Soon there will be sex robots. The creation of such devices raises a host of social, legal and ethical questions. In this article, I focus in on one of them. What if these sex robots are deliberately designed and used to replicate acts of rape and child sexual abuse? Should the creation and use of such robots be criminalised, even if no person is harmed by the acts performed? I offer an argument for thinking that they should (...) be. The argument consists of two premises. The first claims that it can be a proper object of the criminal law to regulate wrongful conduct with no extrinsically harmful effects on others. The second claims that the use of robots that replicate acts of rape and child sexual abuse would be wrongful, even if such usage had no extrinsically harmful effects on others. I defend both premises of this argument and consider its implications for the criminal law. I do not offer a conclusive argument for criminalisation, nor would I wish to be interpreted as doing so; instead, I offer a tentative argument and a framework for future debate. This paper explores cultural understandings of virtual sexual ageplay in the online world of Second Life. Online sexual ageplay is the virtual simulation of child abuse by consensual adults operating in-world with child computer characters. Second Life is primarily governed by Community Standards which rely on residents to recognise sexual ageplay and report it, which requires an appreciation of how residents view, understand and construct sexual ageplay. The research presented drew on 12 months (...) of resident blog posts referring to sexual ageplay: 263 total, with 91 residents. The analysis of this talk explores the cultural understandings of this banned behaviour and beliefs about the nature of Second Life which underpin residents’ likelihood to report sexual ageplay and so comply with the Community Standards. In considering these issues the paper is able to highlight issues regarding the unique cultural position of abuse against children and key concerns which underpin the reporting behaviour of residents. Key considerations relate to defining online sexual activity and child avatars; the moral status of ‘reporters’, and sexual ageplay as a form of edgeplay; belief in the harmfulness of sexual ageplay and its relationship to real world behaviours. Novello, Henry We all know that these are difficult times for the Catholic Church in Australia as it grapples with the scandalous and painful issue of child sexual abuse by some clergy, religious, and lay church personnel. The Commonwealth Royal Commission investigating institutional responses to child sexual abuse, announced by Prime Minister Julia Gillard on 12 November 2012, has made life for the faithful even more difficult, as the Catholic Church in Australia comes under (...) intense and continual public scrutiny. The church's Towards Healing protocol for responding to incidents of child sexual abuse acknowledges that not just the victims and their families but the 'whole Church community has been affected by incidents of abuse, for all Catholic people have been dismayed by the stories they have heard'. Thankfully, a spirit of sincere cooperation with the work of the Royal Commission is discernible on the part of the Catholic Church today, as both share in the objective of providing satisfaction to the victims and improving institutional responses as best they might. Obstacles in dealing with child sexual abuse can hinder survivors in the process of coming to terms with their experiences. The present study aims to identify and analyze factors that may pose obstacles in the long-term process of dealing with CSA. It is part of a larger research consortium “Auf-Wirkung,” funded by the German Federal Ministry of Education and Research, and was conducted in cooperation with the Independent Inquiry into Child Sexual Abuse in Germany. (...) The IICSAG was appointed by the Independent Commissioner for Child Sexual Abuse Issues and the German Federal Ministry for Family Affairs, Senior Citizens, Women, and Youth in 2016. To determine responsibilities, recognize injustice, and further acknowledge the survivors of CSA in the Federal Republic of Germany and the German Democratic Republic, the Independent Inquiry has held 1,303 private sessions with survivors of CSA by Oct. 17th, 2020. The present study focuses on exploring reoccurring problematic experiences reported by survivors in private sessions regarding the long-term process of dealing with experiences of CSA. A total of 30 transcripts of private sessions, conducted by members and appointees of the IICSAG between September 2016 and June 2019, were analyzed using qualitative content analysis. Attendants of private sessions described a variety of obstacles, including negative social reactions to disclosure, institutions' unwillingness to elucidate occurrences of CSA within their midst, as well as general financial difficulties, and those linked to redress claims. Manipulative grooming by perpetrators and limited access to adequate psychotherapy were perceived as obstructive by survivors dealing with CSA. In the context of criminal proceedings, survivors reported long durations of court proceedings and negative experiences in connection to credibility assessment. Results will be discussed to better support survivors of CSA in the process of dealing with their experiences in the future. (shrink)

This article tests the adequacy of social constructionism from a critical realist standpoint by examining a single social problem in some detail: child sexual abuse. A continuum of positions in the research literature is explored, ranging from strong social constructionism and its justificatory emphasis deriving from social and historical relativism to a position that, while accepting ‘weak constructionism’, prioritizes the real abiding features of sexual violence against children and the proven harm it creates in any social (...) context. That critical examination of competing views on the topic places a particular emphasis upon the rhetorical power of the conceptualization of concern about child sexual abuse as a ‘moral panic’. The notion of a moral panic brings with it assumptions about the degree of confidence we can have in the extent of child sexual abuse in modernity, its wrongfulness, the assumed harm that accrues to victims and the costs to society in its wake. The paper is composed of two parts. The first part covers juvenile delinquency with all its characteristics. When analyzing the delinquency, we gave a special place to the socio-pathological phenomena which is more and more present and the rate is higher from year to year. Social pathology is a huge issue that requires special commitment, first, for its detection and then prevention. Within the delinquency, we also cover the most common crimes committed by juveniles. In the second part of this (...) paper, the authors deal in more details with a specific form of crime which can also be committed by juveniles: child sexual abuse and pedophilia. First, the difference between child sexual abuse and pedophilia will be discussed, a difference that is of particular importance in cases where minors are abusers. Furthermore, the main characteristics of cases when both perpetrators and victims of sexual abuse are minors will be addressed. Although these criminal offenses are rarer in practice unlike the criminal offenses and deviant behaviors treated in the first part, however, knowing the main characteristics and specifics of such cases is of particular importance for the legal-criminal treatment of the perpetrators of these criminal offenses. This article provides Catholic authorities with a useful framework for forming prudent and just policies to minimize clerical child sexual abuse, exploiting the 2011 John Jay College report Causes and Context while not ignoring its shortcomings. The framework is St. Thomas Aquinas’s treatment of prudence, and a “profile” of the clerical perpetrators is developed that uses their narcissism as a middle term to explain why these men behaved the way they did. The author concludes by recommending a (...) deterrent policy similar to the policy advocated by St. Paul, which does not unrealistically aim at an angelic clergy but aims to deter those who would enter the priesthood for its benefits. Building rapport is considered important in investigative interviewing of children about alleged sexual abuse, but theoretical understanding of the nature of rapport and how to judge its presence remains sketchy. This article argues that the conversation analytic concept of progressivity may provide empirical tractability to the concept of rapport and indeed may be partially what people are detecting when they judge the presence of rapport. A single case is analysed, drawn from a corpus of 11 video-taped interviews with (...) children conducted by police in an Australian sexual crime unit. Analysis focuses on how the interviewer responds when progressivity breaks down, and how restoration is collaboratively achieved. Findings are discussed in terms of implications for future work that might investigate a more thoroughly social interactional account of rapport, and in terms of new ideas about what might constitute skilful interviewing practices amongst investigative interviewers. In this paper we draw attention that there have been significant increases in activity relating to child sexual abuse and exploitation on both the surface web and dark web during the COVID-19 lockdown period. This paper aim is an analyse about how the COVID-19 pandemic is presently modifying the trends and threats of child sexual exploitation and abuse offences, which were already at high levels prior to the pandemic. This article highlights the trends and (...) threats in the current COVID-19 context compared to pre-pandemic measures, what impact these are having in the short-term, and what changes we have seen when COVID-19 measures are reduced. It contributes to the space of the dark web during lockdown by manifestation on the ongoing organised business model that has evolved as technology expands and the level of threat that it poses to children. The objective is to share these trends across the global law enforcement community and science in order to improve the monitoring and detection of child sexual exploitation and abuse online, further investigations and global police response. Nurses and doctors who deal with human lives have started questioning their own decisions and practices particularly when there is an ethical dilemma. To survive competently within the profession and to make ethical decisions for the client’s safety, one needs to be equipped with knowledge pertaining to Bio-Ethics. This paper brings attention to a real life dilemma of a sixteen year old female child who had been sexually abused by one of her family friends. She insisted the school health (...) nurse to keep the information confidential, particularly from her parents. Consequently, the nurse had to confront a real dilemma regarding the disclosure of information to the parents of the victim. If the nurse respected the client’s autonomy to take her own decisions, then probably she may have put the client’s life at stake as she would not get any support, guidance and protection from further abuse. This paper will examine the role of health nurse or professionals in school setting for client safety. This qualitative study analysed the agency of eight non-abusing mothers in the Turkish Cypriot Community after disclosure that their child had been sexually abused by someone outside the family. The aim was to discover how, after disclosure, such mothers act to protect their children in the contexts of their family and community. The data were gathered via semi-structured in-depth interviews and analysed using Interpretative Phenomenological Analysis. In the nuclear family context, maternal agency emerged in the form of motherhood skills, (...) including emotionally supporting the abused child, double-checking the child’s safety or limiting the child’s mobility, and controlling the actions of adult sons. In the community context, maternal agency was manifested in efforts to prevent men in the extended family or the abuser’s family from concealing the abuse and to obtain informal support from others such as birth or extended family members. The women were usually successful in hiding their reactions or making decisions in their children’s best interest despite frequently having to cope with the reality of living in a restrictive and patriarchal culture. The results emphasise the need for working with the general public and professionals to change the culture of silence and to improve the social support network for sexually abused children and non-abusing family members, especially mothers. This article illustrates the practical usefulness of transdisciplinary work for practical theology by showing how input from an occupational therapist informed my understanding and interpretation of the story of Hannetjie, who had been sexually abused as a child. This forms part of a narrative practical theological research project into the spirituality of female adult survivors of childhood sexual abuse. Transdisciplinary work is useful to practical theologians, as it opens possibilities for learning about matters pastors have to face, (...) but may not have knowledge about. A short retelling of Hannetjie’s story is given to provide information about the context of the research. Next, the transdisciplinary process that was followed is mentioned, and the questions that the transdisciplinary team had to respond to are discussed. Following that, I focus more specifically on the occupational therapist’s answers, and the knowledge gained from her contribution, as an example of how a co-researcher from a divergent discipline can inform a theological study. In this case, knowledge was shared about sensory integration and how the brain processes traumatic stimuli, such as sexual abuse. Lastly, the interrelationship between Hannetjie’s body stories, mind stories and spirit stories is discussed to show how the learning received from occupational therapy affected my thinking about Hannetjie’s stories and the relationships between them. Thus, it is concluded that transdisciplinary work has great value for practical theology, especially in the pastor’s daily work with people who are struggling with difficult stories, because we cannot listen to people’s spirit stories in isolation. Due to evidence that traumatic experience impacts the brain, the body (concerning sensory sensitivity), and the mind, a recent study that attempted to answer the question of whether the effects of CSA can be reversed by using a multidisciplinary approach consisting of dual treatments: hyperbaric & psychotherapy, was conducted. Its results showed that in addition to improvement of brain functionality, symptoms of distress were significantly reduced. The current paper aims to present the process as experienced by the 40 female childhood (...) sexual abuse survivor participants. Data included participants’ daily journals and drawings, and participants’ summaries presented verbally and written, 6-months after the study ended. A phenomenological analysis was used. Results showed three phases, the initial phase – remembering the trauma from both physical and cognitive aspects, the second phase - physiological relaxation as well as positive memories emerge; and, the third phase – bouncing back to life. The results are discussed in light of the study theoretical model and Lev-Wiesel (2014) childhood sexual abuse conceptualization. (shrink)

IN MANY CHURCH-BODY DISPUTES OVER THE MORAL STATUS OF SAME-gender unions, the last line of defense against the affirmation of such unions is often an appeal to homosexual orientation as inherently "disordered," rendering same-gender unions unacceptable regardless of the loving and just qualities they may embody. On the basis of a biblical anthropology shaped by the eschatological orientation of the scriptures and further enhanced by contemporary Trinitarian discourse, this essay engages and challenges this traditional view as it has been developed (...) in the theological ethics of Helmut Thielicke. Sexual abuse of minors by Catholic priests has been a persistent and widespread problem in the Church. Although more than 80 percent of victims have been boys, prior studies have rejected the idea that the abuse is related to homosexuality among priests. Available data show, however, that the proportion of homosexual men in the priesthood is correlated almost perfectly with the percentage of male victims and with the overall incidence of abuse. Objective: The aim of the current study was to investigate associations, unique and interactive, between mothers’ and children’s histories of childhood sexual abuse (CSA) and children’s psychiatric outcomes using an intergenerational perspective. Further, we were particularly interested in examining whether maternal reflective functioning about their own trauma (T-RF) was associated with lower likelihood of children’s abuse exposure (among children of CSA-exposed mothers). Method: One hundred and eleven children (Mage= 9.53 years; 43 sexual abuse victims) and (...) their mothers (Mage= 37.99; 63 sexual abuse victims) participated in this study. Mothers completed the Parent Development Interview (PDI), which yielded assessments of RF regarding their own experiences of abuse, and also reported on their children’s internalizing and externalizing symptoms. Results: Children of CSA-exposed mothers were more likely to have experienced CSA. A key result was that among CSA-exposed mothers, higher maternal T-RF regarding their own abuse was associated with lower likelihood of child CSA-exposure. Mothers’ and children’s CSA histories predicted children’s internalizing and externalizing symptoms, such that CSA exposure for mother or child was associated with greater symptomatology in children. Conclusions: The findings show that the presence of either maternal or child CSA is associated with more child psychological difficulties. Importantly in terms of identifying potential protective factors, maternal T-RF is associated with lower likelihood of CSA exposure in children of CSA-exposed mothers. We discuss these findings in the context of the need for treatments focusing on increasing Trauma - RF in mothers and children in the context of abuse to facilitate adaptation and reduce the intergenerational risk. ABSTRACTThis paper examines in detail the quality of the relationship the Catholic Church in its Sydney Archdiocese had with its lawyers in the John Ellis matter as revealed in the Royal Commission into Institutional Responses to Child Sexual Abuse inquiry. It identifies the particular moral perspective embedded in its lawyers' adversarial approach and asks whether a different approach involving explicit moral conversations might have better served the Church's avowed pastoral ethos.

Questions about when it is right for police forces to investigate alleged offences committed in the more or less distant past have become increasingly pressing. Recent widely publicized cases of child sexual abuse (CSA) and exploitation, sometimes involving high profile individuals, have illustrated the ethical, psychological, and forensic complexities of investigating non-recent child sexual abuse. Hannah Maslen and Colin Paine have developed the Oxford CSA Framework to assist police to weigh the various ethical considerations (...) that militate for and against initiating a CSA investigation. While such a tool is to be welcomed, and while there is much that is helpful in Maslen and Paine's approach, we suggest that the Oxford CSA framework could be strengthened. Our first suggestion is to abandon a proposed distinction between a set of considerations that is said to generate a “presumption” in favor of investigation and other considerations that may supplement or oppose this presumption. Our second suggestion is to review the weightings applied to the considerations within the model, which lack clear justification and create problematic effects. Finally, we suggest that referring the Oxford CSA Framework to a panel with lived and professional experience of CSA could serve important procedural justice goals and enhance the Framework's recommendations. Using extra familial child sexual abuse as an example of family trauma, the author interviewed 60 parents of sexually abused boys on multiple occasions to analyze the organization of gender, race, and class in parental coping processes. Despite access to alternative interpretations of CSA that challenge conventional notions of gender, parents in this study typically rely on traditional themes to make meaning of the CSA experience. The author organized the data analytically around gender strategies and found that (...) parents used race- and class-specific gender strategies in the aftermath of trauma. Most important, mother-blame is theorized as a form of gender reaffirmation. The author uses the term gender reaffirmation to illustrate the way social actors recuperate after a situation has been interpreted as detrimental, challenging, or stressful to heteronormative gender relations. Mother-blaming accounts encouraged race and class enactments of gender that had negative consequences for women and helped maintain men’s cultural power. (shrink)

The aim of the present study was to gain a first-person perspective on the experiences of technology-assisted child sexual abuse (TA-CSA), and a deeper understanding of the way it may affect its victims. Seven young women (aged 17–24) with experience of TA-CSA before the age of 18 participated in individual in-depth interviews. The interviews were teller-focused with the aim of capturing the interviewee’s own story about how they made sense of their experiences over time, and what impact (...) the victimization had on them in the short and long terms. Thematic analysis of the interviews revealed a broad range of abusive experiences that had profoundly impacted the individuals’ lives, health and self-concepts. Three dominant themes emerged from the analysis –From thrilling to abusive,Negative effect on health and wellbeing, andA new self after the abuse.From thrilling to abusivecaptures the wide range of experiences described, starting from the child’s own sexual curiosity to descriptions of having been manipulated or threatened into engaging in sexual activity, as well as the sometimes long and complex process of understanding the severity of one’s experiences.Negative effect on health and wellbeingdescribes the victimization’s comprehensive impact on the life and health of the participants, how they blamed themselves for what had happened, and the struggle of having to live with the constant fear of pictures from the abuse resurfacing.A new self after the abusedepicts how the victimization impacted the way participants viewed and thought about themselves in relation to others, and distorted their views of their bodies. The findings are discussed in relation to previous research on both offline CSA and TA-CSA, as well as theoretical and practical implications. (shrink)

Children may be abused physically, sexually, emotionally and by omission or commission in any permutation under these headings. This is discussed in terms of the separate and overlapping responsibilities of parents, guardians, the community in which they live and the network of professional services developed to care for, protect and educate children. An attempt is made to place these issues within an ethical framework, with regard to the legislature of England and Wales. It is argued that professionals working within this (...) field have an obligation either to keep up to date in respect of a large and growing body of research and practice knowledge or to consult 'experts' within the field when making complex and far-reaching decisions on behalf of abused children and their families. As the suspect interview is one of the key elements of a police investigation, it has received a great deal of merited attention from the scientific community. However, suspect interviews in child sexual abuse investigations is an understudied research area. In the present mixed-methods study, we examine Swedish and Norwegian police interviewers' self-reported goals, tactics, and emotional experiences when conducting interviews with suspected CSA offenders. The quantitative analyses found associations between the interviewers' self-reported goals, tactics, and emotions (...) during these types of suspect interviews. Interviewers who reported experiencing more negative emotions were more likely to employ confrontational tactics. Specifically, anger was positively associated with the goal of obtaining a confession and with aggressive tactics like raising one's voice and emphasizing the seriousness of the crime. Frustration and disgust displayed similar patterns. Somewhat contrasting these quantitative results, the thematic analysis identified a strong consensus that emotions should not and do not affect the police interviewers' work. Furthermore, the police interviewers described a range of strategies for managing emotions during the interview and for processing their emotional reactions afterwards. The present findings highlight the relevance of emotional processes in CSA suspect interviews and provide an initial exploration of the potentially complex relationship between the goals, tactics, and emotional experiences of police interviewers who question CSA suspects. In H.M. Advocate v. Grimmond1 the judge in a Scottish High Court trial refused permission for expert psychological evidence to be admitted on behalf of the Crown in a prosecution involving sexual offences against two children. The Crown had sought to lead an expert witness to explain to the jury about patterns of disclosure in child sexual abuse cases. The case was remarkable, not so much for the strict application of the longstanding rule in R. v. (...) Turner that constrains the use in the courtroom of expert evidence from the behavioural sciences, but for the way in which the arguments presented by the Crown in Grimmond resonate with enduring feminist critiques regarding the treatment of women in rape trials. The theoretical issues raised by the decision include the quest for context to counter rigid evidential frameworks, and the choice of a child sexual abuse case as the medium for challenging the boundaries of the admissibility of expert evidence in the courtroom. The ramifications of Grimmond are tangible as legislation intended to benefit children and women has already been enacted by the Scottish Parliament to ameliorate the effects of the decision. This article suggests that while this legislation should be given a cautious welcome it remains to be seen whether the heralded benefits will actually materialise. (shrink)

Persons who commit crimes involving sexual abuse of children exploit their victims in several ways. Sex offenders use their power and authority over vulnerable children to whom they have easy access. Teachers, coaches, clergy, family members and childcare workers have been exposed as sex offenders. The Pennsylvania State University football coach, Jerry Sandusky, is now in prison for his many crimes. The widespread cover up of sexual abuse by Catholic priests in the USA and other (...) countries is a horrendous scandal. It is not surprising that law enforcement, mental health professionals, victims and their families are outraged. It is no surprise that radical interventions such as chemical or surgical castration are a response to the public pressure to protect children from molestation.I agree with Professor John McMillan's thoughtful discussion and nuanced analysis of surgical castration.1i He concludes that surgical castration of sex offenders is ethically permissible if these conditions are met: Castration should be requested by the sex offender. Informed consent from a competent sex offender is required. Consent to castration must not be coerced via threats or inducements.He also says that “castration might be useful for the reconfiguring of a life that has gone badly awry.”To supplement his discussion I will describe a state law in Texas2 that permits voluntary surgical castration for repeat child molesters while they are incarcerated as …. A paedophile is a person with a sexual attraction to children; some paedophiles commit child sex abuse offences. For such acts, they hold moral and legal responsibility, which presupposes that paedophiles are moral agents who can distinguish right from wrong and are capable of self-control. Like any other moral agents, paedophiles have moral duties. Some moral duties are universal, e.g., the duty not to steal. Whether there are any specific moral duties related to paedophilia is the topic (...) of this paper. I argue that the moral duty not to commit child sex abuse is universal, and the duty to reduce the individual risk of child sex abuse is specific to paedophiles. I further argue that any society has a moral duty to help paedophiles reduce the risk. Both duties provide grounds for moral judgement. Paedophiles should be judged not for their sexual interest but for their efforts to avoid child sex abuse. If a paedophile has an opportunity to reduce the risk of child sex abuse, he is obliged to do so. Unfortunately, societies rarely provide such opportunities and hence fail in their moral duty to paedophiles and children. (shrink)

Denunciations of child sexual abuse in the sport context have been increasing in the last decades. Studies estimate that between 14 and 29% of athletes have been victim of at least one form of sexual violence in sport before the age of 18. However, studies suggest that many do not disclose their experience of CSA during childhood. This finding is alarming since studies have shown that the healing process usually starts with disclosure. Moreover, little is known (...) about the healing process of CSA experienced in the sport context. The aim of the study is to present a single case study of a CSA in sport to better understand the global experience over time from the perspective of the athlete. A narrative inquiry approach was adopted. Three non-structured interviews were conducted with the participant. Three pathways in the survivor journey have been identified through inductive thematic analysis: pathway to understanding, pathway to disclosure, and pathway to healing. These pathways represent distinct processes but are intertwined as they are dynamic and iterative. Indeed, the survivor explained how she had been, and is still, going back and forth between them. Results are consistent with those found in the literature on CSA in the general population. It suggests that theoretical models of CSA in the general population could be applied to CSA in sport. Practical implications include a need for education and clearer boundaries in the coach-athlete relationship. Sport stakeholders also need to be better equipped to recognize the signs of sexual violence in sport. Our results indicate that qualitative research could be a potential avenue to help victims heal from CSA. It gives them the chance to talk about and make sense of their abuse in a safe space. Finally, our results demonstrate the importance of reviewing the current justice system for victims. It should be based on a trauma-informed approach that places the victim at the center of the judicial process. (shrink)
