O tema é discricionariedade nas teorias do positivismo antes e depois de Dworkin desde a crítica hermenêutica do direito e sua teoria da decisão. O problema é: há a possibilidade de uma teoria da decisão no positivismo, seja ele qual for, mantendo-se intactos os seus princípios metodológicos da descrição e da separação entre direito e moral? O objetivo é apresentar a crítica hermenêutica do direito e sua oposição à discricionariedade dos positivismos. In this historical article, Newton da Costa discusses Francisco Miró Quesada’s philosophical ideas about logic. He discusses the topics of reason, logic, and action in Miró Quesada’s work, and in the final section he offers his critical view. In particular, he disagrees with Miró Quesada’s stance on the historicity of reason, for whom “reason is essentially absolute”, whereas for da Costa it “is being constructed in the course of history”. De 1964 a 1985 o Brasil viveu sob um regime de governo ditatorial que de acordo com a historiografia mais recente foi sustentado, em grande parte, pela própria sociedade civil (MELO, 2012; COMISSÃO, 2014). Mais recentemente, a partir dos anos 1980, cresce o movimento de criação de espaços de memória corporativos com o objetivo de tornar pública a trajetória histórica das empresas (COSTA; SARAIVA, 2011). Dentre estes espaços, adquire relevância os Centros de Memória e documentação como lugares de armazenamento (...) e lembrança de memória organizacional, que ajudam a construir simbolicamente a imagem organizacional e a fornecer um senso de coerência e trajetória linear (RIBEIRO; BARBOSA, 2007). Neste contexto, e com base na documentação disponibilizada pela Comissão Nacional da Verdade, a presente pesquisa tem por objetivo identificar como o Museu Histórico da Fundação Bradesco retrata (ou deixa de retratar) o relacionamento da empresa Bradesco com o governo brasileiro no período da ditadura civil-militar. FIRMS, BRAZILIAN CIVIL-MILITARE DICTATORSHIP, AND MEMORY AND CORPORATIVE DOCUMENTATION CENTERS: AN EXPLORATORY STUDY From 1964 to 1985, Brazil lived under a dictatorial system of government that according to the latest historiography was sustained largely by civil society (MELO, 2012; COMISSÃO, 2014). More recently, since the 1980s, it is possible to be noticed the growing movement of creation of corporate memory spaces in order to make public the historical trajectory of the companies (COSTA and SARAIVA, 2011). Among these spaces, acquires relevance the Corporate Documentation and Memory Centers, which help to symbolically build the organizational image and to provide a sense of consistency and linear trajectory (RIBEIRO and BARBOSA, 2007). In this context, and based on documentation provided by the National Commission of Truth, this research aims to identify how the History Museum of Bradesco Foundation portrays (or does not portray) the relationship between Bradesco company and the Brazilian government in the period of civil-military dictatorship. A pesquisa objetivou perceber como a construção curricular e as práticas pedagógicas nos Cursos de Artes–licenciaturas das Universidades Comunitárias de Santa Catarina possibilitam ou não momentos de promoção de igualdade para todos e todas. Após mapear as IES Comunitárias, a análise incidiu sobre os currículos trabalhados por seis Universidades: FURB, UNIVILLE, UNIPLAC, UNOESC, UNC, UNESC, no período de 2000 a 2007. Nos planos de ensino dos professores e na bibliografia recomendada, constatamos a presença de autores que abordam o multiculturalismo. O presente estudo trata-se de uma revisão integrativa de literatura que teve como objetivo descrever a produção de literatura científica acerca das condições de saúde da população LGBTQIAPN+ no sistema prisional brasileiro. A busca pelas informações foi realizada na Biblioteca Virtual de Saúde e Google Acadêmico, utilizando os filtros “minorias sexuais e de gênero”, “prisões”, “condições de saúde” e “Brasil”, compreendendo o período de 2018-2023. Após aplicar os critérios de inclusão e excluídos os duplicados, foram selecionados cinco artigos, dos quais (...) emergiram dois temas de análise macro: principais problemas de saúde que impactam a população LGBTQIAPN+ no sistema prisional brasileiro e os principais desafios na execução da Política Nacional de Atenção Integral à Saúde população LGBTQIAPN+ no Sistema Prisional. Os estudos apontam a violação dos direitos das travestis e transexuais ao observar diversos problemas que se destacam no sistema prisional: alta prevalência de infecções sexualmente transmissíveis e doenças crônicas, violação do nome social, a negação de ingresso de roupas e utensílios femininos nos presídios masculinos, a prática de estupro e violência física e psicológica. Apesar dos inúmeros direitos garantidos constitucionalmente pela população LGBTQIAPN+, ainda é notória a discriminação acentuada, invisibilidade e maior vulnerabilidade em saúde no sistema prisional brasileiro. O profissional de enfermagem figura entre os primeiros que presta os primeiros cuidados as mulheres vítimas de agressões sexuais, necessitando, dessa forma, de competência e sensibilidade para cuidar no âmbito clínico, garantindo a preservação de vestígios da violência e salvaguardar os direitos das vítimas. O objetivo do presente estudo foi evidenciar estudos na literatura científica nacional que enfoquem a assistência de enfermagem em situações de violência sexual contra mulher. Estudo de revisão integrativa de literatura com abordagem quanti-qualitativa, realizada no período (...) de fevereiro a março de 2021. A coleta de dados foi realizada por meio de busca de estudos bibliográficos disponíveis nas base de dados SciELO, Google Acadêmico e BVS. Foram levantados 24 artigos e após aplicação de critérios de elegibilidade, 11 artigos foram utilizados para análise. O cuidar em enfermagem à mulher vítima de violência sexual leva à compreensão de que a assistência destes profissionais estão centradas, em sua maior parte, no cuidado técnico. Mesmo sendo um dos principais profissionais que cuidam deste tipo de violência, urge a necessidade de um cuidar mais humanizado. Torna-se imprescindível maior atenção a formação permanente e continuada destes profissionais para uma assistência mais efetiva às mulheres vítimas de violência sexual no Brasil. (shrink)

In this paper, we present a formal interpretive account of Jean Piaget’s theory of the morality that regulates social exchanges, which we call interactional morality. First, we place Piaget’s conception in the context of his epistemological and sociological works. Then, we review the core of that conception: the two types of interactional moralities that Piaget identified to be usual in social exchanges, and the role that the notion of respect-for-the-other plays in their definition. Next, we analyze the main features of (...) social exchanges that are subject to each of those two types of interactional moralities. Following, we formalize Piaget’s account of how the two types of interactional moralities can be put to regulate social exchanges in which values, norms, beliefs, and goals are exchanged, so that interactional commitments can be established among the participants. Then, we sketch a moral reasoning system able to support formal reasonings about interactional moralities. Finally, we illustrate the usefulness of the overall formal model of interactional moralities that resulted from our study by applying it to the explication of some of the conclusions achieved by Piaget in his moral studies about children games. Este artigo traz, desde uma perspectiva lógico-hegeliana, uma proposta de articulação operatória das noções de interseccionalidade e lugar de fala, com as quais, muitas vezes, se realizam análises de discursos e de situações sociais. O fundamento da proposta é a sequência de silogismos de ideias que, derivados da Lógica de Hegel, estratificam a noção de mundo em três níveis: mundo do sujeito, mundo do gênero e mundo do espírito. O artigo complementa esse fundamento introduzindo duas operações, particionamento de ideias e (...) superposição de partições de ideias, com as quais é derivado o conceito geral mundo setorial. O artigo mostra, então, como as noções de interseccionalidade e lugar de fala podem ser articuladas operatoriamente pelas três formas particulares e estratificadas desse conceito geral: mundo do sujeito setorial, mundo do gênero setorial e mundo do espírito setorial. The paper introduces the concept of relativistic ontological realism, and the corresponding notion of relativistic realization of objects. The conditions that allow for the relativistic realization of objects are determined. In particular, the paper indicates the way the imposition of organizational structures on already existent objects supports the relativistic realization of new, more complex ones. A type-theoretic presentation of the principles of relativistic ontological realism is given in the language of predicate calculus, making use of the notion of typed world (...) and the condition of effectiveness in the determination of the existence of objects. Two case studies illustrating the way the notion of relativistic ontological realism supports ontological analysis are presented, both concerning the ontology of computations, more specifically, the relativistic realization of computational levels in computational systems. The first case study deals with the realization of logical circuits through structural arrangements of electrical circuits. The second, with the realization of software systems through computer programming. A conception of the mechanics of the relativistic realization of objects, taking the imposition of organizational structures on previously extant objects as its basis, is proposed and briefly analyzed. 8 March, now known as International Women’s Day, is a day for feminist claims where demonstrations are organized in over 150 countries, with the participation of millions of women all around the world. These demonstrations can be viewed as collective rituals and thus focus attention on the processes that facilitate different psychosocial effects. This work aims to explore the mechanisms involved in participation in the demonstrations of 8 March 2020, collective and ritualized feminist actions, and their correlates associated with personal (...) well-being and collective well-being, collective efficacy and collective growth, and behavioral intention to support the fight for women’s rights. To this end, a cross-cultural study was conducted with the participation of 2,854 people from countries in Latin America and Europe, with a retrospective correlational cross-sectional design and a convenience sample. Participants were divided between demonstration participants and non-demonstrators or followers who monitored participants through the media and social networks. Compared with non-demonstrators and with males, female and non-binary gender respondents had greater scores in mechanisms and criterion variables. Further random-effects model meta-analyses revealed that the perceived emotional synchrony was consistently associated with more proximal mechanisms, as well as with criterion variables. Finally, sequential moderation analyses showed that proposed mechanisms successfully mediated the effects of participation on every criterion variable. These results indicate that participation in 8M marches and demonstrations can be analyzed through the literature on collective rituals. As such, collective participation implies positive outcomes both individually and collectively, which are further reinforced through key psychological mechanisms, in line with a Durkheimian approach to collective rituals. This work adopts H. Kelsen’s concept of legal system, proposes a formal definition for such notion, and introduces an operational semantical framework for legal systems that are situated in agent societies. Agent societies are defined. Relevant formal properties of situated legal systems are discussed; the way they are exposed in the operational semantical framework is explained, and their truth formally proved. Also, for the sake of a better understanding of the legal-theoretic assumptions of the paper, recurring issues regarding Kelsen’s theory (...) of law are briefly reviewed. They are put in confrontation with the points of view of R. Dworkin, H. Hart, and J. Raz, and an attempt is made to clarify them from the perspective of the provided formalization. A brief case study in agent-based modeling and simulation of public policy processes is presented, as an illustration of the way of using situated legal systems, and the proposed operational semantical framework, in a practical application. This paper presents an exercise in the formalization of political principles, by taking as its theme the concept of distributive justice that Karl Marx advanced in his Critique of the Gotha Programme. We first summarize the content of the Critique of the Gotha Programme. Next, we transcribe the core of Marx’s presentation of the concept of distributive justice. Following, we present our formalization of Marx’s conception. Then, we make use of that formal analysis to confront Marx’s principle of distributive justice (...) with John Rawls’ conception of justice as fairness, and the principles of distributive justice that derive from it. Finally, we discuss methodological issues relative to, and implications of, the way of formalizing political principles introduced here. (shrink)

BackgroundPreprint usage is growing rapidly in the life sciences; however, questions remain on the relative quality of preprints when compared to published articles. An objective dimension of quality that is readily measurable is completeness of reporting, as transparency can improve the reader’s ability to independently interpret data and reproduce findings.MethodsIn this observational study, we initially compared independent samples of articles published in bioRxiv and in PubMed-indexed journals in 2016 using a quality of reporting questionnaire. After that, we performed paired comparisons (...) between preprints from bioRxiv to their own peer-reviewed versions in journals.ResultsPeer-reviewed articles had, on average, higher quality of reporting than preprints, although the difference was small, with absolute differences of 5.0% [95% CI 1.4, 8.6] and 4.7% [95% CI 2.4, 7.0] of reported items in the independent samples and paired sample comparison, respectively. There were larger differences favoring peer-reviewed articles in subjective ratings of how clearly titles and abstracts presented the main findings and how easy it was to locate relevant reporting information. Changes in reporting from preprints to peer-reviewed versions did not correlate with the impact factor of the publication venue or with the time lag from bioRxiv to journal publication.ConclusionsOur results suggest that, on average, publication in a peer-reviewed journal is associated with improvement in quality of reporting. They also show that quality of reporting in preprints in the life sciences is within a similar range as that of peer-reviewed articles, albeit slightly lower on average, supporting the idea that preprints should be considered valid scientific contributions. IntroductionThere is a need to maintain rehabilitation activities and motivate movement and physical activity during quarantine in individuals with Cerebral Palsy.ObjectiveThis paper sets out to evaluate the feasibility and potential benefits of using computer serious game in a non-immersive virtual reality implemented and evaluated completely remotely in participants with CP for Home-Based Telerehabilitation during the quarantine period for COVID-19.MethodsUsing a cross-sectional design, a total of 44 individuals participated in this study between March and June 2020, 22 of which had CP (...) and 22 typically developing individuals, matched by age and sex to the individuals with CP. Participants practiced a coincident timing game1 and we measured movement performance and physical activity intensity using the rating of perceived exertion Borg scale.ResultsAll participants were able to engage with the VR therapy remotely, reported enjoying sessions, and improved performance in some practice moments. The most important result in this cross-sectional study was the significant increasing in rating of perceived exertion in both groups during practice and with CP presenting a higher rating of perceived exertion.ConclusionChildren with CP enjoyed participating, were able to perform at the same level as their peers on certain activities and increased both their performance and physical activity intensity when using the game, supporting the use of serious games for this group for home therapy and interactive games.Clinical Trials Registrationhttps://Clinicaltrials.gov, NCT04402034. This article elaborates on foundational issues in the social sciences and their impact on the contemporary theory of belief revision. Recent work in the foundations of economics has focused on the role external social norms play in choice. Amartya Sen has argued in [Sen93] that the traditional rationalizability approach used in the theory of rational choice has serious problems accommodating the role of social norms. Sen's more recent work [Sen96, Sen97] proposes how one might represent social norms in the theory (...) of choice, and in a very recent article [BS07] Walter Bossert and Kotaro Suzumura develop Sen's proposal, offering an extension of the classical theory of choice that is capable of dealing with social norms. The first part of this article offers an alternative functional characterization of the extended notion of rationality employed by Bossert and Suzumura in [BS07]. This characterization, unlike the one offered in [BS07], represents a norm-sensitive notion of rationality in terms of a pure functional constraint unmediated by a notion of revealed preference (something that is crucial for the application developed in the second part of this article). This functional characterization is formulated for general domains (as is Bossert and Suzumura's characterization) and is therefore empirically more applicable than usual characterizations of rationality. Interestingly, the functional constraint we propose is a variant of a condition first entertained in [AGM85] by Carlos Alchourrón, Peter Gärdenfors and David Makinson in the area of belief change. The second part of this article applies the theory developed in the first part to the realm of belief change. We first point out that social norms can be invoked to concoct counterexamples against some postulates of belief change (like postulate (*7)) that are necessary for belief change to be relational. These examples constitute the epistemological counterpart of Sen's counterexamples against condition α in rational choice (as a matter of fact, Rott has showed in [Rot01] that condition and postulate (*7) are mutually mappable). These examples are variants of examples Rott has recently presented in [Rot04]. One of our main goals in this article consists in applying the theory developed in the first part to develop a theory of norm-inclusive belief change that circumvents the counterexamples. We offer a new axiomatization for belief change and we furnish correspondence results relating constraints of rational choice to postulates of belief change. (shrink)

Carlos Alchourrón, Peter Gärdenfors and David Makinson published in 1985 a seminal article on belief change in the Journal of Symbolic Logic. Researchers from various disciplines, from computer science to mathematical economics to philosophical logic, have continued the work first presented in this seminal paper during the last two decades. This paper explores some salient foundational trends that interpret the act of changing view as a decision. We will argue that some of these foundational trends are already present, although (...) only tacitly, in the original article by the AGM trio. Other accounts decidedly depart from the view of contraction and revision presented in this seminal paper. I shall survey various types of theories that progressively depart form the axiomatic treatment defended by AGM. First, I consider theories where rational agents are considered as maximizers as opposed to optimizers ). Second, I consider which feasible set to use in contraction understood as a cognitive decision. This leads to rethink the very notion of what minimal change in contraction is. I shall conclude with some philosophical reflections concerning the sort of epistemological voluntarism that is tacit in seeing change in view as a rational choice. Este trabajo explora algunos aspectos fundacionalmente salientes que interpretan el acto de cambio de vista como una decisión. Argumentaremos que algunos de esos aspectos fundacionales ya estaban presentes, aunque solo tácitamente, en el artículo original del trío AGM. Otros abordajes parten decididamente de la contracción y revisión tal como fueran presentadas en el trabajo seminal. Inspeccionaré varios tipos de teorías que progresivamente parten del tratamiento axiomático defendido por AGM. Primero, considero teorías donde los agentes racionales aparecen como maximizadres opuestos a los optimiadores ). Segundo, me pregunto cuál conjunto derrotable debe usarse en una contracción entendida como una decisión cognitiva, lo cual lleva a repensar la importante cuestión de en qué consiste la noción de cambio mínimo en la contracción. Those profiled include Antonio Banfi, Sofia Vanni Rovighi, Enzo Paci, Dino Formaggio, Giuseppe Semerari, Enzo Melandri, Paolo Bozzi, Carlo Sini, Giovanni Piana and Paolo Parrini. This collection shows not only the variety of perspectives but also the inner consistency, peculiarity and originality of the tradition. (...) The illustrative case studies come from such faraway places as Latin America (San José, Costa Rica), Asia (Taipei, Taiwan), North America (New York City; Washington, D.C.; Philadelphia, Pennsylvania; and San [End Page 151] Antonio, Texas), Southern Europe (Smederevska Palanka, Serbia), and the Middle East (Beirut, Lebanon; Cairo, Egypt; and Tel Aviv, Israel).Spatializing Culture was first mentioned to me years ago by a former colleague at the University at Albany, SUNY. His ongoing work in Latin America, coupled with his ethnographic training and prior work in a region of the world also extensively examined by Low in other scholarly works, was likely the reason for bringing it up in a conversation about the latest developments in the field and potential research opportunities. I acquired the book when I was teaching Global Urbanism and Culture and International Urban Planning. I was pleasantly surprised with the book’s thorough conceptual lineage, historic characterizations, attention to detail, comprehensive ethnographic investigations, and implications for transforming reality as well as institutional processes. Spatializing Culture is a welcome addition to urban planning textbooks, which tend to be relatively less critical, are often covered with normative constructs and statistics, and are more institutional in their characterization of problems and recommendations for further action.For the most part, the ethnographic method is qualitative, participa-tory, detailed, and quite comprehensive in characterizing key variables as the researcher found them on the ground. This differs slightly from urban planning’s preoccupation with public policy, policy analysis, rules and regulations, institutionalized procedures, the public good, and overall positivist and rationalist concerns with documenting reality and helping to lead transformative planning processes, whether in the realm of land use, transportation, housing, economic development, infrastructure, or the environment. Although International Urban Planning was to be taught in a rather orthodox manner with recourse to understanding planning cultures, best practices, lessons learned, and implications for similar situations, the Global Urbanism and Culture course was slightly more aligned with the discussions put forward by Low. These included attention to postmodern ideals, the use of creativity in community planning, distinctions between popular and highbrow culture, and the building of iconic structures in contexts of urban regeneration and mega-event planning. It is well-known that da Costa's C-systems of paraconsistent logic do not admit a Blok-Pigozzi algebraization. Still, an algebraic flavored semantics for them has been proposed in the literature, namely using the class of so-called da Costa algebras. However, the precise connection between these semantic structures and the C-systems was never established at the light of the theory of algebraizable logics. In this paper we propose to study the C-systems from an algebraic point of view, and to fill (...) in this gap by using the tools and techniques of the newly developed behavioral approach to abstract algebraic logic. A nationwide survey that included personal interviews in 1,021 households studied the incidence, species, and numbers of nonhuman animals kept in Costa Rican households. A total of 71% of households keep animals.The proportion of households keeping dogs is 3.6 higher than the proportion of households keeping cats . In addition to the usual domestic or companion animals kept in 66% of the households, 24% of households keep wild species as pets. Although parrots are the bulk of wild species kept (...) as pets, there is vast species diversity, including other birds, reptiles, mammals, amphibians, fishes, and invertebrates - typically caught in their natural habitat to satisfy the pet market. The extraction from the wild and the keeping of such animals is by-and-large illegal and often involves endangered species. Costa Ricans, in a conservative estimate, keep about 151,288 parrots as pets. More than half the respondents have kept a psittacid at some point in their lives. Pet keeping is a common practice in Costa Rican society, and its incidence is high by international standards. (shrink)
