Road) langfristig auf Kryptowährungen und infolgedessen wo- möglich auch auf die Blockchain-Technologie, nicht nur im Hinblick auf die rechtswidrigen Inhalte wie Kinderpornographie, auswirken. This article summarizes the current status of the legal challenges of blockchain technology. Similar to the World Wide Web, Blockchain represents a kind of basic technology on the basis of which new platforms and business models can be created. However, the question arises as to whether the German legal system is fundamentally capable of mastering the challenges posed by such a decentralized technology. In particular with regard to criminal offences or the new Basic Data Protection Ordinance. The question is how the current negative headlines (e. g. Silk Road) will affect crypto currencies in the long term and, as a result, blockchain technology, not only with regard to illegal content such as child pornography. ". (shrink)

Die Krisenhaftigkeit der jüngeren und jüngsten Zeit ist unübersehbar. Von daher ist auch das verstärkte Bemühen um Verantwortung in Politik und Gesellschaft zu verstehen. Verantwortliches Handeln ist dabei keineswegs unpopulär. Aber es zeigt sich auch, dass es sich in alltagsmoralischen Überzeugungen nicht von alleine durchsetzt, oder in sein Gegenteil verkehrt wird, wenn es bspw. Von Marketingstrategien des 'green-washing' vereinnahmt wird. Die mit einem Geleitwort von Frau Rita Süssmuth versehenen fünf Vorlesungen der Studium Universale-Ringvorlesung 'Kultur der Verantwortung - Verantwortung der Kultur' (...) der Heinrich-Heine-Universität dis-kutieren deshalb auf 120 Seiten einmal die Herkunft und die Widersprüchlickkeit des Verantwortungsprinzips, aber auch die Chancen einer 'neuen Ära der Verantwor-tung' (Ludger Heidbrink). In einer zweiten Vorlesung werden Gründe dafür genannt, warum es auch ethisch vertretbar sein kann, Wirtschaftsunternehmen in Teilen von einer generellen Verpflichtung zur globalen Verantwortung zu entbinden (Michael Baurmann). Dem Zusammenhang von Verantwortung und Kultur gehen an den Beispielen des Intellektuellen und der Avantgardekunst zwei weitere Vorlesungen nach. Während der Intellektuelle in der heute stark medialisierten Öffentlichkeit seine traditionelle Funktion als Kritiker staatlicher und ökonomischer Machtverhältnisse zuneh-mend verliert (Bernd Witte), scheint diese Rolle von den aktivistischen Kunstpraktiken der Avantgarde und der ihr entsprechenden Museumskultur aufgegriffen worden zu sein (Lutz Hieber). Mit der abschließenden Vorlesung wird der Blick auf eine außereuropäische Gesellschaft und Kultur geworfen und gezeigt, wie die offizielle Innen- und Außen-Politik Chinas einer 'harmonischen Gesellschaft und einer harmonischen Welt' sich zwar auf eine konfuzianische Tradition beruft, in der Alltagswirklichkeit diese aber immer wieder wegen tief sitzender Ängste vor einem Zerfall des Riesenreichs unterläuft (Carmen Meinert). In lieu of an abstract, here is a brief excerpt of the content:The Thought and Legacy of Masao AbeChristopher IvesMasao Abe stands as the most important Buddhist in modern interfaith dialogue and the main transmitter of Zen thought to the West following the death of D. T. Suzuki. His most widely read work, Zen and Western Thought, edited by William LaFleur, won an award in 1987 from the American Academy of Religion as the best recent publication in the “constructive and (...) reflective” category. Abe followed that influential volume with further collections of essays edited by Steven Heine: Buddhism and Interfaith Dialogue, Zen and Comparative Studies, and Zen and the Modern World. Abe also wrote widely in Japanese, with his most mature thought finding expression in several volumes he published later in life: Kongen no shuppatsu (Starting from the Root), Kyogi to kyomu (Falsehood and Nihility), and Hibutsu hima (Neither Buddha nor Devil).Abe also made significant contributions to the study of the renowned Sōtō Zen thinker Dōgen (1200–1253). With Norman Waddell he translated a number of fascicles of Dōgen’s Shōbō-genzō, which appeared in The Eastern Buddhist and were then compiled as The Heart of Dōgen’s Shōbō-genzō. Abe published his own essays on Dōgen, again with Heine’s editorial help, in the volume Dōgen: His Philosophy and Religion. In such journals as International Philosophical Quarterly, Abe also published essays on Nishida Kitarō and other Kyoto school thinkers, and with me he translated Nishida’s seminal work, Zen no Kenkyū (An Inquiry into the Good).In the 1980s, Abe and his main Christian dialogue partner, process theologian John Cobb, started the North American Buddhist-Christian Theological Encounter. They were also instrumental in the founding of the Society for Buddhist-Christian Studies. Abe crafted a specific representation of śūnyatā that he repeated in a range of writings and conferences—so much so that Nagatomi Masatoshi, when he was teaching at Harvard, referred to Abe as “Mr. Sunyata.” Though at times his readers may have wanted Abe to revise or elaborate certain parts of his presentation of śūnyatā, I think we may actually have benefited from how he stuck with his discourse, for he provided us with a fairly fixed and consistent point of reference around which to organize our own thoughts, comparisons, and critiques.In terms of specifics, Abe advanced śūnyatā as the metaphysical and spiritual foundation of all religions, including monotheistic traditions, and as the optimal basis on which humanity could, while dealing with antireligious ideologies and interreligious conflict, help ground a new global community beyond nation-states. In “Kenotic God and Dynamic Sunyata,” probably his most widely read essay, he makes these and related arguments after examining the Christian notion of kenosis—divine self-emptying—as a fruitful point of comparison with śūnyatā. Along the way he echoes the Buddhist call for people to “empty” themselves and thereby break through karma, turn ignorance into wisdom, and deliver themselves beyond the realm of ordinary discriminating thought—including dualistic ethical reflection—and into the depth dimension of śūnyatā.In this engagement with... Behavioral scientists routinely publish broad claims about human psychology and behavior in the world's top journals based on samples drawn entirely from Western, Educated, Industrialized, Rich, and Democratic (WEIRD) societies. Researchers – often implicitly – assume that either there is little variation across human populations, or that these “standard subjects” are as representative of the species as any other population. Are these assumptions justified? Here, our review of the comparative database from across the behavioral sciences suggests both that there is (...) substantial variability in experimental results across populations and that WEIRD subjects are particularly unusual compared with the rest of the species – frequent outliers. The domains reviewed include visual perception, fairness, cooperation, spatial reasoning, categorization and inferential induction, moral reasoning, reasoning styles, self-concepts and related motivations, and the heritability of IQ. The findings suggest that members of WEIRD societies, including young children, are among the least representative populations one could find for generalizing about humans. Many of these findings involve domains that are associated with fundamental aspects of psychology, motivation, and behavior – hence, there are no obviousa priorigrounds for claiming that a particular behavioral phenomenon is universal based on sampling from a single subpopulation. Overall, these empirical patterns suggests that we need to be less cavalier in addressing questions ofhumannature on the basis of data drawn from this particularly thin, and rather unusual, slice of humanity. Machine intelligence already helps medical staff with a number of tasks. Ethical decision-making, however, has not been handed over to computers. In this proof-of-concept study, we show how an algorithm based on Beauchamp and Childress’ prima-facie principles could be employed to advise on a range of moral dilemma situations that occur in medical institutions. We explain why we chose fuzzy cognitive maps to set up the advisory system and how we utilized machine learning to train it. We report on the (...) difficult task of operationalizing the principles of beneficence, non-maleficence and patient autonomy, and describe how we selected suitable input parameters that we extracted from a training dataset of clinical cases. The first performance results are promising, but an algorithmic approach to ethics also comes with several weaknesses and limitations. This book provides an innovative, critical textual and literary analysis, in light of Song dynasty (960-11279) Chinese cultural and intellectual historical trends, of the Blue Cliff Record, the seminal Chan/Zen Buddhist collection of commentaries on one hundred gongan/koan cases long celebrated for its intricate and articulate interpretative methods.

This study takes inquiry as the starting point for epistemological theorising. It uses this idea to develop new and systematic answers to some of the most fundamental questions in epistemology, including about the nature of core epistemic phenomena as well as their value and the extent to which we possess them.

The coherence objection to the doctrine of the Incarnation maintains that it is impossible for one individual to have both the attributes of God and the attributes of a human being. This article examines Thomas Aquinas’s answer to this objection. I challenge the dominant, mereological interpretation of Aquinas’s position and, in light of this challenge, develop and defend a new alternative interpretation of Aquinas’s response to this important objection to Christian doctrine.

Assertion is the central vehicle for the sharing of knowledge. Whether knowledge is shared successfully often depends on the quality of assertions: good assertions lead to successful knowledge sharing, while bad ones don't. In Sharing Knowledge, Christoph Kelp and Mona Simion investigate the relation between knowledge sharing and assertion, and develop an account of what it is to assert well. More specifically, they argue that the function of assertion is to share knowledge with others. It is this function that (...) supports a central norm of assertion according to which a good assertion is one that has the disposition to generate knowledge in others. The ethics of autonomous cars and automated driving have been a subject of discussion in research for a number of years :28–58, 2016). As levels of automation progress, with partially automated driving already becoming standard in new cars from a number of manufacturers, the question of ethical and legal standards becomes virulent. For exam-ple, while automated and autonomous cars, being equipped with appropriate detection sensors, processors, and intelligent mapping material, have a chance of being much safer than human-driven cars in (...) many regards, situations will arise in which accidents cannot be completely avoided. Such situations will have to be dealt with when programming the software of these vehicles. In several instances, internationally, regulations have been passed, based on legal considerations of road safety, mostly. However, to date, there have been few, if any, cases of a broader ethics code for autonomous or automated driving preceding actual regulation and being based on a broadly composed ethics committee of independent experts. In July 2016, the German Federal Minister of Transport and Digital Infrastructure, Alexander Dobrindt, appointed a national ethics committee for automated and connected driving, which began its work in September 2016. In June 2017, this committee presented a code of ethics which was published in German and in English. It consists of 20 ethical guidelines. Having been a member of this committee, I will present the main ethical topics of these guidelines and the discussions that lay behind them. (shrink)

In this essay, I argue that a proper understanding of the historicity of love requires an appreciation of the irreplaceability of the beloved. I do this through a consideration of ideas that were first put forward by Robert Kraut in “Love De Re” (1986). I also evaluate Amelie Rorty's criticisms of Kraut's thesis in “The Historicity of Psychological Attitudes: Love is Not Love Which Alters Not When It Alteration Finds” (1986). I argue that Rorty fundamentally misunderstands Kraut's Kripkean analogy, and (...) I go on to criticize her claim that concern over the proper object of love should be best understood as a concern over constancy. This leads me to an elaboration of the distinct senses in which love can be seen as historical. I end with a further defense of the irreplaceability of the beloved and a discussion of the relevance of recent debates over the importance of personal identity for an adequate account of the historical dimension of love. This handbook article gives a critical overview of recent discussions of epistemic authority. It favors an account that brings into balance the dictates of rational deference with the ideals of intellectual self-governance. A plausible starting point is the conjecture that neither should rational deference to authorities collapse into total epistemic submission, nor the ideal of mature intellectual self-governance be conflated with (illusions of) epistemic autarky.

Medieval philosophers had a predilection for using the correlative pair father and son as an illustrative example in their discussions of relations. The use of this example has sometimes led to charges of confusion on the grounds that fatherhood and sonship are not proper converses. The present article shows how a group of twelfth-century philosophers from the milieu around the logician Alberic of Paris handled the problems arising from the use of this illustrative example which they had inherited from their (...) ancient and late-ancient predecessors. Do responsibility voids exist? That is, are there situations in which the group is collectively morally responsible for some outcome although no member can be held individually morally responsible for it? To answer these questions, I draw a distinction between competitive and cooperative decision contexts based on the team-reasoning account of cooperation. Accordingly, I provide a reasoning-based analysis of cooperation, competition, moral responsibility, and, last, potential responsibility voids. I then argue that competitive decision contexts are free of responsibility voids. The (...) conditions for the existence of responsibility voids in cooperative decision contexts depend on the type of uncertainty the group faces, either external or coordination uncertainty. This paper examines two strands of literature regarding economic models of cooperation. First, payoff transformation theories assume that people may not be exclusively motivated by self-interest, but also care about equality and fairness. Second, team reasoning theorists assume that people might reason from the perspective of the team, rather than an individualistic perspective. Can these two theories be unified? In contrast to the consensus among team reasoning theorists, I argue that team reasoning can be viewed as a particular type of (...) payoff transformation. However, I also demonstrate that many payoff transformations yield actions that team reasoning rules out. (shrink)

Should one trust experts? My answer to this question is a qualified ‘no’. In this paper I explore the conditions under which it is rational to trust and defer to experts, and those under which it may be rational to refrain from doing so. I draw on two important factors for an actor’s trust in a partner: trust depends on the partner’s competence and on the partner’s interests. I propose that the conditions under which it is rational to trust and (...) defer to experts depend on the competences of the layperson and the expert, and the degree of interest alignment. I present a model that demonstrates that it can be practically infeasible and even logically impossible to determine the expert’s level of competence and the degree of interest alignment. Although it may sound pessimistic that one can rationally refrain from trusting experts, I will also explore some more optimistic conclusions. (shrink)

Historically, blatantly untrue and defamatory conspiracy theories had disastrous consequences for those who were portrayed in them as evil-doers. At the same time, conspiratorial agreements at the expense of the common good between powerful groups in society do exist and have occasionally been uncovered. Against this background, the article describes different ways in which critical theory has looked at conspiracies. First, an attempt is made to show that Max Horkheimer's notes on `rackets' are an ambitious but flawed attempt to theorize (...) conspiracy. It is argued that Horkheimer's theory is imbued by the very conspiracy thinking that he proposed to criticize. Second, the author suggests recovering Franz Neumann's concept of `political alienation' as a more appropriate starting point to think critically about the ethical and epistemological questions raised by conspiracy theories. This paper is built around a single, simple idea. It is widely agreed that there is a distinctive kind of awareness each of us has of his own bodily actions. This action-awareness is different from any perceptual awareness a subject may have of his own actions; it can exist in the absence of such perceptual awareness. The single, simple idea around which this paper is built is that the distinctive awareness that subjects have of their own mental actions is a (...) form of action-awareness. Conditionalization is a widely endorsed rule for updating one’s beliefs. But a sea of complaints have been raised about it, including worries regarding how the rule handles error correction, changing desiderata of theory choice, evidence loss, self-locating beliefs, learning about new theories, and confirmation. In light of such worries, a number of authors have suggested replacing Conditionalization with a different rule — one that appeals to what I’ll call “ur-priors”. But different authors have understood the rule in different ways, and (...) these different understandings solve different problems. In this paper, I aim to map out the terrain regarding these issues. I survey the different problems that might motivate the adoption of such a rule, flesh out the different understandings of the rule that have been proposed, and assess their pros and cons. I conclude by suggesting that one particular batch of proposals, proposals that appeal to what I’ll call “loaded evidential standards”, are especially promising. (shrink)

Can machine intelligence do clinical ethics? And if so, would applying it to actual medical cases be desirable? How does good combine with bad? Most creatures are neither so blessed as to only enjoy good nor so cursed as to only suffer bad. Rather, the good and bad they receive throughout their lives combine to produce their overall quality of life. But it’s not just whole lives that have combined good and bad. Many stretches within contain both positive and negative occurrences whose value is joined to form the overall quality of that span of time. In a single (...) morning someone might wake up, brush their teeth, stub their toe groggily lumbering down the stairs, and have a sip of coffee that’s tasty but so hot they burn their tongue. These events are good and bad for them to various degrees, and their value comes together to form an overall value for them of that morning. A single moment, even, can have combined value from distinct pockets of good and bad that occur simultaneously. The tastiness of the coffee is good, but the pain of the heat is bad. They combine to form an overall value of the sipping moment – negative if the pain outweighed the flavor. Thus, wellbeing and illbeing combine. But how? How can someone rightly chastise themselves for sipping the overly hot coffee when it was, in fact, good because it was tasty? To pose the question starkly, a life can be bad, even so bad to not be worth living, and yet it can have many instances of good, where these goods are, in themselves, pure of any negativity. Deference principles are principles that describe when, and to what extent, it’s rational to defer to others. Recently, some authors have used such principles to argue for Evidential Uniqueness, the claim that for every batch of evidence, there’s a unique doxastic state that it’s permissible for subjects with that total evidence to have. This paper has two aims. The first aim is to assess these deference-based arguments for Evidential Uniqueness. I’ll show that these arguments only work given a particular kind (...) of deference principle, and I’ll argue that there are reasons to reject these kinds of principles. The second aim of this paper is to spell out what a plausible generalized deference principle looks like. I’ll start by offering a principled rationale for taking deference to constrain rational belief. Then I’ll flesh out the kind of deference principle suggested by this rationale. Finally, I’ll show that this principle is both more plausible and more general than the principles used in the deference-based arguments for Evidential Uniqueness. (shrink)
