The Black community has a long, well-documented history of being disproportionately harassed by law enforcement. While psychological research has studied this phenomenon, more in-depth research on Black men’s lived-experience of police harassment is needed. This qualitative study used descriptive phenomenology to investigate Black men’s experience of being harassed by law enforcement officers. An analysis of non-structured interviews with a sample of four participants revealed several essential aspects of this experience, including: anxiety in response to the initial awareness of law enforcement’s (...) presence, fear and confusion in response to abrupt escalation of aggression and hostility by officers, a sense of humiliation in response to degrading police tactics, anger over inability to pursue redress through the justice system, ongoing negative emotion, and a sense of having been psychologically harmed by the harassment. Social epistemology is the study of the social dimensions of knowledge or information. There is little consensus, however, on what the term "knowledge" comprehends, what is the scope of the "social", or what the style or purpose of the study should be. According to some writers, social epistemology should retain the same general mission as classical epistemology, revamped in the recognition that classical epistemology was too individualistic. According to other writers, social epistemology should be a more radical departure from classical (...) epistemology, a successor discipline that would replace epistemology as traditionally conceived. The classical approach could be realized in at least two forms. One would emphasize the traditional epistemic goal of acquiring true beliefs. It would study social practices in terms of their impact on the truth-values of agents’ beliefs. A second version of the classical approach would focus on the epistemic goal of having justified or rational beliefs. Applied to the social realm, it might concentrate, for example, on when a cognitive agent is justified or warranted in accepting the statements and opinions of others. Proponents of the anti-classical approach have little or no use for concepts like truth and justification. In addressing the social dimensions of knowledge, they understand "knowledge" as simply what is believed, or what beliefs are "institutionalized" in this or that community, culture, or context. They seek to identify the social forces and influences responsible for knowledge production so conceived. Social epistemology is theoretically significant because of the central role of society in the knowledge-forming process. It also has practical importance because of its possible role in the redesign of information-related social institutions. (shrink)

The aim of this paper is to sketch a theory of justified belief. What I have in mind is an explanatory theory, one that explains in a general way why certain beliefs are counted as justified and others as unjustified. Unlike some traditional approaches, I do not try to prescribe standards for justification that differ from, or improve upon, our ordinary standards. One possible aim of epistemology is to advise cognizers on the proper choice of beliefs or other doxastic attitudes. This aim has often been part of scientific methodology: to tell scientists when they should accept a given hypothesis, or give it a certain degree of credence. This regulative function is naturally linked to the notion of epistemic justification. It may well be suggested that a cognizer is justified in believing something just in case the rules of proper epistemic procedure prescribe (...) that belief. Principles that make such doxastic prescriptions might thereby "double" as principles of justification. In the first part of this paper I contrast the regulative conception of justification with another, equally tenable, conception. Then, after noting a fundamental worry about the applicability of the regulative conception, I proceed to lay it out in more detail. The regulative justificational status of a doxastic attitude for person S at time t depends upon (a) the right set of doxastic instructions and (b) the states S is in at (or just before) t. (shrink)

For most of their respective existences, reliabilism and evidentialism (that is, process reliabilism and mentalist evidentialism) have been rivals. They are generally viewed as incompatible, even antithetical, theories of justification.1 But a few people are beginning to re-think this notion. Perhaps an ideal theory would be a hybrid of the two, combining the best elements of each theory. Juan Comesana (forthcoming) takes this point of view and constructs a position called “Evidentialist Reliabilism.” He tries to show how each theory can (...) profit by borrowing elements from the other. Comesana concentrates on reliabilism’s problems and how it might be improved by infusions from evidentialism. This paper follows a similar tack. My emphasis, however, is the reverse of Comesana’s. I highlight problems for evidentialism and show how it could benefit by incorporating reliabilist themes. I am not sanguine that evidentialists will see it my way. They might even view my proposals as an insidious attempt to convert evidentialists to reliabilism. Well, I won’t debate the best way to formulate this paper’s recipe. At any rate, it began with the idea (which anteceded my reading of Comesana) of creating a synthesis of reliabilism and evidentialism. It retains significant strands of that idea, although the synthesis theme does not pervade the entire paper. What is mentalist evidentialism? Its original formulation was succinct. (shrink)

Intuitions play a critical role in analytical philosophical activity. But do they qualify as genuine evidence for the sorts of conclusions philosophers seek? Skeptical arguments against intuitions are reviewed, and a variety of ways of trying to legitimate them are considered. A defense is offered of their evidential status by showing how their evidential status can be embedded in a naturalistic framework.

What is the mission of epistemology, and what is its proper methodology? Such meta-epistemological questions have been prominent in recent years, especially with the emergence of various brands of "naturalistic" epistemology. In this paper, I shall reformulate and expand upon my own meta-epistemological conception (most fully articulated in Goldman, 1986), retaining many of its former ingredients while reconfiguring others. The discussion is by no means confined, though, to the meta-epistemological level. New substantive proposals will also be advanced and defended.

I begin with some familiar conceptions of epistemic relativism. One kind of epistemic relativism is descriptive pluralism. This is the simple, non-normative thesis that many different communities, cultures, social networks, etc. endorse different epistemic systems (E-systems), i.e., different sets of norms, standards, or principles for forming beliefs and other doxastic states. Communities try to guide or regulate their members’ credence-forming habits in a variety of different, i.e., incompatible, ways. Although there may be considerable overlap across cultures in certain types of (...) epistemic norms (e.g., norms for perceptual belief), there are sharp differences across groups in other types of epistemic norms. This chapter argues that empirical findings in cognitive science can play a significant evidential role in an optimal methodology for metaphysics. It does not propose any radical metaphysical methodology or any wholesale replacement of traditional methods. Rather, it offers a supplement to traditional methods. The chapter proposes a general template for metaphysical methodology under which cognitive scientific considerations might become routine or commonplace factors in realist metaphysics, not just isolated or occasional factors. Sharing with proponents of anthropology's recent "ontological turn," McLean insists that experiments with language and form are a performative means of exploring alternative possibilities of collective existence, new ways of being human and other than human, and that such experiments must therefore be indispensable to anthropology's engagement with the contemporary world. As support for clinical ethics committees in the UK grows, care must be taken to define their function, membership and method of working and the status of their decisions.The modern practice of medicine raises a plethora of complex issues—medical, ethical and legal. Doctors and other healthcare professionals increasingly must try to resolve these and may sometimes have to do so in the face of contrary opinion expressed by patients and/or their surrogates. While clearly qualified in the medical arena, and although (...) there is now more ethics teaching in the medical curriculum, healthcare professionals are seldom qualified to adjudicate on ethical or legal matters, or even, perhaps, to recognise them when they arise. Yet, as Doyal says, “clinical life must go on and moral and legal indeterminacy within medicine cries out for practical resolution.”1 Meanwhile, the expectations of patients and their families—and, indeed, of wider society—are that decisions about patient care, resources and therapeutic regimes should be soundly based on appropriate ethicolegal, as well as scientific, principle.Recognition of these additional burdens on healthcare professionals has generated some interest in the provision of ethics consultation. In the USA this has been undertaken by a variety of tribunals and individuals. Hospital ethics committees and ethics consultants feature in many US hospitals and perform a variety of roles. In Europe, a number of countries have also established clinical ethics committees and they are becoming more common in the UK—primarily in England and Wales for the moment. Whereas, however, “[i]n North America, CECs have … become an integral part of the organisational infrastructure of hospitals ...”,1 in the United Kingdom they remain essentially ad hoc bodies, generated for a variety of reasons and with different goals, structures, membership, methods of working and functions. The rapid rise of varieties of historicism in Germany, during the mid- to late-nineteenth century, and subsequently in England and America, resulted in a radical transformation of the principles of coherence and methods of analysis within biblical studies.1This paper will argue that the foundational ‘subject/object’ metaphysics of historicism has been subverted over the past century. For this reason, historical positivism should no longer be accorded the status of ‘normative paradigm’ and ‘gatekeeper’ over and against other interpretive approaches. This paper next (...) lays out five principles for a renewed practice of historical inquiry. It argues, first, that historical inquiry continues to serve a vital function within biblical studies in its ability to call attention to historical difference, and, thereby, to contribute to a strategy of resistance to ideology and to totalizing theories; second, that the traditional appeal to historical ‘context’ and ‘author’ in the interpretation of texts continues to be a useful practice – despite the provisional and constructed nature of both – as a way of taking into account extra-lingual reference and of avoiding presentism; third, that the substitution of new ‘grand narratives’ of Christian origins in place of the (quasi-theological) ‘historical’ narrative of traditional Christianity – under the claim of historical objectivity – should be abandoned because the very concept of ‘origins’ is the result of a literalizing of a metaphor. Such totalizing narratives always reduce history's inherent polycentricism. Fourth, I will argue that the continued use of historicism in the antiquarian attempt to reconstruct the past, disconnected from both a quest for social justice and a desire for personal self-creation, represents a form of thought that alienates scholars from themselves and from their real material contexts. Finally, and following on the previous point, this paper submits that the practice of historical analysis has an ethical dimension by virtue of the fact that the personhood of the biblical historian is indissolubly linked to other dimensions of life including the social and ethical aspects of life. These added dimensions complicate the making of choices, which is implicit within all practices of interpretation. These five principles are here suggested as points of departure for the reconceptualization of the scope and function of historical inquiry within the discipline of New Testament studies. (shrink)

This is the third volume in Alvin Plantinga's trilogy on the notion of warrant, which he defines as that which distinguishes knowledge from true belief. In this volume, Plantinga examines warrant's role in theistic belief, tackling the questions of whether it is rational, reasonable, justifiable, and warranted to accept Christian belief and whether there is something epistemically unacceptable in doing so. He contends that Christian beliefs are warranted to the extent that they are formed by properly functioning cognitive faculties, (...) thus, insofar as they are warranted, Christian beliefs are knowledge if they are true. The development of clinical ethic support in the UK arguably brings with it a series of legal questions, which need to be addressed. Most particularly, these concern questions of due process and formal justice, which I argue are central to the provision of appropriate ethical advice. In this article, I will compare the UK position with the more developed system in the USA, which often provides a template for development in the UK. While it is not argued that the provision (...) of clinical ethics support in the UK will necessarily follow the path mapped in the USA, there are lessons that can be learned from the US experience – particularly in terms of attention to process – from which UK clinical ethics support service might well benefit. An essential and neglected distinction between contract and administrative law is in how each conceives of the Crown as a juristic person. This article explores the extent of this distinction, and its implications for the rule of law and the separation of powers. It offers explanations—historical, jurisprudential and pragmatic—for why contract law conceives of the Crown as a corporation aggregate with the powers and liberties of a natural person, and why administrative law disaggregates the State into named officials.

The patient-doctor relationship has recently come under intense scrutiny, resulting in a re-evaluation of the basis of that relationship. The papers by Glannon and Ross, and McKay seek to identify the sources of authority in the patient-doctor relationship by evaluating it in terms of the concept of altruism. In this paper I argue that the analysis of Glannon and Ross, and of McKay is unnecessary and that the analysis offered by the latter is also flawed. I do acknowledge, however, that (...) The new regulations on xenotransplantation pay insufficient attention to the broad ethical problems raised by this technique and that the abandonment of a national body with overall regulatory authority in this area is a mistake.Following reports from the Nuffield Council on Bioethics1 and, most importantly, the Advisory Group on the Ethics of Xenotransplantation2 , the UK Xenotransplantation Interim Regulatory Authority was established in 1997. The existence of a national body to govern xenotransplantation was deemed to be of critical importance by (...) the Kennedy report given the practical and ethical issues associated with xenotransplantation. Indeed, the Kennedy report recommended that ultimately UKXIRA should be placed on a statutory footing.2 The remit of UKXIRA was to advise the Secretary of State on particular applications, gather information on issues such as safety, and assess whether the preconditions identified by the Kennedy report had been met.3In December 2006, UKXIRA was quietly disbanded, and the Department of Health issued a statement of guidance, the terms of which now govern xenotransplantation in the UK. This document superseded procedures that had been in place since 1998, which had placed the overall regulation of applications to conduct xenotransplantation in the hands of UKXIRA and, ultimately, the Secretary of State.4 The revised guidance defines xenotransplantation as being: “… any procedure that involves the transplantation, implantation, or infusion into a human recipient of either live tissues or organs retrieved from animals, or, human body fluids, cells, tissue or organs that have undergone ex vivo contact with live non-human animal cells, tissues or organs.”5 . ABSTRACT Most university students have engaged in some form of academic dishonesty. These actions can have detrimental consequences for the student, the university, and society at large. It is important to understand factors that contribute to academic dishonesty as well as to identify potential predictors of this behavior. This study employed an experimental design with 361 undergraduate students in a laboratory setting. Deception was used during the experiment to determine the impact of peer influence, personality, and an honor code on (...) cheating behavior. Results revealed that peer influence had the largest impact on cheating behavior. In addition, personality, specifically, individuals who scored high on the openness trait were significantly more likely to cheat than those who scored lower on this trait. Implications of these findings for addressing academic dishonesty in higher education are provided. (shrink)
