Predictive genetic testing is now routinely offered to asymptomatic adults at risk for genetic disease. However, testing of minors at risk for adult-onset conditions, where no treatment or preventive intervention exists, has evoked greater controversy and inspired a debate spanning two decades. This review aims to provide a detailed longitudinal analysis and concludes by examining the debate's current status and prospects for the future. Fifty-three relevant theoretical papers published between 1990 and December 2010 were identified, and interpretative content analysis was (...) employed to catalogue discrete arguments within these papers. Novel conclusions were drawn from this review. While the debate's first voices were raised in opposition of testing and their arguments have retained currency over many years, arguments in favour of testing, which appeared sporadically at first, have gained momentum more recently. Most arguments on both sides are testable empirical claims, so far untested, rather than abstract ethical or philosophical positions. The dispute, therein, lies not so much in whether minors should be permitted to access predictive genetic testing but whether these empirical claims on the relative benefits or harms of testing should be assessed. Non-invasive prenatal testing is at the forefront of prenatal screening. Current uses for NIPT include fetal sex determination and screening for chromosomal disorders such as trisomy 21. However, NIPT may be expanded to many different future applications. There are a potential host of ethical concerns around the expanding use of NIPT, as examined by the recent Nuffield Council report on the topic. It is important to examine what NIPT might be used for before these possibilities become consumer reality. There is (...) limited research exploring views of women on possible future uses of NIPT, particularly those of women who have undergone NIPT. In this study, we examined the views of women who undertook NIPT previously on the acceptability of and interest levels in using NIPT for a number of current and possible future applications. These included several medical conditions encompassing psychiatric, neurodevelopmental and adult-onset conditions as well as non-medical traits such as intelligence. One thousand women were invited to participate and 235 eligible surveys were received. Women generally reported an interest in using NIPT for medical conditions that severely impacted quality of life and with an onset earlier in life and stressed the importance of the accuracy of the test. Concerns were raised about the use of NIPT for non-medical traits. Respondents indicated that termination of pregnancy was not their only reason for testing, particularly in the case of sex. These results can further inform the ethical debate around the increasing integration of NIPT into healthcare systems. (shrink)

This article outlines, first, Pope Francis’ economic vision which is both practical and radical. His views are practical in the sense that they are sensitive to social realities, not theoretical abstractions; and radical in the sense that it rejects traditional economic ideologies. Pope Francis advocates for economic practices that are oriented toward human goals: the common good, human dignity, equality and opportunity for all, meaningful work, ecological responsibility and solidarity. Second, Pope Francis’ various criticisms of neoliberal capitalism essentially challenge what (...) is called ‘’economic rationality,’’ namely a way of thinking that is characteristic of capitalism, which reduces normative and evaluative thinking into measurable economic categories. Abstrak Artikel ini menguraikan, pertama, visi ekonomis Paus Fransiskus yang bersifat praktis dan radikal. Pandangannya praktis dalam arti bahwa peka terhadap realitas sosial, bukan abstraksi teoretis; dan radikal dalam arti bahwa ia menolak pelbagai ideologi ekonomi tradisional. Paus Fransiskus memperjuangkan praktik ekonomi yang berorientasi pada tujuan-tujuan kemanusiaan: kesejahteraan umum, martabat manusia, kesetaraan dan peluang bagi semua, pekerjaan yang bermakna, tanggung jawab ekologis, dan solidaritas. Kedua, pelbagai kritik Paus Fransiskus terhadap kapitalisme neoliberal pada intinya menantang apa yang disebut “rasionalitas ekonomis,” yakni cara berpikir yang karakteristik dalam paham kapitalisme, yang mereduksi pemikiran normatif dan evaluatif menjadi kategori-kategori ekonomis yang dapat diukur. Tragedi perang Palestina–Israel tampak sebagai jalan penderitaan dan kekejian yang tanpa ujung dan tanpa solusi. Di tengah kesuraman seperti itu kisah kehidupan yang diceritakan oleh dokter Abuelaish mengharukan dan membawa harapan. Lahir dalam kamp pengungsi Jabalia di Jalur Gaza pada 1955, tujuh tahun setelah perang 1948 melahirkan negara Israel di tengah tanah Palestina, Abuelaish mengalami kemelaratan sangat ekstrem bersama ayahnya yang kehilangan tanahnya dan ibunya yang berwatak kuat tetapi juga keras serta delapan saudaranya. Sebelas orang ini hidup bertahun-tahun dalam ruang (...) pengungsian sesak dan pengap. Rumah lebih baik yang mereka temukan kemudian, dihancurkan buldoser Israel. Adiknya, Noor, ditangkap dan hilang. Di tengah keadaan gelap seperti itu, sambil terpaksa sebagai anak untuk bekerja keras ikut mencari nafkah, Abuelaish tetap seorang anak yang mau maju dan haus belajar. Semangat itu akhirnya membuka jalan baginya untuk mengambil kuliah kedokteran di Kairo, Mesir. Dengan pengalaman kerja bertahun-tahun di pelbagai rumah sakit di Gaza dan negara timur tengah lainnya dan belajar di London serta Harvard, juga lewat kerja sama dengan spesialis-spesialis Ginekologi Yahudi di Beersheba dan Tel-Aviv, ia berkembang menjadi seorang ginekolog dan spesialis fertilitas perempuan yang disegani. Namun bukan itu saja yang merupakan keistimewaan kisahnya. Dokter ini meyakini dan menemukan jalan bagaimana di tengah permusuhan antara bangsa Israel dan Palestina karya medis dapat membangun jembatan hidup bersama; juga bagaimana para perempuan yang ia layani sebagai ginekolog, merupakan kekuatan damai tatkala laki-laki suka berperang. Karena itu, ia berjuang bagi perempuan dan pemberdayaan mereka lewat pendidikan, termasuk putri-putrinya sendiri. Ia mau repot membawa pasien-pasiennya yang tak bisa ia tolong di rumah sakit serba terbatas di Jalur Gaza, ke pusat-pusat medis di Israel yang dapat dan mau membantu, kendati segala kesusahan untuk mendapat visa dan segala macam penghinaan yang harus ditelan seorang Palestina di setiap penyeberangan perbatasan.................................... Perjumpaan Fransiskus Assisi dengan Sultan al-Kamil di tengah ko- baran perang salib akhir-akhir ini mendapat banyak perhatian dari pel- bagai macam peneliti (Hoeberichts 1997; Warren 2003, Tolan 2007, Moses 2009). Yang terakhir, Paul Moses—seorang Guru Besar Jurnalistik di Brooklyn College, New York— melakukan investigasinya sendiri dan menulis suatu buku yang sangat menarik dan aktual, seperti yang boleh diharapkan dari seorang pakar komunikasi. Landasan penting penelitian Moses adalah evaluasinya yang kritis terhadap sumber-sumber. Ia mengemukakan bahwa sumber-sumber tertua tentang peristiwa ini (Jacques (...) de Vitry, dan sebuah kronik yang anonim, keduanya saksi mata perang salib kelima itu) memberi gambaran lebih damai tentang perjumpaan ini ketimbang riwayat-riwayat hidup Fransiskus yang kemudian (Celano, Bonaventura, dll.) yang menggambarkannya sebagai misi yang konfrontatif, berusaha mempertobatkan Sultan untuk mencari kemartiran. Adalah Konsili Lateran IV (1215) dan Paus Innocentius III (1198-1216) serta penggantinya, Paus Honorius III, yang pada masa itu membangkitkan semangat untuk perang salib kelima guna merebut kembali Yerusalem yang belasan tahun sebelumnya direbut dari tangan penguasa Kristen oleh Salah ad-Din (Saladin), paman Sultan Malik al- Kamil. Kendati keluarga Sultan sudah memberitahukan bahwa Sultan bersedia menyerahkan kembali Yerusalem demi persetujuan damai, pihak Paus dan raja-raja Barat tetap mengobarkan semangat perang dan mengumpulkan pasukan. Menurut Moses, Fransiskus, dan saudara- saudaranya diharapkan oleh Gereja ikut mewartakan perang suci, tetapi ia memilih membawakan Injil ke seluruh Eropa, tidak terkecuali juga ke wilayah-wilayah Muslim. Serangan pasukan salib ke Kesultanan Mesir dimulai dari kota pela- buhan Damietta di delta Sungai Nil. Tawaran damai Malik al-Kamil, Sultan Mesir yang dikenal bijaksana dan juga moderat terhadap umat Kristiani di Mesir, kembali ditolak oleh Kardinal Pelagius, utusan Paus dalam perang salib kelima ini. Fransiskus datang ke camp crusaders pada Agustus 1219 dan memberi peringatan kepada para crusaders bahwa serangan mereka akan gagal, tetapi ia ditertawakan. Lalu pada September 1219 ia memutuskan untuk mencari jalan lain dengan menyeberangi lini permusuhan dan mendatangi Sultan al-Malik, tidak sebagai utusan tetapi hanya dengan pengetahuan Kardinal Pelagius menggambarkan Sultan al-Kamil sebagai binatang buas. Sebagai anak zamannya, Fransiskus ingin menciptakan damai dengan mewartakan Injil kepada Sultan. Hal itu tampaknya dilakukannya dengan cara yang khas, sebab dalam sumber tertua dikatakan bahwa Sultan mendengarkannya dengan penuh perhatian, dan memperlakukan Fransiskus sebagai tamu terhormat selama beberapa hari. Menurut Moses, Sultan mungkin terharu bahwa ada orang Kristiani yang berbeda dengan para agresor rakus yang ia kenal dari perang salib. Al-Kamil yang dikenal terbuka untuk Sufisme mungkin juga suka mendengarkan Fransiskus, karena Fransiskus terkesan mirip dengan seorang Sufi. Di lain pihak, Fransiskus juga terkesan dengan apa yang ia lihat, misalnya cara pasukan Muslim menjawab panggilan untuk berdoa............................................................... Kenyataan asli menurut Tolan ialah bahwa Fransiskus ingin menjalankan hidup rasuli sampai dengan mahkotanya, kemartiran, yang dapat ia peroleh dengan pergi mewartakan Injil kepada Sultan. Ini memang gam- baran yang jelas ada dalam biografi-biografi Celano dan Bonaventura, te- tapi tidak muncul dalam kronik-kronik lebih tua dan konteks hidup Fran- siskus sendiri. Kelemahan karya Tolan ialah bahwa ia kurang kembali kepada tulisan-tulisan Fransiskus sendiri dan riwayat hidupnya, seperti yang dilakukan secara mengesankan oleh Moses yang berhasil memper- lihatkan dalam konteks hidup Fransiskus suatu penolakan terhadap pe- rang, pewartaan damai, penghargaan terhadap praktik doa Islam, dan cara misi baru; yang semuanya harus dijadikan patokan untuk interpretasi per- jumpaan Fransiskus dengan Sultan. Tolan gagal melihat tema damai dalam riwayat hidup dan tulisan-tulisan Fransiskus itu, dan dengan demikian juga tidak mengakui adanya sesuatu yang inspiratif dalam peristiwa perjumpaan itu untuk hubungan Muslim–Kristiani masa sekarang. Sebaliknya, ia agak keras menolak interpretasi sejumlah peneliti dan gerakan damai sejak akhir abad ke-20 yang melihat misi Fransiskus sebagai misi damai dan menemukan dalam Fransiskus suatu model untuk menolak kekerasan perang dan mencari pendekatan baru, khususnya dalam hal ketegangan antaragama. Kelemahan karya Tolan ini sangat tampak justru dalam perbandingan dengan karya Moses, yang tidak mendiskusikan Tolan sebab terlambat menerimanya. Buku ketiga, St. Francis and the Conversion of the Muslims, karya Frank M. Rega, amat berbeda dengan kedua studi ilmiah di atas. Dengan tidak kritis sedikit pun, Rega menggabungkan semua yang bagus-bagus dalam pelbagai versi—dari kronik-kronik paling awal sampai ke legenda- legenda yang sangat kemudian—tentang perjumpaan Fransiskus dengan Sultan itu. Tanpa membedakan pelbagai versi dan bertanya tentang latarbelakang dan tujuan masing-masing, seperti dilakukan Tolan, Rega menciptakan suatu versi gabungan yang agaknya akan disukai oleh pembaca Katolik yang saleh dan konservatif (yang memang dilayani oleh penerbit Tan Books), tetapi tidak bernilai bagi seorang peneliti yang ingin menyingkapkan maksud Fransiskus sendiri dan sumber-sumber masing-masing; dan sangat mengecewakan pembaca kritis sekarang yang mencari ilham dalam adegan ini bagi masalah-masalah dunia sekarang. Cerita legendaris Rega yang penuh triumfantalisme yang hampir-hampir yakin bahwa Sultan bertobat dan dibaptis menjelang kematiannya, tentu lebih mengganggu hubungan Kristen dan Muslim sekarang daripada membantu menemukan suatu pendekatan baru. Buku ini dikarang untuk pembaca “awam” (seperti saya) oleh dua ilmuwan yang masing-masing sudah memiliki nama tersendiri karena banyak publikasi: Brian Thomas Swimme, seorang profesor kosmologi evolusioner di San Francisco, dan Mary Evelyn Tucker, seorang lektor dalam bidang studi lingkungan hidup di Yale, New Haven. Diilhami oleh mentor dan sahabat mereka, almarhum geolog dan teolog Thomas Berry, mereka bersama-sama menyusun suatu “kisah (epos) tentang munculnya alam semesta dan berkembangnya komunitas hidup, dengan menawarkan suatu visi baru tentang cara kita dapat (...) menumbuhkan semangat komunitas bumi.” (cover). Bab 1-4 mengisahkan kurang lebih sembilan milyar tahun perkembangan alam semesta, mulai dari Big Bang, eksplosi terang dan materi yang senantiasa meluas dan melalui suatu proses kreatif menggembleng materi yang kemudian akan menjadi miliaran galaksi. Dengan bahasa yang umumnya non-teknis, dan sangat indah, disertai dengan kepekaan terhadap tradisi-tradisi bangsa-bangsa manusia yang bermenung tentang alam raya, para pengarang berhasil menampilkan deretan kejadian yang dahsyat dan jauh itu menjadi suatu proses yang terasa menyangkut kita juga. Fokus mereka pada proses pembentukan bintang-bintang serta eksplosi-eksplosi bintang yang, baru sesudah 8-9 miliar tahun, memunculkan solar system kita, yakni matahari dengan planet-planet di sekitarnya, khususnya bumi kita yang mengalami suatu proses penyejukan dan pemadatan yang unik. Dalam proses jutaan tahun terbentuk atmosfir di sekitar bumi dan lautan-lautan yang menutupi sebagian besar permukaannya. Dengan energi yang berasal dari terang matahari dari jarak yang menguntungkan, dipersiapkan pentas untuk suatu tahap baru yang menakjubkan: munculnya hidup di bumi..................... Dalam bab 10-11 para pengarang mencari jalan keluar dari ketidak-seimbangan destruktif yang telah terjadi di bumi. Mereka mempermasalahkan pemikiran materialistis deterministis yang sejak Galileo, Newton, Descartes, dan lain-lainnya, menyerahkan materi yang dianggap mati begitu saja kepada kontrol manusia yang berakal budi. Apakah materi memang sepasif seperti dipikirkan filsafat itu? Kita sekarang dapat melihat dari miliaran tahun pembentukan alam semesta bagaimana di dalam materi pun ada dinamika mengatur diri (self organizing) dengan cara-cara yang tidak dapat diprediksi. Di tengah proses besar yang penuh kreativitas ini umat manusia ditantang mencari tempat dan perannya ke depan. Seperti bintang-bintang dan lautan-lautan telah memberi sumbangan tersendiri untuk jagat raya dan bumi, demikian juga miliaran manusia—sebagai garis depan evolusi sekarang—akan dapat membantu membuka jalan bagi sesuatu yang kini belum dapat diduga, asalkan manusia mau melepaskan genggaman kontrolnya atas yang lain dan dengan sikap kekaguman mau menjadi bagian dari komunitas bumi dan menyelaraskan diri dengan iramanya Ini cuma beberapa benang dari sebuah buku yang sangat kaya, inspiratif, dan mampu mengubah pandangan pembaca. Menurut hemat saya, buku ini juga secara mendalam bersifat religius, kendati tidak meminjam bahasa agama apapun. Kalau belum ada teerjemahannya dalam bahasa Indonesia, hendaknya diadakan terjemahan tersebut, dan bila mungkin dengan tetap menjaga keindahan bahasanya. Dalam Alkitab Kristen tersimpan empat kisah Injil yang dengan cara- nya masing-masing menceritakan hidup dan karya Yesus dari Nazaret. Riwayat-riwayat itu dapat sangat bermakna bagi pembaca yang satu, tetapi juga sulit dipahami oleh pembaca yang lain. Hal ini disebabkan, antara lain, karena manusia masa kini kurang akrab dengan latar belakang, zaman dan tempat kisah Injil tersebut ditulis. Bagaimana mengatasi kesulitan itu? Peter Walker, seorang dosen Alkitab di Universitas Oxford, yang pernah meneliti situs-situs di Tanah Suci, dan berpengalaman sebagai pemandu (...) rombongan peziarah, menemukan solusi yang menarik dan sangat berguna. Ia menyusun buku In the Steps of Jesus, untuk memperkenalkan kisah Injil terutama Injil Lukas sambil membawa pembaca buku ini ke tempat-tempat terjadinya adegan-adegan riwayat hidup dan karya Yesus. Tempat-tempat itu diperlihatkannya dengan foto dan gambar, disertai keterangan yang mampu membuka mata dan hati pembaca................................................ Tahun lalu kami sudah memperkenalkan kembaran buku ini: In the Steps of Saint Paul: Penabur Sabda Segala Bangsa, yang disusun oleh pengarang yang sama, Peter Walker, dan juga diterjemahkan oleh pener- jemah yang sama, pakar Alkitab V. Indra Sanjaya dan diterbitkan pula oleh Kanisius. Kedua buku ini bukan hanya enak dipandang dan dibaca, tetapi juga memberi informasi yang dapat diandalkan oleh pembaca dari kalangan mana pun yang ingin lebih mengenal sejarah awal agama Kristen dan warisannya di Palestina serta wilayah Laut Tengah. Buku In the Steps of Jesus ini merupakan suatu penziarahan tersendiri, semacam napak tilas perjalanan hidup Yesus. Selain dapat menjadi buku panduan bagi segelintir orang yang sempat berwisata ke Tanah Suci, buku ini juga membuka kesempatan “berziarah batin” bagi mereka yang tidak pernah akan dapat berangkat ke tanah itu; dan tentu tetap juga memberi banyak pencerahan bagi mereka yang telah pulang dari ziarah yang nyata. Sugirtharajah, seorang pakar biblika kelahiran Sri Lanka, yang mengajar di Universitas Birmingham, U.K., dan dikenal sebagai godfather penelitian pascakolonial dalam bidang Alkitab, menambahkan suatu karya inovatif lagi pada daftar tulisan-tulisannya yang sudah sangat mengesankan. Perhatiannya untuk suara penafsiran pinggiran sudah diketahui dari karyanya yang paling terkenal, Voices from the Margin (1991). Meskipun Alkitab berasal dari Asia, namun kebanyakan peneliti-an tentang Alkitab dan juga tentang pengaruhnya sepanjang sejarah, terfokus pada Eropa dan Amerika, dengan meminggirkan Asia. Itu mendorong S untuk mengadakan penelitian (...) tentang Alkitab di Asia, khusus-nya sejarah penerimaannya. Ia menyadari bahwa dampak Alkitab terhadap kebudayaan Asia minim bila dibandingkan dengan pengaruhnya atas kehidupan dan kebudayaan di Eropa. Itu menjadi sangat tampak dalam uraiannya tentang peran Alkitab dalam sastra Asia (bab 7) di mana kutipan, tokoh, dan cerita Alkitab jarang muncul, dan bila ada, lebih banyak dipakai sebagai kritik terhadap kolonialisme Barat atau institusi kekristenan.... S mengakhiri tulisannya dengan menegaskan bahwa prinsip sola scriptura, Alkitab saja, tak punya pasar di Asia yang cenderung membaca Alkitab bersama dengan yang lain, Bhagavad Gita, Dhammapada, Analecta (mengapa di sini Alquran tak disebut S?). Hermeneutika Asia yang diselidiki oleh S, menolak kecenderungan kolonial yang ada baik dalam Alkitab sendiri dan lebih lagi dalam interpretasi kekristenan Barat: Kebudayaan dan masyarakat Asia tidak bergantung pada nilai-nilai kristiani untuk pemerintahan dan pengembangan yang baik.... Di Asia Alkitab adalah salah satu di antara banyak teks yang berwenang (hlm. 259). Tugas kita, menurut S, adalah membebaskan Asia dari klaim monopolistis kitab suci tertentu. Tugas ini mendesak di saat para fundamentalis dari semua agama memakai kitab sucinya untuk membenarkan kekerasannya terhadap yang lain. S bahkan mempertanyakan monoteisme yang dapat menekan perbedaan dan mengabaikan kemungkinan pusat-pusat yang banyak (p. 260). Ia tidak menganjurkan untuk kembali kepada penyembahan banyak dewa-dewi tetapi men-dorong kajian terhadap spirit politeistis yang mendorong toleransi, kemurahan hati, dan koeksistensi. Pembaca tentu bertanya: di mana sesungguhnya posisi S di medan diskusi pluralisme dan inklusivisme, berkaitan dengan cara dialog antaraagama, dan ditantang untuk memikirkan posisinya sendiri. S mengakui bahwa banyak hal mengenai Alkitab di Asia masih perlu diselidiki. Lima belas abad pra-kolonial dibicarakan dalam dua halaman saja. Alkitab yang oleh gereja Nestorian tanpa kekuatan apa pun disebarkan ke India, Sumatra, dan China cuma dihormati tetapi tinggal tidak diterjemahkan selama belasan abad; kabarnya hanya diketahui melalui liturgi. Ada pula kesan bahwa Asia dalam karya S terutama Asia Selatan dan Asia Timur. Asia Tengah (bekas bagian-bagian USSR) memang dari awal tidak dimasukkan dalam penelitiannya, tetapi juga Asia Barat Daya dan Asia Tenggara yang multi-agama hampir tidak disentuh. S mungkin tidak mengetahui beberapa penelitian tentang penerimaan Alkitab di Indonesia yang sudah dipublikasikan oleh Lembaga Alkitab Indonesia. Namun demikian, apa yang disajikan sungguh menarik dan penting, serta membuka mata dan jalan bagi penelitian yang lebih luas. Beberapa puluh tahun yang lalu Steven McKenzie menjadi editor sebuah kumpulan karangan yang berjudul To Each Its Own Meaning: An Introduction to Biblical Criticism and their Application (1993). Dalam bunga rampai itu dibahas metode-metode penelitian lama yang berfokus pada latar belakang sejarah teks (penelitian sumber, sejarah tradisi, jenis sastra, peredaksian), cara-cara penelitian literer yang lebih baru (seperti penelitian strukturalis, pasca-strukturalis, naratif, atau reader’s respons) dan beberapa yang lain (penelitian ilmu sosial, kanonik, atau retorika). Dalam dua puluh tahun sejak (...) terbitan itu banyak pendekatan baru berkembang, misalnya, dalam symposia pertemuan para pakar Alkitab nasional dan internasional, dan dalam banyak monograf, bunga rampaidan artikel Jurnal. Untuk membantu pembaca mengikuti perkembangan cepat itu, kini McKenzie & Kaltner menerbitkan New Meanings for Ancient Texts. Mereka memilih sembilan pendekatan yang makin berpengaruh dan meminta kepada pionir-pionir utama setiap pendekatan untuk memberi deskripsi pendekatannya yang jelas bagi non spesialis dan mengilustrasikannya dengan meneliti satu atau beberapa teks contoh. Judul bab dari beberapa di antara kesembilan pendekatan itu barangkali segera ditanggap pembaca, karena sudah lebih lama dikenal. Misalnya, “Psychological Biblical Criticism” (D. Andrew Kille, pp. 137-154) dan “Ecological Criticism” (Norman Habel, pp. 39-58). Pendekatan-pendekatan ini agaknya dimuat di sini karena mengalami pergeseran paradigma dalam beberapa dasa warsa terakhir. Juga tidak baru di telinga pembaca akademis adalah “Postcolonial Biblical Criticism”(Warren Carter, pp. 97-116) dan “Postmodernism” (Hugh Pyper, pp. 117-136). Postmodernisme yang membongkar cerita-cerita besar seperti sejarah keselamatan Alkitab dan mau menyadarkan pembaca bahwa banyak jawaban kita selama ini sesungguhnya kurang pasti daripada dikira, meluas di dunia tafsir Barat; sedangkan penelitian Alkitab pascakolonial yang meneliti hubungan dominasi dan subordinasi dalam teksteks Alkitab dan dampaknya dalam sejarah kolonialisme dan lanjutannya dalam masa pasca-penjajahan, sekarang ini menjadi sangat aktual dalam distorsi relasi antara Selatan dan Utara. “New Historicism” (Gina Hens-Piazza, pp. 59-76) tidak lagi mencoba merekonstruksi realitas sejarah di belakang teks (seperti dilakukan oleh Historical Criticism), tetapi dengan cara yang multidisipliner meneliti teks sebagai representasi dari realitas kultural, sosial, politik, dan sebagainya, sambil melepaskan distingsi antara literatur dan sejarah, juga antara pengarang dan pembaca, antara arti dulu dan arti sekarang. Dekat tetapi berbeda dengan itu “Cultural-Historical Criticism of the Bible” (Timothy Beal, pp.1-20) meneliti bagaimana kata, kiasan, objek dan ide dalam Alkitab menerima bentuk dan artinya dalam konteks kebudayaan tertentu yang memproduksikannya atau mereproduksikannya. “The Bible and Popular Culture” (Linda Schearing and Valerie Ziegler, pp. 77-96) kurang berfokus pada Alkitab sendiri tetapi menganalisa bagaimana teks-teks tertentu berfungsi dalam ungkapan-ungkapan budaya rakyat, lelucon, iklan, komik, seni, film, dll., juga mengingat pergeseran yang kini terjadi dari budaya teks tertulis ke apropriasi visual. “Disability Studies and the Bible” (Nasya Junior and Jeremy Schipper, pp. 21-38) dan apa yang disebut “Queer Criticism” (Ken Stone, pp. 155-176) meneliti Alkitab dari situasi kelompok-kelompok tertentu, entah mereka orang-orangcacat yang banyak muncul dalam teks-teks Alkitab yang dapat dimengerti lebih baik dari dalam pengalaman invaliditas; atau mereka yang dari sudut seks dan jender berada dalam posisi yang tidak menguntungkan atau bahkan ditolak. Di sini a.l. tempatnya penelitian Alkitab komunitas gay and lesbian, dan lebih awal feminisme......................... Apakah bunga rampai tentang pelbagai pendekatan baru ini penting untuk seorang yang sudah cukup puas dengan metodenya selama ini atau yang menerima Alkitab sebagai buku yang mempunyai otoritas terhadap dirinya dan jemaatnya? Keberatan (kita) yang sudah lama diajukan terhadap pendekatan tersebut, pada akhir setiap karangan dengan jujur dikemukakan dan diberi tanggapan singkat. Membaca contoh-contoh penafsiran dalam bunga rampai ini, saya sering merasa diajak ke dalam suatu perjalanan yang berbelit-belit. Tetapi setelah beberapa tikungan muncul juga pemandangan menarik dan berharga yang belum pernah saya perhatikan selama ini. Selain itu, setiap artikel mulai dengan pengantar umum tentang, misalnya, fenomen postmodernisme, ilmu ekologi, atauqueer criticism yang sudah lebih lama dikembangkan di akademi umum, dan baru sekarang mulai dipakai juga untuk analisa teks-teks biblis. Pengantar-pengantar itu saja memberi gambaran menarik tentang masalah-masalah yang dewasa ini digumuli dalam komunitas global. Setuju atau tidak, mengetahuinya penting untuk keduanya. El Festival Publicatessen se desarrolla desde hace catorce ediciones en el campus María Zambrano de la Universidad de Valladolid. Está organizado por el alumnado de cuarto curso del grado en Publicidad y RR.PP., con la coordinación directa del profesorado. El objetivo de esta publicación es conocer la valoración de aquellos exestudiantes que han participado, y conocer qué competencias han desarrollado de cara a su vida profesional. Partimos de un recorrido histórico por acuñaciones almohades o postalmohades que, o bien no han sido registradas, o bien necesitan nuevas lecturas o atribuciones. Ello nos permite ofrecer una hipótesis sobre las monedas de plata acuñadas por Idrís al-Mamón y afiadir algunos registros al corpus numismático del Occidente islámico en la Baja Edad Media. Ese trabajo nos permite, por otro lado, afrontar el discurso islámico dominante que surgió a raíz de la llamada revolución almohade, lo que hacemos centrándonos en varias (...) cuestiones, entre ellas: 1) la densidad del mensaje sobre la vida etema en las inscripciones almohades, que derivan de la fuente absoluta del corán; 2) el problema de si es necesaria, de cara a la salvación, la presencia de guías históricos; 3) la evolución de la teología negativa ala afirmativa, y 4) la estrecha relación entre el discurso numismático y las chíes almohades y postalmohades. El pensar cobra gran importancia en la obra tardía de Martin Heidegger, momento en que sus meditaciones se plasman en un gran número de cartas, conferencias y ensayos dirigidos a la posibilidad de reflexionar sobre el ser, apartándose de la tradición filosófica de Occidente agotada en la metafísica. Es en esta época cuando aparece el discurso Serenidad, cuya relevancia radica en la actitud frente a la época técnica, cimentada en el pensar meditativo que se enfrenta al calculador. Será significativo, (...) para estas consideraciones sobre el discurso mencionado, prestar especial atención a los recursos metafóricos y lingüísticos empleados por Heidegger, de modo tal que el concepto de autoctonía toma gran peso. International Law in Context is a pedagogy-forward textbook. It reflects the recent paradigm shift in legal education, which focuses more on what students actually learn rather than the material to which they are exposed. The text aims to prepare the next generation of U.S. lawyers to engage with our interconnected world and to critically evaluate the U.S.'s role within the international legal order. The work is divided into three parts that accomplish these goals. Part One lays a foundation. It covers (...) the various actors within the system, the theories that help explain their behavior, and the principles and sources of law they create. Part Two turns to the fora that define and support the international order, the historical and political contexts that impacted their design, and their efficacy. Part Three is a capstone section that asks students to weave together everything they have learned in Parts One and Two. Students will engage in normative development regarding climate change, including the existing international treaty regime and U.S. implementation options, and the law of war in the modern age. The cornerstone of this book is its organization. The text groups material into conceptual frameworks that promote understanding and retention. For example, rather than consider the various dispute resolution fora in isolation, Part Two asks students to consider them in the context of what types of disputes arise and what legal rules can be employed to resolve them in various international and domestic fora. The institutions also are presented in chronology. In this way, students are encouraged to chart the developmental progression and to make connections and comparisons between various institutions. The use of conceptual frameworks continues within each part. For example, Chapter Six covers the sovereign State as a conflict resolution forum. Under this umbrella, the author discusses (a) State Jurisdiction; (b) The Reception of International Law into the Domestic Sphere; (c) The Qualification as a State Forum or State Litigant (i.e., Recognition of States & Governments); and (d) Protections Afforded Within the Forum: Sovereign, Diplomatic, and Consular Immunity. A typical coursebook might locate this material in four different chapters. The conceptual framework approach, however, allows students to see the big picture and the relationship between concepts. In addition to the frameworks, there are several other innovative pedagogical devices that support student learning. There are Foundation Questions that initially direct readers through the material and cumulatively help students confirm whether they have grasped key takeaways from each section. There also are Assessment Sets in each section, which provide students with immediate opportunities to apply material and gauge their understanding, and "Why Is This Important (a/k/a WITI Moment)" prompts designed to delve deeper into the underpinnings and consequences of various rules. Objective Standards of care regarding obstetric management of life-threatening anomalies are not defined. It is hypothesised that physicians' management of these pregnancies is variable and influenced by demographic factors. Design A questionnaire was mailed to members of the Society of Maternal–Fetal Medicine with valid US addresses assessing obstetric management of both ‘uniformly lethal’ (eg, anencephaly, renal agenesis) and ‘uniformly severe, commonly lethal’ (eg, trisomy 13 and 18) anomalies. Respondents were asked to answer as if not limited by state/institutional restrictions. Fisher's (...) exact or χ2 tests were used as appropriate and correction made for multiple comparisons in analyses that were not prespecified. Results The response rate was 36% (732/2038). Nearly 100% of respondents discuss termination for both uniformly and commonly lethal anomalies. In continuing pregnancies, with patient request for obstetric non-intervention 99% of providers would comply for either uniformly or commonly lethal anomalies. The majority ‘encourage’ such management, but some were non-directive or discouraged this management. In continuing pregnancies, with patient request for full obstetric intervention the majority of respondents was willing to comply for both uniformly (71%) and commonly (82%) lethal anomalies. While most practitioners ‘discouraged’ full intervention, some were non-directive or encouraged this management. Demographics and severity of anomaly influenced counselling. Conclusion Discrepancies exist regarding the management of life-threatening fetal anomalies. Patients may be offered different options based on practitioner demographics. The majority of physicians comply with patient wishes. Differences were noted when comparing the management of lethal with that of severe commonly lethal anomalies, suggesting that practitioners make a distinction when counselling patients. (shrink)

Historical injustice and global inequality are basic problems embedded in territorial rights. In Global Justice and Territory Cara Nine advances a general theory of territorial rights adapting a theoretical framework from natural law theory to ground all territorial claims.

In Sharing Territories, Cara Nine defends a river model of territorial rights. On a river model, groups are assumed to be interdependent and overlapping. Drawing on natural law philosophy, Nine's theory argues for the establishment of foundational territories around geographical areas like rivers.

A long-standing theme in discussion of perception and thought has been that our primary cognitive contact with individual objects and events in the world derives from our perceptual contact with them. When I look at a duck in front of me, I am not merely presented with the fact that there is at least one duck in the area, rather I seem to be presented withthisthing (as one might put it from my perspective) in front of me, which looks to (...) me to be a duck. Furthermore, such a perception would seem to put me in a position not merely to make the existential judgment that there is some duck or other present, but rather to make a singular, demonstrative judgment, that that is a duck. My grounds for an existential judgment in this case derives from my apprehension of the demonstrative thought and not vice versa. (shrink)

Ecological refugees are expected to make up an increasing percentage of overall refugees in the coming decades as predicted climate change related disasters will displace millions of people. In this essay, I focus on those rights ecological refugees may claim on the basis of collective self-determination. To this end, I will focus on a few specific cases that I call cases of ‘ecological refugee states’. Tuvalu, the Maldives, and to a certain extent, Bangladesh are predicted to be ecological refugee states (...) in the near future. These are states whose entire (or close to it) geographical territory is predicted to be lost to rising sea levels; the collective body of the people will itself become an ecological refugee.The question is: what may the people of an ecological refugee state legitimately claim on the basis of their right to self-determination? Should we redraw state borders to accommodate a New Tuvalu? I argue that a plausible position regarding territorial rights is that when (1) a people clearly is (or recently was) self-determining and has a legitimate claim to continue to be self-determining, and (2) the self-determination of a people is existentially threatened because the people lacks territorial rights, that (3) the people becomes a candidate for sovereign over a new territory. The result is that existing state borders may need to change to accommodate something like a New Tuvalu. To generate these results on behalf of ecological refugee states, I examine the principles of the system of territorial states. Because the system of territorial states is a system of exclusive rights over goods, especially land, it is possible that it is subject to the conditions of a Lockean proviso mechanism. This paper is dedicated mainly to adapting a version of the Lockean proviso for use in territorial rights theory. (shrink)

Competition is pervasive in modern society, affecting work, education, and recreation. The question arises whether competition is consistent with scriptural teaching. The context for this enquiry is that Christians today disagree among themselves about whether Scripture has any normative content relating to competition. Some view competition as incompatible with Scripture, while for others it is compatible. On the basis of a given definition of competition, Christian contributions to the debate in the last decade are reviewed. Only six inputs were discovered, (...) with five arguing that Scripture takes no normative position toward competition. Most of this article is taken up with evaluating their cases that are found to be unpersuasive. A sixth paper claims that Scripture is incompatible with competition, examined in the penultimate section. From reviewing the six contributions to the debate, the conclusion is that that Scripture does not have a favorable attitude toward competition. (shrink)

Cooperation, meaning collaboration between people who assist each other to achieve common goals, is argued to be one of Jesus’ major normative themes. This proposal has not previously been made in Christian ethics. Jesus’ emphasis on cooperation occurs within His major undertaking, His practice of obedience to God. Outlined initially is the meaning of cooperation that aims for mutual help and partnership with others in a friendly, trusting and harmonious alliance. Following that, Jesus’ teachings relating to cooperation are assessed, as (...) interpreted by Biblical exegetes. These teachings include the Golden Rule, Jesus’ admonitions for forgiveness, the need for generosity, required relations between His disciples, and Jesus’ healings. In the penultimate section, objections to the extension of Jesus’ teachings on cooperation in the modern world are found to be unpersuasive. (shrink)

On Inception is a translation of Martin Heidegger's Gesamtausgabe 70. This work belongs to the crucial period, before and during WWII, when Heidegger was at work on a series of treatises that begins with "Contributions to Philosophy" and includes "The Event" and "The History of Beyng." These works are difficult, even hermetic, but represent a crucial development in Heidegger's thinking. On Inception deepens the investigation underway in the other volumes of the series and provides a unique perspective on Heidegger's (...) thinking of Being and of Event. Here, Heidegger asks, with a greater insistence than anywhere else in his work, what it might mean to think of being as event, and not as presence. Event cannot be thought without the sense of a beginning - an inception - and so, Heidegger insists, we must try to think of being as inception, as fundamentally inceptive. On Inception pursues rigorously the difficult and puzzling implications of this speculation. It does not merely extend work already undertaken but also opens doors onto wholly other pathways. Is it OK to lie to Siri? Is it bad to mistreat a robot for our own pleasure? Under what condition should we grant a moral status to an artificial intelligence (AI) system? This paper looks at different arguments for granting moral status to an AI system: the idea of indirect duties, the relational argument, the argument from intelligence, the arguments from life and information, and the argument from sentience. In each but the last case, we find unresolved issues with (...) the particular argument, which leads us to move to a different one. We leave the idea of indirect duties aside since these duties do not imply considering an AI system for its own sake. The paper rejects the relational argument and the argument from intelligence. The argument from life may lead us to grant a moral status to an AI system, but only in a weak sense. Sentience, by contrast, is a strong argument for the moral status of an AI system—based, among other things, on the Aristotelian principle of equality: that same cases should be treated in the same way. The paper points out, however, that no AI system is sentient given the current level of technological development. (shrink)

In ‘What’s Wrong with Colonialism,’ Lea Ypi argues that the wrong of colonialism can be expressed as procedural wrongs, not as wronging territorial rights. On her view, colonial practices went wrong in two ways: they forced residents into political associations, and the terms of the political association were not established through equal and reciprocal negotiations. I argue that because Ypi’s account successfully side-lines all but essential claims to territory, her theory ends up being vulnerable to an objection it means to (...) avoid. Historical residents may be subject to unequal treatment under newly formed political associations because their historical patterns of land use are not considered to have any independent moral weight. My analysis does not rely on any appeal to property or territorial rights. Instead, I appeal to pre-existing obligations holding between residents. (shrink)

Drinking water is an important health behavior to support overall child health. Research indicates that children are consuming too little water and too many sugary drinks. Overconsumption of sugary drinks increases child risk for the epidemics of obesity and diet-related chronic diseases like type-II diabetes, stroke, and heart disease. Increasing access to appealing, low-cost drinking water in schools and childcare where children spend much of their time supports efforts to reduce sugary drink consumption. Drinking water infrastructure is key to water (...) access in childcare and schools. In 2012-2013, almost one-third of permanent U.S. school buildings had plumbing systems in fair or poor condition, and almost 40 percent had major renovations or repairs planned.3 Basic plumbing standards for new construction and major renovations or repairs are contained in state and local plumbing codes, and many of these codes are derived from model codes established by private organizations. This article describes the model code process and intervention points where the public health community can work to improve plumbing standards in school buildings and childcare centers. (shrink)

This essay defends a strong right against displacement as part of a basic individual right to secure access to one’s home. The analysis is purposefully situated within the difficult context of climate change adaptation policies. Under increasing environmental pressures, especially regarding water security, there are weighty reasons motivating the forced displacement of persons—to safeguard water resources or prevent water-related disasters. Even in these pressing circumstances, I argue, individuals have weighty rights to secure access to their homes. I explain how the (...) home provides a functional context for conditions of autonomous agency. Being coerced from the home disrupts and subverts the conditions necessary for autonomous processes. I conclude by suggesting that the right to the home could be a foundational element of territorial rights. (shrink)

Some time ago, John Perry argued that the content of an indexical belief, that is, a belief expressible with a sentence containing an indexical or demonstrative, cannot be a proposition. I consider several of his arguments for this view, and show that they can be extended to show that belief expressible with other non-indexical expressions such as natural kind terms and proper names presents the very same problem for the traditional picture. I then suggest that if indexical belief has any (...) special status, this is not because it has a special kind of content, but rather because action is impossible if agents do not have indexical belief. Over the past three decades, the philosophy of biology has emerged from the shadow of the philosophy of physics to become a respectable and thriving philosophical subdiscipline. The authors take a fresh look at the life sciences and the philosophy of biology from a strictly realist and emergentist-naturalist perspective. They outline a unified and science-oriented philosophical framework that enables the clarification of many foundational and philosophical issues in biology. This book will be of interest both to life scientists and philosophers.

We provide a battery of examples of delusions against which theoretical accounts can be tested. Then, we identify neuropsychological anomalies that could produce the unusual experiences that may lead, in turn, to the delusions in our battery. However, we argue against Maher’s view that delusions are false beliefs that arise as normal responses to anomalous experiences. We propose, instead, that a second factor is required to account for the transition from unusual experience to delusional belief. The second factor in the (...) aetiology of delusions can be described superficially as a loss of the ability to reject a candidate for belief on the grounds of its implausibility and its inconsistency with everything else that the patient knows. But we point out some problems that confront any attempt to say more about the nature of this second factor. (shrink)

Disability scholars have critiqued medical models that pathologize disability as an individual flaw that needs treatment, rehabilitation, and cure, favoring instead a social-constructionist approach that likens disability to other identity categories such as gender, race, class, and sexuality. However, the emphasis on social constructionism has left chronic illness and pain largely untheorized. This article argues that feminist disability studies must attend to the common, chronic gynecological condition endometriosis when theorizing pain. Endo is particularly important for FDS analysis because the highly (...) feminized and sexualized nature of endo pain is a major source of disability. Because medical treatments of endo enhance fertility rather than provide pain relief, those with endo must not only have access to medical services to manage their pain, but also demand better medical management of their pain as well as disability accommodations for their pain. Thus, I propose a pain-centric model of disability that politicizes pain through social-constructionist and medical models of disability by attending to the lived experiences of pain. (shrink)
