verses. Many modern scholars have criticized and tried to reinterpret Kṛṣṇa’s injunction in the Bhagavadgītā to perform action abandoning all kāma “desire.” These modern scholars have tried to re-understand Kṛṣṇa’s injunction for desireless action assuming the modern dogma that intentional action entails desire. The aim of the present essay is to examine the cogency of the advocacy of desireless action by understanding how the desireless action is performed.

A sociological study of science is not very recent and has never been seen as particularly problematic since science, and especially modern science, constitutes an impressive and extremely ramified "social system" of activities, institutions, relations and interferences with other social systems. Less favourable, however, has been the consideration of a more recent trend in the philosophy of science known as the "sociological" philosophy of science, whose most debatable point consists in directly challenging the traditional epistemology of science and, in particular, (...) in stripping scientific knowledge of its most appreciated characteristics of objectivity and rigour . A vicious circle seems to lie at the root of this sociological epistemology because, on the one hand, criticism of the traditional concept of scientific knowledge is developed by relying upon sociology, but this, on the other hand is reasonable only if sociology is credited with the status of a reliable instrument, that is, because it has been recognized as a science through an epistemological debate . In this paper it is shown that not all circles are vicious: in particular, feedback loops, positive and negative, are normally considered in cybernetic models of various processes. Negative feedback loops are fundamental in self-regulating processes and have already occurred from time to time in readjusting the concept of science itself. Therefore, a sociological epistemology of science can contribute to a more careful analysis of the real meaning and purport of the cognitive aspect of science, provided that it is not pushed to the self-defeating extreme of challenging the legitimacy of considering objectivity and rigour as the characteristic features of scientific knowledge. Stephen Turner defends the sociopolitical role that experts—mainly but not only of the scientific kind—play in modern democratic society and explores means for increasing the rationality of their employment. Laudable though this is, at times Turner goes into more detail than democratic principles require; in his enthusiasm for rationality, he aims at levels of adequacy that are not always within the grasp of democracy.

Les solutions étaient bien sûr extrêmement diverses : Spinoza niera même que l’on puisse (...) faire la distinction entre principe créateur et création, tandis que d’autres, tel Robert Boyle, s’imagineront un maître horloger créant une machine absolument parfaite, qui depuis sa création ne requiert aucun acte supplémentaire de la part de son créateur. Jusque dans la pensée du jeune Kant, cette idée se rencontrera sous des formes diverses. Tous convenaient, tout de même, qu’il fallait rejeter l’ancien modèle aristotélicien d’une nature désirante, reconstruisant la nature comme un système reposant sur quelques lois fondamentales et repensant à nouveaux frais le rôle que Dieu peut, ou doit, jouer dans un tel système. Defense of Scientific Hypothesis: From Reproducibility Crisis to Big Data sets out to explain and defend the scientific hypothesis. Alger's mission is to counteract the misinformation and misunderstanding about the hypothesis that even seasoned scientists have concerning its nature and place in modern science. Most biological scientists receive little or no formal training in scientific thinking. Further, the hypothesis is under attack by critics who claim that it is irrelevant to science. In order to appreciate and evaluate scientific controversies like (...) global climate change, vaccine safety, etc., the public first needs to understand the hypothesis. Defense of Scientific Hypothesis begins by describing and analyzing the scientific hypothesis in depth and examining its relationships to various kinds of science. Alger then guides readers through a review of the hypothesis in the context of the Reproducibility Crisis and presents survey data on how scientists perceive and employ hypotheses. He assesses cognitive factors that influence our ability to use the hypothesis and makes practical and policy recommendations for teaching and learning about it. Finally, Alger considers two possible futures of the hypothesis in science as the Big Data revolution looms: in one scenario, the hypothesis is displaced by the Big Data Mindset that forgoes understanding in favor of correlation and prediction. In the other, robotic science incorporates the hypotheses into mechanized laboratories guided by artificial intelligence. But in his illuminating epilogue, Alger envisions a third way, the Centaur Scientist, a symbiotic relationship between human scientists and computers. (shrink)

The purpose of this paper is to discover an important contribution of classical Chinese ontological conceptions for the future world philosophy and the modern human Weltanschauung in the process of its globalization. Through a brief mosaic of a development of mutual Euro-Chinese encounters, from the Middle Ages to the present, the paper presents the view that both Chinese and European philosophical complexes were quite indispensable parts of the history of world philosophy; and in the future, perhaps, they will be the (...) leading factors that decide (in their serious confrontation) the basic determination of the roots of the global world metaphilosophy. At the same time the author, long having carried out scholarly research and published translations of Laozi 's Dao De Jing, Confucius' Lunyu, the Books of Xunii, Huang Lao, Huang di si jing, etc., wants to demonstrate, on the basis of specific examples of original Chinese dialectical metaphysics, their unique philosophical value for the future world philosophy and the modern human Weltanschauung. Contemporary scholars routinely argue colonialism and imperialism are indistinguishable. In this essay, I challenge this argument. While it is true the “colonial” and “imperial” overlap and intersect historically, I argue there is a central thread of modern colonialism as an ideology that can be traced from the seventeenth century to mid-twentieth century that was not only distinct from—but often championed in explicit opposition to—imperialism. I advance my argument in four parts. First, I identify key ways in which the colonial can (...) be distinguished from the imperial, including most importantly the specific kind of productive power inherent in colonialism. Second, I examine how colonialism and imperialism evolve in meaning and are redefined by both champions and critics, in relation to each other in the late nineteenth/early twentieth centuries. Third, I examine the historical moment when colonialism and imperialism fully conflate after WWII through the UN process of decolonization as the “salt water thesis” delimits colonialism to mean foreign racialized domination, and it thus becomes synonymous with imperialism. I conclude with an analysis of why the distinction still matters in both theory and practice. (shrink)

This article examines the financial technology of derivatives. Derivatives are financial products whose values are based on possible fluctuations in the values of underlying assets. Hence derivatives markets are markets that trade in the risks of other markets. In order for derivatives markets to function, forms of prognostication that can assess the possible future fluctuations of the underlying markets are necessary. What such prognostications do, the article argues, is to create information out of future possibilities. Building upon a notion of (...) virtuality derived from Gilles Deleuze, Ulrich Beck and Niklas Luhmann, the article shows how market risks and uncertainties, by means of prognostications, cease to be mere possibilities and instead come to have virtual existence. Through the technology of derivatives, uncertainty and risk can be rendered virtual and be traded. The article suggests that this technology is an example of a new way in which capitalism is now expanding self-referentially as it creates markets out of markets; and of how it is colonizing the future by developing new technologies for ‘hyper-speculation’, that is, speculation not in the possible developments of a given asset but simply in the risk of such speculation. A critical review of the crucial Freudian change in the general explanation of hysterics and neurosis that took place in 1897 would not let us assess in a definite way the epistemic import of Psychoanalysis. However some difficulties that appear in Freud’s works, related for instance to the no-contradiction principle, demand that we make an epistemic and a moral decision. But only if we wanted to maintain the critical attitude that modern science and philosophy have brought to us, a decision (...) that would allow us to see Freudianism as a faith and as “a testimony of a man in our age”. Charles Taylor argues that recognition begins with the politics of "self-image," as groups represented in the past by others in ways harmful to their own identity replace negative historical self-images with positive ones of their own making. Given the centrality of "self image" to his politics of recognition, it is striking that Taylor, himself, represents disabled people in language that is both limiting and depreciating. The author argues such negative self-images are not unique to Taylor but endemic to modern political (...) thought from John Locke to John Rawls, as the disabled are constituted in direct opposition to the rational person and/or citizen. Using contemporary social theories of disability, as articulated by disabled scholars and advocates, the author concludes that such negative self-images must be purged from political theory and replaced with an alternative theory of personhood/citizenship rooted in the image of interdependency.
