In this paper, a series of observations have been made on the pecularities originated by the Theory of Law as an autonomous subject within the wider framework of the Philosophy of Law. The object of these observations is not, however, the Theory of Law in genere but the Theory of Law as understood and defended by some Italian Philosophers of Law of the so-called ‘Bobbio School’. As a result of this examination, it can be seen how a methodological approach to (...) the legal phenomenon does not prevent the existence of a series of dualistic attitudes at three levels: 1) the conception of philosophical analysis ; 2) the status of metajurisprudence ; 3) the emphasis on meaning. Subsequently, with reference to certain manifestations whicharise from the second of these levels, the dual category is revised and submitted to the instrumentality of the Theory of Law both intentionally and effectively. Normal 0 21 In 1802 Hegel publishes in Jena “On the Relationship of Skepticism to Philosophy”. This article has the objective of criticizing the skepticism of Gottlob Ernst Schulze. The accomplishment of that critic will demand from Hegel the review of some fundamental aspects of the ancient skepticism. It treats here of reconsidering Hegel’s interpretation of the ancient skepticism, starting from that critic to the modern skepticism of Schulze.

A contradição é um conceito central para que se compreenda o desenvolvimento dialético da filosofia de Hegel. Desde a Antiguidade é debatido pelos filósofos se a contradição seria ou não uma anomalia a ser combatida quando se pensa na possibilidade da constituição de um discurso acerca das coisas e qual o seu alcance. No que se refere a Hegel, a contradição não está presente apenas no domínio dos conceitos, mas também na natureza. O que pretendemos aqui é apreender o significado (...) dessa contradição na natureza e do conceito de movimento que dela deriva. Para tanto, primeiro acompanharemos certos aspectos dessa temática no debate de Hegel com alguns autores da Antiguidade e a seguir trataremos da exposição hegeliana do mesmo tema na Filosofia da Natureza da Enciclopédia a partir da dedução do conceito de tempo. The contradiction is a central concept in order to understand the dialectical development of Hegel's philosophy. Since ancient times is debated by philosophers if the contradiction would or wouldn’t be an anomaly to be fought when considering the possibility of setting up a speech about things and what its scope is. With regard to Hegel, the contradiction is not only present in the field of concepts, but also in the nature. What we intend here is to grasp the significance of this contradiction in the nature and the concept of movement derived from it. For this, first we will follow certain aspects of this theme in Hegel’s discussion with some authors of antiquity and then dealing with the hegelian exposition of the same theme in the Philosophy of Nature of the Encyclopaedia from the deduction of the concept of time. The aim of this paper is to focus on the specificities of the creative processes in taste industries: industries that have connected the artistic and industrial dimensions to supply goods and services—demand for which derives not from the logic of needs and necessity, but from the logic of pleasures, tastes, ethic preferences and hedonism. These taste industries belong to the creative industries but, unlike scientific and technological production, they work not on the basis of cumulative knowledge but through the creation (...) of ideas, drawings, recipes, goods and services which pass through time, and which constitute heritages. Thus, creativity works on the basis of heritages: that is, past and accumulated creativity. The paper considers how the different types of heritage contribute to creative process. It concludes on the double-edged effect of heritages, which while bestowing competitive advantages and favouring the development of creativity, do orient development along a given path, promoting a certain kind of creativity that may lead to lock-in effects, and build obstacles in the way of development. Résumé. : L’article s’interroge sur la manière dont l’institution scolaire est aujourd’hui mise en question dans son projet de formation par les activités juvéniles, dans une sphère extrascolaire où ils jouissent d’une grande autonomie. Ces activités électives (numériques, musicales, sportives…) réalisent une éducation informelle où les adolescents forgent leur caractère, alors même que l’école n’a plus de modèle lisible de projet éducatif. À partir d’une enquête qualitative réalisée auprès d’une centaine d’adolescents français, on dégagera différentes épreuves qui forment les adolescents (...) dans cette sphère, avant de montrer comment elles mettent en question les finalités, mais aussi les modalités de fonctionnement de l’école. Abstract: This article examines how school is questioned today by youth culture and its activities, especially outside school where teenagers are notably autonomous. These chosen activities (digital music, sports, dance, musical activities ...) could be described as an informal education which tends to build the identity and the self of the youth. From a qualitative survey conducted among a hundred French teenagers, we will first identify different trials teenagers face in this specific sphere, before showing how they are questioning the goals, but also the operating procedures of school. Este trabajo se inscribe en una revisión in progress del Derecho antidiscriminatorio moderno que las autoras vienen efectuando desde hace más de tres lustros. En la primera parte del mismo se examinan los textos de una f ilósofa política y de dos juristas esta- dounidenses (I. M. Young, C. A. MacKinnon y K. Crensahw) que inspiran la propuesta de un concepto de discriminación y de una visión de la interseccionalidad basados en el reconocimiento de los sistemas de opresión. La segunda (...) parte se centra en el análisis del concepto de discriminación múltiple o interseccional propuesto por la doctrina jurídica española a partir de la jurisprudencia referida al caso de una mujer (“La Nena”) casada por el rito gitano que ve denegada su pensión de viudedad. A partir de lo anterior, el trabajo concluye con una serie de propuestas entre las que destacan las referidas a la necesidad de evitar que el discurso sobre la interseccionalidad disuelva la identidad política de los grupos en la individualidad, refuerce el sistema sexo-género y consolide un Derecho antidiscriminatorio de corte excesivamente jurisprudencial. En partant de quelques transformations sociétales majeures, et en s’appuyant sur la fiction romanesque française, l’article dessine deux grandes constellations imaginaires de la mobilité dans la modernité. La première associe le but du déplacement, l’existence d’un ailleurs, le goût de l’aventure, l’attitude de départ actif et le rôle de la mobilité comme logique de pouvoir. La deuxième, souvent en résonance avec les items précédents, souligne plutôt l’exigence de la mobilité pour la mobilité, la fin de l’idée de dehors, l’impératif de (...) la fuite, la prolifération de l’expérience du départ passif, enfin, la centralité croissante de la mobilité dans le saisissement de la domination. Au terme de ce parcours, l’imaginaire de la mobilité apparaît comme une boussole privilégiée pour cerner les transformations de la modernité.The article tracks two major imaginary constellations of modern mobility, through the analysis of important social transformations, illustrated by certain French novels. The first joins the goal of mobility, the existence of an « elsewhere », the taste for adventure, an active departure, and the role of mobility as a logic of power. The second, frequently in relationship with the precedent, emphasizes the idea of mobility for itself, the end of elsewhere utopia, the need to run away, the multiplication of experiences of passive departure, and finally the growing link between mobility and domination. The mobility imaginary appears at last as a privileged compass to surround the transformations of modernity. (shrink)

Para que se compreenda a crítica de Hegel a Kant em _Crença e saber_, artigo publicado pelo filósofo no _Jornal Crítico de Filosofia_, editado em conjunto com Schelling, retomaremos inicialmente no escrito sobre a _Diferença_ o primeiro esboço da exposição hegeliana daquilo que pare ele constitui a tarefa filosófica, de modo que ela dê conta das cisões originadas pela cultura filosófica moderna. O ponto de vista filosófico de Hegel no artigo está apoiado nesse texto. A seguir, reconstituiremos o contexto da (...) criação do _Jornal Crítico_, as diretrizes a serem atendidas pela crítica filosófica e expostas no artigo introdutório do _Jornal_, para só então abordar os traços gerais da crítica às filosofias da reflexão e, por fim, a crítica de Hegel a Kant. Com respeito a esta, procura o filósofo tanto apontar aquilo que há de limitado no projeto filosófico crítico, quanto aquilo que pode ser considerado um prenúncio da autêntica especulação filosófica. Podemos afirmar de modo fundamental que a crítica de Jacobi à filosofia deriva de seu afastamento do sensível em direção à constituição de verdades cada vez mais abstratas e passíveis de demonstração. Com isso a filosofia apenas conseguiu gerar disputas a respeito do que ela seja, sem conseguir demonstrar qual posição filosófica deu conta da tarefa e que terminam por levar à perda de confiança no empreendimento, ou em outras palavras, levar ao ceticismo. Trata-se aqui de, sem desconsiderar a influência (...) da filosofia do senso comum de Thomas Reid, além em certa medida também da influência de Hume, como Jacobi procura sair desse impasse a partir do modo como compreende a noção de crença. Este texto recoge una visión particular de la Filosofía del Derecho, en tanto situada y posicionada. Lo primero porque parte de la experiencia y la subjetividadde quien le da voz. Lo segundo porque en el texto se defiende una concepción instrumentalista del Derecho con fines contra-hegemónicos. Paraestructurar la exposición de esta particular visión iusfilosófica se utiliza la distinción entre la Filosofía como teoría y como práctica. En el apartado relativoa la Filosofía como teoría se analizan diversas posturas sobre la relación (...) entre el Derecho y el Poder. This book represents a synergy of the mathematical theories of categories, lattices, and modelling, and the result is a synthetic biology that provides a characterization of life. Biology extends physics. Life is not a specialization of mechanism, but an expansive generalization of it. Organisms and machines share some common features, but organisms (...) are not machines. Life is defined by a relational closure that places it beyond the reach of physicochemical and mechanistic dogma, outside the reductionistic universe, and into the realm of impredicativity. In this paper I examine Grace A. de Laguna’s theory of universals in its historical context and in relation to contemporary debates in analytic metaphysics. I explain the central features of her theory, arguing that her theory should be classified as a form of immanent realism and as a powers ontology. I then show in what ways her theory affords a theory of modality in terms of potentialities and discuss some of its consequences along the way.

This book argues for the use of nonideal theory in social ontology. The central claim is that a paradigm shift is underway in contemporary social ontology, from ideal to nonideal, and that this shift should be fully followed through. To develop and defend this central claim, the first step is to show that the key questions and central dividing lines within contemporary social ontology can be fruitfully reconstructed as a clash between two worlds, referred to as ideal and nonideal social (...) ontology. Ideal social ontology is characterized by consensus and cooperation, while nonideal social ontology is characterized by conflict and contestation. The second step is to show that, when taken together, objections to the standard model of ideal social ontology (the dominant version of ideal social ontology) imply that this model needs to be given up in favor of nonideal social ontology. In other words, we should look to nonideal rather than ideal social ontology for core concepts. The third step is to offer a positive account, called the power view, of nonideal social ontology. This account places the concept of social power at the core of a general theory of the social world and replaces the flat and narrow conception of power in ideal social ontology with a richer and more extensive conception. In addition, it rectifies a shortcoming in nonideal social ontology by attending to class, which has been notably and oddly overlooked in the literature. (shrink)

This paper is prompted by the publication of a book by Henry Louis Gates, Jr. and Andrew S. Curran on the contest launched in 1739 by the Bordeaux Academy on the origin of black skin and hair. The most influential work submitted as part of this contest was an essay by Pierre Barrère. This paper has two parts, one devoted to a review of the book, the other to the discovery of a cogent text, which was certainly written by (...) a member of the Lyon Academy, Guillaume Rey. Rey criticized Barrère’s essay and debunked various beliefs about the origin of black skin that were commonly held at the time of its publication. (shrink)

La admirable riqueza cultural y artística del Renacimiento esconde una desoladora miseria y aquella "edad de la abundancia" contrasta con una inmensa pobreza. Lejos de ser una broma o una pesadilla, la celebrada Utopía de Tomás Moro fue antes que nada un desafío insoslayable, pues proponía que ninguna sociedad merece tal nombre si tolera la miseria de un solo pobre. Rico y pobre explora la cuestión en ese libro de 1516 y en otros del escritor londinense para concluir con un (...) esbozo de su vida a la luz de la pobreza como virtud indispensable y libertadora. He aquí un hombre afortunado que no fue indiferente ante el infortunio de tantos y que vio en la humanitas la virtud por excelencia que lleva a una constante atención y cuidado del prójimo. Inspirado por un cambio de actitud en su época, así como por su fe cristiana y la mejor tradición estoica, mostró una robusta preocupación sobre el tema subrayando el valor social que debe tener toda riqueza, tanto a nivel estatal como individual, destacando la grave obligación cívica de los ricos y la necesidad que tienen todos, ricos y pobres, de empeñarse en la práctica de cierto desprendimiento y generosidad si no quieren mermar su propia humanidad y fallecer en su avaricia. La percepción de la miseria había cambiado de tal manera que su remedio ya no podía estar en una u otra limosna en plazas e iglesias, sino en la acción bien pensada y perentoria de todo gobierno que se tenga por justo.
