This paper examines how civil society actors in the EU utilize the political and legal opportunities provided by the EU’s fundamental rights policy to mobilize against discrimination, notably racism, and xenophobia. It emphasizes the multiple enabling roles that this policy provides to civil society associations engaged in judicial activism, political advocacy, and service delivery both at the EU and Member State levels, and assesses their effectiveness. It describes several factors that hinder the implementation of EU (...) fundamental rights policy and reviews the strategies of civil society to overcome them. It highlights the reluctance of parts of public opinion to combat ethnic prejudice, considers reactions against what at a time of crisis is perceived as a costly project of social regulation, and examines civil society responses. Engaging civil society actors as knowledgeable dialogue partners in the development and governance of emerging technologies is a new challenge. The starting point of this paper is the observation that the design and orchestration of current organized interaction events shows limitations, particularly in the articulation of issues and in learning how to address the indeterminacies that go with emerging technologies. This paper uses Dewey’s notion of ‘publics’ and ‘reflective inquiry’ to outline ways of doing better and to (...) develop requirements for a more productive involvement of civil society actors. By studying four novel spaces for interaction in the domain of nanotechnology, this paper examines whether and how elements of Dewey’s thought are visible and under what conditions. One of the main findings is that, in our society, special efforts are needed in order for technology developers and civil society actors to engage in a joint inquiry on emerging nanotechnology. In this paper, two claims are made. The main claim is that a fruitful approach for theorizing the political legitimacy of global governance and the proper normative role of civil society actors is the so-called ‘function-sensitive’ approach. The underlying idea of this approach is that the demands of legitimacy may vary depending on function and the relationship between functions. Within this function-sensitive framework, six functions in global governance are analyzed and six principles of legitimacy defended, together constituting (...) a minimalist account of political legitimacy. This account suggests that civil society actors may strengthen political legitimacy by performing five of these functions under certain conditions and insofar as the proposed normative political principles are fulfilled: problem identification, agenda-setting, implementation, enforcement and monitoring, and evaluation. The second claim is critical and is chiselled out against the backdrop of this function-sensitive account, through which I demonstrate that much vagueness and confusion with regard to the proper role of civil society actors for strengthening the political legitimacy of global governance could be traced to the so-called ‘transmission belt’ model, which has gained popularity in international political theory. This model depicts civil society as a transmission belt between the public sphere and decision-making loci, where it is assumed that civil society actors contribute to the strengthening of political legitimacy by transmitting peoples’ preferences, beliefs, and opinions from the former to the latter space by indirectly or directly influencing the decision-making. It is argued that this picture is misleading and generates erroneous prescriptions of how civil society actors should act to increase political legitimacy. (shrink)

The literature on transnational civil society encompasses a number of conflicting views regarding civil society organizations’ (CSOs) behavior and impacts and the desirability of civil society involvement in international policymaking. This piece suggests that this lack of consensus arises from the diverse range of contexts in which CSOs operate and the wide variety of activities in which it engages. This article seeks to organize and analyze the disparate data on civil society by (...) developing a context-based standard of democratic legitimacy for CSOs. The article disaggregates democracy into input, throughput, and output components, and shows how CSOs must support or manifest different aspects of democracy in order to be democratically legitimate in a given context. Applying this standard to existing works, the article identifies several problems in current research, including a failure to recognize ways the democratic imperatives of transnational advocacy differ from national advocacy, and the potential for international civil society interventions to undermine local democratic processes. A healthy civil society is essential in order to deal with “wicked” societal problems. Merely involving institutional actors and mass media is not sufficient. Intermedia can play a crucial complementary role in strengthening civil society. However, the potential of these technologies needs to be carefully tailored to the requirements and constraints of the communities grown around them. The GRASS system for group report authoring is one carefully tailored socio-technical system aimed at unlocking this potential. How is poverty discursively constituted, both as a category of thinking and as a label applied to particular social categories in times of austerity? How is it linked to social exclusion? Based on extensive fieldwork with representatives from 79 typical non-governmental organizations and informal initiatives of civil society in two Greek cities (Athens and Patras, in the periphery), this chapter explores the link between crisis, poverty and social exclusion. In their attempt to underline the marginalizing effects of austerity (...) in Greece, civil society actors question previous assumptions about what constitutes poverty and exclusion in Greek society and offer important insights into the seemingly disparate practices and experiences among those classified as “poor” or “new excluded”. While Corporate Social Responsibility (CSR) is often seen to involve voluntary and deliberative approaches such as certification, governments have recently stepped into the picture through national legislation. France’s Law on Duty of Vigilance adopted in 2017 is a landmark case of such legislation. Years of voluntary CSR certification schemes led by Civil Society were replaced by a new philosophy of fighting for mandatory CSR controlled by a judge. The latest discussions about civil society have been reconsidering the globalization processes, and the theoretical discourse has been broadened to include the notion of the global civil society. The notion and the practice of a civil society are being globalized in a way that reflects the empirical processes of inter-connecting societies and of shaping a world society. From the normative-mobilizing perspective, civil society activists and theoreticians stress the need to defend the (...) world society from the global threat of a nuclear war, environmental catastrophes, crime and violence, domination of world powers over the fate of individual countries and societies, i.e. the need to oppose the tendency of “power policy” on the world level, and to defend the autonomy of the society as one compatible primarily with the expansion of policies based on the rule of law worldwide, and incompatible with the policy of force, state reasons, and domination of world power-centers. The globalization processes result in a conflicting and/or assimilative crossing of civilizations and cultures, as well as controversial tendencies of, on one hand, attempts for the introduction of international political institutions and the adoption of international conventions for human rights’ protection, for the defense of democratic values, for combating terrorism and segregation on various grounds, thus leading to a global standardization of the human-rights culture and of democratic political and legal order, and on the other, of rising xenophobia, particularization and ethno nationalism, civil wars, ecological threats, global terrorism, threat of hunger problem, nuclear war, new disease, etc. Contemporary victory of liberal and democratic values is the positive reach, but followed by the contested issue of sovereignty, urban decay, racism, ethnic cleansing, xenophobia, failing political legitimacy , and followed at the world scale by: global injustice, poverty, environmental dangers, mass and deadly diseases, oppression of minority groups, relentless growth of population, political and economic power great asymmetries, terrorism at the global scale, threat of a nuclear disaster, etc. Global civil society has three dimensions: 1) empirical phenomena of globalized social relations, interconnections, 2) mobilizing, formative force of the project/vision, and 3) social actors at the global/transnational level. The anti-globalization movement is an effort to counter perceive negative aspects of the current process of globalization. Although adherents of the movement often work in concert, the movement itself is heterogeneous and includes diverse, sometimes opposing, understandings of this process, alternative visions, strategies and tactics. Thus, more nuanced terms include anti-capitalist/anti-corporate alternative globalization. Participants may use the positive terms such as ‘global justice’ or ‘fair trade movement’; or ‘Global Justice and Solidarity Movement’; or ‘Movement of Movements’; or simply ‘The Movement’; or ‘anticorporatist capitalism movement’. Generally speaking, anti-globalization movement is not so much an opposition to globalization as such than an opposition to the particular way it is taking place – like neoliberal process of globalization. This article analyzes the current political transition in México from the vantage point of civil society. It departs from a definition of the Mexican authoritarian regime, now the oldest in the world, as a model of fusion between the state, the market and society. The crisis of the developmental model and the regime’s increasing inability to incorporate the new social actors created by industrialization and urbanization opened up a long period of political crisis whose main content (...) was a process of societal differentiation. The failure of President Salinas’ project of neo‐liberal reconstruction of the authoritarian regime deepened the crisis and led to the formation and consolidation of strong national political parties, the beginning of a still unequal, but effective electoral competition and especially to the emergence of several civic groups that are struggling for a democratization that goes beyond electoral politics. The collective identity as civil society of these civic groups has been instrumental for the critique of the regime’s gradualist strategy of “permenent electoral reform”. (shrink)

Democratic legitimacy is rarely associated with private governance. After all, private actors are not legitimized through elections by a demos. Instead of abandoning democratic principles when entering the private sphere of governance, however, this article argues in favour of employing alternative criteria of democracy in assessments. Specifically, this article uses the criteria of participation, transparency and accountability to evaluate the democratic legitimacy of private food retail governance institutions. It pursues this evaluation of the democratic legitimacy of these institutions against (...) the background of their ambivalent impact on the sustainability of the global agrifood system. Although scholars have long been interested in the relationships among civil society, the state and the market in advanced industrial democracies, the implications of state disengagement from the affairs of private firms for civil society have yet to be explored in the contemporary literature. Think tanks became key political and economic actors during the twentieth century, creating and occupying an intellectual and political position between academic institutions, the state, civil society, and public debate on organization and management. Think tanks are especially active in setting frames for what constitutes politically and socially acceptable ways of thinking about economic activity and the rights or obligations of corporations. Their operation and influence has been acknowledged and analysed in political science and policy analysis, but (...) in organization and management studies they are almost entirely ignored. In this paper, we review the existing literature on think tanks to develop an ethical–political framework based on a Gramsci’s account of state–civil society relations, referring to historical case materials relating to a significant Brazilian think tank, the Instituto de Pesquisas e Estudos Sociais. We show how the IPES was successful in bringing then-controversial neoliberal perspectives on management and organization into mainstream political debate, where they could be discussed and ultimately accepted as morally and intellectually legitimate. We note the importance of management education and business schools with respect to think tanks in the development of a hegemonic pro-capitalist interpretation of corporate responsibility, and suggest this is worth more investigation. We conclude by outlining how think tanks are central to civil society acceptance of pro-corporate ideologies, how they might be researched regarding the ethical implications of the work they do, and how our approach provides a foundation for this. Today civil society groups are important actors on the international stage. Nongovernmental organizations (NGOs) have taken roles that traditionally have been the sole province of states or intergovernmental institutions. NGOs are not bound to act in the public interest. Neither are their actions justified by formal democratic procedures, as is the case with states. Therefore, questioning the legitimacy of their actions is a crucial thing to do. This article presents the results of empirical research on the legitimacy (...) of internationally operating NGOs (INGOs). From the interview data seven types of legitimacy are distinguished. These do not give us a comprehensive categorisation of sources of legitimacy; rather they provide tools to counterbalance existing views of legitimacy. The aim is to develop concepts for evaluating the legitimacy of INGO activities which are grounded in theory as well as in practice. Before analysing the empirical results concerning NGO legitimacy, some views on civil society will be discussed with a focus on the problem of legitimacy. (shrink)

For the past half a century, Latin American scholars have been pointing toward the emergence of new social actors as agents of social and political democratization. The first wave of actors was characterized by the emergence of novel agents—mainly, new popular movements—of social transformation. At first, the second wave, epitomized by nongovernmental organizations, was celebrated as the upsurge of a new civil society, but later on, it was the target of harsh criticism. The literature often portrays (...) this development in Latin American civil society as a displacement trend of actors of the first wave by the second wave—“NGOization”—and even denounces new civil society as rootless, depoliticized, and functional to retrenchment. Thus, supposedly, NGOization encumbers social change. The authors argue that NGOization diagnosis is a flawed depiction of change within civil society. Rather than NGOization related to the depoliticization and neoliberalization of civil society, in Mexico City and São Paulo, there has been modernization of organizational ecologies, changes in the functional status of civil society, and interestingly, specialization aimed at shaping public agenda. The authors argue that such specialization, instead of encumbering social change, brings about different repertoires of strategies and skills purposively developed for influencing policy and politics. Exploration of the political roles firms play in society is a flourishing stream within corporate social responsibility research. However, few empirical studies have examined multiple levels of political CSR at the same time from a critical perspective. We explore both how the motivations of managers and internal organizational practices affect a company’s choice between competing CSR approaches, and how the different CSR programs of corporate and civil society actors compete with each other. We present a qualitative (...) interpretative case study of how a French children’s clothing retailer develops CSR practices in response to accusations of poor working conditions and child labor in its supply chain. The company’s CSR approach consists of superficial practices, such as supplier audits by a cooperative business-organized nongovernmental organization and philanthropic activities, which enable managers to silence more radical alternative models defended by other NGOs, activists, and trade unions. By this approach, the core business model based on exploitative low-cost country sourcing remains intact through self-regulated CSR. Through the case study, we develop a framework of dynamism in competing CSR programs. We discuss the implications of our study for CSR researchers, company managers, and policy makers. (shrink)

As some thinkers have sought in the concept of global civil society an ethically driven site of deliberation and even resistance, so others have criticized global civil society for its lack of legitimacy and representativeness. This article attempts to answer these criticisms ? at least in part ? by invoking a moral commitment to the value of justification. I argue that the idea of justification, when examined, offers us a particular understanding of legitimacy which would be (...) attainable for global civil society actors. The article begins by setting out the case for concern about the legitimacy of global civil society. I then outline a certain understanding of justification, showing how a commitment to this conception provides both a response to critics of global civil society and an ethical baseline for humane actors within global civil society. I move on to trace the significance of the moral relevance of justification for actors' strategies. Lastly, however, I highlight the difficulty of justification in a diverse world. This is to say that the issues of legitimacy and strategy facing global civil society are only made more tractable, not dissolved, by an appeal to the importance of justification. (shrink)

Civil society organizations attempt to induce corporations to behave in more socially responsible ways, with a view to raising labour standards. A broader way of conceptualizing their efforts to influence the policies and practices of employers is desirable, one centred upon the concept of civil governance. This recognizes that CSOs not only attempt to shape the behaviour of employers through the forging of direct, collaborative relationships, but also try to do so indirectly, with interactions of various kinds (...) with the state being integral. Drawing on evidence derived from UK-based CSOs involved in work and employment relations, four types of civil governance are identified and characterized. By elaborating the concept of civil governance, and demonstrating how different types of civil governance operate, the research extends our knowledge and understanding of how CSOs, as increasingly prominent actors in the field of work and employment relations, operate within, and contribute to, systems of labour governance. In Morocco’s process of liberalization (and democratization), the dynamics between social actors defining themselves as “secular” and those labeled “Islamist” are critical. This paper probes the possibility of these actors transcending their frequent opposition and building mutual trust and “civil” interaction, thereby strengthening civil society and the possibility of continued reform in Morocco. Using Morocco’s recent Equity and Reconciliation Commission as an analytical tool, the paper focuses on the human rights arena as a potentially fruitful (...) place for Islamists and secularists to meet. To what extent is a shared commitment to human rights norms possible for non-violent Islamists and secularists? Today, scientific discussions on the specifics of the development of civil society in Russia do not stop. The institutional approach allows us to look at this problem through the prism of formal and informal institutions existing in society. Researchers and practitioners should not focus only on the rule of law, official prescriptions and orders, setting the framework for interactions between authorities and citizens, promoting private initiatives, and realizing the rights and freedoms of the population. If they do (...) not correspond to the prevailing norms, stereotypes, ways of thinking and actions for centuries, then the most useful, at first glance, innovations in the political and social sphere may not take root. This does not mean, however, that informal institutions remain unchanged under any circumstances. They also evolve. This process can be targeted. In the postmodern era, European political philosophy has introduced several concepts. These concepts have ideologically prepared Western countries for decentralization reform. Being still “in process”, reflection on the proper structure of postmodern society is marked by ambiguous and often contradictory ideas. The very view on the state as a de-hierarchical, rhizomorphic and horizontal phenomenon presupposes numerous ways of reforming it. Throughout their histories, European countries have shifted from confrontations, hostilities and rivalries towards new mechanisms of fruitful relationships between (...) class='Hi'>civil society and state institutions. Nowadays, many aspects are influencing the elaboration and implementation of strategies on civil society development in different countries. These aspects include the following: different starting conditions; the presence or absence of basic principles of public space development; the possibility of fulfilling civic practices’ potential; the level of political participation. West European countries have managed to create a viable structure to support the development of civil society, as well as maintain a stable dialogue between it and the state. However, the process is still on: effective practices of interaction between them are being developed; conditions for more effective cooperation are being improved; new financial instruments are being created and implemented. All Central and East European countries have a common understanding of civil society as one of the most important actors in developing cooperation with the government. At the same time, they should be able to solve existing essential problems, such as low awareness about global development problems and the population’s unreadiness to meet the immediate objectives of civil society development. Scholars have established that cultural codes and styles of expression in civil society must be recognized as informal mechanisms of exclusion, calling into question the possibility of the Habermasian normative ideal of the public sphere. This article joins theoretical discussions of how to remedy this problem. Going beyond Alexander's model of "multicultural incorporation" and borrowing from Sewell's theory of the duality of structure, we develop a theoretical framework of code hybridization to conceptualize how civil society participants (...) achieve civil solidarity amid multiple, potentially contradictory cultural legacies. Code hybridization is a process whereby social actors not only incorporate the cultural codes of subordinate groups into the public sphere, but in doing so also potentially transform dominant codes. We conceptualize code hybridization in terms of three analytic steps: enlargement of the terrains of signification; reinterpretation of codes; and mixing of schemas. The resulting hybridized schemas and frameworks are particularly useful cultural tools for developing visions of civil inclusiveness for young, unstable civil societies. Using a brief comparative study of the representation of women in political cartoons in Hong Kong and Taiwan, we offer a concrete example of code hybridization—a process linking the codes of liberty and caring while producing alternative and more inclusive narratives during moments of political agitation. There is a huge number of publications devoted to civil society. Nevertheless this theme is inexhaustible, because the very subject of it is multidimensional and changing along with the evolution of society. Alongside this, one of the key problems of the civil society theory is a problem of its perception in our mind. Answering these questions, the author, at first, stresses the necessity to differ three historical types of civil society: ancient classical polis, (...) civil communities of the Modern History and contemporary civil society. They all are substantially different inter se from the axiological point of view. That is a reason not to use the ideological and methodological curves developed for historically previous types of civil society for the analysis of contemporary one. Secondly, the author focuses attention upon epistemological aspect of the civil society theory, in particular he proposes to rethink the concept of “totality” not in a formal logic way but in the “logic” of living systems in order to be able by means of this concept to express the unity of the diversity of social system. Thirdly, the author treats the concept of “citizen” in informal sense, stresses its existential, personal content and contemplates it through the dialectical relation of “totality-peculiarity-individuality.” Fourthly, the author researches the phenomenon of contemporary civil society as a counterpart of a state in the complex society the main features of which are the diversity and individuality. He comes to the conclusion that the civil society is not a society in common sense, but rather is some kind of “soil structure,” so called “social mycelium” that fertilizes social system with new opportunities. In the final part of the article author gives the example of one of the approaches to estimate the degree of maturation of civil society, proposed by the world-wide international organization “Civicus.” He stresses that the logic of power distribution in contemporary society presupposes cooperation of different actors, and one of the most influential of them is the civil society. ABSTRACTThis article addresses the identity of the legitimate actors of international law-making from the perspective of democratic theory. It argues that both states or state-based international organisations, and civil society actors should be considered complementary legitimate actors of international law-making. Unlike previous accounts, our proposed model of representation, the Multiple Representation Model, is based on an expanded, democratic understanding of the principle of state participation: it is specifically designed to palliate the democratic deficits of more (...) common versions of the Principle of State Consent. Farmers’ markets (FMs) represent a crucial player in urban food systems, being the interconnection of local agricultural production and consumption, and serving as spaces for both economic exchange and community building. Despite their transformative potential, there is a scarcity of research that comprehensively investigates the dynamics of FMs network structure and the influence of the actors shaping FMs. The present article delves into the network of relationships within FMs in the Italian city of Bologna. This study adopts the Social (...) Network Analysis (SNA) methodology applied with the Net-Map tool. The research objectives are to visualise the underlying network structure, map the dynamics, and identify the key actors who play pivotal roles in Bologna’s FMs and their level of influence. The research carried out interviews with ten FMs stakeholders, revealing the network of relationships between 54 actors, divided into three categories—civil society, food economy and public administration. Actors were linked by a total of 428 relationships across three types of networks: support, economic, and hindering. Findings indicate a strong support network structure characterised by varying degrees of centrality among different actors. Farmers emerge as a central node due to their pivotal role in providing fresh, local produce. Additionally, local institutions contribute significantly to FMs resilience and growth. Our research demonstrates the importance of recognising the embeddedness of FMs within the local context. By understanding the network structure and influential actors in FMs, policymakers can devise more effective policies for promoting local agriculture, and enhancing the sustainability of urban–rural exchanges. In conclusion, the present study offers valuable insights into the network dynamics of FMs, highlighting their crucial role in the sustainable development of urban and local food systems. (shrink)

Analysts of political culture within the "civil religion" tradition have generally assumed that discourse in civil society is structured by a single set of enduring codes based on liberal traditions that actors draw upon to resolve crises. Based on two case studies of national crises and debate in Brazil during its transition to democracy, I challenge this assumption by demonstrating that not only do actors draw upon two distinct but interrelated codes, they actively seek to (...) impose one or another as dominant. In Brazil this is manifest in actors who defend elements from the code of liberty and its valuation of the freestanding citizen, and those who defend the corporate code and its valuation of the collectivity over the individual. In an earlier debate on crime the corporate code was dominant, but in a later debate surrounding presidential improprieties, the liberal code became dominant. This analysis makes two contributions to the literature: it highlights the importance of nonindividualist cultural codes, such as the corporate code, in animating discourse in the public sphere in democratizing societies, raising attention to the importance of the symbolic contestation between actors seeking to establish one or another code during political transitions. Second, it offers a subtle commentary on the literature on democratization: changes in collective representations in the public sphere may not proceed apace of institutional changes and may be contingent on the kinds of crisis events and actors willing to contest previously dominant codes. This is the possibility of disobedience justified by appeal to standards of decency that are shared by peoples who do not otherwise share commitments to the same principles of justice, and whose societies are organized according to very different basic social institutions. Justified by appeal to shared decency standards, disobedience by diverse state and non-state actors indeed challenge injustices in the international (...) system of states. The book considers three case studies: disobedience by the undocumented, disobedient challenges to global economic inequities, and the disobedient disclosure of government secrets. It proposes a substantial analytical redefinition of civil disobedience in a global perspective, identifying the creation of global solidarity relations as its goal. Michael Allen breaks new ground in our understanding of global justice. Traditional views, such as those of Rawls, see justice as a matter of recognizing the moral status of all free and equal person as citizens in a state. Allen argues that this fails to see things from the global perspective. From this perspective disobedience is not merely a matter of social cooperation. Rather, it is a matter of self determination that guarantees the invulnerability of different types of persons and peoples to domination. This makes the disobedience by the undocumented justified, based on the idea that all persons are moral equals, so that all sovereign peoples need to reject dominating forms of social organization for all persons, and not just their own citizens. This paper focuses on the push to stabilise society through civil defence education in the changing context of nationalism and populism. We analysed the way in which justifications and criticism of civil defence education have evolved as an ordering project intended to solve the problems with dangers that were variously defined. We identified two locations of the danger to be tackled by the new CDE – external and specific; and internal and general – which partly correspond to (...) key political events: the migrant and Ukraine crises, and pre-election battles. Transformation of dangers stabilised education’s subservient role while destabilising educators’ position in the public debate. Drawing on relational sociology, qualitative analysis of the Czech media, and interviews, we show that the dangers defined by educational actors are circumvented to be replaced by populist and nationalist problems that were not the problems of the actors who would be most affected by the proposed curricular changes. We suggest looking at contemporary nationalists’ claims in education as a sign that topological arrangements are being reshaped among political, educational, and civic actors in terms of divides, externality, and irrelevance. Resumo O artigo trata dos diversos entendimentos acerca de quem faz parte da sociedade civil nos discursos de atores estatais e de organizações da sociedade civil no contexto da temática ambiental durante o governo Lula. Os dados são de entrevistas realizadas com organizações ambientalistas, assim como atores políticos do Ministério do Meio Ambiente e outros setores do governo Lula com alguma vinculação à questão ambiental. A análise aponta para um entendimento - do lado do governo - ampliado de (...) sociedade civil, incluindo desde organizações e movimentos sociais de diversas temáticas extrapolando a ambiental, e que inclui, em certos momentos, setores empresariais e sindicatos. Por outro lado, as organizações ambientalistas demonstram um entendimento mais hermético do conceito, do qual fazem parte, fundamentalmente, ONGs e movimentos sociais, mas com grande diferenciação de atuação. Esses aspectos trazem conseqüências para as relações estabelecidas entre Estado - sociedade civil e, principalmente, para os limites e funções de cada um. Assim, levantam questões sobre o papel esperado da sociedade civil no mundo contemporâneo - seus desafios na tentativa de participar e nfluenciar na política sem perder a sua identidade constitutiva. Palavras-chave: Sociedade civil; Organizações ambientalistas; Política ambiental; Participação política.The present paper concerns the several viewpoints on who comprises the civil society in the rhetoric of state actors and civil society organizations in the context of the environmental issue during the Lula administration. The data were gathered from interviews with environmental organizations as well as political actors from Ministry for the Environmental and other government sectors with some connection to the environmental issue. The analysis suggests an expanded understanding - on the government side - of civil society, including social movements and organizations with causes beyond the environmental and, on occasion, the business and union sectors. On the other hand, environmental organizations display a less flexible understanding of the concept, fundamentally composed of NGOs and social movements, albeit with great diversity of spheres of action. Modern dialogue of society and science proceeds in the conditions of social media distribution and the convergence of scientific knowledge. This processes change system of mass information and communication channels between scientific actors, leaders of public opinion and organizers of public initiatives. The conflict between an elite normativity of a scientific discourse and an egalitarian normativity of a public discourse takes the new forms. Authors show how in large quantities extending practice of civil expertise, based on (...) class='Hi'>civil journalism (a blogosphere and social networks), interrupt into procedures of scientific examination. Active inclusion of civil experts became an attribute of transdisciplinary science. The main feature of this type of science is operational decision making in the conditions of uncertainty. However transition of transdisciplinary science to a phase of the technoscience defines convergence borders of the formal and informal knowledge. Technoscience takes root into the vital world as a magic “black box” for the inhabitant. Authors believe that the transdialogue formed by transdisciplinary scientific experts and deprofessionalized leaders of civil journalism is complicated by deficiency of epistemological competence of civil experts. One of the problem is inclusion the electronic media practices in production and the social circulation of scientific knowledge. Using rather known, but not yet entered in the field of philosophical scientific research examples of direct influence of civil experts on processes which in a former communication order were intra scientific, authors realised a research of the new aspects of modern science expanding a traditional subject of philosophy of science and technology. El trabajo propone discutir el concepto de sociedad civil, para replantearlo desde una posición que privilegia el momento normativo de construcción teórica, desde una función epistemológica más que teórica, en sus articulaciones con la ciudadanía activa y con estrategias de gobernanza local que privilegian la pertenencia de la ciudadanía a una comunidad política determinada. En el marco de la globalización hoy los procesos de desarrollo local requieren complejizar las relaciones de actores que participan de estos procesos, más allá de (...) la relación Estado-Mercado. Para ello trabajamos un concepto normativo de sociedad civil y sus relaciones con la ciudadanía activa, que luego problematizamos con la inclusión de estrategias de participación ciudadana en la preocupación por la gobernanza local. Finalizamos con algunas notas sobre el rol de la investigación participativa en la relación anteriormente propuesta, todo enmarcado en un horizonte donde es posible otra democracia. (shrink)

Courts play a central role in legal and political processes in many countries in the common law world. Legal actors have a stake in making sure that legal processes and procedures are perceived as legitimate, both by the general population and professionals. Civil procedure, in both common law and civilian legal systems, has been historically known for its complexity. This article presents a body of empirical research about courts and procedural rules, and their role in different societies. It (...) also analyzes research and states how it has been used in policy debates and reforms. In addition, it discusses the question of the demand and supply for empirical research about rules of procedure and courts, and explores the difficulty of carrying out empirical research that goes beyond a focus on the institutional needs of the courts themselves and the reformers interested in their own court-reform agendas. This volume brings together academics from a variety of disciplines to discuss Collingwood's contributions to philosophy, aesthetics, philosophy of history, political philosophy and archaeological theory. It begins with a general survey of his contribution to history, politics and philosophy.

Ethical questions concerning global sustainability governance have been widely discussed with respect to the role of civil society in general. Interestingly, faith-based actors (FBAs) have so far attracted scant attention in this context. Yet FBAs actively participate in international political negotiations and public debates on sustainable development. Secularisation theory differentiates between religious and secular actors. To date, however, it remains unclear whether FBAs contribute a distinct faith-based perspective to global sustainable development discourse and, if so, what (...) this perspective is. The present article aims to identify the relevant norms and ideas in FBAs' communications and to contrast them with other existing ideas on sustainable development. On the basis of a content analysis of the submissions by FBAs and non-faith based civil society groups in the context of the UN Rio+20 summit, the article first investigates what visions are contained in current articulations of FBAs with respect to sustainable development. Secondly, it explores in what way FBAs' ideas about sustainable development differ from those of secular civil society. Our analysis establishes a basis for further inquiries into the role of FBAs in global sustainable development discourse. (shrink)

The post 9/11 environment has been characterized by domestic policy actors being incorporated into a globalizing defense industrial sector through the concept of civil-military integration. From administration to administration, the push for increased civil-military integration has spread beyond its original boundaries and has reached the frontlines of the American military. This begs the question, can the market-driven logic of the commercial sector be integrated into the objectives and values of the noncivilian, military sector? More precisely, is (...) class='Hi'>civil-military integration the appropriate solution to the post 9/11 strategic shift? The purpose of this study is not to address the detailed merits or limitations of the increased reliance on private contractors. Rather, this study’s primary focus is to examine the policies that set into motion and continue to promote the cornerstone of civil-military integration: strategic outsourcing. This study argues that in today’s threat environment, the extent of civil-military integration poses unique challenges for U.S. strategic policy. With contactors on the battlefield, basic doctrinal issues emerge. The most basic of these is the notion that in a war zone military members are asked to risk their lives for their country. But, while people are willing to risk their lives for their country, they may not be willing to risk their lives for their company. (shrink)

Les trois principaux acteurs , à la recherche d'un compromis, ont débattu sur la protection des données personnelles et sur l'efficacité administrative en utilisant de multiples moyens de communication.Communication on the computerization project in the education sector, the (...) National Education Information System shows how civil society in South Korea was able to enforce its claims, although it is often excluded from the process institutional policymaking. This article shows how Jürgen Habermas and Claude Lefort try to explain the relationship between universality and particularity in modern democratic societies, politics and civil society. It will demonstrate that Habermas defends a substantive kind of universality that is opposed to particular positions and thus to real politics. This article further argues that Lefort’s lesser known theory of negative universality is better at combining a universal and a particular perspective. It claims that where Habermas requires citizens to transform (...) their particular interests, Lefort emphasizes that individual actors should acknowledge their particular position and interests when invoking universal principles. The article further argues that their disagreement leads to a different interpretation of ideology, politics, power, civil society, human rights, popular sovereignty, elections and the state. (shrink)
