    A teoria habermasiana do direito reivindica uma terceira via entre a normatividade das teorias “abstratas” da justiça e o funcionalismo de teorias como a de Luhmann. Na verdade, a posição de Habermas é normativa num sentido forte e, apesar do funcionalismo de sua reivindicação, enfoca apenas o direito positivo moderno, na medida em que não distingue claramente entre direito e moralidade. Outrossim, termina por incorrer nesta aporia, culminando numa espécie de legalização da moralidade.
