Distinctions among juristic ways of thinking -- Classification of juristic ways of thinking in the overall development of legal history.

The clash between religious freedom and equality for lesbians and gay men has become a controversial legal issue in the United Kingdom. Increasingly, claims are made that compliance with anti-discrimination norms impacts upon conscientious, faith-based objectors to same-sex sexual acts. This article explores this issue and draws insights from North American case law, where this question has been considered in the context of competing constitutional rights. It raises far-reaching issues concerning the distinction between belief and practice, as well as the (...) role of identity in the public sphere. The author advocates that courts and tribunals should adopt a fact-specific approach which is sensitive to the rights in a particular context, and which focuses upon the values of accommodation, tolerance and mutual respect. This paper argues that a fact which constitutes part of a subject’s being justified in adopting an action or a belief at a particular time need not be part of what induced the subject to adopt that action or belief but it must be something to which the subject had immediate access. It argues that similar points hold for justification of the involuntary acquisition of a belief and for the justification of continuing a belief (actively or dispositionally.).

Social distancing has become the most prominent measure many countries have implemented to combat the spread of COVID-19. The aim of the current study was to explore the potential role of empathy and self-construal styles, as individual personality traits, on self-reported social distancing. Participants completed the Interpersonal Reactivity Index, the Singelis Self-Construal Scale, and were asked to rate their level of social distancing and how much they endorsed social distancing on a five-point Likert-scale. Across a large and diverse sample, results (...) showed that trait-levels of empathic concern and perspective taking positively correlates with social distancing. However, we did not find evidence to suggest that trait-levels of personal distress correlates with social distancing. We interpret these findings as suggesting that empathy, both its altruistic and cognitive dimensions, plays an important role in motivating people to socially distance and should be emphasized during times of crisis. Furthermore, we suggest that emphasizing a person’s self-distress during times of crisis may not be an effective approach in promotion social distancing policies. We also found that both independence and interdependence self-construal styles positively correlates with social distancing. While we expected the latter result, we did not expect the former. This suggests that more work is needed to fully understand how self-construal styles, along with their cultural level analogs, influences social distancing. Overall, these results provide us with novel multi-national data about the role of individual differences on social distancing tendencies specifically, and human behavior during a global health crisis more generally. This paper develops a theory of how democratic governance is possible. It analyses democracy as a laminated system consisting of three interdependent levels – the political/institutional, the social/interactional, and the psychological/intrapsychic – each of which is necessary for the others to exist. Each level is subject to a regulatory principle that is necessary for it to function appropriately. At the political/institutional level, competing political parties must be governed by the regulatory principle of ‘loser’s consent,’ in which the losing party must (...) agree to cede power to the winning party. At the social/interactional level individuals from opposing political parties must be governed by the regulatory principle of a superordinate identity as citizen, which allows them to transcend their partisan political identities. At the psychological/intrapsychic level individuals must be governed by the regulatory principle of mutuality/thirdness which allows the possibility of an alternative to the binary identities that result from the doer/done-to position. Scientific indigenous psychologies have been developed mostly in non‐western countries. Indigenous psychologies, seeing mainstream psychology as too western in its cultural foundation, are based on the culture of the society being investigated. In this article I critique the concept of culture used by representative researchers of indigenous psychologies in the English‐language literature and contrast it to current concepts of culture in the social sciences. Furthermore, I argue that the concept of culture used in this literature has implications for the cultural (...) contents that are identified as the culture of a specific society. I also suggest that the political dimensions of what contents of culture are associated with a specific society are not given sufficient attention in this literature. Finally, alternative approaches to culture for the indigenous psychologies are discussed. (shrink)

In this paper the nature of the indigenized psychologies is discussed. The ongoing development of indigenized psychologies is an important phenomenon that gives rise to many important and interesting questions, not the least of which concerns the conditions for the development and transfer of traditions of understanding between different social and cultural contexts. The indigenized psychologies are distinguished by being reactions to what is seen as modern mainstream western (US) psychology, by being (more or less) anchored in the identified culture (...) of its countries and by a desire to increase the practical applicability of the discipline in the local cultural context. In order to improve our understanding of the indigenized psychologies, it is important to recognize the historical and cultural context of their origin, such as anti-colonial reactions, and to recognize their great diversity. The diversity is for example evident with respect to how many, and which, aspects of western psychology one thinks should be indigenized. Moreover, some authors tend to stress the value of the indigenized psychology as being anchored in the researcher's culture and other authors emphasize the importance of their practical applicability. The indigenized psychologies are still at an early stage of their development and their progress is to a large extent affected by limitations in material resources and lack of institutionalization of academic culture. The relation of the indigenized psychologies to the concept of science is not clear but is not given much attention in the literature produced by, and on, the indigenized psychologies. (shrink)

The culture concept used in the indigenous psychologies is important since these psychologies aim to be rooted in the local culture of the research participants. Culture is an empirical phenomenon. Thus, the extent to which meaning content is shared in a society, and by what categories of people, is an empirical issue. It should not be solved by default by the use of a culture concept that assumes that all cultural content is shared. The philosophical and pragmatic?political reasons suggested by (...) Hwang and Liu are not convincing enough to change this conclusion. Moreover, irrespective of the cultural concept used, it is imperative that the researcher has empirically informed him/herself about the cultural understanding of the participants in the study. Finally, the indigenous psychologies are not intrinsically allied with the nation state and need to be seen as a part of cross?cultural psychology. (shrink)

Obese people consume significantly greater amounts of health resources. This study set out to determine if health resource utilization by obese people decreases after losing weight in a comprehensive medically supervized weight management programme. Four hundred and fifty-six patients enrolled in a single-centred, multifaceted weight loss programme in a universal health care system were studied. Patient information was anonymously linked with administrative databases to measure health resource utilization for 1 year before and after the programme. Mean body mass index (BMI) (...) decreased by more than 15%. The mean annual physician visits (pre = 9.6, post = 9.4) did not change significantly after the programme. However, patients saw a significantly fewer number of different physicians per year following the programme (pre = 4.5, post = 3.9; P < 0.001). Mean annual number of emergency visits (pre = 0.2; post = 0.2) and hospital admissions (pre = 0.05; post = 0.08) did not change. Neither baseline BMI, nor its change during the programme, influenced changes in health resource utilization. Our study suggests that weight loss in a supervized weight management programme does not necessarily decrease short-term health resource utilization. Further study is required to determine if patients who maintain their weight loss experience a decrease in health utilization. (shrink)

In his paper entitled “Ethics and the Funding of Research and Development at Universities”1 Spier examines some of the potential problems of the relationship between 1) corporate sponsors of research and 2) the universities (and faculty) that receive that funding. Citing “He who pays the piper, calls the tune,” Spier suggests that a better way of funding research would be to “set up a dedicated publicly sponsored research establishment” with the stated goal of achieving particular technical or engineering objectives. (Spier (...) cited the successful Animal Virus Research of the UK as an example). Spier states that researchers at these establishments are “not subjected to the triple requirement to teach, research and administer as are university members, so they do not have to face the same ethical challenges of the academics.” This paper will examine the stated dangers of public/corporate research partnerships and whether the proposed alternative shares equally troubling ethical issues.
