This article explores how the institutional context, including central and local governments, has co-evolved with business in relation to small cars and sustainability. This issue is very relevant for business and society in view of the environmental implications of the rapidly growing vehicle fleet in China, the economic importance attached to this pillar industry by the government, and citizen interest in owning and driving increasingly larger cars. The interactions between different levels of government, and with business in countries with a (...) large role for the state is a novel area of study in the business-society area and a complex one given the multitude of objectives and interests involved in industry competitiveness, economic development, energy security, and sustainability. The article shows that the central government has adopted policies to further the production and use of small cars, which it perceives as serving environmental, economic, and social goals. Concurrently, however, many local governments imposed restrictions on small cars and have, implicitly or explicitly, favored larger cars. There seems to be a clear linkage to municipal ownership of those domestic automobile companies which, via joint ventures with foreign firms, focused more on larger cars. By adopting a co-evolutionary approach focused on macro-level interactions, the case helps to shed some more light on concrete sustainability challenges, and broader government–business interactions in a highly institutionalized setting, contributing insights on issues that have remained underexposed in business and society research. In On Global Justice, Mathias Risse claims that the earth’s original resources are collectively owned by all human beings in common, such that each individual has a moral right to use the original resources necessary for satisfying her basic needs. He also rejects the rival views that original resources are by nature owned by no one, owned by each human in equal shares, or owned and co-managed jointly by all humans. I argue that Risse’s arguments fail to establish a form (...) of ownership at all and, moreover, that his arguments against the three rival views he considers all fall short. His argument establishes, rather, a moral constraint on any conventional system of property ownership. (shrink)

The concept of ‘ownership’ is increasingly central to debates, in the media, health policy and bioethics, about the appropriate management of clinical data. I argue that the language of ownership acts as a metaphor and reflects multiple concerns about current data use and the disenfranchisement of citizens and collectives in the existing data ecosystem. But exactly which core interests and concerns ownership claims allude to remains opaque. Too often, we jump straight from ‘ownership’ to ‘private property’ (...) and conclude ‘the data belongs to the patient’. I will argue here that private property is only one type of relevant relationship between people, communities and data. There are several reasons to doubt that conceptualising data as private property presents a compelling response to concerns about clinical data ownership. In particular I argue that clinical data are co-constructed, so a property account would fail to confer exclusive rights to the patient. A non-property account of ownership acknowledges that the data are ‘about the patient’, and therefore the patient has relevant interests, without jumping to the conclusion that the data ‘belongs to the patient’. On this broader account of ownership, the relevant harm is the severing of the connection between the patient and their data, and the solution is to re-engage and re-connect patients to the data research enterprise. Boyer's minimal model of ownership psychology suggests that joint possession triggers representations of collective agency. However, many forms of co-ownership based on cooperation or competition can be represented as a set of P() or L() tags without inferring a unifying collective entity. Moreover, representations of partible ownership are required to engage in cooperative production and distribution of resources.

In the 1990s, the role of the chief executive officer (CEO) of major United States corporations underwent a profound transformation in which CEOs went from being bureaucrats or technocrats to shareholder partisans who acted more like proprietors or entrepreneurs. This transformation occurred in response to changes in the competitive environment of U.S. corporations and also to the agency theory argument that high levels of compensation by means of stock options helped to overcome the agency problem inherent in the separation of (...) ownership and control. Some critics charge that this new CEO role is objectionable for a variety of reasons, which may also be applicable to the current financial crisis in which CEO misconduct may have played a part. These objections are based largelyon a team production model of corporate governance, which is held by these critics to be superior to the standard agent-principal model. This article examines the objections offered by critics of the changed role of the CEO and argues that their negative assessment of this development and their use of the team production model to support their conclusions are not warranted. CEOs have changed from hired hands to co-owners, and this change may have contributed in some measure to the current financial crisis. However, in determining the morally preferable role of the CEO, care must be taken not to discard what is sound in the changed role. (shrink)

The paper documents the post-war retrenchment and failure of the post-war British Consumer Co-operative Movement. In contrast to the general failure one CEO, Terry Thomas stands out both for his success in co-operative rebranding and returning to profitability the UK Co-operative Bank and because he alone amongst the top echelons of the Co-operative Groups Management based his strategies on a clearly articulated philosophy based on his understanding of the values and purpose of the co-operative movement rooted in its historical traditions (...) grounded in the writings and achievements of Robert Owen, The paper goes on to provide a case study of the bank’s process of transformation from loss-making subsidiary to the first positive co-operative national brand in the post-war period of its history. The author argues that lack of appropriate vision based on the founding values and purposes of the Co-operative Movement is the principal reason for the management’s and governance failures that have beset the UK Co-operative Group. Instead of using the past to help in understanding the present and planning for the future, the UK Co-operative Group Leadership ignored it or worse used the past successes to congratulate itself and disguise its manifest failures. In this, they were supported by an uncritical Co-operative Union. Davis argues large co-operatives cannot be managed by a civil service responsible to an elected board. Co-operatives need a servant-leadership model of professional management dedicated to the transformational goals set by the founders of the co-operative movement. This needs a radical rethink and promotion of co-operative management education and a dedicated executive recruitment that seeks out value-based professionals whose attitudes and values are compatible with Co-operative values, ownership and purpose. The primary aim of this essay is to present a case for a heavily revised notion of heterophenomenology. l will refer to the revised notion as ‘enkinaesthesia’ because of its dependence on the experiential entanglement of our own and the other’s felt action as the sensory background within which all other experience is possible. Enkinaesthesia2 emphasizes two things: (i) the neuromuscular dynamics of the agent, including the givenness and ownership of its experience, and (ii) the entwined, blended and situated (...) co-affective feeling of the presence of the other(s), agential (for example, human, horse, cat, beetle) and non-agential (for example, cup, bed, apple, paper) and, where appropriate, the anticipated arc of the other’s action or movement, including, again where appropriate, the other’s intentionality. When the ‘other’ is also a sensing and experiencing agent it is their - in this case, the pair’s - affective intentional reciprocity, their folding, enfolding, and unfolding, which co-constitutes the conscious relation and the experientially recursive temporal dynamics that lead to the formation and maintenance of the deep integral enkinaesthetic structures and melodies which bind us together, even when they pull us apart. Such deeply felt enkinaesthetic melodies emphasise the dialogical nature of the backgrounded feeling of being. (shrink)

Que se passe-t-il lorsqu’un risque menace une activité sociale encadrée par une institution réputée protectrice ? La question est ici posée au sujet d’activités relatives à la propriété immobilière : l’achat et la propriété d’un logement ; la gestion de copropriété. Face aux risques que représente aujourd’hui l’acquisition d’un logement, les acteurs du marché adoptent des comportements préventifs qui consistent surtout à ne pas porter atteinte aux valeurs attachées à la propriété. Quant aux spécialistes de la copropriété, ils entretiennent la (...) confiance dans des règles juridiques qui excluent la notion de risque, en se référant à une représentation fixiste de la propriété. Dans les deux cas, les comportements qui concourent à la méconnaissance des risques sont rationnels : ils visent à entretenir la confiance nécessaire aux activités sociales considérées.What happens when a risk threatens a social activity which is ruled by an apparently protective institution ? We are questioning here the activities that have to do with property : home ownership and management of joint ownership buildings. Actors of the housing market face home ownership’s risks by defending property’s conservative values and meanings. As for experts in joint ownership, they try to maintain trust in legal rules that exclude the notion of risk. In both cases, it is more rational to ignore risks than endanger trust in property. ABSTRACT The publication of Pope Leo XIII's encyclical Rerum Novarum in 1891 established a tradition of Catholic social teaching concerned with the moral obligations that should exist between capital and labour. In Ireland the encyclical instigated enthusiasm among some clergy for their congregation's welfare. An urgency given to social and economic questions coincided with the co-operative movement's introduction to the Irish countryside. Rural co-operative societies were established as part of a wider programme of economic democracy that placed ownership of (...) production in the hands of farmers. The growth of the co-operative movement benefitted from the participation of members of the clergy at both a national and local level. Co-operative organisers and socially minded priests shared an interest in addressing the iniquities of capitalist modernisation. Co-operators championed a communal form of business organisation that emphasised the moral importance of economic activity as much as its productive importance. The involvement of Catholic priests in the co-operative movement naturalised priest-led social action in the sphere of rural development. This article analyses intersections between the economic objectives of co-operation and Catholic social teaching to understand how attempts to promote a more democratic economy had a profound influence over the country's economic development. In The Food Sharing Revolution, Michael Carolan tells the stories of (...) traditional producers like Marvin, who are being squeezed by big agribusiness, and entrepreneurs like Josh, who are bucking the corporate food system. The difference is Josh has eschewed the burdens of individual ownership and is tapping into the sharing economy. Josh and many others are sharing tractors, seeds, kitchen space, their homes, and their cultures. They are business owners like Dorothy, who opened her bakery with the help of a no-interest, crowd-sourced loan. They are chefs like Camilla, who introduces diners to her native Colombian cuisine through peer-to-peer meal sharing. Their success is not only good for aspiring producers, but for everyone who wants an alternative to monocrops and processed foods. The key to successful sharing, Carolan shows, is actually sharing. He warns that food, just like taxis or hotels, can be co-opted by moneyed interests. But when collaboration is genuine, the sharing economy can offer both producers and eaters freedom, even sovereignty. The result is a healthier, more sustainable, and more ethical way to eat. The notion of community infers unity and a source of moral obligations in an organisational ethic between individuals or groups. As such, a community, having a strong sense of collective identity, may foster collective action to promote social change for the betterment of society. This research critically explores notions of community through analysing discursive identity construction practices within a member-owned urban consumer co-operative public house in the UK. A strong sense of community is an often-claimed CC characteristic. The paper’s main (...) contributions stem from using the lens of identity work to critically unpack the notion of community through highlighting paradoxical tensions of community residing within CCs. The findings reveal that the notion of community may be illusionary with counter-veiling forces, one that reflects a more traditional sense of connection, attachment and communion, and the other of boundaries, disconnection or division. As these repertoires collide, tensions are evident between the hegemonic discourse of neoliberal managerialism and that of democratic collective ownership. Despite these individual-level tensions, communities may operate within boundaries enabling an organisational and societal ethic, beyond the individual. (shrink)

Internet of Things, Internet of Everything and Internet of People are concepts suggesting that objects, devices, and people will be increasingly interconnected through digital infrastructure that will generate a growing gathering of data. Parallel to this development is the celebration of the smart city and sharing city as urban policy visions that by relying heavily on new technologies bear the promise of efficient and thriving cities. Law and policy scholarship have either focused on questions related to privacy, discrimination, security, or (...) issues related to the production and use of big data, digital public services. Little or no attention has been paid to the disruptive impact of technological development on urban governance and city inhabitants’ rights of equal access, participation, management and even ownership, in order to understand whether and how technology can also enhance the protection of human rights and social justice in the city. This Article proposes complementing the technological and digital infrastructure with a legal and governance infrastructure, the Internet of Humans, by construing and injecting in the policy framework of the city the principle of Tech Justice. Building on a literature review and from an analysis of selected case studies, this Article stresses the dichotomy existing between the market-based and the society-based applications of technology, the first likely to increase the digital divide and the challenges to human rights in the city, the latter bearing the promise to promote equal access to technology in the city. The main argument advanced by this Article is that the principle of Tech Justice if embedded as an empirical dimension of smart city and sharing city policies can steer their developments in the direction of a more just and democratic city. With the aim of understanding current problematizations of embryonic stem cell patenting this article rehearses the history of social entitlements related to reproductive material derived from women seeking care in institutions for reproductive health in Denmark. Our interest lies in the emergence of commercial exchange of material derived from embryos. Such exchange is characterized by contestation of the status of the embryo: is it a person or a commodity? To understand the modus operandi of the exchanges, we first explore how (...) the concepts of personhood and morality, of commodity and ownership tend to be related in the ideal type of capitalist exchange. Historical context then helps us understand the contingency of exchange systems. Historically Danish women have had much less influence on the dissemination of material derived from them than they do today. However, today their entitlements have also found their limits, in particular with respect to commercial transactions. We claim that, ironically, material derived from institutionally mediated reproduction gains unprecedented personhood from confrontation with a capitalist exchange form which potentially designates it as a mere commodity. Esta contribución, enmarcada en las V y VI convocatorias de proyectos de innovación docente de la Universidad de Cantabria (España), demuestra los resultados obtenidos tras la incorporación de metodologías docentes de gamificación y de creación de video-píldoras informativas en el contexto de aprendizaje de Geo-tecnologías. El alumnado participante mostró un grado de satisfacción muy elevado con el proyecto de innovación, alcanzando una media de 4.45 sobre 5 y las competencias de la asignatura se lograron satisfactoriamente. "Contra la postmodernidad" entabla una polémica con las principales contribuciones políticas, sociológicas y filosóficas de los últimos tiempos. Comparecen ante el tribunal pensadores como Zygmunt Bauman, Anthony Giddens, Agnes Héller, Toni Negri, Simon Critchley, Gianni Vattimo, Eloy Fernández Porta y Jean-François Lyotard, entre otros. Se discuten las falacias de la economía neoclásica, el fetichismo de la alteridad radical y la retórica de la diferencia. A esto se añade una ardua polémica con aquella forma de filosofía obsesionada con el suicidio de (...) la razón, la muerte de la metafísica y la superación de la Modernidad. También se debate sobre la crisis del proyecto europeo y sobre movimientos sociales recientes como el 15-M o la primavera árabe. La tesis principal del libro afirma que la postmodernidad hace tiempo que llegó a su fin, sus categorías no son aplicables a un tiempo como el nuestro, marcado por una grave crisis económica, ecológica y social. Asistimos al regreso de la lucha de clases, la geopolítica, las estrategias neocoloniales, el populismo y el fundamentalismo étnico, cultural y religioso. En este contexto de grandes transformaciones, la apuesta normativa del postmodernismo resulta intelectualmente muy pobre y políticamente inútil. El afán por las cuestiones culturales e identitarias lleva a que muchos de sus autores olviden deliberadamente el análisis económico del sistema. Por este motivo, el postmodernismo resulta ser, en la mayor parte de los casos, una réplica exacta de la ideología neoliberal. (shrink)
