National electronic health record initiatives are in progress in many countries around the world but the debate about the ethical issues and how they are to be addressed remains overshadowed by other issues. The discourse to which all others are answerable is a technical discourse, even where matters of privacy and consent are concerned. Yet a focus on technical issues and a failure to think about ethics are cited as factors in the failure of the UK health record system. In (...) this paper, while the prime concern is the Australian Personally Controlled Electronic Health Record (PCEHR), the discussion is relevant to and informed by the international context. The authors draw attention to ethical and conceptual issues that have implications for the success or failure of electronic health records systems. Important ethical issues to consider as Australia moves towards a PCEHR system include: issues of equity that arise in the context of personal control, who benefits and who should pay, what are the legitimate uses of PCEHRs, and how we should implement privacy. The manner of this dismissal however is based upon an unlikely paradigm of rationality: it is based upon the presumption that our intellectual capacities are not as limited as in fact they are, and do not vary as much as they (...) do between rational people. When we understand rationality in terms of intellectual virtues, however, which recognize these limitations and provide for the complexity of our thinking, ad hominem considerations can sometimes be relevant to assessing arguments. Ectogestation involves the gestation of a fetus in an ex utero environment. The possibility of this technology raises a significant question for the abortion debate: Does a woman’s right to end her pregnancy entail that she has a right to the death of the fetus when ectogestation is possible? Some have argued that it does not Mathison & Davis. Others claim that, while a woman alone does not possess an individual right to the death of the fetus, the genetic parents (...) have a collective right to its death Räsänen. In this paper, I argue that the possibility of ectogestation will radically transform the problem of abortion. The argument that I defend purports to show that, even if it is not a person, there is no right to the death of a fetus that could be safely removed from a human womb and gestated in an artificial womb, because there are competent people who are willing to care for and raise the fetus as it grows into a person. Thus, given the possibility of ectogestation, the moral status of the fetus plays no substantial role in determining whether there is a right to its death. (shrink)
The objective list theory of well-being holds that a plurality of basic objective goods directly benefit people. These can include goods such as loving relationships, meaningful knowledge, autonomy, achievement, and pleasure. The objective list theory is pluralistic (it does not identify an underlying feature shared by these goods) and objective (the basic goods benefit people independently of their reactive attitudes toward them). In this paper, I discuss the structure of this theory and show how it is supported by people's considered (...) judgments. I then respond to three objections. First, I argue that there is no conceptual reason to favor a monistic theory of well-being over a pluralistic one (such as the objective list theory). Second, I argue that states of affairs can benefit people even though they hold no positive reactive attitudes toward them. And, third, I argue that objective list theorists can identify a fairly-determinate list of basic goods. (shrink)
This article investigates the role of privacy and transparency in the 4th Space and outlines their implications for the development and dissemination of conspiracy theories. We argue that privacy can be exploited by individuals and organizations to spread conspiracy theories online, while organizational transparency, intended to increase accountability and ultimately trust, can have the adverse effect and nurture conspiracy beliefs. Through the lens of the 4th Space concept, we offer suggestions on how to approach those challenges which emerge as a (...) result of the complex entanglements of both actual and virtual world across time. Research in the organizational sciences has tended to portray prosocial behavior as an unqualified positive outcome that should be encouraged in organizations. However, only recently, have researchers begun to acknowledge prosocial behaviors that help maintain an organization’s positive image in ways that violate ethical norms. Recent scandals, including Volkswagen’s emissions scandal and Penn State’s child sex abuse scandal, point to the need for research on the individual factors and situational conditions that shape the emergence of these unethical pro-organizational behaviors. Drawing (...) on trait activation theory, we argue that the “dark” trait of Machiavellianism should make individuals more willing to engage in UPB. Further, we argue that this willingness will be augmented when Machiavellians hold bottom-line-mentality climate perceptions, or the perception that ethical standards matter less than organizational performance. Using data from 170 U.S. employees, results suggested that Machiavellians are more willing to engage in UPB, but that BLMCPs may not affect their motivation to engage in UPB. We discuss the study’s theoretical and practical implications, as well as avenues for research. (shrink)
Phenomenological psychology is shown as a means to examine implications of mass-commodity culture, through the presentation of a phenomenological analysis of a TV commercial. This advertisement plays upon the vicissitudes of fathers' experiences of their relationships with their pre-pubescent daughters. The findings disclose an image of a father's ambivalently lived inability to tolerate his daughter's first sexual attraction to another male, and his attempt to continue to control the satisfaction of his daughter's bodily desire through commodities. The onomasticon of Hellenistic Uruk demonstrates that, in some cases, individuals with Greek names were included in otherwise Babylonian families. Often, such Greek names have been interpreted by scholars as evidence for Hellenization. This article suggests an alternate explanation, based on evidence throughout the family trees for a series of naming practices that focus on the perpetuation of names of female relatives and transmission of preferred family names through maternal lines. Particularly important to this discussion are the practices of mammonymy, (...) a term coined here to refer to papponymy’s gendered parallel, i.e., the naming of a girl after her grandmother or other female ancestor, and the practice, previously unexamined in the Assyriological literature, of “maternal-line papponymy,” the tradition of naming a son for his maternal grandfather or other male ancestor from a maternal line. Maternal-line papponymy can be observed in family trees in which the members bear only Babylonian names, as well as in family trees that include individuals with Babylonian names and individuals with Greek names. The Greek names used for boys are often those of fathers or grandfathers of women with Greek names who married into these Babylonian families. This article argues that the incorporation of Greek names into the elite Babylonian families of Hellenistic Uruk cannot be assumed to be straightforward evidence of impulses toward “Hellenization.” Rather, this evidence indicates that Greek names were given to sons in such families within the context of traditional Babylonian maternal-line naming practices. This finding has important implications for scholarship’s understanding of acculturation and the display of cultural identity in Hellenistic Babylonia. (shrink)
What, if anything, directly detracts from well-being? Objective list theorists affirm basic goods such as knowledge, friendship, and achievement, but it is less clear what they should say about opposing bads. In this paper, I argue that false beliefs, unhealthy relationships, and failed projects are not basic bads and do not directly detract from well-being. They can have bad effects or elements, or block the realization of basic goods, but do not themselves carry negative weight with respect to well-being. This (...) is shown by comparing cases where these bads are present and absent, examining their relation to negative overall well-being, and considering the role of these bads in the pursuit of positive goods. What does it mean to be “strengths-based” or to be a “strengths-based practitioner?” These are diffuse areas that are generic and ill-defined. Part of the confusion arises from the customary default of practitioners and leaders across many cultures to label anything positive or complimentary as “strengths-based,” whether that be an approach, a theoretical orientation, an intervention, or a company. Additional muddle is created by many researchers and practitioners not making distinctions between very different categories of “strength” in human beings – (...) strengths of character, of talent/ability, of interest/passion, of skill/competency, to name a few. To add clarity and unification across professions, we offer seven characteristics and a comprehensive definition for a character strengths-based practitioner. We center on the type of strength referred to as character strengths and explore six guiding principles for understanding character strengths and their practical corollaries. Reflecting this foundation and based on character strengths research, our longstanding work with strengths, discussions with practitioners across the globe, and a practitioner survey asking about strength practices, we point out several character strengths practices or approaches we describe as soaring, emerging, or ripe with potential. We use the same framework for describing general research domains. Some areas of research in character strengths are soaring with more than 25 studies, some are emerging with a handful of studies, and others are ripe with potential that have none or few studies yet opportunity looms large for integrating character science. Using this framework, we seek to advance the exchange and collaboration between researcher and practitioner, as well as to advance the science and practice of character strengths. (shrink)

Toward the end of his classic treatise An Essay on Free Will, Peter van Inwagen offers a modal argument against the Principle of Sufficient Reason which he argues shows that the principle “collapses all modal distinctions.” In this paper, a critical flaw in this argument is shown to lie in van Inwagen’s beginning assumption that there is such a thing as the conjunction of all contingently true propositions. This is shown to follow from Cantor’s theorem and a property of conjunction (...) with respect to contingent propositions. Given the failure of this assumption, van Inwagen’s argument against the Principle of Sufficient Reason cannot succeed, at least not without the addition of some remarkable and previously unacknowledged qualifications. In a recent paper, “Incompatiblism, Sin, and Free Will in Heaven,” Timothy Pawl and Kevin Timpe discuss and propose a novel solution to a problem posed for traditional Christian theism that they call the Problem of Heavenly Freedom. In short, Christian tradition contains what seems to be a contradiction, namely, the redeemed in heaven are free but nonetheless can’t sin. Pawl and Timpe’s solution to the Problem of Heavenly Freedom is particularly attractive for two reasons: it shows great respect for (...) the Christian tradition’s teaching on heaven, and it entails that the redeemed in heaven act with morally weighty libertarian free will. Nonetheless, I think their solution can be improved upon. By drawing on some of the teachings of the Catholic tradition on heaven, particularly those of St. Thomas Aquinas, I raise three objections to Pawl and Timpe’s solution and introduce a modified version of their solution. In doing so, I have attempted to make their “best” solution to the Problem of Heavenly Freedom even better. (shrink)

Thirdly, I show how my defense of Aquinas’s substance metaphysic in AST is useful for the purpose of constructing defeators for certain kinds of arguments for reductionism. Fourthly, I defend Aquinas’s views on the unity of substance against Toner’s suggestion that they are implausible on the grounds that they are in conflict with certain so-called “scientifically informed”common-sense beliefs. In these replies, I shall respond to criticisms offered by Kaczor and Rodger to my article titled “Ectogestation and the Problem of Abortion.” In the process, I shall also try to bring into focus why the possibility of ectogestation will radically alter the shape of the abortion debate.

Background Following passage of the Patient Self Determination Act in 1990, health care institutions that receive Medicare and Medicaid funding are required to inform patients of their right to make their health care preferences known through execution of a living will and/or to appoint a surrogate-decision maker. We evaluated the impact of external factors and perceived patient preferences on physicians’ decisions to honor or forgo previously established advance directives (ADs). In addition, physician views regarding legal risk, patients’ ability to comprehend (...) complexities involved with their care, and impact of medical costs related to end-of-life care decisions were explored. Methods Attendees of two Mayo Clinic continuing medical education courses were surveyed. Three scenarios based in part on previously court-litigated matters assessed impact of external factors and perceived patient preferences on physician compliance with patient-articulated wishes regarding resuscitation. General questions measured respondents’ perception of legal risk, concerns over patient knowledge of idiosyncrasies involved with their care, and impact medical costs may have on compliance with patient preferences. Responses indicating strength of agreement or disagreement with statements were treated as ordinal data and analyzed using the Cochran Armitage trend test. Results Three hundred eighty-eight of 951 surveys were completed (41% response rate). Eighty percent reported they were likely to honor a patient’s AD despite its 5 year age. Fewer than half (41%) would honor the AD of a patient in ventricular fibrillation who had expressed a desire to “pass away in peace.” Few (17%) would forgo an AD following a family’s request for continued resuscitative treatment. A majority (52%) considered risk of liability to be lower when maintaining someone alive against their wishes than mistakenly failing to provide resuscitative efforts. A large percentage (74%) disagreed that patients could not appreciate complexities surrounding their care while 69% agreed that costs should never impact a physician’s decision as to whether to comply with a patient’s AD. Conclusions Our findings highlight the impact, albeit small, external factors have on physician AD compliance. Most respondents based their decision on the clinical situation at hand and interpretation of the patient’s initial wishes and preferences expressed by the AD. (shrink)
This paper explores the case of using robots to simulate evolution, in particular the case of Hamilton’s Law. The uses of robots raises several questions that this paper seeks to address. The first concerns the role of the robots in biological research: do they simulate something or do they participate in something? The second question concerns the physicality of the robots: what difference does embodiment make to the role of the robot in these experiments. Thirdly, how do life, embodiment and (...) social behavior relate in contemporary biology and why is it possible for robots to illuminate this relation? These questions are provoked by a strange similarity that has not been noted before: between the problem of simulation in philosophy of science, and Deleuze’s reading of Plato on the relationship of ideas, copies and simulacra. Truth is a locus of guilt for the Christian, according to Jacques Lacan. The religious person, he argues, punitively defers truth eschatologically. Yet Lacan’s own view dissolves eschatological deferral to the world, as the “Real”. The metaphysics of Erich Przywara SJ helps highlight that this mirrors Lacan’s view of the religious person. Przywara’s Christian metaphysics and Lacanian psychoanalysis converge on the immanence of truth to history. But Przywaran analogy corrects Lacan’s position on the religious person, which by implication calls for (...) an adjustment to Lacan’s worldview. In the final analysis, Lacan’s dialectical nihilism should yield to a Christian’s hopeful relation to the truth. (shrink)

In the United States, food banks served an estimated 46 million people in 2015. A combination of government policy reforms and political economic trends contributed to the rising numbers of individuals relying on private food assistance in the US, the United Kingdom and other high-income countries. Although researchers frequently map urban food environments, this project is one of the first to map private food assistance and potential need at the census-tract scale. We utilize Geographic Information Systems, demographic data, and food (...) assistance locations to develop a rapid assessment tool that could support food banks, pantries, soup kitchens, and government agencies that seek to answer the question of whether people with the greatest need have food distribution sites in close proximity. We define access based on distance and then calculate potential food insecurity using either poverty rates or a food insecurity index. We apply these methods in a case study analysis of Santa Clara County, California. Our findings suggest that food assistance distribution locations match the areas of potential need in more than 80% of urban census tracts. However, there are several potentially underserved locations and populations that could benefit from new food assistance operations. The poverty and index-based approaches show significant spatial overlap in mapped areas of high food insecurity and low access. The poverty only approach produces a higher estimate of food insecurity rates, is easier to calculate, and draws attention to the need to address poverty as a root cause of hunger. (shrink)

Jean-Paul Sartre, in Being and Nothingness, develops the concept of “bad faith” in order to account for the paradoxical fact that knowledge can be ignorant of itself, and thus that a self-conscious subject can deceive itself while being aware of its own deception. Sartre claims that Freudian psychoanalysis would account for self-deception by positing an unconsciousness that guides consciousness without consciousness being aware of it. Therefore, Freudian psychoanalysis is an insufficient model with which to address bad faith. I disagree. There (...) is a specific psychic mechanism in Freud that answers Sartre’s criteria for bad faith, and it is called “disavowal” . Disavowal is the mechanism responsible for fetishism. And thus, fetishism is the Freudian account of bad faith. (shrink)
This is a brief and accessible introduction to the thought of the great Franciscan theologian St. Bonaventure. Cullen focuses on the long-debated relation between philosophy and theology in the work of this important but neglected thinker, revelaing Bonaventure as a great synthesizer. Cullen's exposition also shows in a new and more nuanced way Bonaventure's debt to Augustine, while making clear how he was influenced by Aristotle. The book is organized according to the categories of Bonaventure's own classic text. De reductione (...) artium ad theologiam. Part I is devoted to the definition of Christian Wisdom. In Part II, "The Light of Philosophical Knowledge," individual chapters are devoted to Bonaventure's physics, metaphysics, and moral philosophy. “Moral hazard” is a term familiar in economics and business ethics that illuminates why rational parties sometimes choose decisions with bad moral outcomes without necessarily intending to behave selfishly or immorally. The term is not generally used in medical ethics. Decision makers such as parents and physicians generally do not use the concept or the word in evaluating ethical dilemmas. They may not even be aware of the precise nature of the moral hazard problem they are experiencing, beyond a general (...) concern for the patient's seemingly excessive burden. This article brings the language and logic of moral hazard to pediatrics. The concept reminds us that decision makers in this context are often not the primary party affected by their decisions. It appraises the full scope of risk at issue when decision makers decide on behalf of others and leads us to separate, respect, and prioritize the interests of affected parties. (shrink)
Ontological understanding of biological units is crucial to their use in experimental design, analysis, and interpretation. Conceptualizing fundamental units in biology as individuals or classes is important for subsequent development of discovery operations. While the criteria for diagnosing individuals are acknowledged, temporal boundedness is often misinterpreted and temporal minima are applied to units in question. This results in misdiagnosis or abandonment of ontological interpretation altogether. Biological units such as areas of endemism in biogeography and species in evolutionary biology fall victim (...) to such problems. Our goal here is to address the misconception that biological individuals such as species and areas of endemism have a temporal minimum. Areas of endemism can persist within small temporal boundaries in the context of metapopulation dynamics, island biogeography, and range expansion and contraction. Similarly, lineage reticulation illustrates examples of short-lived species. Here, examples of known entities are provided to illustrate their persistence on short time scales in attempt to rescue future interpretation of biological units from ontological misdiagnosis, elucidate the philosophical individuality of areas of endemism and species with short lifespans, and provide justification for the “snapshot in time” diagnostic approach. The Syllabus as Curriculum: A Reconceptualist Approach by Samuel D. Rocha. The review examines the central tenets of Rocha’s book, namely that the syllabus is an object which is made, and that his phenomenological attention to the syllabus as such bears the poetic pledge and possibility of curriculum. Rocha considers the syllabus, working within the reconceptualist tradition of the curriculum field, as correspondence, essay, and outline, and describes the way it humbly gives itself to teachers and students as an invitational (...) object. Using a presentative method and rooted in the humanities, Rocha additionally presents and explores three interrelated and analogical demands of the syllabus, namely love, art, and order, contributing to an ongoing and complicated conversation within curriculum studies and philosophy of education.
