In this paper, we examine the lawfulness of a proposal to provide elective ventilation to incompetent patients who are potential organ donors. Under the current legal framework, this depends on whether the best interests test could be satisfied. It might be argued that, because the Mental Capacity Act 2005 (UK) (and the common law) makes it clear that the best interests test is not confined to the patient's clinical interests, but extends to include the individual's own values, wishes and beliefs, (...) the proposal will be in the patient's best interests. We reject this claim. We argue that, as things currently stand, the proposal could not lawfully be justified as a blanket proposition by reference to the best interests test. Accordingly, a modification of the law would be necessary to render the proposal lawful. We conclude with a suggestion about how that could be achieved. (shrink)

The extended Church-Turing thesis posits that any computable function can be calculated efficiently by a probabilistic Turing machine. If this thesis held true, the global effort to build quantum computers might ultimately be unnecessary. A common objection against deflationism is that it cannot account for the fact that truth depends on reality. Consider the question ‘On what does the truth of the proposition that snow is white depend?’ An obvious answer is that it depends on whether snow is white. Now, consider what answer, if any, a deflationist can offer. The problem is as follows. A typical deflationary analysis of truth consists of biconditionals of the form ‘The proposition that p is true (...) iff p’. Such biconditionals tell us nothing about what the truth of the proposition that p might depend on. Therefore, it seems that a typical deflationist cannot give an answer. Since we know that an answer is available, this throws doubt over the adequacy of deflationism as an account of truth. Articulated here is a defence of deflationism against this objection. It is argued that although biconditionals of the sort mentioned do not explicitly state a dependency between truth and reality, they nevertheless convey one. The reason is that, given the context in which a deflationist invokes the biconditionals, such a dependency is implicated. A potential problem with this defence is that it leaves the deflationist still unable to give an account of what it is for truth to depend on reality. One might think that a deflationist can offer such an account by appealing to truthmaker theory but, it is argued below, truthmaker theory is unavailable to a deflationist. God and the World introduce the note of interpretation.—Alfred North Whitehead1Theistic finitism, the position that God is not omnipotent, is the most tenable solution to the problem of evil—but it also necessitates a slide toward immanence. So [God] is also a loveless being.”8 Or, as Dietrich Bonhoeffer reflected as he awaited execution in a Nazi concentration camp, “Only the suffering God can help.”9However, when one strips away divine omnipotence, one must also bid adieu either to God’s omniscience or creator-hood: for an omniscient creator, crafting the world with full knowledge of how everything would unfold, would be ipso facto omnipotent. We are left, then, with the following alternatives: we could posit a God who pressed the “create world” button not knowing what would happen (which seems irresponsible, calling into question God’s goodness)—as Tim Bayne puts it, “If future contingents fall outside the scope of God’s knowledge, then creation was a massive gamble.”10 We may share Albert Einstein’s famous distaste for a God who plays dice with the universe. Sweeping denials of the story's capacity to accurately reflect the past are ever catalyzing equally misleading global affirmations. The impositionalists, such as theorist Hayden White, view historical narratives as imposing a falsifying narrative structure on the past, and conclude that narratives cannot be true. Plot-reifiers, such as Alasdair MacIntyre, David Carr, and Frederick Olafson, posit that the past is already narratively structured; historical plots are reified in order for there to be something in the world to which narrative structures (...) can correspond in being true. The antireferentialists such as JeanFrançois Lyotard and Roland Barthes deny that narrative histories even claim truth. Escaping this trilemma of theoretical interpretation involves accepting the idea that construction of a history does not entail its falsification. Historical narrative need to be allowed to function both figurally, in the sense of generating new discursive figures, and at the same time literally, in the sense of asking to be understood literally. Narratives need to be understood on their own terms, and not treated as an approximation to some foreign ideal. (shrink)

In recent years, and especially in the wake of Barack Obama's reelection, projections that whites will soon become a minority have proliferated. In this essay, I will argue that such predictions are misleading at best, as they rest on questionable philosophical presuppositions, including the presupposition that racial concepts like ‘whiteness’ are static and unchanging rather than fluid and continually being reconstructed. If I am right about these fundamental inaccuracies, one must wonder why the myth of the white minority persists. (...) I will argue that by reenvisioning whites as a minority culture struggling against a hostile dominant group, and by promoting white solidarity as a response to a crisis, such predictions actually serve to defend and legitimize white supremacy. Rights have become,in recent years, a significant concern of legal theorists, as well as of those involved in moral and political philosophy. This new book seeks to move a number of debates forward by developing the analysis of rights and focusing upon more general theoretical considerations relating to rights. The book is divided into five parts. The first includes an explanation of the part played by conceptual analysis within jurisprudence, while the second conducts a re-examination of Hohfeld’s analysis of rights. (...) This part deals with the arguments advanced by a number of modern theorists including Hart, White and MacCormick. The third part contains the author’s own framework for discussing rights, including examples drawn from tort, constitutional law and international law, together with an analysis of Unger’s theory of rights. Part four centres on the perceived conflict between Dworkin, Rawls and Nozick as the defenders of a rights approach, and Bentham as the champion of utilitarianism and concludes that neither deals with the fundamental concerns of morality on which their theories are based. The fifth part consists of a conclusion which reflects on the key themes and considers the role of rights within general theory. For students, particularly helpful features of the book are the overt consideration of jurisprudential methodology and the opportunity to examine a number of key theorists linked by their divergent views on the subject of rights. Many contemporary philosophers of mind are concerned to defend a thesis called a posteriori physicalism. This thesis has two parts, one metaphysical, and the other epistemological. The metaphysical part of the thesis—the physicalist part—is the claim that the psychological nature of the actual world is wholly physical. The epistemological part of the thesis—the a posteriori part—is the claim that no a priori connection holds between psychological nature and physical nature. Despite its attractiveness, however, a familiar argument alleges that a posteriori (...) physicalism cannot be true. This argument is sometimes called the Property Dualism Argument Against Physicalism. In this paper, I consider Stephen White’s version of the Property Dualism Argument and argue that it fails. At its root is the notion that every citizen should be able to have an individual property stake, and it has recently been revived in Britain and in the U.S. in a number of proposals aimed at countering the huge and growing inequality in the distribution of assets. Such asset egalitarianism is fed from many streams; it has a long history in civic republican thought, beginning with Thomas Paine and Thomas (...) Jefferson, but has also featured in the distributist theories of G.K. Chesterton and Hilaire Belloc; the guild socialism of G.D.H. Cole and the ethical socialism of R.H. Tawney; the market liberalism of the Ordo Liberals and some of the Austrian School, particularly F.A. Hayek; and more recently the market socialism of James Meade, A.B. Atkinson and Julian Le Grand, and the market egalitarianism of Michael Sherraden, Samuel Bowles, Herbert Gintis, Richard Freeman and Bruce Ackerman. There are also important links to the proponents of a citizens' income as a different approach to the welfare state (White 2002) as well as to the ideas of stakeholding (Dowding et al. 2003). The Flats, a district near downtown Cleveland, was once was the vibrant heart of Midwestern industry and is now in the throes of change: Some of its warehouses and factories have been transformed into nightclubs and restaurants, while homes in adjacent neighborhoods have been replaced by mini-mansions. In Cleveland, photographer Andrew Borowiec documents the Flats today and evokes the way of life they once embodied. Given the rare opportunity to access one of Cleveland's vast steel mills before it was (...) modernized or destroyed, Borowiec employed his camera to explore the Flats and its monuments of American industry. His striking black and white images reveal the broken power and vulnerability of the once-mighty mill as well as its relation to the surrounding city and its neighborhoods. The commercial buildings, factories, warehouses, and iron bridges that sustained Cleveland's industrial pulse convey a quiet dignity in these compelling photographs, as do the modest frame houses that sheltered those who labored for decades in the Flats. As Clevelanders struggle to redefine themselves as citizens of a twenty-first-century corporate metropolis, the Flats stand as a haunting testament to a time when men worked with their hands and steel was indeed the backbone of our nation. Gorra (2020) argues that this very ambivalence is a generative resource for the author's greatest achievements, quoting Yeats's notorious dictum, "We make out of the quarrel with others, rhetoric, but of the quarrel with ourselves, poetry" (346). This can remind us of the notorious "crucible of doubt" out of which Dostoevsky allegedly forged his fiction. The Russian novelist is named (Blotner 2005, 718) as among seven of Faulkner's "masters" in the literary education of this omnivorous autodidact, with the others being Melville, Conrad, Balzac, Flaubert, Dickens, and Cervantes. With Dostoevsky especially he shares an admixture of horror and benign good humor. On occasion Faulkner was classed as an author of Southern Gothic, a label also applied to Flannery O'Connor, who, with Toni Morrison and Cormac McCarthy, counts among his greatest literary progeny. This article engages with Alan White’s discussion of the relationship between rights and claims and the literature provoked by it, particularly the response of Neil MacCormick. A further challenge is brought against White’s position of maintaining that there is but one kind of right, and that a right to something does not imply (nor is implied by) a claim to that thing. The analysis offered here insists on acknowledging different meanings of claim and different strengths to claims. A (...) core distinction between claim as assertion and claim as justified requirement is advanced, together with an accompaying distinction between making a claim and holding a claim. It is then possible to identify four different claims relating to a particular right as follows. HansenSix days before he delivered his Second Inaugural Address, Abraham Lincoln strode into his White House office. Greeting him were G. B. Lincoln, John A. Bingham, and Francis Carpenter, the last of whom had been living with Lincoln in the White House for six months, painting a portrait of the president reading the Emancipation Proclamation to the cabinet. It (...) is Carpenter's delineation of the president's entrance that contains the "only known description of the preliminaries of the Second Inaugural" (Barondess 1954, 62). "Mr. Lincoln came in through the side passage which had lately been constructed," Carpenter writes, "holding in his hand a roll of manuscripts." Lincoln turned to his guests and quipped, "Lots of wisdom in that document, I suspect; it is what will be called my 'second inaugural' " (quoted in Barondess, 62).The content and modesty of Carpenter's description of the "preliminaries of the Second Inaugural" give the rhetorical critic a telling preview of what might be discovered in a reading of Lincoln's composition of that manuscript. The Second Inaugural seemingly speaks beyond its content and situation.Contained within the aura of adoration that surrounds the Second Inaugural is a significant charge to the rhetorical critic: what is it particularly about the address that sustains its agency and permits it to escape the evanescence accorded to most rhetorical efforts? When the agency of discourse helps to eliminate or extenuate the immediate exigency that calls forth that speech, it usually becomes remanded to the annals of history and is examined by the public or by scholars only when that historical nidus forces itself back upon the public's or the scholar's attention. The speech is exhausted by its situation and swallowed by its surrounding and future events. There are, however, those speeches like the Gettysburg Address and the Second Inaugural that practice their persuasion on audiences beyond the immediate exigency. They persist, they talk to us still, and their agency endures. Why is this true of Lincoln's Second Inaugural? This is the question that motivates my close reading of Lincoln's speech; and, as I hope to demonstrate, it is only through a close reading that such a question even makes sense. The paper proposes two ideas: (1) The wilderness preservation movement has failed to identify key elements involved in situations of environmental conflict. (2) The same movement seems unaware of its location within a tradition which is both elitist and Puritan. Holmes Rolston's recent work on the apparent conflict between feeding people and saving nature appears to exemplify the two points. With respect to point (1), Rolston's treatment fails to address the institutional and structural features which set the agenda for individual (...) human lives. The human ecology of environmental destruction cannot ignore the role of corporate actors such as banks, national governments, transnational corporations, trade unions and so on. These agents interact with each other in various ways and also have an internal structure – perhaps akin to Arthur Koestler's conception of the holarchy - which enables people working within them to avoid taking responsibility for policies that have damaging environmental consequences. As far as thesis (2) is concerned, Rolston's work shares common features with Arne Naess's deep ecology and Aldo Leopold's land ethic. All of these writers draw, perhaps unconsciously, on a tradition of sporting elitism associated with the Great White Hunter. One variety of this tradition combines elitism with a form of Puritanism. This book defends Frank Jackson’s knowledge argument against physicalism. According to physicalism, consciousness is a physical phenomenon. The knowledge argument stars Mary, who learns all objective, physical information through black-and-white media and yet acquires new information when she first sees colors for herself: information about what it is like to see in color. Based partly on that case, Jackson concludes that not all information is physical. The book argues that the knowledge argument succeeds in refuting all standard versions of (...) physicalism: versions on which consciousness is grounded by what objective science reveals. It also argues that given further, plausible assumptions, the knowledge argument leads to Russellian monism, on which there are intrinsic properties that both constitute consciousness and underlie properties physics describes, such as mass and charge. However, many healthcare researchers believe that a growing number of Americans are underinsured. Because any characterization of underinsurance will refer to the value judgments of people about what counts as "adequate" and "inadequate" healthcare, the goal of characterizing and measuring the underinsured is difficult to achieve. Theological education in Aotearoa New Zealand has developed within the structures of whiteness which inhibit the flourishing of indigenous students. This article employs Willie Jennings’s work, especially from After Whiteness, as an analytical frame to interpret the experience of a wahine Māori (an indigenous woman) student and her Pākehā (European) supervisor during the completion of her capstone integrative theology project at Carey Baptist College in Aotearoa. This project, which intersected Māori knowledges with theology to develop a theological account of land, (...) unveiled the structural injustices that often prevent Māori from flourishing in theological education. We examine the historical legacy of theology's role in instituting educational injustice in Aotearoa and detail the shape this legacy takes in contemporary theological education. We reflect on our distinct experiences in the process of change undertaken to address some of the educational injustices and develop a form of assessment that enabled a Māori student to flourish as Māori. One aim of this essay is to understand why white evangelical Christians, more than any other religious adherents in the United States, are deeply invested in denying the emergency of anthropogenic climate change and in obstructing action to address anthropogenic climate change. Michael S. Hogue, in his recent book, American Immanence, blames a religious imaginary he names the “redeemer symbolic.” This symbolic complex inspires the devotion of the politically powerful white evangelical Christian and nationalist movement in the United (...) States at the present time. A second aim of the essay is to analyze the redeemer symbolic. Through a reading of Maurice Sendak’s much-loved illustrated children’s book, Where the Wild Things Are, the essay suggests that U.S. white evangelical devotees of the redeemer symbolic share a kind of inability to come to terms with a vital and ineliminable wildness in persons and cultures; further, that this inability correlates with a political-theological failure, even refusal, to grasp the emergency of anthropogenic climate change. The essay first explicates the redeemer symbolic, with a particular focus on its implication in the legitimation of climate skepticism. Then, with the aid of key concepts from the psychoanalytic theory of D.W. Winnicott, it interprets the story of Max, the protagonist in Where the Wild Things Are, as a fable of healthy development of what Winnicott calls “transitional space” and a related “capacity to be alone.” Unsuccessful development of those resources, it is suggested, contributes to an account of why adherents of the redeemer symbolic typically refuse wildness and thus may be prone to climate negligence. More importantly, though, recognizing the cultural-psychological importance of “wild things” may help fire imaginative ways around the obstructiveness of the redeemer symbolic, to more effectively address climate change in particular, and human well-being in nature in general. Abstract:The attractiveness of life writings stems from its promise of exceptional intimacy with a writer. Yet that intimacy can come at a cost, especially in relation to writers from marginalized backgrounds. As many of them have noted, they can feel expected to produce vulnerable versions of themselves on the page for the vicarious satisfaction of white audiences. Such satisfactions can become especially problematic in the classroom when life writing by one author is allowed to stand for the experience of (...) an entire social group. This article details strategies for de-essentializing the use of life writing in the classroom by underscoring the complexities both of race and of the classroom reading experience. (shrink)

In this paper, I offer a psychologically informed critique of and alternative to approaches to teaching issues of race and racial justice that are based on the recognition of white privilege. White privilege pedagogy, I argue, faces serious limitations avoided by a pedagogy grounded in “interest convergence.” Advanced by critical race theorist Derrick Bell, the theory of interest convergence holds that racial progress is most likely when the interests of whites converge with the interests of oppressed racial groups. Applying this insight to pedagogical practice, I argue that it has the potential to overcome white resistance to acknowledging and addressing racial injustice, in the classroom and in the broader public sphere. After making this case in general terms, I illustrate it concretely by describing an interest convergence-based approach to teaching affirmative action. (shrink)
