The Law and Economics approach to law dominates the intellectual discussion of nearly every doctrinal area of law in the US and its influence is growing steadily outside America as well. 2013 marked the fortieth anniversary of the publication of Richard Posner's Economic Analysis of Law, the book that launched the Law and Economics movement. The eighth edition of the book was published in 2011, this time competing against over twenty textbooks, collections and casebooks on law and economics. What are the alternative theories and how much influence do they exert? What can be considered mainstream today? What are the norms and values underlying this impressive body of research? Due to the confinement imposed by the COVID-19 pandemic situation, companies adopted remote work more than ever. The rapid rise of remote work also affected local life and many employers introduced or extended their telework activities because of the associated advantages. However, despite the evident positive benefits, some employees were pressured to work remotely while ill. This evidence brought new challenges to the presenteeism literature. This article investigates how individual, economic/societal, and organizational/sectorial/supervisory-related variables can moderate the role of a contagious (...) disease, such as the COVID-19, in explaining presenteeism behavior. Moreover, the current research presents a multi-level conceptual model to describe how a new construct of remote-work presenteeism behavior mediates the relationship between different post pandemic health conditions and future cumulative negative consequences. The authors suggested that the widespread pervasive adoption of remote work because of COVID-19 has important implications for the presenteeism literature and opens avenues for further research. This paper explores the aporetic nature of social and historical being as it emerges from a juxtaposition of the philosophies of Castoriadis and Heidegger with specific emphasis on their meditations on history, individuality and collective being. It is argued that any current attempts to grasp the problems posed by historical time should not overlook the conceptual space opened up by contrasting Castoriadis' theorisation of social-historical praxis as the enactment of autonomy expressed through the emergence of the `radically new' with Heidegger's (...) treatment of authentic historicity as fate and repetition. The attempt of both thinkers to break with the philosophical tradition of the West is examined from the perspective of their conceptions on time and history, while their opposing accounts serve to revaluate the traditional dichotomy between allegedly `linear' and `cyclical' conceptions of time. Additionally, it is argued that instead of treating Phenomenological-Hermeneutic and Marxist accounts as adverse and incompatible, our reflections on history and society are enriched by their juxtaposition. Castoriadis and Heidegger present us with the most promising individual cases of thinkers representing these philosophical schools mainly due to their emphasis on the historical dimension of human life and to their overall groundbreaking philosophical elaborations that resist labelling and defy confinement to specific philosophical or epistemic traditions. This article explores the consecutive modifications that phenomenology underwent in the works of Heidegger and Levinas. In particular, it discusses their importance for contemporary attempts to expand — and transcend — phenomenology in philosophy and the social sciences. Heidegger and Levinas responded to the problem of subjectivity — and intersubjectivity — in diametrically opposed ways and consequently the exposition of their thoughts involves focusing on conceptual dichotomies like finitude and infinity, time and eternity. Ultimately, it is argued that the very (...) conceptions of the human being that the two thinkers furnish under the guise of Dasein and Autrui reveal the impasses associated with western metaphysics and pave the path for the development of more adequate theorizations of subjectivity, radical otherness and communal being. Despite the separation between classical and modern theories of government, contributors to Aristotle and Modern Politics find Aristotle a useful interlocutor for assessing both possibilities and limitations in contemporary politics. In this collection, noted political scientists, theologians, and philosophers discuss the magnitude of Aristotle's presence in contemporary debate and demonstrate some of the ways in which Aristotle sheds new light on contemporary problems. This engaging book also exhibits the persistence of political philosophy at a time when the pervasive influence of (...) ideology and historicism lead many to deny its possibility. The paper attempts to walk some first steps toward a unified and empirically oriented theory of both the structure and the history of physics. Physics is considered a structured whole made up of three interconstitutive elements (conceptual system, object, experimental procedures). This conceptual system is always already interpreted while it is this interpretation which ties the system to our overall experience thereby making it understood. It is argued that our experience is always ideologically (and thence socially) determined and that this (...) interpretation inevitably harbours the ideological element in the form of scientifically unwarranted ideological "assumptions." The character of such "assumptions" is discussed, some examples are given and some consequences for the history of physics are drawn. (shrink)

Bachelard's concept of the problématique is used in order to classify physical problems and their interrelations. This classification is effectuated along two dimensions. Along the horizontal dimension, physical problems are divided into the kinds that the different modes of physics' development define. These modes are themselves determined by the interplay among the conceptual system, the object and the experimentation transactions specific to physics. Along the vertical dimension, physical problems are classified according to the different stages of maturation they have to (...) undergo before the process of their solution is effectively undertaken. To determine these maturation stages, the Althusserian conception of ideology is used. The interrelations between physical problems are examined through the introduction and elaboration of the notion interdependence network. (shrink)

The ArgumentStarting from the thesis that a science constructs the knowledge of the part of the world allotted to it, the present paper aims at bringing together all the various aspects of physics under a unified conceptual framework — that provided by the Marxian concept “mode of production.” After an introduction providing the initial plausibility grounds for the undertaking, the concept is analyzed into its conceptual elements in Part I of the paper. The analysis presents the reconstruction initiated by Louis (...) Althusser and developed by his followers. Part II starts from a characterization of physical problems. This offers a basis for “reading” physics in the terms introduced in Part I. The rest of Part II is devoted to the identification of all the aspects of physics with the conceptual elements in question. The paper aims at three things: to uncover the connections holding among seemingly disparate aspects of physics, usually discussed in almost total independence from each other; to take full account of the social dimensions of physics without vindicating social constructivism; to show that the boundaries separating the disciplines of philosophy, history and sociology of science are more arbitrary than usually considered.
