In The Autonomy of Morality Charles Larmore challenges two ideas that have shaped the modern mind. The world, he argues, is not a realm of value-neutral fact, nor does human freedom consist in imposing principles of our own devising on an alien reality. Rather, reason consists in being responsive to reasons for thought and action that arise from the world itself. Larmore shows that the moral good has an authority that speaks for itself. This review article is a discussion of Charles Larmore's book The Autonomy of Morality. After presenting an outline of Larmore's position, it focuses on three critical issues: whether Larmore is right to see Kant as an anti-realist; whether he deals adequately with the threat to autonomy posed by the apparent obligatoriness of morality; and whether he establishes that the constructivist idea of practical reason as self-legislating must really be as unconstrained and empty as he suggests.

The theist thesis that any true ethics must be a religious one is criticized from two different angles; it is shown that: (i) in order to avoid divine voluntarism, theism uses a supposition the acceptance of which makes arguments against autonomous ethics un- acceptable, for they inevitably beg the question; (ii) it assumes a kind of moral foun- dationalism which is, according to some Wittgensteinean arguments, utterly superfluous; the idea that any authoritative ethics needs the absolute authority of God (...) can thus be shown to be unjustified. Critical review of Charles Larmore The Autonomy of Morality.

My aim is to defend Winch's view that morality must be autonomous from religion. I defend him from Mounce's criticism, who claims that unless morality is supported by divine law, moral relativism cannot be avoided. Winch considers the Samaritan's behaviour and says (i) that the background of divine law is irrelevant to the parable; (ii) that we do not need divine law to understand the Samaritan's impossibility to ignore the victim; (iii) and that the absolute moral ought requires (...) no external support provided by religion. Winch adds that God cannot make any moral demand on humans, and thus He cannot reward them with salvation or punish them, without turning Himself into a means of moral corruption. All this spells the end of religion at least as far as the relation between God and man's moral and spiritual life is concerned; while relativism is shown to be morally corrupt and internally inconsistent. Some philosophers have been attracted to the idea that morality is an autonomous domain. One version of this idea is the thesis that non-moral claims are irrelevant to the justification of fundamental normative ethical theories. However, this autonomy thesis appears to be in tension with a pair of apparent features of metaethical theorizing. On one hand, metaethics seemingly aims to explain how morality fits into our broader conception of the world. On the other, metaethical theorizing appears to have (...) potential normative ethical implications. This apparent tension may help to explain some contemporary worries about metaethics as a philosophical project. This paper examines three responses to this tension. The first response seeks to resolve the tension by claiming that metaethical theories must be neutral between normative ethical theories. The second response seeks to eliminate the tension by appealing to a deep divide between practical and theoretical reasoning. I show that each of these responses would require a radical reconception of metaethics. I argue that such a reconception is not required in order to resolve the apparent tension between metaethics and the autonomy thesis. I show that this tension is merely apparent, and can be dissolved without casting doubt on metaethics as a project. I argue that on the picture that results, whether the autonomy thesis is true itself depends upon metaethical fact. (shrink)

Los cuidados paliativos deben manejar los diferentes problemas que los pacientes y las familias pueden tener al final de la vida. La sedación es una maniobra terapéutica utilizada con cierta frecuencia en cuidados paliativos y constituye una buena práctica médica cuando está bien indicada; sin embargo, presenta el riesgo de conculcar algunos principios éticos. Los principios de beneficencia y autonomía son posiblemente los principios éticos mayormente afectados cuando se considera la sedación. Se deben cumplir los siguientes requisitos: síntoma refractario, enfermedad (...) terminal y consentimiento, y en lo posible estar avalada por una segunda opinión médica. La sedación paliativa no es eutanasia y las diferencias están en el objetivo, el proceso y el resultado. En el presente trabajo se discuten algunos de los aspectos para prevenir la conculcación de los principios éticos, asimismo se proporcionan algunas sugerencias para ayudar en la toma de decisiones. Palliative care to the different problems encountered by patients and their families at the end of life. Sedation is a therapeutic manoeuvre frequently used in palliative medicine, that could eventually infringe some ethical principles. From our standpoint, beneficence and autonomy are probably the most affected principles when sedation is considered. The following conditions are required in order for it to be applied: refractory symptom, terminal illness and consent, and as long as possible, the decision must be supported by a second medical opinion Palliative sedation is different from euthanasia, and the differences lie in the objective, the pro- cess and the result. Some measures to prevent such violations to occur are discussed, and suggestions intended to guide in decision making are proposed. (shrink)

Background The birth plan is a tool that allows the self-learning and thoughtful analysis of the women during the birthing process, facilitating their making of decisions and participation, in agreement with the bioethical principles of autonomy and no malfeasance. Goal: To understand the perception and satisfaction of women who presented a birth plan. Methodology: Qualitative, descriptive, observational, retrospective and cross-sectional study. The population of the study was composed of 21 women who presented a birth plan regulated in a Hospital (...) ever since the recording of the presentation of the birth plan was started until 2015. Place: Cartagena. Techniques/methods: Semistructured interview. Results-Discussion: Most women considered the plan as a useful self-learning tool on the meaning of the birthing process, as it favored the communication between the expectant mothers/health professionals. Our informants sought information related to the birthing process from informal sources; most perceived a level of respect of their wishes during the process of giving birth. The use of the birth plan did not imply the perception of loss of the degree of control during the birth, although attention to the written document could be improved. Conclusions The use of the birth plan is a very satisfactory and useful experience for their involvement in their self-care, although in some cases, the births did not proceed according to their plans. Nevertheless, the prevalence of the principle of Non-Malfeasance over Autonomy was evidenced. (shrink)

This paper sheds light on Kant’s notion of autonomy in his moral philosophy by considering Kant’s critique of the rationalist theories of morality that Kant discussed in his lectures on practical philosophy from the 1760s to the time of the Groundwork. The paper first explains Kant’s taxonomy of moral theories and his perspective on the history of ethics. Second, it considers Kant's arguments against the two main variants of ‘rationalism’ as he construes it, that is, perfectionism and (...) theological voluntarism, pointing out the similarities to previous criticisms. Third, the paper argues that Kant’s discussion of the 'rationalist' views does not amount to an unqualified dismissal, but to an attempt at working out a novel rationalist position. Kant’s criticisms of rationalist views suggest that his project emerges from the failures of previous rationalism, with the aim to work out a rationalist view that can account for moral obligation by integrating insights from the theological conception. The combination of perfectionism and theological views yields the basic outline of the idea of autonomy, consisting in the lawgiving function of a rational will as a key to the legislation of a necessary law. Autonomy is the central idea of modern practical philosophy. Understood as self-legislation, autonomy seems to require that the validity of norms depends on recognition, namely, that their addressees, being autonomous agents, recognise these norms to be valid. But how can one be bound by norms whose validity depends on their being recognised as valid by their addressees? The questions of how autonomous morality and, on this basis, the authoritative character of law can be understood, present persistent puzzles that (...) have been widely discussed, but still await a satisfactory solution. This book presents an analysis of the idea of autonomy as self-legislation and its consequences for law and morality. It links the idea of autonomy with the idea of the balancing of normative arguments, develops a notion of normative arguments as distinct from normative judgements and statements and explains claims to correctness and objectivity that are found in normative discourse. Thus, a 'logic of autonomy' emerges, and it is pervasive in normative reasoning. It connects theses regarding the logic of norms, the structure of balancing, human and fundamental rights, legal validity, legal interpretation, and the relations among legal systems, offering a theory of central elements of normative argumentation, a theory that is undergirded by the mutual relations that exist between and among its parts as well as through the relations that it bears to other theories. Moreover, it offers an alternative to Kantian notions of autonomy and provides solutions to problems that other theories have failed to master. (shrink)

Grounded in achievement goal theory and self-determination theory, the aim of this study was to analyze the motivational determinants of precompetitive anxiety in the sports context, considering the horizontal motivational sequence: adaptive social factors, competence need, types of motivation, and consequences. This study was also conducted in order to analyze the mediating role of the need for competition and motivational regulations on social factors and consequences. The sample consisted of 217 athletes of both sexes engaged in elite sport, who answered (...) a series of questionnaires to measure study variables to develop an analysis of the structural equation model. The results showed that both the task-involving climate and autonomy support were associated with competence need, and competence need was associated with autonomous motivation in a positive way and with controlled motivation and amotivation in a negative way. On the other hand, autonomous motivation was positively associated with self-confidence, while amotivation was positively related to somatic and cognitive anxiety before a competition. Furthermore, there was a total mediation of competence need and autonomous motivation between task climate and self-confidence. In conclusion, these social factors favor self-confidence, and besides, these climates disfavor anxiety before a sport competition. (shrink)

It is a common view that artificial systems could play an important role in dealing with the shortage of caregivers due to demographic change. One argument to show that this is also in the interest of care-dependent persons is that artificial systems might significantly enhance user autonomy since they might stay longer in their homes. This argument presupposes that the artificial systems in question do not require permanent supervision and control by human caregivers. For this reason, they need the (...) capacity for some degree of moral decision-making and agency to cope with morally relevant situations (artificial morality). Machine ethics provides the theoretical and ethical framework for artificial morality. This article scrutinizes the question how artificial moral agents that enhance user autonomy could look like. It discusses, in particular, the suggestion that they should be designed as moral avatars of their users to enhance user autonomy in a substantial sense. (shrink)

Why can't we own people? Boyer proposes that the key consideration concerns inclusion in the moral circle. I propose an alternative, which is that specific mental capacities, especially the capacity for autonomy, play a key role in determining judgments about human and animal ownership. Autonomous beings are viewed as owning themselves, which precludes them from being owned by others.

Informed consent bears significant relevance as a legal basis for the processing of personal data and health data in the current privacy, data protection and confidentiality legislations. The consent requirements find their basis in an ideal of personal autonomy. Yet, with the recent advent of the global pandemic and the increased use of eHealth applications in its wake, a more differentiated perspective with regards to this normative approach might soon gain momentum. This paper discusses the compatibility of a (...) class='Hi'>moral duty to share data for the sake of the improvement of healthcare, research, and public health with autonomy in the field of data protection, privacy and medical confidentiality. It explores several ethical-theoretical justifications for a duty of data sharing, and then reflects on how existing privacy, data protection, and confidentiality legislations could obstruct such a duty. Consent, as currently defined in the General Data Protection Regulation – a key legislative framework providing rules on the processing of personal data and data concerning health – and in the recommendation of the Council of Europe on the protection of health-related data – explored here as soft-law – turns out not to be indispensable from various ethical perspectives, while the requirement of consent in the General Data Protection Regulation and the recommendation nonetheless curtails the full potential of a duty to share medical data. Also other legal grounds as possible alternatives for consent seem to constitute an impediment. (shrink)

Legal restrictions of the right to self-determination increasingly pretend to be compatible with the liberal concept of autonomy: they act upon a ‘soft’ or autonomy-orientated paternalistic rationale. Conventional liberal critique of paternalism turns out to be insensitive to the intricate normative problems following from ‘soft’ or ‘libertarian’ paternalism. In fact, these autonomy-oriented forms of paternalism could actually be even more problematic and may infringe liberty rights even more intensely than hard paternalistic regulation. This paper contributes to the (...) systematic differentiation of soft and hard paternalism by discussing the (legal) concept of autonomy and elaborates the moral and legal limits of autonomy-orientated paternalism. Kant takes the idea of autonomy of the will to be his distinctive contribution to moral philosophy. However, this idea is more nuanced and complicated than one might think. In this chapter, I sketch the rough outlines of Kant’s idea of autonomy of the will while also highlighting contentious exegetical issues that give rise to various possible interpretations. I tentatively defend four basic claims. First, autonomy primarily features in Kant’s account of moral agency, as the (...) condition of the possibility of moral obligation. Second, autonomy amounts to a metaphysical property as well as a normative principle and a psychological capacity. Third, although there is legitimate scholarly disagreement about whether or not autonomy involves self-legislation of the moral law, there is good reason to believe it underwrites an ‘inside-out’ (as opposed to ‘outside-in’) conception of the relationship between the will and moral requirements. Fourth, persons have dignity because their autonomy makes them members in the set of beings over whom the categorical imperative requires us to universalise our maxims, not because autonomy is an independently important property. Human morality may be thought of as a negative feedback cotrol system in which moral rules are reference values, and moral disapproval, blame, and punishment are forms of negative feedback given for violations of the moral rules. In such a system, if moral agents held each other accountable, moral norms would be enforced effectively. However, even a properly functioning social negative feedback system could not explain acts in which individual agents uphold moral rules in (...) the face of contrary social pressure. Dr. Frances Kelsey, who withheld FDA approval for thalidomide against intense social pressure, is an example of the degree of individual moral autonomy possible in a hostile environment. Such extreme moral autonomy is possible only if there is internal, psychological negative feedback, in addition to external, social feedback. Such a cybernetic model of morality and moral autonomy is consistent with certain aspects of classical ethical theories. (shrink)

REX University of California, Berkeley The Autonomy of Reason: A Commentary on Kant's "Groundwork of the Metaphysic of Morals." By Robert Paul Wolff. (New York: Harper & Row, 1975. Pp. x + 228. $12.50) The Autonomy of Reason reflects Wolff's determination to get out of Kant's system what is good and to get out of Kant's system for good. It thus burns with the conflicting passions of a devoted student who has learned much from a reserved teacher but who now finds it imperative to break with him for precisely the reasons that attracted him initially. This explains why much of the book reads like a declaration of independence yet is based on a sympathetic, even immanent, critique of Kant addressed to Wolff himself. Although he is addressing himself, others may share and will certainly benefit from Wolff's two decades of intense study of Kant. Without question Wolff has written a provocative and important book. Contrary to its title, however, it is not really about the autonomy of reason; and contrary to its subtitle, it is only partly a commentary on Kant's Groundwork. It serves, rather, as a propaedeutic to Wolff's own moral and political views. I believe this at least accounts for some of the puzzling features of the book: its highly personal nature, its style of philosophical commentary, and its devastating introduction. Wolff does not see his task as one of either historical exegesis or philosophical criticism. In the place of both Whiff proposes a "philosophical reconstruction" of the text. This is both desirable and necessary, he says, because "of all the great philosophers, there is none so rich in insights and so plagued by inconsistency as Kant" (p. 4). The resulting reconstruction will be worthwhile provided that affirmative answers can be given to two questions: "Does the interpretation developed here illuminate the text, so that at least some of what Kant says is clearer and more plausible in the light of it; and, more important still, does the interpretation result in an argument whose independent philosophical merit justifies the effort spent grappling with Kant?" (p. 5). A third question suggests itself: would Kant recognize himself as the author of the reconstructed text? This question one must answer in the negative, for the Groundwork that emerges, although certainly Kantian, does not accurately reflect Kantianism. To the extent that this is a criticism, it is so only because the book advertises itself as a commentary. In short, Wolff's book is similar to Strawson's Bounds of Sense in that the value of both lies in salvaging something of worth from the sunken hulk of Kantianism. Wolff's Introduction is particularly revealing, for it consists of a sustained attack on several BOOK REVIEWS 483 of Kant's central metaphysical claims, an attack which, if successful, undermines much of his ethics. Those of us who are sympathetic to Kantian ethics usually are so because we regard it as an ethics of autonomy, based on rational self-esteem and respect for the human capacity to direct one’s own life according to rational principles. Kantian ethical theory is grounded on the idea that the moral law is binding on me only because it is a law proceeding from my own will. The ground of a law of autonomy lies in the very (...) will which is to be subject to the law, and this leaves no room for any issue about why this will should obey the law. The idea of autonomy also identifies the authority of the law with the value constituting the content of the law, in that it bases the law on our esteem for the dignity of rational nature in ourselves, which makes every rational being an end in itself. The present paper is focused on how the acceptance of the emotional basis of morality can change the way we approach moral problems, concretely the case of moral autonomy. Is it posible to include the role of emotions in moral agency without losing moral autonomy? Simultaneously, it seems hard provide an account on moral agency without accepting as a premise the existence of moral autonomy. Thus, all this lead us to a (...) picture where the assumtion of a premise implies the denial of another one , and viceversa. With regard to this paradox, the question is therefore how these two facts —that we are necessarily emotional and autonomous— can become compatible. In this sense, I will argue that emotions are not an obstacle but a necessary element to moral autonomy. (shrink)

Thomas Reid has the unusual distinction of arriving at a metaethical position very much like G. E. Moore’s via a route very similar to that employed by the Kantians. That is, Reid embraces a version of nonnaturalist moral realism by appeal not to open question-style considerations but to a particular account of agency. In this essay, we reconstruct Reid’s agency-centered argument for his constitutivist version of moral nonnaturalism, highlighting its commitments. Having presented Reid’s argument, we close by considering (...) a prominent contemporary Kantian view, namely, Christine Korsgaard’s, and identifying where, despite their common commitments, Reid and Korsgaard part company. The comparison, we suggest, is instructive because it allows us to see more clearly why the link between agency-centered approaches to ethical theorizing and nonrealist, constitutivist views of morality, such as Korsgaard’s, is deeply contingent. This chapter aims to situate Kant’s account of practical reason in metaethical debates. First, it explains the reasons why it is legitimate and instructive to discuss Kant’s relevance in contemporary metaethics, hence addressing some issues about the intended scope of metaethics and its relation to practical reason and psychology. Second, it defends an interpretation of Kant’s conception of autonomy, which avoids some paradoxes traditionally associated with self-legislation. Third, it shows that constructivism best captures Kant’s conception of practical reason and (...) of its authority. Kantian constructivism is defended as a self-standing metaethical theory, which is designed to account for the objectivity and unconditional authority of practical knowledge, on the basis of standards congruent with shared subjective experience. This version of constructivism, adopting a “dialogical” interpretation of the autonomy of rational will, explains how finite rational agents are obligated and bound by the moral law. (shrink)

Drawing on the built environment concept of “inclusive design” and its emphasis on creating accessible environments for all persons regardless of ability, I suggest that a central task for feminist disability theory is to redesign foundational philosophical concepts to present opportunities rather than barriers to inclusion for people with disability. Accounts of autonomy within liberal philosophy stress self-determination and the dignity of all individual persons, but have excluded people with intellectual disability from moral and political theories by denying (...) their capacity for individual autonomy, seen as a chief marker of moral personhood. This paper modifies and extends feminist theories of relational autonomy by arguing for the need to view autonomy as a feature of persons that is manifested only through relations of support, advocacy, and enablement. An “inclusively designed,” relational account negotiates the tensions encountered in attempts to apply autonomy to people with high support needs, and politicizes the concept as an advocacy tool for people with intellectual disability and their allies.
