In this article, I respond to David McIvor’s and Lars Rensmann’s discussion of my recent book, The Politics of Repressed Guilt: The Tragedy of Austrian Silence (2018, Edinburgh University Press). Both invited me to clarify my use of Arendt in my conception of embodied reflective judgment. I argue for a stronger connection between judgment and emotions than Arendt because one can effectively shut down critical thinking if one uses defense mechanisms to repress feelings of guilt. In response to McIvor, I (...) discuss the idea of the “subject-in-outline” and “embodied reflective spaces” to overcome the guilt/defense complex to engender a reparative politics of justice. Finally, in response to Rensmann, I point out that the lingering culture of repressed guilt helps us explain the general conditions that contributed to the rise of the far and extremist right in Austria, which I develop further in my new book Analyzing the Far Right. Rather than focusing on political and legal debates surrounding attempts to determine if and when genocidal rape has taken place in a particular setting, this essay turns instead to a crucial, yet neglected area of inquiry: the moral significance of genocidal rape, and more specifically, the nature of the harms that constitute the culpable wrongdoing that genocidal rape represents. In contrast to standard philosophical accounts, which tend to employ an individualistic framework, this essay offers a situated understanding of harm that (...) features the importance of interdependence and relationality and that conceptualizes harms as embodied and contextual. The paper ultimately reveals what is distinctive about this particular crime of sexual violence by exploring the logic of genocidal rape: genocidal rape involves the harm of forced self-betrayal unleashed relationally, causing victims as representatives of their group to participate inadvertently in the destruction of that group. In this article, I respond to Laury Naranch’s and Mary Caputi’s discussion of my book Power and Feminist Agency in Capitalism (2017). In response to Naranch, I clarify how the political subject-in-outline translates into collective political action through the figure of the Chicana working-class woman. I also explain why the proletariat, more so than the precariat, implies a radical political imaginary if we rethink this concept in the context of my idea of the political subject-in-outline. I also clarify that my (...) chapters on Marx expose how Adorno and Marx have problematic imaginations of the working-class woman, which counter their otherwise radical imaginary. In response to Caputi, I clarify the meaning of capitalism in my book and underline that we need a rigorous critique of capitalism to counter the rise of the Far Right. I also explain why the fluid subject does not have agency and why the subject-in-outline is a better way to theorize transformative feminist agency. I also clarify that my conception of feminist political subjectivity does not assume a privileged vantage point outside power structures. (shrink)

In his seminal _Philosophy of David Hume_, Norman Kemp Smith called for a study of Hume "in all his manifold activities: as philosopher, as political theorist, as economist, as historian, and as man of letters," indicating that "Hume's philosophy, as the attitude of mind that found for itself these various forms of expression, will then have been presented, adequately and in due perspective, for the first time." Claudia Schmidt seeks to address this long-standing need in Hume scholarship. Against the (...) charges that Hume holds no consistent philosophical position, offers no constructive account of rationality, and sees no positive relation between philosophy and other areas of inquiry, Schmidt argues for the overall coherence of Hume's thought as a study of "reason in history." She develops this interpretation by tracing Hume's constructive account of human cognition and its historical dimension as a unifying theme across the full range of his writings. Hume, she shows, provides a positive account of the ways in which our concepts, beliefs, emotions, and standards of judgment in different areas of inquiry are shaped by experience, both in the personal history of the individual and in the life of a community. The opportunities to become a good person are not the same for everyone. Modern European ethical theory, especially Kantian ethics, assumes the same virtues are accessible to all who are capable of rational choice. Character development, however, is affected by circumstances, such as those of wealth and socially constructed categories of gender, race, and sexual orientation, which introduce factors beyond the control of individuals. Implications of these influences for morality have, since the work of Williams and Nagel in the seventies, (...) raised questions in philosophy about the concept of moral luck. In The Unnatural Lottery, Claudia Card examines how luck enters into moral character and considers how some of those who are oppressed can develop responsibility. Luck is often best appreciated by those who have known relatively bad luck and have been unable to escape steady comparison of their lot with those of others. The author takes as her paradigms the luck of middle and lower classes of women who face violence and exploitation, of lesbians who face continuing pressure to hide or self-destruct, of culturally Christian whites who have ethnic privilege, and of adult survivors of child abuse. How have such people been affected by luck in who they are and can become, the good lives available to them, the evils they may be liable to embody? Other philosophers have explored the luck of those who begin from privileged positions and then suffer reversals of fortune. Claudia Card focuses on the more common cases of those who begin from socially disadvantaged positions, and she considers some who find their good luck troubling when its source is the unnatural lottery of social injustice. In this contribution to philosophical ethics, Claudia Card revisits the theory of evil developed in her earlier book The Atrocity Paradigm, and expands it to consider collectively perpetrated and collectively suffered atrocities. Redefining evil as a secular concept and focusing on the inexcusability - rather than the culpability - of atrocities, Card examines the tension between responding to evils and preserving humanitarian values. This stimulating and often provocative book contends that understanding the evils in terrorism, torture and genocide enables (...) us to recognise similar evils in everyday life: daily life under oppressive regimes and in racist environments; violence against women, including in the home; violence and executions in prisons; hate crimes; and violence against animals. Card analyses torture, terrorism and genocide in the light of recent atrocities, considering whether there can be moral justifications for terrorism and torture, and providing conceptual tools to distinguish genocide from non-genocidal mass slaughter. Statements such as “X is beautiful but I don’t like how it looks” or “I like how X looks but it is not beautiful” sound contradictory. How contradictory they sound might however depend on the object X and on the aesthetic adjective being used (“beautiful”, “elegant”, “dynamic”, etc.). In our study, the first sentence was estimated to be more contradictory than the latter: If we describe something as beautiful, we often intend to evaluate its appearance, whereas it is less counterintuitive (...) to appreciate an appearance without finding it beautiful. Furthermore, statements including “beautiful” appeared more contradictory than those including “elegant” and “dynamic”, pointing to its greater evaluative component. When related to artworks, sentences could appear less contradictory due to readers’ consideration of the divergence between conventional beauty and art-related sensory pleasures that can even include negative valence. Such ambivalence might be more frequent in art-objects than in other artefacts. Indeed, in our study, sentences referring to artworks were estimated to be less contradictory compared to sentences referring to other artefacts. Meanwhile, an additional small group of graphic design students showed a less clear difference between art-related and non-art-related sentences. We discuss the potential influence of art experience and interest as well as theoretical and methodological challenges like the conceptualization of beauty. (shrink)

The aim of the current article is to analyze the concept of tragic cases and its different implications based on Manuel Atienza, one of the jurists who specially addressed the issue, and on Robert Alexy, whose work is one of the main references in contemporary Legal Philosophy. According to parameters exposed by Alexy (correctness, rationality, legal argumentation, human rights), some of Atienza’s central assertions about tragic cases (lack of correct answer, legal rationality limitation, option for the lesser evil) are herein (...) demonstrated as inadmissible. Based on Alexy’s work, it is possible to justify the opposite conclusion about tragic cases, i.e., cases where there is more than one correct answer and these answers are opposed to each other. O presente texto narra a história de duas professoras rurais que atuaram em Caxias do Sul, no período de 1920 a 1950: Alice Gasperin e Irides Lourdes Rech. Entretecer a história da educação do município a partir das histórias ordinárias de vida dessas professoras nos permite compreender os cenários escolares rurais: os saberes ensinados, os fazeres cotidianos, as dificuldades para frequentar a escola, para se tornarem e, mesmo, para se manterem professoras. São histórias ímpares, mas que comungam da condição (...) de terem atuado em área rural, no Município de Caxias do Sul, como professoras leigas inicialmente. Considerando as contribuições da História Cultural e, metodologicamente, da História Oral, o artigo analisa asentrevistas e os relatos autobiográficos das docentes, evidenciando o reconhecimento simbólico do fazer docente nas comunidades rurais caxienses no período em estudo. Ethical attitudes towards pregnant women were examined by using a questionnaire among 50 nurses, 50 midwives and 100 nursing students (third and fourth years). The main findings show that nurses and students differ in: (1) their knowledge of the Code of Ethics; (2) their protection of patients' rights with regard to secrecy and privacy; and (3) their reporting of mistakes. These findings highlight the need for more serious study of ethics among senior professional nurses.

Addressing studying as a distinct educational concept and phenomenon in its own right, the essays in this volume consider study and studying from a range of perspectives. Countering dominant educational discourses, which place a heavy emphasis on learning and instruction, the contributors explore questions such as: What does it mean to study something? How is studying something different from being taught about it, or learning something about it? What does the difficulty demanded by study mean for the one who studies (...) and for the teacher? In this classic work, now appearing in English for the first time, Claudia Moatti analyses the intellectual transformation that occurred at the end of the Roman Republic in response both to the political crisis and to the city's expansion across the Mediterranean. This was a period of great cultural dynamism and creativity when Roman intellectuals, most notably Cicero and Varro, began to explore all areas of life and knowledge and to apply critical thinking to the reassessment of tradition and (...) the development of a systematic new understanding of the Roman past and present. This movement, linked to the development of writing, challenged old forms of authority and adhesion, belief and behaviour, without destroying tradition; and for this reason this rational trend can be described not as a cultural but as an epistemological revolution whose greatest achievement, Professor Moatti argues, was the development of the system of Roman law. In Aristotle's Ethics as First Philosophy Claudia Baracchi demonstrates the indissoluble links between practical and theoretical wisdom in Aristotle's thinking. Referring to a broad range of texts from the Aristotelian corpus, Baracchi shows how the theoretical is always informed by a set of practices, and specifically, how one's encounter with phenomena, the world, or nature in the broadest sense, is always a matter of ethos. The use of psychoanalytic ideas to explore social and political questions is not new. Freud began this work himself and social research has consistently drawn on his ideas. This makes perfect sense. Social and political theory must find ways to conceptualise the relation between human subjects and our social environment; and the distinctive and intense observation of individual psychical structuring afforded within clinical psychoanalysis has given rise to rich theoretical and methodological resources for doing just this. However, psychoanalytic concepts do (...) not remain the same when they are rearticulated in the context of research. This book traces the reiteration and transformation of concepts in the psychoanalytic theory of Freud, Klein and Lacan, the social theory of Butler, Derrida, Foucault, Laclau and Zizek, and case studies of empirical research ranging from the classic Tavistock Institute studies to contemporary work in politics, gender studies, cultural studies and education. McGowan has provided a linguistic mechanism that explains how speech can constitute harm. Her idea is that utterances routinely enact s-norms about what is permissible in a given context. My aim is to argue that these s-norms are sensitive to the conversational standing of the speaker. In particular, I claim that the strength of the norm enacted depends on the standing of the speaker. In some cases, the speaker might even lack the standing required to enact new s-norms.

For years, mainstream feminist ethics focused criticism on male supremacy. Feminist philosophers in this volume adopt a less male-focused stance to look closely at oppression's impact on women's agency and on women's relations with women.
