Counter-terrorism officials in the USA and the UK responded to the events of 11 September 2001 and 7 July 2005 with an increasing resort to the use of ?intelligence-led policing? methods such as racial and religious profiling. Reliance on intelligence, to the effect that most people who commit a certain crime have a certain ethnicity, can lead to less favourable treatment of an individual with that ethnicity because of his membership in that group, not because of any act he is (...) suspected or known to have committed. This paper explains the context in which intelligence-led policing flourishes, and how this discussion contributes to the profiling debate in both the USA and the UK, and then sets out two key contentions. First, we argue that Article 14 ECHR as applied under the UK Human Rights Act has a more protective, and less ?prosecutorial?, conception of discrimination than has the US Equal Protection Clause, meaning that judges need not find a discriminatory motive to find that discrimination has occurred. Second, we contend that Article 14 provides the judiciary with the key tool of proportionality, which, when properly applied, makes it harder for discrimination to stand up to scrutiny. (shrink)

Several recent systematic and targeted reviews have highlighted limitations in our understanding of talent in sport. However, a comprehensive profile of where the scientific research has focused would help identify gaps in current knowledge. Our goal in this scoping review was to better understand what others have done in the field of research, to summarize the constituent areas of research in a meaningful way, to help identify gaps in the research, and to encourage future research to address these gaps. Peer-reviewed (...) articles written in English that met several inclusion criteria were analyzed. A total of 1,899 articles were identified, and the descriptive findings revealed a relatively narrow focus of research on talent in sport. Specifically, the majority of examined articles focused on males only, the sport of soccer, perceptual cognitive variables, developing athletes, adult samples, and cross-sectional designs. For better or worse, the concept of talent remains a central element of how coaches, practitioners, and scientists think about athlete development. Findings from this scoping review highlight the continued need to explore issues related to talent identification, selection, and development in more diverse samples and contexts. There is also a clear necessity to focus on under-researched areas using alternative methodologies. (shrink)

In recent years, there has been a surge of projects using a wide array of tools. As practitioners and researchers have gravitated toward more playful approaches, there is a need to review and evaluate such approaches. Aaron Zimmerman presents a new pragmatist account of belief, in terms of information poised to guide our more attentive, controlled actions. And he explores the consequences of this account for our understanding of the relation between psychology and philosophy, the mind and brain, the nature of delusion, faith, pretence, racism, and more.

The Representational Theory of the Mind (RTM) has been forcefully and subtly developed by Jerry A. Fodor. According to the RTM, psychological states that explain behavior involve tokenings of mental representations. Since the RTM is distinguished from other approaches by its appeal to the meaning or "content" of mental representations, a question immediately arises: by virtue of what does a mental representation express or represent an environmental property like coto or shoe? This question asks for a general account of the (...) semantics of mental representation. Fodor places two conditions on the requisite theory: it must be physi calistic (that is, it must be couched in nonsemantic and nonintentional terms, free of expressions like "refers to" or "denotes" or "means that"), and it must be atomistic (that is, it must allow that the thinker can have a single intentional state without having any others). What is wanted, then, is a reductive theory that "naturalizes" content by specifying sufficient conditions, in physicalistic and atomistic terms, for a mental symbol to represent or express a certain property. The fact that philosophy is systematic—that philosophical issues are thoroughly interconnected—was a commonplace among nineteenth century idealists, then neglected by analytic philosophers throughout much of the twentieth century, and has now finally started to get some renewed attention. But other than calling attention to the fact, few philosophers have tried to say what it consists in, or what its implications are. -/- I argue that the systematicity of philosophy has disastrous epistemological implications. In particular, it implies philosophical skepticism: philosophers are (...) rationally prohibited from believing any philosophical thesis. The argument goes by way of a new principle that connects inquiry with what is rational to believe. I conclude with a discussion of the relationship between my argument and other, more well-trodden arguments for philosophical skepticism. (shrink)

Throughout his illustrious career, Roderick Chisholm was concerned with the nature of persons. On his view, persons are what he called ‘entia per se.’ They exist per se, in their own right. I too have developed an account of persons—I call it the ‘Constitution View’—an account that is different in important ways from Chisholm’s. Here, however, I want to focus on a thesis that Chisholm and I agree on: that persons have ontological significance in virtue of being persons. In their target article, McKay & Dennett (M&D) conclude that only “positive illusions” are adaptive misbeliefs. Relying on overly strict conceptual schisms (deficit vs. motivational, functional vs. organic, perception vs. belief), they prematurely discount delusions asbiologicallyadaptive. In contrast to their view that “motivation” plays a psychological but not a biological function in a two-factor model of the forming and maintenance of delusions, we propose asingleimpairment in prediction-error–driven (i.e., motivational) learning in three stages in which delusions play a biologically adaptive role.

How do we know right from wrong? Do we even have moral knowledge? Moral epistemology studies these and related questions about our understanding of virtue and vice. Political constructivism is associated with John Rawls more than any other contemporary philosopher. This chapter suggests that Rawls's political constructivism is better understood as a general method of justification which runs throughout his work as a whole, including his early work and A Theory of Justice. The chapter develops the general characterization of Rawls's political constructivism. Its main elements are taken in turn and developed with special attention to the two places where Rawls discusses the topic in depth – his (...) Dewey Lectures on Kantian Constructivism in Moral Theory and its substantially revised version called “Political Constructivism” (PL, Lecture III). The main elements include social role, sources, interpretive basis, representation and conclusion. Rawls endorsed a Kantian metaethical constructivism in part because it offered a way of more deeply characterizing how his previous political constructivism could be a live and distinct possibility. Haskell Curry’s philosophy of mathematics is really a form of “structuralism” rather than “formalism” despite Curry’s own description of it as formalist (Seldin 2011). This paper explains Curry’s actual view by a formal analysis of a simple example. This analysis is extended to solve Keränen’s (2001) identity problem for structuralism, confirming Leitgeb’s (2020a, b) solution, and further clarifies structural ontology. Curry’s methods answer philosophical questions by employing a standard mathematical method, which is a virtue of the “methodological autonomy” emphasized by (...) Curry (1951, 1963) and more recently with greater clarity by Maddy (1997, 2007). (shrink)

Biological science uses multiple species concepts. Order can be brought to this diversity if we recognize two key features. First, any given species concept is likely to have a patchwork structure, generated by repeated application of the concept to new domains. We illustrate this by showing how two species concepts (biological and ecological) have been modified from their initial eukaryotic applications to apply to prokaryotes. Second, both within and between patches, distinct species concepts may interact and hybridize. We thus defend (...) a semantic picture of the species concept as a collection of interacting patchwork structures. Thus, although not all uses of the term pick out the same kind of unit in nature, the diversity of uses reflects something more than mere polysemy. We suggest that the emphasis on the use of species to pick out natural units is itself problematic, because that is not the term’s sole function. In particular, species concepts are used to manage inquiry into processes of speciation, even when these processes do not produce clearly delimited species. (shrink)

The evil God challenge is an argumentative strategy that has been pursued by a number of philosophers in recent years. It is apt to be understood as a parody argument: a wholly evil, omnipotent and omniscient God is absurd, as both theists and atheists will agree. But according to the challenge, belief in evil God is about as reasonable as belief in a wholly good, omnipotent and omniscient God; the two hypotheses are roughly epistemically symmetrical. Given this symmetry, thesis belief (...) in an evil God and belief in a good God are taken to be similarly preposterous. In this paper, we argue that the challenge can be met, suggesting why the three symmetries that need to hold between evil God and good God – intrinsic, natural theology and theodicy symmetries – can all be broken. It offers readers 17 chapters, written especially for this volume by an international cast of leading scholars. Some chapters are devoted to large, thematic issues like the relationship between analytic philosophy and other philosophical traditions such as British Idealism and phenomenology, while other chapters are tied to more fine-grained topics or to individual philosophers, like Moore and Russell on philosophical method or the history (...) of interpretations of Wittgenstein’s _Tractatus_. We identify a species of experiment—Kon-Tiki experiments—used to demonstrate the competence of a cause to produce a certain effect, and we examine their role in the historical sciences. We argue that Kon-Tiki experiments are used to test middle-range theory, to test assumptions within historical narratives, and to open new avenues of inquiry. We show how the results of Kon-Tiki experiments are involved in projective inferences, and we argue that reliance on projective inferences does not provide historical scientists with any special (...) protection against the problem of unconceived alternatives. This dissertation compares the thought and practice of Xunzi, a 4th--3rd century BCE Confucian, with that of Augustine of Hippo, a 4th--5th century CE Christian. Specifically, it compares their versions of the view that human nature is significantly bad or evil, and their prescriptions for the cultivation of ethically and religiously preferable modes of life, through the practice of what Pierre Hadot has called "spiritual exercises." ;Xunzi and Augustine deploy conceptual apparatuses structured by distinctive terms of art, responding to debates (...) within their own contexts. Their articulations of human personhood deeply shape their proposals and hopes for personal cultivation. This thesis examines their different anthropologies, with special attention to Augustine's concept of natura and Xunzi's idea of xing, both traditionally rendered in English as "human nature." It then discusses their positive proposals for ethico-religious education and personal cultivation, focusing on the specific practices they recommend and their accounts of how and why these practices are effective in the production of flourishing human beings. It explores Xunzi's opposition of "nature" and "artifice," his analysis of emotion, desire, and action, and his accounts of study, ritual practice, and music as spiritual exercises. It investigates Augustine's views of original sin and the mind imaging God, his account of disciplina "teaching" and "discipline," and his understandings of the liberal arts, learning from scripture, fasting, the Eucharist, and different types of prayer. ;Comparison of Xunzi and Augustine makes three contributions. First, it refines our analytical categories as students of religious thought and practice, especially in this case "human nature" and "spiritual exercises." Second, it illuminates both thinkers' views more fully, in particular deepening our understanding of Xunzi's moral psychology and Augustine's theories of Christian formation after "conversion" and baptism. Third, it contributes to contemporary debates in religious ethics: first, about moral personhood, proposing a new model of "chastened intellectualism" but underscoring the limitations of universalistic accounts; and second, about spiritual exercises, retrieving elements of Xunzi's account of ritual and Augustine's techniques for affecting one's inner discourse of interpretation and judgment. The American conservative movement is a force of anti-reflexivity insofar as it attacks two key elements of reflexive modernization: the environmental movement and environmental impact science. Learning from its mistakes in overtly attacking environmental regulations in the early 1980s, this counter-movement has subsequently exercised a more subtle form of power characterized by non-decision-making. We examine the conservative movement’s efforts to undermine climate science and policy in the USA over the last two decades by using this second dimension of power. The (...) conservative movement has employed four non-decision-making techniques to challenge the legitimacy of climate science and prevent progress in policy-making. We argue that reflexive modernization scholars should focus more attention on similar forces of anti-reflexivity that continue to shape the overall direction of our social, political and economic order, and the life chances of many citizens. Indeed, better understanding of the forces and effectiveness of anti-reflexivity may very well be crucial for societal resilience and adaptation, especially in the face of global environmental problems like climate change. Prior research on the influence of various ways of framing anthropogenic climate change do not account for the organized ACC denial in the U.S. media and popular culture, and thus may overestimate these frames' influence in the general public. We conducted an experiment to examine how Americans' ACC views are influenced by four promising frames for urging action on ACC —when these frames appear with an ACC denial counter-frame. This is the first direct test of how exposure to an ACC (...) denial message influences Americans' ACC views. Overall, these four positive frames have little to no effect on ACC beliefs. But exposure to an ACC denial counter-frame does significantly reduce respondents' belief in the reality of ACC, belief about the veracity of climate science, awareness of the consequences of ACC, and support for aggressively attempting to reduce our nation's GHG emissions in the near future. Furthermore, as expected by the Anti-Reflexivity Thesis, exposure to the ACC denial counter-frame has a disproportionate influence on the ACC views of conservatives, effectively activating conservatives' underlying propensity for anti-reflexivity. A study of the relationship between African political theory and the politics of liberation. It elucidates the dialectical inter-relationship between the political philosophical views of these thinkers and the political, social and economic contexts of their respective countries.

This paper investigates the complexity hypothesis in microbial evolutionary genetics from a philosophical vantage. This hypothesis, in its current version, states that genes with high connectivity are likely to be resistant to being horizontally transferred. We defend four claims. There is an important distinction between two different ways in which a gene family can persist: vertically and horizontally. There is a trade-off between these two modes of persistence, such that a gene better at achieving one will be worse at achieving (...) the other. At least some genes are likely to experience selection favoring increased transferability. One consequence of this can be encapsulated as the “simplicity hypothesis”: horizontally persisting genes will experience selection favoring reduced connectivity. In order to make sense of the simplicity hypothesis, we need to consider evolutionary populations that transcend species boundaries. Vertical and horizontal persistence are therefore not two competing ways of succeeding at the same game, but involve playing two different games altogether. The complexity hypothesis can be understood in terms of two related notions: entrenchment and Cuvierian functionalism. This framing reveals previously unrecognized and philosophically interesting connections between reasoning about deep conservation and horizontal transfer. (shrink)

The desire to minimize the number of individual new entities postulated is often referred to as quantitative parsimony. Its influence on the default hypotheses formulated by scientists seems undeniable. I argue that there is a wide class of cases for which the preference for quantitatively parsimonious hypotheses is demonstrably rational. The justification, in a nutshell, is that such hypotheses have greater explanatory power than less parsimonious alternatives. My analysis is restricted to a class of cases I shall refer to as (...) additive. Such cases involve the postulation of a collection of qualitatively identical individual objects which collectively explain some particular observed phenomenon. In The Case for Animal Rights, Tom Regan defends the view that all animals who are “subjects of a life” have an equal moral right to life. In this chapter, I consider whether it makes sense to think that animals have an equal right to life in light of the challenge that life has less value for animals than humans. This challenge raises two central questions: (1) does life have less value for animals than humans and (2) if it does, (...) does this fact justify the view that animals do not have an equal right to life. I argue, first, that life has greater value for most humans than animals because most humans are capable of experiencing higher qualities of enjoyment in life, in the form of creative, intellectual pleasures. However, this does not justify denying that animals have an equal right to life. Whether beings’ lives deserve strong respect depends on whether the value of life for those beings meets a certain threshold. I argue that the value of life for many animals meets this threshold because it is compatible with the virtue of compassion. (shrink)
