Shaul Magid's Meir Kahane: The Public Life and Political Thought of an American Jewish Radical (2021) stresses the American character of Kahane's thought. This review analyzes this claim in two ways. First, it offers a transnational perspective on Kahane's philosophy. Second, it examines Magid's concept of neo‐Kahanism in light of Kahane's legacy in Israel.

The present article focuses on the case of the 2012 hunger-strike of Palestinian prisoners in Israeli jails. We analyze the ethical dilemma involved in the way the Israeli medical community reacted to these hunger-strikes and the question of force feeding within the context of the fundamental dual-loyalty structure inherent in the Israeli Prison Services—system. We argue that the liberal perspective that focuses the discussion on the dilemma between the principle of individual autonomy and the sanctity of life tends to be (...) oblivious to the asymmetrical relation of power that characterizes the prison system and to the socio-political context in which hunger-strikes take place. Emphasizing hunger-strikes as political acts implies that health practitioners’ conducts cannot be analyzed only through the prism of clinical medical ethics. It requires a public health ethics’ approach, an approach that understands health in the context of the complex relationship between society, state, organizations, communities and individuals. The authors are both academics and volunteers in Physicians for Human Rights—Israel thus our analysis is based both on sociological and public health ethics principles and on the continuous work and advocacy for the right to health of prisoners. In a recent paper, Dylan Evans proposed that emotions could help solve what has been known as ‘the frame problem’. In the process, he first questioned the utility of using the frame problem as a framework. After tackling this issue, he provided an alternative terminology to the frame problem—termed ‘the search hypothesis of emotion’—in order to re-examine how emotions aid rational agents. His new terminology, however, opens itself to other critiques. While accepting the basic tenets of his analysis, I question (...) (i) whether a single search theory of emotion is adequate, and (ii) whether his theory would have been better termed ‘the search hypothesis of feeling’. This book offers a systematic account of Wittgenstein's unique ethical thought, both in his early and in his later writings.

This article argues that constitutional mixture should be regarded as an inherent, inevitable feature of constitutions, and to some degree all constitutions are mixed. Thus, “mixed constitutions” should not be regarded as a distinct category of constitutions. Instead of asking whether a constitution is mixed, it might therefore be more useful to ask in which characteristics and to what extent a constitution is mixed. To demonstrate this, the article provides a preliminary typology of constitutional mixture considering the form or system (...) of government; the nature or character of government; the religious or secular identity; the flexibility or rigidity of the constitution; and its model of judicial enforcement—judicial or parliamentary supremacy. Examining these constitutional features, allows to shed light on the three different dimensions of “constitutional mixture”: First, the various features of the constitutional order do not function in a binary yes-or-no manner but appear and move along a spectrum. Magnetic resonance imaging (MRI) is an imaging technique with a rapidly expanding application range. This methodology, which relies on quantum physics and substance magnetic properties, is now being routinely used in the clinics and medical research. With the advent of measuring functional brain activity with MRI (functional MRI), this methodology has reached a larger section of the neuroscience community (e.g. psychologists, neurobiologists). In the past, the use of MRI as a biomarker or as an assay to probe tissue pathophysiological condition (...) was limited. However, with the new applications of MRI: molecular imaging, contrast‐enhanced imaging and diffusion imaging, MRI is turning into a powerful tool for in vivo characterization of tissue pathophysiology. This review focuses on the diffusion MRI. Although it only measures the averaged Brownian translational motion of water molecules, using different analysis schemes, one can extract a wide range of quantitative indices that represent tissue morphology and compartmentalization. Statistical and visualization routines help to relate these indices to biologically relevant measures such as cell density, water content and size distribution. The aim of this review is to shed light on the potential of this methodology to be used in biological research. To that end, this review is intended for the non‐MRI specialists who wish to pursue biological research with this methodology. Статтю присвячено аналізу розуміння ієрархії у православній філософській та богословській думці, та визначенню того, як це розуміння впливає на православний світогляд. Мета статті досягається за допомогою застосування авторами методології, розробленої представниками філософської школи інтегрального традиціоналізму, оскільки остання являє собою продукт глибокого вивчення та зіставлення досвіду різних релігійних традицій, а також виявляє критерії традиціоналістського світогляду як такого, спільні для різних традицій. Зокрема, автори використовують висновки французького філософа-традиціоналіста Рене Генона про сакральну та ініціатичну природу ієрархії у традиційних суспільствах для пошуку відповідників у (...) православній релігійній традиції. Такі відповідники автори знаходять у працях отців церкви, які вважаються канонічними для православної релігійної традиції та являють собою «становий хребет» її філософського світогляду. За підсумками проведеного дослідження, автори даної публікації виявили, що православний релігійний світогляд є ієрархічним за своєю суттю. (shrink)

When quality in an organisational context includes more employee-oriented arrangements and systems, the introduction of a new relationship pattern between employers and employees can rightly be considered a quality program. In this article we describe the shifting roles of HRM and 'people management' in general within a changing environmental and organisational context. We present an original 'FIT' organisational model, in which the role of HRM as 'partner-champion' is highlighted, and which was implemented during the 1990s in a multinational company. Ignoring primitive terms leads to an infinite regress. The alternative is to account for an intuitive understanding into the meaning of such terms. The current investigation proceeds on the basis of an idea of the structure of the various modes of being within which concrete entities function. Examples of primtive terms are given from disciplines such as mathematics, physics and logic and they are related to the general idea of a modal aspect. It is argued that primitive terms are not (...) isolated but reveal their meaning only through their interconnections with other primitive terms that are embedded in other modal aspects. However, although primitive terms are found within the various aspects, the meaning of an aspect only comes to expression through its coherence with other aspects, evinced in modal analogies that are qualified by the core meaning of an aspect. There appears to be two options, either reduce what is irreducible or merely provide synonymous terms for given primitives. The former happens when other unique terms are used to define a specific one and the latter when the attempted ‘definitions’ revert to terms with which the original terms could be meaningfully replaced. It is been pointed out that the coherence between primitives invites every academic discipline to account for the meaning attached to the analogies of primitive terms it is employing, without exploring this additional theme any further. ABSTRACT A common conclusion of lab dishonesty studies is that subjects cheat to a very modest extent even when they cannot get caught. The modest level of cheating is attributed to subjects’ moral feelings which restrict their cheating to a level that enables them to retain their self-image as honest individuals. The present paper questions this claim, reporting the results of two experiments which uncover a discrepancy between self-portrayed honesty and actual dishonest behavior. The experiments reveal, first, that self-portrayed honesty (...) is stricter than practical honesty, suggesting that when facing an opportunity to benefit from dishonest behavior, subjects trade off some of their self-image as honest persons for dishonestly-generated payoffs. Secondly, dishonesty out of lab, in subjects’ self-chosen environment, is greater than in the lab, with a considerable fraction of subjects cheating to the maximum extent possible. We suggest that it is not a concern about their self-image that holds subjects back from cheating maximally, but rather a concern about their social image. The modest level of dishonesty observed in the lab presumably reflects caution subjects exercise in an unsafe setup. Given an environment where they feel safe to reap the fruits of dishonesty without compromising their image as honest persons in the eyes of others, the image they have of themselves hardly plays a role in curbing their unethical behavior. In this paper evidence will be provided that Wittgenstein’s intuition about the logic of colour relations is to be taken near-literally. Starting from the Aristotelian oppositions between propositions as represented in the logical square of oppositions on the one hand and oppositions between primary and secondary colors as represented in an octahedron on the other, it will be shown algebraically how definitions for the former carry over to the realm of colour categories and describe very precisely the relations obtaining between (...) the known primary and secondary colours. Linguistic evidence for the reality of the resulting isomorphism will be provided. For example, the vertices that resist natural single-item lexicalization in logic (such as the O-corner, for which there is no natural lexicalization *nall (=not all)) are not naturally lexicalized in the realm of colour terms either. From the perspective of the architecture of cognition, the isomorphism suggests that the foundations of logical oppositions and negation may well be much more deeply rooted in the physiological structure of human cognition than is standardly assumed. "A demain le bon sexe"... disait, non sans une pointe d'ironie, Michel Foucault, au plus fort de la "révolution sexuelle", et l'on sentait que ce n'était pas gagné. Qu'est-ce que le bon sexe? J'ai écrit ce livre en neuf mois... et toute une vie... Sans doute, pour moi, une manière de réaliser une certaine façon qui fut mienne d'être femme je me revois, dans ma petite chambre mansardée, étudiante, tentant en vain de lire en son entier l'Histoire de la sexualité (...) de Michel Foucault... Que savais-je de la sexualité, que pouvais-je recevoir de cet essai, que je trouvais grandiose, lumineux et obscur? Foucault, le seul des philosophes à parler de "ces choses-là", était bien isolé. Il faudrait du temps pour que ses écrits fassent leur route et du temps pour changer les mentalités. Du temps aussi pour moi, pour pouvoir les entendre, qu'ils fassent écho en moi. "Le sexe, disait Foucault, ça s'administre, la sexualité, ça se subit ; quant à la sensualité, elle est chaque jour à inventer." J'ai voulu rouvrir le dossier, emprunter les chemins qu'il a tracés en 1976 en écrivant son Histoire de la sexualité, qui est l'histoire des discours sur la sexualité, eux-mêmes histoire des corps investis par le pouvoir. Depuis quelques années, un mouvement d'idées venu des Etats-Unis, qualifié de "Révolution transhumaniste", a pris un essor considérable. Demain, on vivra 200 ou 300 ans... et bien sûr en parfaite santé : l'immortalité n'est pas loin! Ces prophéties s'appuient sur les avancées réelles de l'intelligence artificielle et de la recherche en biologie, en particulier dans le domaine du vieillissement, passant ainsi allègrement de l'homme préservé et/ou augmenté à un véritable homme dieu. Mais dès que l'on s'intéresse au cerveau, les données, (...) particulièrement complexes, ne vont pas dans leur sens. Il existe une contradiction criante entre la jeunesse éternelle promise et la réalité actuelle, marquée en particulier par les échecs thérapeutiques répétés dans les maladies neurodégénératives. Forts de leur expérience et de leur autorité dans le domaine des neurosciences et du vieillissement, Danièle Tritsch et Jean Mariani dénoncent l'imposture du transhumanisme et ses excès ou délires, données scientifiques à l'appui. De façon accessible et vivante, avec de nombreux exemples de la vie quotidienne, ils démontrent que les efforts lents et soutenus de la recherche biologique et médicale - auxquels contribuera l'intelligence artificielle - restent la seule voie pour comprendre le fonctionnement du cerveau, le maintenir en bonne santé (cerveau préservé), le doter de capacités nouvelles (cerveau augmenté) et, dans un délai non prévisible, guérir ou stabiliser les maladies neurodégénératives (cerveau réparé). The problems of racism and racially motivated violence in predominantly African American communities in the United States are complex, multifactorial, and historically rooted. While these problems are also deeply morally troubling, bioethicists have not contributed substantially to addressing them. Concern for justice has been one of the core commitments of bioethics. For this and other reasons, bioethicists should contribute to addressing these problems. We consider how bioethicists can offer meaningful contributions to the public discourse, research, teaching, training, policy development, and (...) academic scholarship in response to the alarming and persistent patterns of racism and implicit biases associated with it. To make any useful contribution, bioethicists will require preparation and should expect to play a significant role through collaborative action with others. (shrink)

Trois délires politiques mortifères hantent notre époque. Dans le premier, le délire occidental, la pléonexie (vouloir toujours plus) à l'oeuvre dans le néolibéralisme se transforme en risque de tout perdre (dislocation des subjectivités, déchirure du lien social, épuisement de la planète, destruction des bases mêmes de la vie sur terre). Le second, le délire théo fasciste de l'islamisme djihadiste prétend, contre l'égoïsme érigé en système et la démesure caractérisant l'Occident, restaurer une pureté absolue. Or, quand cette pureté originaire revendiquée se (...) réalise, elle se transforme en souillure et en horreur absolues. Le troisième, le délire identitaire néo-fasciste (qui monte aujourd'hui partout en Europe) se présente comme le seul rempart possible contre les deux premiers. Contre la mondialisation néo-libérale, il prône un retour à la patrie. Non pas une patrie fondée sur un principe universaliste (du type "liberté, égalité, fraternité"), mais une patrie refermée sur elle-même, désignant des boucs émissaires, les étrangers, pour que des acolytes réputés "amis" se regroupent et décrètent contre ces "ennemis" l'"état d'exception". Ces trois délires tendent de plus en plus à former système : on ne sort de l'un que pour entrer dans l'un des deux autres. Puisqu'aucun des garde-fous démocratiques (État, médias et université) ne fonctionne plus, il faut songer à tout refonder à partir des principes de dignité et de commune humanité, également bafoués par ces trois délires. Il se pourrait bien que le travail actuellement fourni par Les Convivialistes puisse fournir les bases de cette reconstruction probablement une des dernières possibles avant la catastrophe annoncée."--Page 4 of cover. The language of rights is increasingly used to regulate access to health care and allocation of resources in the health care field. The right to health has been grounded on different theories of justice. Scholars within the liberal tradition have grounded the right to health care on Rawls's two principles of justice. Thus, the right to health care has been justified as being one of the basic liberties, as enabling equality of opportunity, or as being justified by the maximin principle. (...) In this article, Filc analyzes—from a radical egalitarian standpoint—the limitations of the different attempts to ground an equal right to health on Rawls's theory of justice and offers a first approximation to a radical egalitarian formulation of the right to health. Ten years after the enactment of the Biologics Price Competition and Innovation Act, competition in biologics markets remains scant and far from sufficient for lowering prices of biologics to the level of 80-90% price drops seen in generic drug markets. This reality is not a result of one or two cardinal reasons, but many. If lowering the price of biologics is the goal and competition is the means by which we seek to achieve that goal, then there does not seem (...) to be a quick fix to address all of the many impediments to competition that plague biologics markets. Yet, certain changes to how the Food and Drug Administration evaluates and approves biologics may go a long way toward the creation of meaningful competition in biologics markets. One such change would be making original biologics' manufacturing information available to follow-on manufacturers.As recognized by several commentators, access to biologics manufacturing information is key to increasing competition in biologics markets. Without access to such information, making follow-on biologics is difficult and expensive, if not outright impossible. This is expected to be especially true for the highly anticipated class of interchangeable biologics, none of which has been approved by the FDA to date. Yet, it has long been the position of the brand-name pharmaceutical industry that biologics manufacturing information is proprietary and, thus, may not be shared. Congress has subscribed to the Industry's position, prohibiting the FDA from disclosing regulatory filings submitted by developers of original biologics, including manufacturing information, to third parties. That prohibition not only undermines competition in biologics markets, but is also wasteful, potentially unethical, and poses unnecessary risks to the health and safety of patients.This article makes the case for FDA sharing of original biologics manufacturing information with follow-on biologics developers. It is informed by the similar legal and commercial circumstances in the area of pesticides and the regulatory regime established by Congress in the Federal Insecticide, Fungicide and Rodenticide Act, which is administered by the Environmental Protection Agency. The article reviews the FIFRA regime, including its upholding as constitutional by the United States Supreme Court, and then examines its applicability to the area of biologics. The article concludes with a proposal for a similar regime to be incorporated into the pathway for approval of follow-on biologics as a means of increasing competition in biologics markets. (shrink)

The specificities of mental health care combined with the contemporary context of health care make ethical issues particularly salient in psychiatry. Thus, residents in training in this medical discipline may be particularly exposed to difficult situations involving an ethical dilemma, which can be a cause of distress and moral suffering. Future physicians are equipped with knowledge and skills that should enable them to address the ethical issues inherent to clinical practice, as teaching of this discipline is now a requirement for (...) accreditation of residency training programs in Canada. However, many questions remain about the design of a valid and effective clinical ethics education for these young practitioners. In this essay, we attempt to sketch out possible answers to this wide range of questions, based on our experience as residents. After having examined some of the specificities of the ethics curriculum which we benefited from the psychiatry residency program at the University of Sherbrooke, we analyze how its structure can be a good example for ethics training of other young professionals, that is, residents. More specifically, we highlight how creating a space to acknowledge the suffering of the care giver in-training can have an impact on their own sensitivity to the suffering of the patient who they are treating. The recent publication of a special number of the SAJP dedicated to a discussion of Samantha Vice’s thoughts on being a white South African prompted this reflection on justice, equity and the modern idea of the state – against the background of moral feelings of guilt and shame, cultural diversity and merging identities. Its aim is to provide a perspective on the unity of the public legal order of the state, the distinct meaning of citizenship and affirmative action in terms (...) of the distinction between constitutive and regulative legal principles also helping white South Africans to understand how affirmative action relates to injustices of the past. The classical understanding of equity will play a key role in this discussion, aimed at showing how we can avoid the apparent impasse of equality before the law and of “fair discrimination.”. (shrink)
