In 1999, Dan Zahavi’s Self Awareness and Alterity: A Phenomenological Investigation initiated a critique of the standard interpretation of the distinction between the second and third levels of Husserl’s analysis of time-constituting consciousness. At stake was the possibility of a coherent account of self-awareness (Zahavi’s concern), but also the possibility of prereflectively distinguishing the acts of consciousness (Brough and Sokolowski’s rebuttal of Zahavi’s critique). Using insights gained from Husserl’s Analyses Concerning Passive Synthesis rather than the work on time-consciousness, this paper (...) provides a new, more precise vocabulary in which to carry on the debate, in the hopes of bringing it to a mutually satisfactory resolution. After briefly laying out the terms of the Zahavi–Brough/Sokolowski debate (Sect. 2), I then elaborate a three-fold distinction in consciousness from the Analyses (Sect. 3) and relate that back to the issue of objectivity in the debate (Sect. 4). I end by suggesting how this three-fold model from the Analyses helps us preserve the essentially tripartite structure (as Brough and Sokolowski insist we do) while not making one of these levels the object of another (in keeping with Zahavi’s critique) (Sect. 5). This book stems from more than 30 years of experience in the development of practical law enforcement ethics training. It is written based on the real-world application of a wide variety of approaches to enhancing ethics awareness and decision-making skills. There has been an explosion of efforts to increase the emphasis on ethics in law enforcement. The most effective of these efforts involve our law enforcement officers themselves in (1) sharing ideas, experiences, and wisdom with each other and (2) analyzing (...) long-term consequences in a risk-free learning environment, before the need arises for making actual decisions or engaging in conduct. Accomplishing those objectives can be attempted with a variety of formats, presentations, and approaches. Instead of being shown how to “teach” ethics, readers will be given material and ideas on how to enhance existing ethics awareness and ethics skills with their personnel. Readers are provided with pointers on talking with staff, not “at” them, in order to foster awareness about how ethical values and standards to which they already subscribe apply in real-world law enforcement decision-making and conduct. A unique aspect of this text is that it is written primarily for line sergeants and lieutenants to use with their own in-service personnel. It contains material that is designed to be easy-to-present and non-intimidating. It is adaptable to briefings of limited duration as well as longer training sessions. There is substantial content to enable an agency to maintain an on-going program of recurrent, short-but-meaningful discussions with and among personnel. Most importantly, it is practical and down-to-earth–not theoretical or abstract. Also, the book is based on the belief that with a combination of interest and practice, any sergeant or lieutenant, or any officer or deputy, can overcome any self-perceived weakness and become an accomplished “ethics awareness discussion leader.” In addition to its primary audience, the book will also be a helpful resource for field-training officers, senior officers, non-sworn personnel, and law enforcement executives. Despite a long period of neglect, research on emotion in organizational behavior has developed into a major field over the past 15 years, and is now seen to be part of an affective revolution in the organization sciences. In this article, we review current research on emotion in the organizational behavior field based on five levels of analysis: within person, between persons, dyadic interactions, leadership and teams, and organization-wide. Specific topics we cover include affective events theory, state and trait affect (...) and mood, emotional intelligence, emotional labor, emotional contagion, emotions and leadership, and building a healthy emotional climate. Jurors’ emotions, both integral and incidental, can affect their attributions of legal responsibility and blame in several, sometimes complexly interrelated ways. The article reviews the experimental research, outlining the multiple paths of emotional influence, and explains why identifying them is worthwhile. It then discusses why the modest to moderate effect sizes found in the research may understate emotions’ actual influence in some cases yet overstate it in others, and discounts moral intuitionism as a reason for believing that emotional influences in (...) real cases are stronger than the experimental data indicates. The most prominent recent attack on compatibilism about determinism and moral responsibility is the so-called manipulation argument, which presents an allegedly responsibility-undermining manipulation case and then points out that the relevant facts of that case are no different from the facts that obtain in an ordinary deterministic world. In a recent article in this journal, however, Matt King presents a dilemma for proponents of this argument, according to which the argument either leads to a dialectical stalemate or else is dialectically (...) infelicitous. This paper reports the results of a survey of ethical attitudes, values, and propensities in public sector employees in Australia. It was expected that demographic variables, personal values, and contextual variables at the individual level, and group- and organisational-level values would predict use of formal codes of ethics and ethical tolerance (tolerance of unethical behaviour). Useable data were received from 500 respondents selected at random across public sector organisations in a single Australian state. Results supported the study hypotheses, but indicated (...) that different mechanisms underlie each of the criterion variables. Use of ethical codes was determined primarily on the basis of a perception that others use the code, while ethical tolerance was determined by personal values. At an applied level, the research highlights the need for orgasnizations to establish a critical mass of code users, so that this operates as a normative influence on others in the organization.
