In recent years several proposals to view reasoning with legal cases as theory construction have been advanced. The most detailed of these is that of Bench-Capon and Sartor, which uses facts, rules, values and preferences to build a theory designed to explain the decisions in a set of cases. In this paper we describe CATE (CAse Theory Editor), a tool intended to support the construction of theories as described by Bench-Capon and Sartor, and which produces executable code corresponding (...) to a theory. CATE has been used in a series of experiments intended to explore a number of issues relating to such theories, including how the theories should be constructed, how sets of values should be compared, and the representation of cases using structured values as opposed to factors. This article reports three experiments that investigated the relationship between working memory capacity and syllogistic and five-term series spatial inference. A series of complex and simple verbal and spatial working memory measures were employed. Correlational analyses showed that verbal and spatial working memory span tasks consistently predicted syllogistic and spatial reasoning performance. A confirmatory factor analysis showed that three factors best accounted for the data--a verbal, a spatial, and a general factor. Syllogistic reasoning performance loaded all three factors, whilst spatial (...) reasoning loaded only the general factor. The implications of these findings are discussed in the context of reasoning theories and contemporary accounts of the structure of working memory. (shrink)

In this paper we describe AGATHA, a program designed to automate the process of theory construction in case based domains. Given a seed case and a number of precedent cases, the program uses a set of argument moves to generate a search space for a dialogue between the parties to the dispute. Each move is associated with a set of theory constructors, and thus each point in the space can be associated with a theory intended to explain the seed case (...) and the other cases in the domain. The space is large and so an heuristic search method is needed. This paper describes two methods based on A* and alpha/beta pruning and also a series of experiments designed to explore the appropriateness of different evaluation functions, the most useful precedents to use as seed cases and the quality of the resulting theories. Abstract -/- In this paper, I shall deal with quasi-(proper) names, that is expressions like ‘Mum’, ‘Dad’, ‘Grandpa’, ‘Grandma’ in English or ‘Papà’, ‘Mamma’, ‘Nonna’, ‘Nonno’ in Italian. I shall use examples both from English and Italian. Quasi-names are directly referential like proper names, even if they apparently exhibit some conceptual materials, which, however, are not active and are inert. They can be used as vocatives or as arguments of verbs. I called terms like ‘Mum’, ‘Dad’ ‘quasi-names’ because they have (...) certain characteristics of names (but they could also be called ‘indexical names’). They confer significance to an individual. This book contains essential contributions to enrich and broaden the application field of pragmatics. It provides an example of how the fruitful reflections and refined conceptual distinctions born in the philosophical field can find a practical application in addressing social, cognitive, clinical, and psychological problems. Its chapters address, from different points of view, the relationship between pragmatic linguistics and philosophy, and outline the possible application of pragmatic theories to different domains. Developed during the third Pragmasophia international conference, whose name is (...) derived from the Greek terms πρᾶγμα (action, fact) and σοφία (knowledge, science), the book aligns itself with its aim to study human actions and activities and how they take shape through language. But ‘Pragma’ and ‘Sophia’ also signal another purpose: highlighting the importance of creating links between empirical investigations on language use, and more traditional philosophical approaches. In this reading, ‘Pragma’ represents the experimental goal devoted to analysing and interpreting language facts. In contrast, the term ‘Sophia’ recalls the original vocation of past philosophers to pursue an ideal of ‘pure knowledge’, disconnected from any practical-economic interest. While maintaining the conference's original purpose of encouraging productive comparisons between different approaches, the book consists of two sections: first, on philosophical approaches, recalls more theoretical aspects (closer to the term ‘Sophia’); the second, ‘Inferential and Cognitive Pragmatics,’ addresses more practical issues affecting domains such as Greek literature, pragmatic disorders, dictionary entries, and speech analysis. The reader, whether in linguists, philosophy or psychology, obtains a complete overview of the most advanced current research lines, both theoretical and empirical, and thus contributes to broadening the scope of pragmatics. The Beloved Self is about the holy grail of moral philosophy, an argument against egoism that proves that we all have reasons to be moral. Part One introduces three different versions of egoism. Part Two looks at attempts to prove that egoism is false, and shows that even the more modest arguments that do not try to answer the egoist in her own terms seem to fail. But in part Three, Hills defends morality and develops a new problem for egoism, (...) an epistemological problem. She shows that it is not epistemically rational to believe the most plausible versions of egoism. The first part of the book will be most relevant to those interested in moral theory, as it contains detailed discussions of recent interpretations of virtue ethics and especially of Kant's moral theory. The second and third part of the book turn to epistemology, particularly moral epistemology, and include an account of the relationship between knowledge and action, a new theory of moral understanding, and a discussion of the epistemically rational response to various kinds of disagreement. The thought that empathy plays an important role in moral motivation is almost a platitude of contemporary folk psychology. Parallel themes were mooted in German moral philosophy and aesthetics in the 1700s, and versions of the empathy construct remained prominent in continental accounts of moral motivation through the nineteenth century and early twentieth centuries. This chapter elucidates the Empathic Motivation Hypothesis (EMH) and sets out some of the conceptual and empirical challenges it faces. It distinguishes empathic concern from other dimensions (...) of empathy (e.g., resonance, attunement, distress, and non-empathic concern) and examines the merits of EMH as a developmental thesis, focusing on evidence from psychopathology and attachment theory. Although the concept of food sovereignty is rooted in International Peasant Movements across the global south, activists have recently called for the adoption of this framework among low-income communities of color in the urban United States. This paper investigates on-the-ground processes through which food sovereignty articulates with the work of food justice and community food security activists in Oakland, California, and Seattle, Washington. In Oakland, we analyze a farmers market that seeks to connect black farmers to low-income consumers. In Seattle, (...) we attend to the experiences of displaced immigrant farmers from Latin America and their efforts to address their food needs following migration. In both cases, we find that US based projects were constrained by broader forces of neoliberalism that remained unrecognized by local activists. In Oakland, despite a desire to create a local food system led by marginalized African Americans, emphasis on providing green jobs in agriculture led activists to take a market-based approach that kept local food out of the economic grasp of food-insecure neighborhood residents. In Seattle, the marginalization of the immense agroecological knowledge of Latino/an immigrant farmers rendered local food projects less inclusive and capable of transformative change. Taken together, these very different cases suggest that a shift towards food sovereignty necessitates a broad acknowledgement of and resistance to neoliberalism. (shrink)

My project is to explain why the question ‘How does it feel to be a white problem?’ cannot be answered in the fluttering grammar of white talk. The whiteness of white talk lies not only in its having emerged from white mouths, but also in its evasiveness—in its attempt to suppress fear and anxiety, and its consequential [if unintended] reinscription and legitimation of racist oppression. I White talk is designed, indeed scripted, for the purposes of evading, rejecting, and remaining ignorant (...) about the injustices that flow from whiteness and its attendant privileges. I want to suggest a new point of entry—a way to flip the script, so to speak. -/- I begin with some observations about the basic advantages and disadvantages of using white talk as a route into the white problem. My account develops an expanded version of Alice MacIntyre’s definition of white talk that is attentive to the racialized bodily scripts that accompany white talk. I argue that white talk persists because it has an enduring and powerful moral, ontological, and epistemic pay off for white folks. I explore each payoff with an eye towards clarifying how white talk functions to maintain the illusion that we are invulnerable beings. Next, I pause to reply to the popular objection that this particular critique of white talk silences white people in conversations on race. If we cannot address the question ‘how does it feel to be a white problem’ in the fluttering grammar of white talk, then how shall we begin? In closing, I suggest that we might reduce fluttering by replacing white talk with a discourse of vulnerability, where vulnerability is defined not as weakness, but as a condition for potential. I offer some brief guidelines for how we might start this conversation. (shrink)

This paper problematises the ways women’s leadership has been understood in relation to male leadership rather than on its own terms. Focusing specifically on ethical leadership, we challenge and politicise the symbolic status of women in leadership by considering the practice of New Zealand Prime Minister Jacinda Ardern. In so doing, we demonstrate how leadership ethics based on feminised ideals such as care and empathy are problematic in their typecasting of women as being simply the other to men. We apply (...) different strategies of mimesis for developing feminist leadership ethics that does not derive from the masculine. This offers a radical vision for leadership that liberates the feminine and women’s subjectivities from the masculine order. It also offers a practical project for changing women’s working lives through relationality, intercorporeality, collective agency and ethical openness with the desire for fundamental political transformation in the ways in which women can lead. This short article argues that an adequate response to the implications for governance raised by ‘Big Data’ requires much more attention to agency and reflexivity than theories of ‘algorithmic power’ have so far allowed. It develops this through two contrasting examples: the sociological study of social actors used of analytics to meet their own social ends and the study of actors’ attempts to build an economy of information more open to civic intervention than the existing one. The article concludes with (...) a consideration of the broader norms that might contextualise these empirical studies, and proposes that they can be understood in terms of the notion of voice, although the practical implementation of voice as a norm means that voice must sometimes be considered via the notion of transparency. It is no accident that white privilege designed to be both be invisible and weightless to white people. Alison Bailey’s “On White Privilege and Anesthesia: Why Does Peggy McIntosh’s Knapsack Feel Weightless?” extends a weighty invitation white readers to complete the unpacking task McIntosh (1988) began when she compared white privilege to an “invisible and weightless knapsack.” McIntosh focuses primarily making white privilege visible to white people. Bailey’s project continues the conversation by extending a ‘weighty invitation’ to white readers (...) to explore why the metaphorical knapsack, despite the weight of its contents, feels weightless. Here’s the short answer. The knapsack only feels weightless because white people have become anesthetized us to our own brokenness. We are more comfortable considering what white privilege does for us than what it does to us. People of color feel the weight of whiteness every day. The weighty invitation invites white readers to become sensitive to our own insensitivity. To do this Bailey (1) explores white resistance to unpacking the weight; (2) people of color’s testimonies to the daily impact of the weight on their bodies; and (3) how the anesthesia of white privilege distorts our humanity. The article concludes with a McIntosh style list of that the anesthesia of privilege distorts white people’s humanity. (shrink)

Causes always seem to come prior to their effects. What might explain this asymmetry? Causation's temporal asymmetry isn't straightforwardly due to a temporal asymmetry in the laws of nature—the laws are, by and large, temporally symmetric. Nor does the asymmetry appear due to an asymmetry in time itself. This Element examines recent empirical attempts to explain the temporal asymmetry of causation: statistical mechanical accounts, agency accounts and fork asymmetry accounts. Vladimir Putin's image functions as a political talisman far outside of the borders of his own country. By studying material objects, fan fiction and digital media, this book traces the satirical uses of Putin's public persona, notably how he stands as a foil for other world leaders. It argues that the internet is crucial to the creation of contemporary Putin memorabilia and that these items show a continued political engagement by young people, even as some political scientists and media experts (...) decry what they see as the opposite. The book further addresses the ways in which explicit sexual references about government officials are being used as everyday political commentary in the United States. Turning a critical eye to Putin kitsch shows how the number of such references skyrocketed during the 2016 US Presidential election campaign, and suggests that the phenomenon is likely to still be important when Americans next return to the polls. Finally, the internet makes possible a totally new kind of kitsch--the virtual kind. An examination of how the Russian president's image circulates via memes and parodies, as well as through apps and games, suggests that political culture has become increasingly participatory in the last decade. The massive disparity between the relative wealth of most citizens in affluent countries and the profound poverty of billions of people struggling elsewhere for survival is morally jolting. But why exactly is this disparity so outrageous and how should the citizens of affluent countries respond? Political philosopher, Thomas Pogge, has emerged as one of the world’s most ardent critics of global injustice which, he argues, is caused directly by the operation of a global institutional order that not only systematically disadvantages (...) poor countries but is imposed on them by precisely those wealthy, powerful countries that benefit the most from the order’s injustice. In allowing their governments to perpetrate this injustice, Pogge contends that citizens of the wealthy countries collude in a monumental crime against humanity. This paper describes one way in which a precise reason model of precedent could be developed, based on the general idea that courts are constrained to reach a decision that is consistent with the assessment of the balance of reasons made in relevant earlier decisions. The account provided here has the additional advantage of showing how this reason model can be reconciled with the traditional idea that precedential constraint involves rules, as long as these rules are taken to be defeasible. (...) The account presented is firmly based on a body of work that has emerged in AI and Law. This work is discussed, and there is a particular discussion of approaches based on theory construction, and how that work relates to the model described in this paper. (shrink)

Archaeological facts have a perplexing character; they are often seen as less likely to “lie,” capable of bearing tangible, material witness to actual conditions of life, actions and events, but at the same time they are notoriously fragmentary and enigmatic, and disturbingly vulnerable to dispersal and attrition. As Trouillot (1995) argues for historical inquiry, the identification, selection, interpretation and narration of archaeological facts is a radically constructive process. Rather than conclude on this basis that archaeological facts and fictions are indistinguishable, (...) I identify a number of strategies that archaeologists rely on to make discerning use of “legacy” data – archaeological data recovered and curated over for decades, even centuries, often for very different purposes than those that animate contemporary archaeological inquiry. These include source criticism, secondary retrieval, repositioning and recontextualizing these data in ways that can, sometimes radically shift the “facts” associated with them. The construction of critical genealogies of these facts – the travels and transformations of the material, interpretive and narrative facts of archaeology – is a crucial condition for the successful exploitation of these epistemic possibilities. By attending to sonic rhetorics through Awkwafina’s blaccent controversy, the article explores the condition of epistemic violence that position Asian American voices as “unhearable.”.

According to ‘orthodox’ representationalism, perceptual states possess constitutive veridicality (truth, accuracy, or satisfaction) conditions. Typically, philosophers who deny orthodox representationalism endorse some variety of anti-representationalism. But we argue that these haven’t always been, and needn’t continue to be, the only options. Philosophers including Descartes, Malebranche and Helmholtz appear to have rejected orthodox representationalism while nonetheless endorsing perceptual representations of a fundamentally practical kind not captured by orthodox representationalism. Moreover, we argue that the perceptual science called on by contemporary philosophers to (...) defend orthodox representationalism instead motivates a return to this older view, and we suggest that contemporary philosophers may conceptualize fundamentally practical perceptual representations as _‘de agendo’_ representations, a species of representation that has constitutive appropriateness rather than veridicality conditions. This is a long-overdue biography of the Huxleys: the Victorian natural historian T.H. Huxley ("Darwin's Bulldog") and his grandson, the scientist, conservationist, and zoologist Julian Huxley. Both T.H. and Julian suffered from depression, thinking and writing about the condition and genetic inheritance in highly curious ways. And between them, they communicated to the world the great modern story of the theory of evolution by natural selection. Because the grandson modeled himself so self-consciously on the grandfather, celebrated historian Alison Bashford (...) writes seamlessly about these omnivorous intellects together, almost as if they were one very long-lived man whose vital dates bookended the colossal shifts in world history from the age of sail to the Space Age, and from colonial wars to world wars to the cold war. Many women wrote philosophy in nineteenth-century Britain, and they wrote across the full range of philosophical topics. Yet these important women thinkers have been left out of the philosophical canon and many of them are barely known today. The aim of this book is to put them back on the map. It introduces twelve women philosophers - Mary Shepherd, Harriet Martineau, Ada Lovelace, George Eliot, Frances Power Cobbe, Helena Blavatsky, Julia Wedgwood, Victoria Welby, Arabella Buckley, Annie Besant, Vernon Lee, and (...) Constance Naden. Alison Stone looks at their views on naturalism, philosophy of mind, evolution, morality and religion, and progress in history. She shows how these women interacted and developed their philosophical views in conversation with one another, not only with their male contemporaries. The rich print and periodical culture of the period enabled these women to publish philosophy in forms accessible to a general readership, despite the restrictions women faced, such as having limited or no access to university education. Stone explains how these women became excluded from the history of philosophy because there was a cultural shift at the end of the nineteenth century towards specialised forms of philosophical writing, which depended on academic credentials that were still largely unavailable to women. As Spinoza's near‐total omission from the history of physics reflects, Spinoza never produced a physics in this narrow sense: a careful and systematic investigation of bodies, forces, and their motions of the kind found in Descartes, Regius, or Huygens. Spinoza did have things to say about extension, motion, and the causal interactions of bodies. Understanding Spinoza's physics requires reckoning with his responses to Descartes. Like Descartes, Spinoza thinks that all and only bodies share an attribute, the attribute of Extension. Spinoza's (...) commitment to the “attribute‐neutrality” of some causal facts is reflected in his physics. Attribute‐neutrality can also make sense of some changes in the DPP. Physics investigates the nature and properties of bodies, so for Spinoza as for Descartes, it will involve an analysis of the attribute of Extension. Spinoza never drew out the detailed physical implications of his metaphysics of bodies. (shrink)

The collection offers the stories of women academics from around the globe and across disciplines and showcases their efforts to meaningfully listen and converse in order (...) to resist self-audit and diminished identities. Reflections come from a range of responsive, personal and aesthetic techniques, including writing groups, guided autobiography, auto-ethnography, collective activism and slow scholarship. Chapters engage with themes and ideas such as agency, neoliberalism, ontological security, androcentricity, identity and collegial support, which manifest in unique ways for female academics. The focus in this volume is what really matters to women in the academy, as they share their efforts to 'be' themselves in their work, to 'care for themselves and others' and to 'count what isn't counted'. Based on ethnographic research in the city of Carrara, in central Italy, the article discusses the experiences of both quarry workers and sculptors who work with marble.
