Over the past twenty years, Private Military and Security Companies (PMSCs) have become significant elements of national security arrangements, assuming many of the functions that have traditionally been undertaken by state armies. Given the centrality of control over the use of coercive force to the functioning and identity of the modern state, and to international order, these developments clearly are of great practical and conceptual interest. This edited volume provides an interdisciplinary overview of PMSCs: what they are, why they (...) have emerged in their current form, how they operate, their current and likely future military, political, social and economic impact, and the moral and legal constraints that do and should apply to their operation. The book focuses firstly upon normative issues raised by the development of PMSCs, and then upon state regulation and policy towards PMSCs, examining finally the impact of PMSCs on civil-military relations. It takes an innovative approach, bringing theory and empirical research into mutually illuminating contact. Includes contributions from experts in IR, political theory, international and corporate law, and economics, and also breaks important new ground by including philosophical discussions of PMSCs. US foreign policy became one of the most popular issues in public and academic discussions, particularly since George W. Bush was elected president. A lot has been said about the negative effects that the Bush administration had on the world's international relations and peace, mainly with regard to the restraints which are required by jus ad bellum. However, not much has been said about the damage that the Bush administration caused to the norms of jus in bello, by ignoring (...) them or turning a blind eye toward their violations. In this paper, I want to recall a few military and civil reasons which have been neglected for following the requirements of jus in bello by the fighting soldiers and the fighting unit, as well as by the belligerent state. Are there situations where military coups can be considered justified, such as the overthrow of a collapsing, genocidal dictatorship? I argue that under certain circumstances there is an opening for “just coups.” I propose a theoretical assessment of coups based on an adaptation of just war theory. I bring the comparative literature surrounding civil–military relations into conversation with the literature on just war theory in order to develop a theory of just coups. By adapting the categories (...) of just war theory into jus ad coup, jus in coup, and jus post coup, I show that these categories create a framework for understanding the ethical status of coups. Doing this gives us a more subtle understanding of the problem of coups and lets us understand how a hypothetical just coup may be possible. (shrink)

Recent developments such as the 'new wars' or the growing privatisation of warfare, and the ever more sophisticated military technology, present the military with difficult ethical challenges. This book offers a selection of the best scholarly articles on military ethics published in recent decades. It gives a hearing to all the main ethical approaches to war: just war theory, consequentialism, and pacifism. Dance is addressed as making significance for what Elias terms the civilizing process of early modernity through its contribution to the ennoblement of warriors and the pacification of merchants. The grounds for this are drawn from McNeill's contention that expenditure of muscular energy rhythmically in dance, as in military drill, but with different sociocultural consequences, is a fundamental human device for consolidating community feeling by facilitating cooperation by arousing a warm sense of togetherness. The significance of dance as a (...) sociocultural practice in early modernity is discussed critically through contemporary writings from the 16th and 17th centuries, with particular consideration given to the description of dance as an allegory for moral order in Elyot's manual on the education of the ruler. This article takes a step toward filling the gap in the scholarly literature by examining the impact of religious intervention in the military on civil-military relations. Using the case of Israel, I argue that although the subordination of the Israeli military to elected civilians has remained intact, and the supreme command has been mostly secular, external religious authorities operate within the formal chain of command and in tandem with the formal authorities, managing the military (...) affairs. This religious influence is apparent in three major domains: the theological influence on military deployment, the exclusion of women from equal participation in military service, and the role expansion of the Military Rabbinate as a quasi-state agency and its reflection in the socialization of secular soldiers and the development of alternative military ethics. The rise to taking over state power after elections of 2014 by majoritarian forces in India has since witnessed weakening of institutions of governance. The ruling Bhartiya Janata Party has returned to power with an enhanced parliamentary majority in the 2019 elections. The rise of hindutva, the Hindu nationalist political philosophy of the formations comprising the BJP and the Sangh parivaar or affiliates of the right wing Rashtriya Swayamsevak Sangh, has reshaped the discourse on the “idea of India”. Under the (...) extensive reframing in majoritarian nationalist terms of Indian political verities, it is conceivable that the Indian military, widely regarded as a professional, apolitical and secular force, will also be impacted. There has been little academic scrutiny of the possible influence of majoritarianism on the Indian military. The paper examines impact of the onset of majoritarianism democracy on India’s military by taking a close look at the movement in civil-military relations under the BJP government. There is a shift in civil-military relations from objective civilian control, that enhances professionalism and keeps the military apolitical, to subjective civilian control, wherein the military is co-opted through subscribing to the ideologybased security perspective of the ruling party. This shift poses for the military a risk of losing their a political ethic. Erosion of the apolitical ethic of the military will open up the military’s secular ethic to modification. The conclusions are both relevant for policy and theory. The relevance for policy lies in the need for the Indian state and the military to preserve professionalism by persisting with the objective civilian control model. The theoretical relevance is in discerning limits to the concept of obedience of the military to the civilian political rulers. Where there is a threat from a political ideology or its penetration into the military’s intellectual domain with the potential to dilute the military’s professionalism, the military needs to pushback for the sake of national security. The notion of the “deep state” or a “state within a state” is creepy, to say the least. It indicates the existence of a shadowy group of unelected bureaucrats deeply embedded in the military-intelligence establishment secretly manipulating government policy. International relations scholars and public administration experts associate deep states with authoritarian regimes, such as Egypt, Turkey, Pakistan and pre-civil-war Syria. Continuing control over the political and developmental policies of Amazonia has become perhaps the last best hope of the Brazilian military establishment, which has seen its principal raisons d'etre—the threats traditionally thought to be posed by foreign enemies and internal subversion—disappear in recent years. Alfred Stepan has clarified the unusually high level of "military prerogatives" exercised in the post-1985 Brazilian political system, which relate to a wider theoretical consideration of political and biological diversity and are linked both directly (...) and analogously, particularly in the Amazon region. In this regard, the direction of development policy in the greater Amazon region suggests the relevance of this military "policy prerogative" to the future of civil-military relations in Brazil, and the survival of one of the world's last great wildernesses. Samuel Phillips Huntington was an influential American political scientist. He was also a consultant to various America government agencies. He upholds the idea of conservative realism in politics. His research covers several areas of political science, such as civil-military relations, modernization and political development, comparative politics, and international relations. Regarding the role of military, he argues for autonomous military professionalism. In discussing about modernization of developing countries, he emphasizes the priority of political order over (...) democracy. In the case of America, as well as other democratizing countries, he worries that the excess of political participation would diminish the authority and effectiveness of state governance, enhancing political instability, and, at worst, leading to the reverse of democratization. After the end of the Cold War, Huntington characterizes the international order as multicivilizational, in which the clash of civilizations will direct the development of global politics. In such a multicultural situation, Huntington urges Americans to affirm their unique national identity by revitalizing Anglo-Protestant culture and its religiosity which has defined America since its founding. This article attempts to answer why some countries experience the recurrence of civil war and others do not. One of the most significant differences between civil war onset and its recurrence is that the latter has once experienced termination of civil war, while the former has not. To find the cause of recurrence, this article examines how different war termination types influence the duration of post-civil war peace. Duration analysis of the civil wars between 1944 (...) and 1999 shows that military victory, supported by peacekeeping operations or power-sharing arrangements, leads to the most durable peace in a post-civil war country. Contrary to the accepted wisdom, negotiated peace settlement, even when supported by peacekeeping operations or power-sharing arrangements, is not positively related to post-conflict peace. (shrink)

A wide variety of sources, including the Huntington literature and popular mass media, show that Huntington’s “clash of civilizations” idea actually has very little value in understanding the current global political context. The central assumption of Huntington’s view, that cultural kinship ties influence loyalties and agreements on a global scale, has little to do with the daily lives of American citizens and little to do with the decisions made by the current presidential administration. The mass media evidence from the United (...) States shows that the most important “kinship” ties are not religious or cultural, but economic. The argument involves a deeper analysis of the current trend towards religious programs on American television, a timeline of events relating to the Halliburton – Cheney relationship, and views expressed by members of the United States military in Stars and Stripes. The post 9/11 environment has been characterized by domestic policy actors being incorporated into a globalizing defense industrial sector through the concept of civil-military integration. From administration to administration, the push for increased civil-military integration has spread beyond its original boundaries and has reached the frontlines of the American military. This begs the question, can the market-driven logic of the commercial sector be integrated into the objectives and values of the noncivilian, military sector? More (...) precisely, is civil-military integration the appropriate solution to the post 9/11 strategic shift? The purpose of this study is not to address the detailed merits or limitations of the increased reliance on private contractors. Rather, this study’s primary focus is to examine the policies that set into motion and continue to promote the cornerstone of civil-military integration: strategic outsourcing. This study argues that in today’s threat environment, the extent of civil-military integration poses unique challenges for U.S. strategic policy. With contactors on the battlefield, basic doctrinal issues emerge. The most basic of these is the notion that in a war zone military members are asked to risk their lives for their country. But, while people are willing to risk their lives for their country, they may not be willing to risk their lives for their company. (shrink)

In this paper I will analyze several cases from the American Civil War, the two World Wars and the American Vietnam War, and contemporary research in enhancement substance, to determine how drug use can be analyzed and understood in both physical and moral (ethical) terms. This will require a discussion of drug use at different levels. First, I will address the consequences of drug use for the physical and mental sanity of soldiers, during and after wartime, irrespective of the (...) reason for drug use. Second, I will look into the moral questions related to drug use for the enhancement of soldiers, that is, as a method for modern warfare. The moral dimension has at least two different angles: (i) the moral responsibility of superiors administering drugs to their inferiors who are exposed to the rule of full obedience, and (ii) the ethical consequences of enhancement for moral judgment by soldiers in the gray zone between acts of war and war crimes (the difference between the Super soldier and the Killing machine). Since the 1990’s the rise of China provokes heated debates in the West. Numerous politicians and scholars, who study contemporary political affairs, pose the question, which will be the new role of China in international affairs? Many Western observers presume that China will act as the Western powers did in the past, promoting policy of domination, enslavement and gaining profits at all costs. The Chinese declarations on peace, co-operation, mutual interests, and harmony are often considered empty words, a certain decorum (...) of “real politics”, as it had been often practised in the West. An inquiry into the Chinese political and intellectual traditions, almost unknown in the West, challenges such widespread opinions and fears. Of course, it is an open question to which degree the traditional Chinese concepts will determine contemporary policy, since China had been westernised in enormous degree.Nevertheless, attitude to war, struggle, and competition constitutes one of the principal characteristics of each culture and appears closely related to its structure of values. Such attitudes determine political concepts and systems, foreign relations, norms of social life, etc. The analysis of Western and Chinese civilisations demonstrates that in this respect they represented divergent orientations. In Erich Fromm’s typology of societies, the Chinese culture could be considered non-destructive but aggressive, whereas Western civilisation could be called aggressive and destructiveOf course, there were great differences both within Chinese and within Western civilisations. Local/regional cultures belonging to each of them had their own characteristics in respect to struggle, and one could also notice great changes in the course of their histories. In general, at the dawn of these two civilisations, both of them were more or less bellicose, although in the cultures of the Chinese Central Plain “avoiding struggle” traits could be detected quite early. Appreciation of peace and harmony eventually prevailed with the predomination of the Confucian ideology, although Taoism and other schools of thought also condemned struggle and war. On the other hand, in the Mediterranean the bellicose cultures and war-mongering states prevailed. The beginning of this “great divergence” could approximately be dated for the middle of the 1st millennium BC, and the civilisations of East Asia and Europe took the opposite courses in theirsocial and political development. Struggle constituted a fundamental principle in the Western vision of the world-order, and its crucial archetype constituted the eternal struggle of Evil against Good, with the eventual triumph of God, who embodies Good and forces of Light. The Chinese tradition promoted instead the vision of the universe as one giant organism based on the principle of harmony, where Yin complements Yang. Hence both civilisations adopted the dualistic concepts, but one was antagonistic, and the second—complementary.In the 19th century, when Asian nations faced the colonial conquests, many of them tried to protect their independence and modernise themselves. For this end they tried to adopt not only Western armaments and military skills, but also Western bellicose ideology and values. Japan was obviously the champion of such a militarist course, but there were similar tendencies in China as well. Such bellicose ideology reached its apex there during the famous Maoist Cultural Revolution, when class struggle and bellicosity was exalted. The triumph of the Western bellicose approach and rejection of the traditional native heritage marked the century 1860’s–1960’s in China. However, after the unimaginable sufferings of the World War I and II, of Nazism and of communism, the West started to revalidate its traditions condemning war and violence. People started to appreciate peace and co-operation within and among nations. The United Nations and the European Union had been founded for such purposes: to promote peace and co-operation. However, the condemnation of wars did not halt military confrontation of the states, and the West still cultivates political ideologies, which propagate the “proper order” based on competition and struggle. Hence the concepts of multi-party democracy and of free market could serve as hallmarks of the West. In China, since the end of the 1970’s step by step the ancient ideological traditions have been appreciated again and the new concepts of peaceful and harmonious development evolved. At the beginning of the 21st century the Chinese leaders elaborated a new ideology of both harmonious domestic and international order aiming at peaceful development based on co-operation. Of course, there are still vivid the remnants of the previous Western-type approach of the brutal competition and of aggressive foreign policy.Notwithstanding divergent tendencies inside each of these civilisations, in general they both approach each other again, but this time in a common search for peace, cooperation and harmonious development. Their interpretations obviously differ, since in China such concepts are traditional, but rather new in the West, and in various respects both sides have different values and ideals. (shrink)

This paper examines the social contract theories of Grotius, Hobbes, Pufendorf, and Locke, highlighting the failure of their contractarian defenses of the military and military service. In order to ground the duties of military service, each theorist presumes a chivalric gender order wherein men as men are expected to be willing to sacrifice themselves as violent instruments for the sake of their families and communities. While Grotius, Hobbes, and Pufendorf use the contract method to defend absolute, or (...) near absolute, political authority wherein subject's primary political obligation is to serve the sovereign in war upon command, Locke uses the contract method to create a liberal political order that preserves the natural rights of subjects. Nevertheless, Locke maintains the commitment to self-sacrificial military service. In Locke, then, the military is peeled away from liberal civil society and we see the first statement of the civil-military distinction that persists today. (shrink)

Cosmopolitanism is a stream of opinion that has at its heart the ideal of a united humanity protected by a universal morality codified in human rights and international legal standards supervised by international organisations. These views are powerful ones that are recognisable in many policies, institutions and initiatives around the world. This paper examines cosmopolitanism and its influence on British military policy.

This study examines the relationship between US Marine discourse and civil–military public argument. A computer-aided semantic analysis of public record speech from senior Marine officers shows a style of cohesion, marked by future-oriented, inclusive, highly certain language. An appraisal theory discourse analysis of interviews with US Marines conducted during an ethnography of communication shows their talk argues discursively for cohesion. This way of speaking may constrain Marines in public argument, as they repeat ways of talking appropriate within the (...) community, even when situationally inappropriate for civilian audiences. Although conscientious objection is a long-standing phenomenon, it has only recently become a major factor affecting armed forces and society. The only comprehensive, comparative scholarly study of conscientious objection to military service, this book examines the history of the practice in the Western world and state policies that have grown up in response to it. It shows how the contemporary refusal to bear arms is likely to be secular and widespread rather than religious and marginal, now including service people (...) as well as conscription resisters. No account of civil-military relations or peace movements in advanced industrial countries is complete without reference to conscientious objection, and this book will be the standard text on the subject. The aim of this article is to analyse the new forms of militarism as well as the position and the role of the armed forces in Latin American political systems in the twenty-first century. The first part analyses two selected forms of military participation in politics: the participation of former servicemembers in presidential elections and their performance as presidents, and the militarisation of political parties. The second part of the article focuses on the issue of contemporary civil-military (...) relations in Latin America, discussing the problems associated with the establishment of democratic control over the armed forces, the reform of the Ministries of Defense and the redefinition of the functions of the army. This teaching case study poses classic questions about following orders versus serving one's conscience. It tracks the actions of Captain Lawrence Rockwood, an intelligence officer with the Tenth Mountain Division of the United States Army, who was sent to Haiti in September 1994 as part of the mission to oust the dictator Cedras and put the elected Aristide in power. Captain Rockwood felt that his conscience, his humanitarian duty and international law all required that he inspect the National Penitentiary where, (...) intelligence reports showed, political prisoners were being tortured and murdered. His chain of command was unanimous in refusing him permission to inspect the prison and in directing that he do nothing that would endanger fragile relations with the peacefully departing Cedras regime. The case is intended for use in courses on force and justice, for ethics and leadership classes at military academies, at chaplaincy schools and seminaries or in classes on law of war and international law, civil-military relations, peacekeeping and new missions for the military. Modern military campaigns cannot (...) be waged without some degree of reliance on the logistical support such contractors provide, but their use makes it easier for governments to hide the true risks and costs of modern war from the electorate, serving to undermine key conceptions of “just war” principles like “legitimate authority” and “public declaration” of war. On the other hand, the dramatic increase in maritime piracy forces an unpleasant choice between either increasing defense spending on appropriate weapons systems and personnel during a global economic crises in order to provide enhanced maritime security, or else, ironically, relying even more on private security contractors to protect global shipping and transportation. Both these and similar foreign policy challenges focus attention on the need for “ethical interoperability,” the ability to share common notions of military ethics, public service, and professional responsibility among coalition military forces otherwise drawn from a variety of disparate national, cultural, and ethnic backgrounds. In this wide-ranging interview, the historian Charles van Onselen discusses his recent book, Showdown at the Red Lion: The Life and Times of Jack McLoughlin, 1959–1910 against the backdrop of his previous work. He explores social formation and the consolidation of state-power in southern Africa through the empirical optic of social banditry and the role of individual outliers. The theoretical framing is drawn from historical sociology. The so-called person?situation debate in psychology, which pits internal, personality-based explanations of behavior against external, environment or situation-based explanations seems headed for a resolution that will somehow include elements of both perspectives. These two alternative views of human behavior have also been applied to that subset of human behavior thought of as leadership, and in this domain a rapprochement also seems well underway. In the domain of ethical leadership, however, especially as applied to military misconduct, public discussion of such (...) events is dominated by strictly situation-based explanations, while institutional developments within the military are showing signs of integration, paralleling developments in the broader academic domain. The public discussion of such events thus lags behind the approach to ethical conduct in war taken by the military, which increasingly integrates personal and situational factors in the moral and ethical development of soldiers and leaders. Potential consequences of overreliance on situationist approaches to military ethics are discussed. (shrink)

Civil society organizations attempt to induce corporations to behave in more socially responsible ways, with a view to raising labour standards. A broader way of conceptualizing their efforts to influence the policies and practices of employers is desirable, one centred upon the concept of civil governance. This recognizes that CSOs not only attempt to shape the behaviour of employers through the forging of direct, collaborative relationships, but also try to do so indirectly, with interactions of various kinds with (...) the state being integral. Drawing on evidence derived from UK-based CSOs involved in work and employment relations, four types of civil governance are identified and characterized. By elaborating the concept of civil governance, and demonstrating how different types of civil governance operate, the research extends our knowledge and understanding of how CSOs, as increasingly prominent actors in the field of work and employment relations, operate within, and contribute to, systems of labour governance. Farabi defines “Ilm al-Hiyal” in Ihsa al-Ulum as “knowing a way by which, human can adjust all of the concepts that have been proved in mathematics with verification to exotic objects, and helps their states in exotic objects to be carried”. He believes this will be recognized and be attained by craft. This was the common view in Islamic wisdom and philosophy in third and fourth Hijra centuries. Researchers believe that the unique emphasis on parallelism between theoretical science and practical (...) work is an important feature of Baghdad school and affected Islamic visual culture. Baghdad school had been affected by translation. In this way, Ikhwan-al-Safa, whom wrote the first encyclopedia of science in Islamic culture, had a very efficient role. They devised geometry into intellectual and sensual ones in the second part of their book, al-Rasa-el, and considered intellectual geometry as one of the middle philosophy and recognition and understanding factor for meaning of sensual geometry evidences. They insisted on basic situation of intellectual geometry in guidance of whom, want to learn intellectual things from sensual ones. They knew intellectual geometry as the factor for requiring skill in scientific crafts, and sensual geometry as the factor of practical crafts, and made a vast relation between them. They also defined end of intellectual geometry understanding the base of all sciences and the main factor of wise, essence of self. Important feature of Ikhwan-al-Safa’s wisdom is omitting the gap between theory and practice, making a vast relation between them, which affected the meaning of crafts in Islamic culture, and rendered a spiritual feature to crafts and arts. It seems this relation has created the concept of traditional arts, and integrating wisdom and crafts in Iranian-Islamic culture constructed all of the Fotowat-Nam e. This article reviews the concept, which affiliates theory and practice in third and fourth centuries and has a deep effect on recognition of art and craft in Islamic culture. (shrink)

The establishing of the Military Chaplaincy Service of Ukraine is closely related to the fundamental socio-cultural transformations of the entire Ukrainian society, which began in 1991, when Ukraine gained independence. After three revolutions, and especially the Revolution of Dignity in 2013-2014, the people of Ukraine finally chose the path of European integration and their further development in the great family of the civilized world. Gradually, all state and public institutions began to reform their internal structures to approach the standards (...) of European societies. This also affected the armed forces of Ukraine, including and chaplain service. Since 1991, the chaplaincy has gone through several stages in its formation. As early as 2014, before the start of full-scale Russian military aggression against Ukraine, important changes took place in the Military Chaplaincy Service, which brought its internal structure closer to the standards of the armed forces of foreign countries. During the years of work of military chaplains in the combat units of the Armed Forces of Ukraine, experience has been gained that gradually allows us to assess the effectiveness of the mechanisms of activity and management. This article is a scientific reflection of the personal experience of the author, who is serving in the Armed Forces of Ukraine as a military chaplain in one of the combat units. The activity of a military chaplain within the framework of the military chaplaincy of the Armed Forces of Ukraine, and at the same time, in the conditions of the unit's execution of combat missions, gives an opportunity to fix and understand the factors of decreasing the effectiveness of military chaplains. The aim of this study is to determine the institutions and administrative factors of ineffective work of military chaplains and to propose management solutions to overcome them. (shrink)
