Many important regulatory decisions are taken by professionals employing limited and conflicting evidence. We conduct an experiment in a merger regulation setting, identifying the role of different standards of proof, volumes of evidence, cost of error and professional or lay decision making. The experiment was conducted on current practitioners from 11 different jurisdictions, in addition to student subjects. Legal standards of proof significantly affect decisions. There are specific differences because of professional judgment, including in how error costs and volume of (...) evidence are taken into account. We narrow the range of explanations for why professional decision making matters. (shrink)

Formalised knowledge systems, including universities and research institutes, are important for contemporary societies. They are, however, also arguably failing humanity when their impact is measured against the level of progress being made in stimulating the societal changes needed to address challenges like climate change. In this research we used a novel futures-oriented and participatory approach that asked what future envisioned knowledge systems might need to look like and how we might get there. Findings suggest that envisioned future systems will need (...) to be much more collaborative, open, diverse, egalitarian, and able to work with values and systemic issues. They will also need to go beyond producing knowledge about our world to generating wisdom about how to act within it. To get to envisioned systems we will need to rapidly scale methodological innovations, connect innovators, and creatively accelerate learning about working with intractable challenges. We will also need to create new funding schemes, a global knowledge commons, and challenge deeply held assumptions. To genuinely be a creative force in supporting longevity of human and non-human life on our planet, the shift in knowledge systems will probably need to be at the scale of the enlightenment and speed of the scientific and technological revolution accompanying the second World War. This will require bold and strategic action from governments, scientists, civic society and sustained transformational intent. (shrink)

It is the presumptive thesis of William Lyons that an examination of introspection, though more a historical than a current topic in philosophy and psychology, still has much substance for today's scholar. By introspection, he means the direct access to mental knowledge, as it has been written about over the centuries from Augustine to Descartes to the empiricists, and as it has been developed in the late nineteenth and early twentieth centuries as an experimental method in psychology by Wundt, (...) James, and Titchener. Lyons is chiefly concerned with whether introspection exists as a possible form of knowing, not with its applications. Since he finds all past attempts to demonstrate the valid existence of introspection unsatisfactory, he turns to contemporary philosophy and psychology to determine whether, even if they cannot justify introspection, they can shed light on why such a long-running conceptual illusion existed in the past and, in several guises, continues to exist. Here Lyons puts us on contemporary ground with descriptions of brain scanners, Turing machines, computer-program possibilities, behaviorist tactics, and Rylean moves. The first section bears the general title "The Dethronement of Introspection," while the second section, emphasizing the computer models of Daniel Dennett, is titled "The Mechanization of Introspection." But, unhappily, all the contemporary approaches are also judged unsatisfactory in justifying introspection. We are, however, given some hints that the illusion of introspection's existence must rest in our culture's folk psychology, "which has changed little over the last thousand years or more.". This is a review article of two recent, complete translations of the Arabian Nights, in French by André Miquel and Jamel Eddine Bencheikh and in English by Malcolm Lyons, respectively.

Between the American Revolution and the Civil War many Americans professed to reject altogether the notion of adhering to tradition, perceiving it as a malign European influence. But by the beginning of the twentieth century, Americans had possibly become more tradition-minded than their European contemporaries. So argues Michael D. Clark in this incisive work of social and intellectual history. Challenging reigning assumptions, Clark maintains that in the period 1865 to 1942 Americans became more conscious of tradition as a social force, (...) viewed it more positively, and used it more eclectically and selectively for personal and social enrichment. Clark expands upon the existing body of scholarly work by clearly distinguishing tradition from other ways of relating to the past and by studying particular traditions that shaped American thought and culture. He gives primary attention to five individuals who represent the growing influence of tradition in this period: the popular philosopher and historian John Fiske, representing Anglo-American tradition; the Virginia historians Philip Bruce and Lyon G. Tyler, representing a southern variation on a national tradition; the country's leading neo-Gothic architect, Ralph Adams Cram, representing a surprisingly pervasive medieval tradition; and the sociologist Charles H. Cooley, representing views on immigrant traditions. Clark examines how the idea of tradition, initially associated with family home and local town, was carried outward to the larger sphere and applied to promote American expansionism -- territorially, economically, and demographically. Tradition was also used as a weapon by well-entrenched social groups in struggles over power and values. It offered a sense of stability in a time of unsettling technological and sociological change. Ironically, Clark shows, `traditionalists of this era helped to create a modern sensibility by opposing the Victorian linear sense of history and employing instead historical cycles and typology as ways to bridge past and present. The American Discovery of Tradition, 1865--1942 describes a period of time when the social and intellectual forces of tradition and modernity converged in the United States. America was both a nation looking back, now having a memory of its own past, and a nation looking forward to future progress. Clark's book reveals the shaping of the modern American self and its distinctive attitude -- both positive and negative -- toward tradition. (shrink)

I hope to persuade Charles Fried to think again about his developing views on distributive justice. Since I live at a certain remove from Cambridge, the best I can offer is a hypothetical dialogue with an imaginary person whose views seem, to me at least, of a Friedian inspiration. My central question deals with the way Fried establishes his rights to things he candidly concedes he does not deserve. To present my problems, I shall begin with a simpler case than (...) those – involving kidneys and talents – that Fried makes central to his discussion. Rather than starting with these rather special goods, I find it clarifying to focus first on more garden variety commodities – which, to emphasize their character, I shall call apples. (shrink)

An introduction to the philosophy of law, which offers a modern and critical appraisal of all the main issues and problems. This has become a very active area in the last ten years, and one on which philosophers, legal practitioners and theorists and social scientists have tended to converge. The more abstract questions about the nature of law and its relationship to social norms and moral standards are now seen to be directly relevant to more practical and indeed pressing questions (...) about the justification of punishment, civil disobedience, the enforcement of morality, and problems about justice, rights, welfare, and freedom. John Stuart Mill's connection with the Irish question spanned more than four decades and embraced a variety of elements. Of his writings on Ireland, the best known are his forty-three Morning Chronicle articles of 1846–47 composed in response to the Famine, the section of the Principles of Political Economy that treats the issue of cottier tenancy and the problem of Irish land, and, most conspicuous of all, his radical pamphlet England and Ireland, published in 1868. All of these writings take (...) the land question as their paramount concern. The fairly absorbing interest in the subject disclosed by Mill during the second half of the 1840s arose from the fortuitous conjuncture of the disaster unfolding in Ireland and his engagement with the principles of political economy. Between 1848 and 1871 Mill's Principles went through seven editions and the substantive revisions he made in the section on Ireland from one edition to the next illumine both the essence and the accidentals of his bearing towards that country. Mill's cogent and controversial advocacy of fixity of tenure in England and Ireland constituted the heart of his answer to the Fenian challenge. The land question aside, Mill was drawn into the battle over the Irish university system in the 1860s largely through his friendship with John Elliot Cairnes, professor of jurisprudence and political economy at the Queen's College Galway. On this subject, however, Mill wrote almost nothing for publication. The longest single piece he ever drafted on Ireland was his first, an essay that predated the Morning Chronicle articles by two decades. In his own bibliography this essay is referred to as ‘An article on the Catholic Question which appeared in the Parliamentary Review for 1825’. Although the essay of 1825 could justly have borne the same title as the pamphlet of 1868, the particulars of course differ markedly. Ireland never ceased to pose a question during the course of the nineteenth century, but the dynamics shaping that question changed much between the mid-1820s and the late 1860s. Even so, the 1825 essay prefigures something of Mill's later involvement with the Irish question, and also invites examination as a quite remarkable piece of political journalism from the pen of a young man not yet twenty, who would subsequently establish himself as the most influential thinker of his generation. In a recent article in Religious Studies, Professor P. W. Gooch attempts to wean the orthodox Christian from anthropological materialism by consideration of the question of the nature of the post-mortem person in the resurrection. He argues that the view that the resurrected person is a psychophysical organism who is in some physical sense the same as the ante-mortem person is inconsistent with the Pauline view of the resurrected body; rather, according to him, Paul's view is most consistent with that (...) which affirms the disembodied survival of the person. ‘I want to argue’, he writes, ‘for the thesis that a Pauline resurrection body may well be ontologically the same as a disembodied person.’ I intend to show that Professor Gooch has failed to provide any support for this view and indeed that his own view falls prey to the criticisms which he has raised against other views. In an attempt to make the idea of surviving one's own death in a disembodied state intelligible, H. H. Price has presented a possible description of what the afterlife might be like for a disembodied self or consciousness. Price suggests that the world of the disembodied self might be a kind of dream or image world. In it he would replace his present sense-perception by activating his image-producing powers, which are now inhibited by their continuous bombardment by sensory stimuli, to (...) produce mental images. Though he would be cut off from any new supply of sensory material, he might be able to draw upon his memory of his previous physical existence to create an entire environment of images. A nexus of perspectively inter-related images would constitute an object; this would serve as a substitute for the material objects which he perceived in his past life. The entire environment of the disembodied individual would be composed of such families of mental images and would serve to constitute his world. It need not, however, be a solipsistic world, for by means of telepathy the discarnate individual could communicate with other disembodied selves and in this way acquire new information. Price notes that since this world would be as real to the discarnate self as our present world is to our embodied self, in the afterlife the disembodied self in effect would create for itself a real world, though of course if it took it to be anything other than an image world it would be deceiving itself. Bruce Janz, Jessica Locke, and Cynthia Willett interact in this exchange with different aspects of Chakravarthi Ram-Prasad’s book Human Being, Bodily Being. Through “constructive inter-cultural thinking”, they seek to engage with Ram-Prasad’s “lower-case p” phenomenology, which exemplifies “how to think otherwise about the nature and role of bodiliness in human experience”. This exchange, which includes Ram-Prasad’s reply to their interventions, pushes the reader to reflect more about different aspects of bodiliness.

I respond to Jonathan Chimakonam’s paper in which he presents an approach to dialogue in philosophical space, and raises questions about my own approach. I raise four questions to his understanding of conversation. First, I ask him for more details on his conception of conversation. Second, what happens if not everyone cares to enter into conversation? Third, is conversation a prerequisite to philosophy, or a part of philosophy? And fourth, how does wonder fit into conversation in and about place?

One of the more sustained efforts to think beyond current academic structures has been launched by CIRET, the International Centre for Transdisciplinary Research, in Paris. This centre was involved in the First World Congress of Transdisciplinarity, in Portugal, 1994, and another international congress in Locarno, Switzerland, in early May 1997. They have a project with UNESCO on transdisciplinarity, and are involved in the World Conference on Higher Education, to be held in Paris at the end of September 1998.

This collection brings together previously unpublished works by well-known philosophers on the philosophy of action, the metaphysics of causality, and the philosophy of psychology. Nine of the essays directly discuss Donald Davidson's work on these topics, while three others challenge a Davidsonian approach through discussion of independent but related issues. These essays are followed by replies from Davidson, including a previously unpublished essay, "Adverbs of Action.".

Dr Lyons starts by giving a thorough and critical survey of other principal theories, before setting out his own 'causal-evaluative' account. In addition to giving an analysis of the nature of emotion - in which, Dr Lyon argues, evaluative attitudes play a crucial part - his theory throws light on (...) the motivating role of emotions in our lives, our attitudes towards our emotions and our responsibility for them. This essay reads John Locke’s Two Treatises through its nonhuman animal presences, especially the emblematic figures of cattle and “noxious creatures” like “lyons,” “tygers,” and wolves. It argues that the real ground of Lockean human equality is an ongoing practice of subjugating nonhuman animals, and not any attribute of the human species as such. More specifically, the Lockean social compact founded on this equality relies on a “dominion covenant,” an existential “agreement” in which God lends the power of dominion (...) to man and any threats to this order require punishment. This dynamic enables violence toward humans, in the name of their humanity, if they do not properly exert their power of dominion. Critics have connected Locke’s theory of property to indigenous dispossession and his theory of punishment to carceral systems; both processes, I argue, intimately rely on the dominion covenant. Lockean racism is the fulfillment of, and not a deviation from, his account of human equality. (shrink)

Sir John Lyons’s Linguistic Semantics: An Introduction (Cambridge, UK: Cambridge University Press, 1995) is a tolerable addition to the list of half a dozen or so impressive titles he has produced on linguistic subjects over the years. This book was initially planned to be a second edition of his Language, Meaning and Context (Lyons, 1981). However, in the end it turned out to be a successor and replacement. For it is, in the author’s words, a very different book (...) compared to the 1981 volume: it is much longer, treats topics missing in the earlier volume, and is written in a different style. I defend a moderate (neither extremely conservative nor extremely liberal) view about the contents of perception. I develop an account of perceptual kinds as perceptual similarity classes, which are convex regions in similarity space. Different perceivers will enjoy different perceptual kinds. I argue that for any property P, a perceptual state of O can represent something as P only if P is coextensive with some perceptual kind for O. 'Dog' and 'chair' will be perceptual kinds for most normal people, 'blackpool (...) warbler' for the expert birdwatcher but not for the rest of us, 'dangerous', 'familiar', or 'meaning that the cat is on the mat' for none of us. In Against Moral Responsibility, Bruce Waller launches a spirited attack on a system that is profoundly entrenched in our society and its institutions, deeply rooted in our emotions, and vigorously defended by philosophers from ancient times to the present. Waller argues that, despite the creative defenses of it by contemporary thinkers, moral responsibility cannot survive in our naturalistic-scientific system. The scientific understanding of human behavior and the causes that shape human character, he contends, leaves no room for moral responsibility. (...) Waller argues that moral responsibility in all its forms--including criminal justice, distributive justice, and all claims of just deserts--is fundamentally unfair and harmful and that its abolition will be liberating and beneficial. What we really want--natural human free will, moral judgments, meaningful human relationships, creative abilities--would survive and flourish without moral responsibility. In the course of his argument, Waller examines the origins of the basic belief in moral responsibility, proposes a naturalistic understanding of free will, offers a detailed argument against moral responsibility and critiques arguments in favor of it, gives a general account of what a world without moral responsibility would look like, and examines the social and psychological aspects of abolishing moral responsibility. Waller not only mounts a vigorous, and philosophically rigorous, attack on the moral responsibility system, but also celebrates the benefits that would result from its total abolition. (shrink)

The authors bring a fresh approach to the traditional challenges of a critical thinking course: effectively explaining the nature of validity, (...) assessing deductive arguments, reconstructing, identifying and diagramming arguments, and causal and probabilistic inference. Additionally, they discuss in detail, important, frequently neglected topics, including testimony, including the evaluation of news and other information sources, the nature and credibility of science, rhetoric, and dialectical argumentation. The treatment of probability uses frequency trees and a frequency approach more generally, and argument reconstruction is taught using argument maps; these methods have been shown to improve students’ reasoning and argument evaluation. William Lyons presents an original thesis on introspection as self-interpretation in terms of a culturally influenced model. His work rests on a lucid, careful, and critical examination of the transformations that have occurred over the past century in the concepts and models of introspection in philosophy and psychology. He reviews the history of introspection in the work of Wundt, Boring, and William James, and reactions to it by behaviorists Watson, Lashley, Ryle, and Skinner.

Is perception cognitively penetrable, and what are the epistemological consequences if it is? I address the latter of these two questions, partly by reference to recent work by Athanassios Raftopoulos and Susanna Seigel. Against the usual, circularity, readings of cognitive penetrability, I argue that cognitive penetration can be epistemically virtuous, when---and only when---it increases the reliability of perception.

In this book, Bruce Waller attacks two prevalent philosophical beliefs. First, he argues that moral responsibility must be rejected; there is no room for such a notion within our naturalist framework. Second, he denies the common assumption that moral responsibility is inseparably linked with individual freedom. Rejection of moral responsibility does not entail the demise of individual freedom; instead, individual freedom is enhanced by the rejection of moral responsibility. According to this theory of "no-fault naturalism," no one deserves either (...) blame or reward.In the course of arguing against moral responsibility, Waller critiques major compatibilist arguments-by Dennett, Frankfurt, Strawson, Bennett, Wolf, Hampshire, Glover, Rachels, Sher, and others. In addition, the implications of denying moral responsibility-for individual freedom, for moral judgments and moral behavior, and for social justice-are examined; the supposed dire consequences of the denial of moral responsibility are challenged; and the benefits of denying moral responsibility are described. In American legal journals over the last decade there were hundreds of pages of articles worrying over threats to justice and freedom arising from the power to withhold benefits. Government officials have tremendous discretion to offer or withhold foreign aid, ration-books, government contracts and jobs, welfare subsidies, public housing, tariff protection, academic grants, alien resident status, paroles, or exemption from conscription or combat, from arrest or prosecution or imprisonment. Right-wing economists have worried about welfare-state emphasis on administrative discretion rather than (...) the rule of law. And left-wing economists have worried about the rich man's power to intimidate the poor man by threatening to cut off his productive work. (shrink)
