In this paper we prove the equiconsistency of "Every $\omega_1$-tree which is first order definable over has a cofinal branch" with the existence of a $\Pi^1_1$ reflecting cardinal. We also prove that the addition of MA to the definable tree property increases the consistency strength to that of a weakly compact cardinal. Finally we comment on the generalization to higher cardinals.

This article tackles Giorgio Agamben's critique of Michel Foucault's genealogy of governmentality in two ways: first, by presenting an alternative model of the relations between pastoral and theological economy and, second, by conducting a genealogy of the former as revealed in the state of exception, when canon law is suspended. Following the author's genealogy of oikonomia in the state of exception, he argues that politics and economy are distinct from one another by virtue of the fact that the primary relation (...) of the latter is one of inclusion while that of the former is one of exclusion. Finally, the author traces three of oikonomia's prolific qualities in the operation of governmentality in civil society and of market economy: its inclusiveness; the constant representation of the irreconcilability of law and authority; and its operation by accommodating to the ways of the governed. The article reviews the uses of the term ‘oikonomia’ in Greek-speaking antiquity and illustrates how the term was used in all spheres of human existence and in various arts and sciences, usually denoting the prudent dispensation of the field resources. In this era the arts and sciences also received their own economies, and the term oikonomia, designating in most cases the prudent management of resources, appears in political theory, military strategy, law, finance, medicine, literary criticism, architecture, music, history and rhetoric. (...) Among all the spheres, arts and sciences that were economized, the story of oikonomia in the field of rhetoric is at the center of this article’s attention. As shown, the concept of oikonomia took an intermediate form between the realm of thought – that is, the domain of philosophy – and the realm of public speech – the domain of politics. (shrink)

When harm is caused by multiple injurers, damages are allocated among the responsible injurers in proportion to their relative responsibility for harm. This Article shows that a proportional allocation of liability between strictly-liable injurers distorts incentives to take precautions. The effects of this distortion depend on the nature of the injurers’ precautions. If precautions are complements, injurers compete for lower liability shares, which results in excessive care-taking. If precautions are substitutes, injurers are afflicted by moral hazard, which gives rise to (...) insufficient care-taking. By illuminating injurers’ strategic incentives, this Article highlights a tension between equity and efficiency under a proportional allocation of liability. (shrink)

The present study tested the existence of a cognitive schema that guides people's evaluations of the likelihood that observed problem-solving processes will succeed. The hypothesised schema consisted of attributes that were found to distinguish between retrospective case reports of successful and unsuccessful real world problem solving (Lipshitz & Bar Ilan, 1996). Participants were asked to evaluate the likelihood of success of identical cases of problem solving that differed in the presence or absence of diagnosis, the selection of appropriate or inappropriate (...) solutions, and the pairing of diagnosis with appropriate or non-appropriate solutions. Consistent with the proposition, diagnosis affected perceived likelihood of success, albeit only when solution quality was held constant, and appropriate diagnosis with a compatible solution produced higher perceived likelihood of success than appropriate diagnosis with incompatible solutions. In addition, results showed that solution quality played a significant role, and that compatibility with a six-phase rational model of problem solving played no role in judging likelihood of success.
