Our understanding of civilian casualties is not based solely on what is reported but also who reports these human rights abuses. Competing interests at the data collection stage have impeded the development of a more thorough understanding of civilian victimization during conflict. We find that current definitions of “casualty” neglect nonphysical forms of victimization and that group-based definitions of “civilian” can obscure the role of different individuals in conflict. We contend that the dominant definition of “civilian casualty” should be expanded (...) to include the full array of harm inflicted on individuals, including psychological harm and what we refer to as multiple casualties of conflict. Expanding our definition of civilian casualties to include different degrees and kinds of wartime victimization would improve both documentation and analysis. We propose several areas for improvement in terms of the documentation of civilian casualties as well as potential solutions to the problems we identify. (shrink)

In this study, I chart the genealogy and development of new trends in high-tech warfare which have emerged in the past decade and note challenges and dangers. I discuss the Bush administrations’s military program and foreign policy moves, highlighting the ways that the Bush II cabal intensifies the dangers of high-tech war, while undermining efforts at collective security, environmental protection, and global peace. My argument is that the volatile mixture of a highly regressive and unilateralist and militarist administration with the (...) development of high-tech weapons provides a clear and present danger of a protracted and frightening period of war. The mixture of rightwing unilateralism and militarism dramatically erupted in the Bush administration’s military response to the terrorist attacks of September 11 and is intensifying the dangers to world peace in the Bush military campaign against terrorism which they are labeling “World War III.”. This book addresses the question of when and why it is justifiable for a polity to prepare for war by militarizing. In doing so it highlights the ways in which a civilian population compromises its own security in maintaining a permanent military establishment, and explores the moral and social costs of militarization.

The problem of moral sunk costs pervades decision-making with respect to war. In the terms of just war theory, it may seem that incurring a large moral cost results in permissiveness: if a just goal may be reached at a small cost beyond that which was deemed proportionate at the outset of war, how can it be reasonable to require cessation? On this view, moral costs already expended could have major implications for the ethics of conflict termination. Discussion (...) of sunk costs in moral theorizing about war has settled into four camps: Quota, Prospect, Addition, and Discount. In this paper, I offer a mathematical model that articulates each of these views. The purpose of the mathematisation is threefold. First, to unify the sunk costs problem. Second, to show that these views differ in the nature of their justifications: some are justified qualitatively and others quantitatively. Ask any Civil War historian about the cost of the Civil War and they will recite a host of well-known assessments, from military casualties and government expenditures to various measures of direct and indirect costs. But those numbers are not likely to include an appraisal of the humanitarian crisis and suffering caused by the wartime destruction of slavery. Peace-time emancipation in other regions and in other societies certainly presented dangers and difficulties for the formerly enslaved, but wartime emancipation chained (...) the new opportunities and possibilities for freedom to war’s violence, civil chaos, destruction and deprivation. The resulting health crisis, including illness, injury, and trauma, had immediate and lasting consequences for black civilians and soldiers. Although historians are more accustomed to thinking of enslaved people as the beneficiaries of this war, rather than its victims, we cannot assess the cost of this war until we answer two important questions: first, what price did enslaved people have to pay because their freedom was achieved through warfare rather than a peacetime process; and secondly, in this war in which so many Americans paid such a high cost, to what extent did racism inflate the cost paid by people of African descent? In answering these questions, we reconsider this specific war, but we must also tie the U.S. Civil War to a larger scholarship on how wars impact civilians, create refugee populations, and accelerate harsh treatment of people regarded as racial, religious, or ethnic outsiders. Why does it matter that those who fight wars be authorized by the communities on whose behalf they claim to fight? I argue that lacking authorization generates a moral cost, which counts against a war's proportionality, and that having authorization allows the transfer of reasons from the members of the community to those who fight, which makes the war more likely to be proportionate. If democratic states are better able than non-democratic states and sub-state groups to gain their community's (...) authorization, this means that some wars will be proportionate if fought by democracies, disproportionate if not. This article presents estimates of the global cost of collective and interpersonal violence for the period of one year. This includes war, terrorism, homicides, assaults and domestic violence against women and children. The cost of conventionally defined interpersonal violence, that is, homicides and assault, are about 7.5 times higher than the cost due to war and terrorism. I also estimate the costs of non-fatal domestic violence against children and women and suggest that these costs are much higher (...) than the combined costs of homicide, assault, terrorism and war. The main reason is that the prevalence of these types of violence is very high: possibly as many as 16 per cent of all children are punished using violent methods and about 12 per cent of all women experience intimate partner violence. Richer societies have lower levels of violence, and there is evidence that prevalence rates have been declining over time. However, it is often unclear why this is the case. Interdisciplinary communication on war is impeded by doctrinal gaps concerning its morality, immorality, and amorality. Much is written on ad bellum ethical standards for military force by states, mainly in the fields of international politics and religious studies. However, a necessary first step in comparing these different approaches to war ethics with each other is to develop a system for classifying them. The classification system offered in this paper places war ethics on a grid with two scales. One axis of (...) the grid ranges from permissiveness to restrictiveness. The other axis ranges from regard for self to regard for others. Twelve forms of war ethics are assigned points within the grid, including pacifism, just war, holy war, UN Charter obligations, several variants of realism, cost–benefit analysis, isolationism, and various ideological war ethics such as communist and fascist approaches. In doing so, this paper lays the groundwork for “quantifying” war ethics, to enable measurements of their effects against other state-level characteristics and outcomes of interaction. (shrink)

It is commonly assumed that the pre-codified, customary law of war had little true influence on the decisions or behavior of combatants in the western world. Evaluating this assumption concerning the custom (or norm) of the giving of quarter to enemy combatants in the Texas War of Independence of 1835--1836, this paper finds a strong and widely accepted norm on this subject already by the early 19th century, which exerted significant influence on the behavior in and the results and consequences (...) of the war. The following of this custom of war by the Texian Army, on the one hand, and its intentional and preplanned breaking by the Mexican army headed by Santa Anna for the supposed military and psychological benefits that would accrue from it, on the other, such as in the cases of the Alamo and Goliad, led to severe internal and external consequences for the Mexican side in the short and long term that greatly contributed to their failure to achieve their objectives and to the Texian success in achieving theirs. These consequences indicate the importance of the norms of warfare, even in the pre-codification era, and the major potential costs involved in their breaking or disregard by decision makers. ABSTRACTIn this paper I argue that a remotely piloted aircraft pilot’s act of killing remotely, when it is done in the defense of another person, can be viewed as an act of sacrifice. This argument concludes from two premises. First, the RPA pilot faces psychological risk to self by carrying out such an action; second, the RPA pilot is motivated to some significant degree by something other than self-interest. Moreover, I challenge both the view that RPA represent merely an incremental (...) development in technology yielding an incremental expansion of the distance between the war-fighter and the target and the view that RPA is revolutionary in some fundamental sense. I instead argue that, based upon the natural geometric boundary imposed by the earth’s shape, RPA have maximized the physical distance between the war-fighter and the target and, over time, this fact will change, not only the psychological effects on the RPA pilot, but also the way we view killing and distance in general. Although the prison was originally conceived for the noble purpose of rehabilitating criminal offenders, critics from its very inception worried that the prison was an inherently criminogenic institution, reinforcing the criminal behaviors of its occupants. In this article I focus on an indirect mechanism, elaborating and empirically testing the impact of a prison record/experience on ex-inmates' labor market outcomes, by which ex-inmates will face significantly higher risks of recidivism and hence future prison spells, especially when they are released into weaker (...) labor markets. Specifically, I specify and test a version of the "secondary labor market hypothesis." Because most ex-inmates were mired in secondary jobs prior to their incarceration, I consider the impact of a prison record/experience on their chances of "moving up" to good jobs with higher pay, steadier hours, and greater mobility. In the conclusion I draw out the somber implications of my labor market analyses by examining trends in recidivism rates and their social costs. The evidence suggests that the War on Drugs policies have trapped an increasing number of more marginal drug offenders in the revolving door of recidivism, conventionally defined. It also highlights a new and quantitatively important recidivism risk for released prisoners, the revocation of parole on technical violations. To break out of this vicious cycle, my analysis shows, would demand vast direct government interventions in the labor market. As a more modest first step, I consider policy innovations like drug courts that place marginal drug offenders in treatment programs rather than prison. In illustrating and elaborating my arguments, I focus on the War on Drug policies and on marginal drug offenders. My reasons are several. First, the War on Drugs constituted a true social experiment, an exogenous shift in criminal justice policy that is best understood as a "moral" panic, precipitated in part by the tragic but transitory episode of lethal gun violence in the social regulation of the crack trade. Second, the War on Drugs policies were quantitatively important in instituting the regime of mass incarceration. And finally, these policies indiscriminately incarcerated marginal, not just more serious, offenders. (shrink)

Learning to live together is the central concern of education everywhere in the world. Traditional sporting games provide interpersonal experiences that shape miniature communities charged with emotional meanings. The objective of this study was to analyze the ethnomotor features of TSG in three Catalan-speaking Autonomous Communities and to interpret them for constructing emotional communities. The study followed a phenomenological-interpretative paradigm. The identification of TSG was done by a hermeneutic methodological approach by using an exhaustive exploratory documentary research. We studied 503 (...) games collected in the Dictionary Català-Valencià-Balear de Alcover and Moll. Instruments and procedure: A database was built up with information about the internal and external logic of the games. The validity of the information was confirmed by means of a concordance test between the researchers. Data processing was carried out by means of classification trees, identifying the predictive variables of the types of TSG. Most of the TSGs were sociomotor games. The classification tree identified four explanatory variables. Three variables were internal traits, and one variable corresponded to external logic. Features of the TSG of the Catalan-speaking Autonomous Communities build original emotional communities. The ethnomotor regularities triggered emotional experiences associated with pleasure for living together ; domesticating of aggressiveness over opponents ; developing sustainability ; educating the competition ; and interpersonal well-being based on the community. We give a general method for producing various effective Null and Positivstellensätze, and getting new Positivstellensätze in algebraically closed valued fields and ordered groups. These various effective Nullstellensätze produce algebraic identities certifying that some geometric conditions cannot be simultaneously satisfied. We produce also constructive versions of abstract classical results of algebra based on Zorn's lemma in several cases where such constructive version did not exist. For example, the fact that a real field can be totally ordered, or the fact that (...) a field can be embedded in an algebraically closed field. This article argues that an artificial superintelligence (ASI) emerging in a world where war is still normalised constitutes a catastrophic existential risk, either because the ASI might be employed by a nation–state to war for global domination, i.e., ASI-enabled warfare, or because the ASI wars on behalf of itself to establish global domination, i.e., ASI-directed warfare. Presently, few states declare war or even war on each other, in part due to the 1945 UN Charter, which states Member States should “refrain (...) in their international relations from the threat or use of force”, while allowing for UN Security Council-endorsed military measures and self-defense. As UN Member States no longer declare war on each other, instead, only ‘international armed conflicts’ occur. However, costly interstate conflicts, both hot and cold and tantamount to wars, still take place. Further, a New Cold War between AI superpowers looms. An ASI-directed/enabled future conflict could trigger total war, including nuclear conflict, and is therefore high risk. Via conforming instrumentalism, an international relations theory, we advocate risk reduction by optimising peace through a Universal Global Peace Treaty (UGPT), contributing towards the ending of existing wars and prevention of future wars, as well as a Cyberweapons and Artificial Intelligence Convention. This strategy could influence state actors, including those developing ASIs, or an agential ASI, particularly if it values conforming instrumentalism and peace. (shrink)

Abstract Finding the western just war criterion of reasonable chance of success to be a contribution to ethical decision making about armed conflict requires dealing with a number of critiques. Specifying ?probability? rather than the alternatives ?hope? or ?chance?, and raising standards of evidence involved, makes the term less vague. Expanding the concept of ?success? to include morally defensible aims that can be achieved without military victory enriches the understanding of the moral relationship between ends and means in armed conflict. (...) Asking decision makers to accept moral responsibility for the costs of possible failure is a unique contribution to the just war criteria. The enriched concept of reasonable probability of success thus offers morally significant insights to prewar jus ad bellum decisions, and can benefit ethical decision-making about whether to continue once fighting has begun. The underlying idea behind the concept in all the religions remains the same, that is, the world will come to an end. The end itself, which has been called the Judgment Day, Day of Resurrection, or the Day of Retribution or Reckoning will be preceded by some signs. It has also been called the day of Apocalypse, the day when (...) the whole world will be destroyed. One of the distinct forms of it is Muslim Apocalypse about which a lot has been written. However, the argument of the present research paper shall be to examine the concept of the Mahdi primarily from the Shi’te Muslim point of view. The premise of the argument is that Shi’te argument or concept of the Mahdi is far more substantial having a solid theoretical foundation than the other perspectives about it. No wonder, therefore, the concept of the Mahdi has manifested itself in literature across cultures and ages. There are so many poets, primarily, Muslim poets who have highlighted this concept in their poetry and thus the research paper shall make an attempt to look at some of those poets and their understanding of it. By the middle of the twentieth century, many liberals looked glumly at the world modernity had brought about, with its devastating wars, rising totalitarianism, and permanent nuclear terror. They concluded that, far from offering a solution to these problems, the ideals of the Enlightenment, including emancipation and equality, had instead created them. The historian of political thought Samuel Moyn argues that the liberal intellectuals of the Cold War era--among them Isaiah Berlin, Gertrude Himmelfarb, Karl Popper, Judith Shklar, and Lionel Trilling--transformed (...) liberalism but left a disastrous legacy for our time. This article reassesses the quality and character of Carthaginian strategy during the First Punic War. It uses the ship count figures contained in Polybius' account, combined with comparative evidence from the Athenian navy to estimate the relative cost of naval operations for both Carthage and Rome. It shows that, contrary to prevailing scholarly opinion, Carthage's naval effort was no less extensive than Rome's. In conclusion, it seeks to explain Carthaginian strategy as a result of limitations imposed by cost (...) and geography. Consequently, the critical scholarly consensus rendered against Carthaginian strategy in this war is to be revised. (shrink)

We present two prudent semantics within Dung's theory of argumentation. They are based on two new notions of extension, referred to as p-extension and c-extension. Two arguments cannot belong to the same p-extension whenever one of them attacks indirectly the other one. Two arguments cannot belong to the same c-extension whenever one of them indirectly attacks a third argument while the other one indirectly defends the third. We argue that our semantics lead to a better handling of controversial arguments than (...) Dung's ones. We compare the prudent inference relations induced by our semantics w.r.t. cautiousness; we also compare them with the inference relations induced by Dung's semantics. (shrink)

Important moral dilemmas arise in the context of what I have called jus terminatio and Darrel Moellendorf has called jus ex bello—the norms governing the termination of war. I discuss three dilemmas, showing how they also illuminate proportionality and jus ad bellum: morally accounting for new costs that arise during the course of a war; two variants of the “sunk-cost dilemma” in which an agent is permitted to contribute to a project that is all things considered morally unjust, when (...) that project is morally justified on a forward-looking basis; and the problem of moral hazard in peace negotiations. One of the important determinants of development during the transition to adulthood is the undertaking of social roles characteristic of adults, also in the area of finishing formal education, which usually coincides with beginning fulltime employment. In the study discussed in this paper, it has been hypothesized that continuing full-time education above the age of 26, a phenomenon rarely observed in Poland, can be considered as an unpunctual event that may be connected with difficulties in the process of identity formation. (...) Relationships between identity dimensions and identity statuses, and age and educational context were analyzed. 693 individuals aged 19-35 took part in the study. The participants attended three types of educational institutions: full-time university studies, part-time university studies, and full-time post-secondary school. Among the students of full-time university studies predictable dependencies, also in respect of highlevels of indicators of identity crisis and a high frequency of diffused identity occurrence, were observed. Such dependencies were not found in the group of full-time post-secondary school students. (shrink)

Most individuals realise that we have a moral obligation to avoid the evils of war. But this realization raises a host of difficult questions when we, as responsible individuals, witness harrowing injustices such as ""ethnic cleansing"" in Bosnia or starvation in Somalia. With millions of lives at stake, is war ever justified? And, if so, for what purpose? In this book, Richard J. Regan confronts these controversial questions by first considering the basic principles of just-war theory and then applying those (...) principles to historical and ongoing conflicts. Part One presents two opposing viewpoints: first, that war is not subject to moral norms and, second, that war is never morally permissible. The author rejects both perspectives, and moves to define the principles of just-war theory. He evaluates the roles of the president, Congress and, most importantly, the UN Security Council in determining when long-term US military involvement is justified. The moral limits of war conduct and the moral problem of using, or threatening to use, nuclear weapons are also discussed. On the just cause to wage war, Regan argues that defense of nations and nationals - whether in self-defense or in defense of others - remains the ""only"" classical cause that in the modern world would justify resorting to war. With respect to military intervention in secessionist and revolutionary wars, he contends that such intervention might be justified, but that prudence dictates extreme caution. In considering acceptable war conduct, Regan elaborates the specific principle of discrimination and proportionality; he maintains that civilians uninvolved in the enemy's war should not be directly targeted and that the costs of military action must be proportionate to the anticipated benefits of destroying military targets. The second part of the book presents case studies of eight historical wars - World War I, the Vietnam War, the Falklands War, the revolution and civil war in Nicaragua, the civil war in El Salvador, the Gulf War, the intervention in Somalia, and the Bosnian War - and poses several provocative questions about each. It invites readers and students to apply just-war principles to complex war-related situations and to understand the factual contingencies involved in moral judgements about war decisions. Several species were observed, which led us to propose and then estimate some mathematical models. Computing the functioning of a tree in a given environment therefore involves finding the probability function of the meristems and following the evolution of the parameters of this law along the botanical gradients (order, (...) trend, acrotony) within its architecture. The article is devoted to transformations and the crisis of values in a global world. The genealogy of values is traced as a way of existence and justification of normativity characteristic of modernity. In this context, value is compared with cost. Both the first and second are reductions inherent in the modern way of human existence. Value personifies the reduction of the complex, heterogeneous, qualitatively diverse world of external goods of pre-industrial society to a single denominator of abstract labor. (...) Same, the complexly structured and heterogeneous reality of due acquired the appearance of a single space of values. In this context, the theoretical limitations of the pan-production view of human historical development are analyzed. The current war, which in its impact on humanity has acquired a de facto global character, is considered as a defining symptom of the crisis of values in global reality. War as a feature of the modern world is significant not in itself, but as an expression of the growing role of violence in the life of global civilization. In turn, the increase in violence and coercion is a manifestation of an even deeper process — the depreciation of values. The depreciation of values does not mean the destruction of certain specific values, but in general the role of the due in human life. In this regard, a key question arises about the prospects for overcoming the process of depreciation of values. By analogy with the three recognized paradigms of philosophizing (being, consciousness/subject, language), three historical paradigms of normativity are distinguished: transpersonal indisputable prescriptions (“commandments”); mediated by personal reflection and recognition of binding significance (values); abstinences — negative normative presumptions aimed at ensuring peaceful productive interaction with guaranteed autonomy of participants in interactions. The development of the normative practice of such abstinences may be with a possible scenario for overcoming the depreciation of values in the global world. (shrink)
