Non-Identity arguments have a pervasive but sometimes counter-intuitive grip on certain key areas in ethics. As a result, there has been limited success in supporting the alternative view that our choices concerning future generations can be considered harmful on any sort of person-affecting principle. However, as the Non-Identity Problem relies overtly on certain metaphysical assumptions, plausible alternatives to these foundations can substantially undermine the Non-Identity argument itself. In this paper, I show how the pervasive force and nature of Non-Identity arguments (...) rely upon a specific adoption of a theory of modality and identity and how adopting an alternative account of modality can be used to reject many conclusions formed through Non-Identity type arguments. By using Lewis’s counterpart-theoretic account to understand ways we might have been, I outline the basis of a modal account of harm that incorporates a person-affecting aspect. This, in turn, has significant implications for ethical decision-making in areas such as reproductive choice and the welfare of future generations. (shrink)

Recent legal rulings concerning the status of advance statements have raised interest in the topic but failed to provide any definitive general guidelines for their enforcement. I examine arguments used to justify the moral authority of such statements. The fundamental ethical issue I am concerned with is how accounts of personal identity underpin our account of moral authority through the connection between personal identity and autonomy. I focus on how recent Animalist accounts of personal identity initially appear to provide a (...) sound basis for extending the moral autonomy of an individual - and hence their autonomous wishes expressed through an advance directive - past the point of severe psychological decline. I argue that neither the traditional psychological account nor the more recent Animalist account of personal identity manage to provide a sufficient basis for extending our moral autonomy past the point of incapacity or incompetence. I briefly explore how analogies to similar areas in law designed to facilitate autonomous decision, such as wills and trusts, provide at best only very limited scope for an alternative justification for granting advance statements any legal or moral authority. I conclude that whilst advance statements play a useful role in formulating what treatment is in a patient’s best interests, such statements do not ultimately have sufficient moral force to take precedence over paternalistic best interest judgements concerning an individual’s care or treatment. This essay seeks to characterise the essential features of an equitable health care system in terms of the classical Aristotelian concepts of horizontal and vertical equity, the common language of “need” and the economic notion of cost-effectiveness as a prelude to identifying some of the more important issues of value that policy-makers will have to decide for themselves; the characteristics of health that can cause policy to be ineffective ; the information base that is required to support a policy directed (...) at securing greater equity, and the kinds of research that are needed to underpin such a policy. Seminal work in moral neuroscience by Joshua Greene and colleagues employed variants of the well-known trolley problems to identify two brain networks which compete with each other to determine moral judgments. Greene interprets the tension between these brain networks using a dual process account which pits deliberative reason against automatic emotion-driven intuitions: reason versus passion. Recent neuroscientific evidence suggests, however, that the critical tension that Greene identifies as playing a role in moral judgment is not so much a tension between (...) reason and passion, but a tension between distinct forms of deliberative reasoning: analytic versus empathetic. Hope takes on a particularly important role in end of life situations. Sustaining hope can have considerable benefits for the quality of life and any prospect of a good death for the dying. However, it has proved difficult to adequately account for hope when dying, particularly in some of the more extreme end of life situations. Standard secular accounts of hope struggle to establish how the fostering of hope may be possible in such situations. This leads to a practical ethical (...) dilemma for those caring for the dying, the ‘paradox of hope’, whereby one can either help maintain the welfare of the dying by generating a misleading ‘false hope’ or maintain truthfulness and concede that hope is not possible. These two problems combine to leave individuals the prospect of dying in terrible circumstances facing only despair. To address this, I argue that we should look beyond standard intentional or dispositional accounts of hope in such cases and treat hope as a cluster concept. Rather than appeal to a unitary conception, what we precisely mean by ‘hope’ may therefore vary depending on the context of use. I outline an account of hope based on Marcel’s account of ‘absolute’ hope but offering an alternative, secular foundation based on solidarity that can explain how hope when dying in extreme circumstances is possible. Hence, where the more familiar accounts break-down in these circumstances, ‘hope talk’ may still be possible if it is seen as relying on this conception of hope. (shrink)

This article addresses a tendency within postcolonial studies to place the work of Michel Foucault and Frantz Fanon in opposition. This has obscured the real, and potentially very productive, similarities between them. The most important of these links has to do with their shared critique of the sovereign subject of humanism: for Fanon and Foucault, this critique of the traditional humanist subject provides a way of opposing what they both see as the dangerous nostalgia for a lost moment of origin. (...) Furthermore, Fanon and Foucault both end in a moment of ethics, but it is an ethics without the sort of stable subjects assumed by humanism. I offer a consideration of some of the links that can be found in several texts by Fanon and Foucault. I then attempt to define the term I will be using to describe their shared strategy of an ethics without subjects: the “humanism effect.” I conclude by trying to suggest some of the strategic possibilities of an ethics without subjects in the postcolonial context. Prominent evolutionary psychologists have argued that our innate psychological endowment consists of numerous domainspecific cognitive resources, rather than a few domaingeneral ones. In the light of some conceptual clarification, we examine the central inprinciple arguments that evolutionary psychologists mount against domaingeneral cognition. We conclude (a) that the fundamental logic of Darwinism, as advanced within evolutionary psychology, does not entail that the innate mind consists exclusively, or even massively, of domainspecific features, and (b) that a mixed innate cognitive economy of domainspecific (...) and domaingeneral resources remains a genuine conceptual possibility. However, an examination of evolutionary psychology's 'grain problem' reveals that there is no way of establishing a principled and robust distinction between domainspecific and domaingeneral features. Nevertheless, we show that evolutionary psychologists can and do live with this grain problem without their whole enterprise being undermined. (shrink)

Sociology today faces a number of serious challenges to its integrity as a discipline. As a synthesis of Weberian and Durkheimian traditions, the work of Randall Collins represents an innovative vindication of sociology in the early 21st century. This article explores Collins’s interaction ritual theory to demonstrate its contemporary utility. However, to highlight the importance of Collins’s work, it seeks to advance and refine it theoretically. Specifically, it seeks to develop Collins’s argument about the role of emotions and, specifically, effervescence, (...) in rituals. This paper argues that, while important, effervescence alone cannot be sufficient to ensure the conformity which is a typical feature of interaction and essential to explaining social order. Drawing on Goffman, Asch and Scheff, the paper argues that effervescence is underpinned by more robust mechanisms of honour and shame, themselves immediately connected to access to collective goods. In this way, the paper affirms the importance of Randall Collins’s work for sociology today. (shrink)

This is a collection of writings by the late Lord Quinton, one of the wittiest and most versatile philosophers of his generation.

Merleau-Ponty’s writings on the philosophy of painting, though widely influential and much discussed, remain enigmatic. In this paper I compare his views on painting with those of his older contemporary, Jacques Maritain, who also holds that painting can give us a non-conceptual insight into deep truths about things that are inaccessible to discursive thought. I argue that some ideas that are obscure and undeveloped in Merleau-Ponty are developed more clearly and fully in Maritain. Even where there are significant differences between (...) them, these are not as great as it might at first seem. This comparison can help us to see the ways in which both philosophers’ theories of art are important for understanding their philosophies as a whole. Furthermore, the views they hold in common can continue to suggest a plausible and fruitful way to think about art today. (shrink)

The Sustainable Development Goals are an opportunity to address major social and environmental challenges. As a widely agreed framework they offer a potential way to mobilise stakeholders on a global scale. The manner in which the goals, with time-based targets and specific metrics, are set out within a voluntary reporting process adopted by both governments and business, provides a fascinating and important case for organisational studies. It is both about advancing performance measurement and evidence-based policy-making for sustainable development, and also (...) participation and consultation at a wider, more global scale, than has ever been possible before. This paper contributes to the notion of SDGs as a wicked problem, answering calls for deeper theorisation, via synthesis with core ideas in the management field of decision theory. A case study on the wicked problem of deforestation and its links to supply chains, multi-stakeholder initiatives and SDG reporting, provides an illustration of the relevance of the application of decision theory to wicked problems, presented using a novel conceptual framework. This helps to illustrate new avenues for research and practical application regarding the balance of technocratic and participative approaches for sustainable development. (shrink)

Doing theology with children, in a systematic and focused way, is a new practice. This article contributes to this theological practice by examining its emergence, nature and mission and proposing multimodal narrativity as a practical theological methodology for doing such theology. The article argues, from a practical theological standpoint, that doing theology with children should be understood as a synodal event – a journeying together with children about their faith; as a way of seeing the mysteries of God through the (...) eyes of the child and of encouraging a robust understanding of God and God’s plan for humanity and the entire creation; and as a way of seeing the faces of children and hearing their voices, thereby accounting for their suffering and hope. Children themselves are sources and disruptors of hope. The use of multimodal narrativity creates space for these narratives and disruptions of hope and encourages children to theologise their experiences in the midst of their different communities. The inquiry into the nature of truth plays an important role in Fichte's thought, especially following his departure from Jena, and indeed in the WL-1804-ii the doctrine of truth emerges as the centerpiece of the WL. The following paper argues that the conception of truth evolves significantly after the WL-1804-ii, and that, in such texts as the Erlanger Metaphysik, the Spekulation zu Koppenhagen, and the 1812 WL, Fichte, building on the account of the hiatus in the WL-1804-ii while moving away (...) from its notion of absolute truth, seeks to understand truth in terms of freedom, or indeed, as what »yields to freedom«, wherein freedom, through the negativity of the concept, produces an emptiness, a clearing, that is »fulfilled« with truth. Anticipating the phenomenological account of truth yet without abandoning a strong sense of normativity, Fichte’s alethology remains a compelling alternative to contemporary positions. (shrink)

Through a radically conceived sentimentality – the unmediated juxtaposition of the abjection of things, conceived as a paradoxical “desire for desire” having no place in the world, with a cruel, apathetic gaze – Andersen challenges the existence of the soul or subjectivity as what, by combining the theoretical gaze with contemplative pleasure, grants coherence to experience. Thus undermining not only Romantic self-reflection, and its suturing of philosophy to criticism, but (...) This article argues that criminal justice and health institutions under settler colonialism collude to create and sustain “truths” about First Nations lives that often render them as “bare life,” to use the term of Giorgio Agamben. First Nations peoples’ existence is stripped to its sheer biological fact of life and their humanity denied rights and dignity. First Nations people remain in a “state of exception” to the legal order and its standards of care. Zones of exception place First Nations people (...) in a separate and diminished legal order. Medical and health agencies have been instrumental in shaping colonial “biopower,” both in and beyond carceral settings to ensure that First Nations lives are managed in accordance with the colonial settler state project. This project is able both to threaten First Nations rights to live and to maintain settler self-perceptions of decency and care. We illustrate this discussion with reference to the tragic and unnecessary deaths in custody of twenty-two-year-old Yamatji woman Ms Dhu in 2014 in South Hedland Police Station, Western Australia, and twenty-six-year-old Dunghutti man David Dungay Jnr in Long Bay jail in Sydney, NSW, in 2015. Health professionals and police demonstrated callous disregard to Ms Dhu and Mr Dungay—treating them as “bare life.”. (shrink)

Mentalizing - the ability to understand oneself and others by inferring the mental states that lie behind overt behavior - develops during childhood within the context of a secure attachment relationship. The “information age” is often thought in terms of the digital revolution that begins with Turing’s 1937 paper, “On computable numbers, with an application to the Entscheidungsproblem.” However, this can only be partially correct. There are two aspects to Turing’s work: one dealing with questions of computation that leads to computer science and another concerned with building computing machines that leads to computer engineering. Here, we emphasize the latter because it shows us a Turing connected with mechanisms of information flow (...) rather than solely with the mathematical and logical problems of computability for which he is better known. Our reasons for doing so will become clear in what follows. In fact, the 1937 paper just mentioned provides a general schematic for building a computing machine; this mechanical connection puts Turing on an historical continuum with others who discovered mechanisms to cope with information. Of those involved in this quest in the 19th Century, two people in particular, Edison and Bell, had explicit visions of an information age that would follow from their work. Because they were explicitly aware of what they were doing and partly brought it about long before 1937, they deserve substantial credit for the information age they set out to inaugurate. Regarding one purely mechanical and non-electronic technology, Edison noted ten uses for the phonograph, including not only the replication of sound, but also “connection with the telephone, so as to make that instrument an auxiliary in the transmission of permanent and invaluable records, instead of being the recipient of momentary and fleeting communication”. Even though the telephone was only two years old when Edison wrote of a network made up of mechanical hard storage systems and people connected by wire, the network vision was already clearly in his head. Resumo: A Segunda consideração extemporânea geralmente é tida em conta por filósofos e historiadores, em razão de sua crítica ao que Nietzsche classifica como “doença histórica”,. Isso por uma boa razão: a crítica de Nietzsche tem como alvo não apenas a famosa tríade composta por historiadores monumentais, antiquários e críticos, mas também suas modalidades contemporâneas em historiografia e teleologia científicas. O que frequentes vezes é desconsiderado é que o próprio Nietzsche expõe - ainda que numa retórica altamente estilizada - uma (...) concepção afirmativa da história. Essa concepção, como eu proponho, faz o leitor retornar ao enunciado que inaugura o livro, qual seja, o Ceterum Censeo, de Goethe. A demanda de Nietzsche de que a história serve à vida é uma nova aplicação da teoria de Goethe do crescimento morfológico como consequência de forças polares concorrentes para o reino da história. Uma vez que Goethe tinha os organismos vivos como a crescer por meio de forças em concorrência, também Nietzsche entendia que os indivíduos e culturas cresciam por meio de uma história considerada, acima de tudo, uma espécie de arena competitiva em que se expressam impulsos antagonistas.: The second Untimely Meditation is usually regarded by philosophers and historians for its critique of what Nietzsche labels ‘historische Krankheit’. This is for good reason, as Nietzsche’s critique not only targets the famous triad of Monumental, Antiquarian, and Critical historians, but also his contemporary fashions in scientific historiography and teleology as well. What is too often overlooked is that also Nietzsche exposits -- albeit in highly-stylized rhetoric -- an affirmative vision of history. This vision, I argue, returns the reader to the opening sentence of the book, namely, the Ceterum Censeo from Goethe. Nietzsche’s demand that history serve life is a novel application of Goethe’s theory of morphological growth as a consequence of polar competing forces to the realm of history. As Goethe thought living organisms grow by means of intrinsic competitive forces, so Nietzsche thought individuals and cultures grow by means of a history that is, above all, considered as a sort of competitive arena in which to express antagonistic drives.
