In Understanding Social Action, Promoting Human Rights, editors Ryan Goodman, Derek Jinks, and Andrew K. Woods bring together a stellar group of contributors from across the social sciences to apply a broad yet conceptually unified array of advanced social science research concepts to the study of human rights and human rights law.

This essay addresses recent claims about the compatibility of the sociobiological theory of reciprocal altruism with standard Western formulations of the Golden Rule. Derek Parfit claims that the theory of reciprocal altruism teaches us to be “reciprocal altruists,” who benefit only those people from whom we can reasonably expect benefits in the future. The Golden Rule, on the other hand, teaches us to benefit anyone regardless of their intention or ability to return the favor, or as Parfit puts it, (...) the Golden Rule teaches us to be “suckers.” I argue that this distinction is founded on a misconception of the nature of the theory of reciprocal altruism, which is sociobiological as opposed to moral, and that this distinction accordingly confuses is with ought. Sociobiological theories may explain underlying psychological motivations in individuals (and perhaps even in populations), but these theories do not prescribe any sort of moral behavior. Furthermore, the theory of reciprocal altruism does not imply mental states of which agents are aware. The unconscious motivations assumed by this theory are in fact compatible with certain formulations of the Golden Rule; I will accordingly argue for the view that certain words with moral content related to the Golden Rule—such as “altruism” and “selfishness”—exist only insofar as they are social tools, which can further the self-interests of an individual in any group. This chapter offers an opinionated introduction to higher-order formal languages with an eye towards their applications in metaphysics. A simply relationally typed higher-order language is introduced in four stages: starting with first-order logic, adding first-order predicate abstraction, generalizing to higher-order predicate abstraction, and finally adding higher-order quantification. It is argued that both β-conversion and Universal Instantiation are valid on the intended interpretation of this language. Given these two principles, it is then shown how we can use pure higher-order logic to (...) ask, and begin to answer, metaphysical questions with non-trivial implications. In particular, while we must reject the popular idea that structural differences between sentences correspond to parallel distinctions in the logical structure of extra-linguistic reality, it may still be possible to give a purely logical characterization of objectual aboutness and related notions. Early discussions of ?climate justice? have been dominated by economists rather than political philosophers. More recently, analytical liberal political philosophers have joined the debate. However, the philosophical discussion of climate justice remains in its early stages. This paper considers one promising approach based on human rights, which has been advocated recently by several theorists, including Simon Caney, Henry Shue and Tim Hayward. A basic argument supporting the claim that anthropogenic climate change violates human rights is presented. Four objections to this (...) argument are examined: the ?future persons? objection; the ?risk? objection; the ?collective causation? objection; and the ?demandingness? objection. The Tattvasaṃgraha, or Encyclopedia of Metaphysics, is the most influential and most frequently studied philosophical text from the late period of Indian Buddhism. This edition includes verses by Śāntarakṣita (c. 725-788 CE), which are clarified and expounded in the commentary of his student Kamalaśīla (c. 740-795 CE); both of these authors played crucial roles in founding the Buddhist tradition of Tibet. In the Tattvasaṃgraha, they explain, discuss and critique a vast range of views and arguments from across the whole South (...) Asian philosophical and religious spectrum. The work deals at length with ideas drawn from Buddhism, Jainism, and a variety of traditions now incorporated within Hinduism, including Mīmāṃsā, Nyāya-vaiśeṣika, and Sāṃkhya; it also includes the earliest discussion of Advaita Vedānta in any Buddhist text. The chapters selected for translation from Sanskrit and Tibetan deal with such fundamental philosophical issues as the existence or nonexistence of God and the soul; the nature of matter and of causal relationships; the connection between words and their referents; the rules of logic; the sources of our knowledge; and the compatibility of beliefs about karma with Buddhism's fundamental claim that there is no self. I defend the thesis that most or all perceptual experiences are infused with imaginative contributions. While the idea is not new, it has few supporters. I begin by developing a framework for the underlying debate. Central to that framework is the claim that a perceptual experience is infused with imagination if and only if there are self-generated contributions to that experience that have ampliative effect on its phenomenal and directed elements. Self-generated ingredients to experience are produced by the subject as (...) opposed to being received from the world. Some form of stored content is an obvious starting point. Ampliative effects are aspects of perceptual experience that outstrip the content the senses get from the world. This conceptual framework is applied to three case studies: object-sameness and object-kind recognition (section 2), memory colour (section 3), and perceptual constancy and amodal completion (section 4). If the three cases and my overall analysis are accepted (a substantive if), then we have a forceful inductive argument for perception being infused with imagination. (shrink)

This is the second volume of a major new work in moral philosophy. It starts with critiques of Derek Parfit's work by four eminent moral philosophers, and his responses. The largest part of the volume is a self-contained monograph on normativity. The final part comprises seven new essays on Kant, reasons, and why the universe exists.

This paper discusses varieties of normative phenomena, ranging from morality, to epistemic justification, to the rules of chess. It canvases a number of distinctions among these different normative phenomena. The most significant distinction is between formal and authoritative normativity. The prior is the normativity exhibited by any standard one can meet or fail to meet. The latter is the sort of normativity associated with phenomena like the "all-things-considered" ought. Closest-possible-world analyses of counterfactuals suffer from what has been called the ‘problem of counterpossibles’: some counterfactuals with metaphysically impossible antecedents seem plainly false, but the proposed analyses imply that they are all (vacuously) true. One alleged solution to this problem is the addition of impossible worlds. In this paper, I argue that the closest possible or impossible world analyses that have recently been suggested suffer from the ‘new problem of counterpossibles’: the proposed analyses imply that some plainly true counterpossibles (viz., (...) ‘counterlogicals’) are false. After motivating and presenting the ‘new problem’, I give reasons to think that the most plausible objection to my argument is not compelling. (shrink)

It’s intuitive to think that an intentional action requires that the agent knows that she’s doing so. In light of some apparent counterexamples, Setiya suggests that this intuitive insight is better captured in terms of credence: performing an intentional action requires the agent to have a higher credence that she’s doing so than she would have otherwise. I argue that there is no such thing as an agent’s credence for what she’s doing. After distinguishing this thesis from an idea some (...) defend under the slogan “deliberation crowds out prediction”, I explore the thesis’s broader epistemological implications for the belief-credence relation. The book opens by describing the author's life-changing encounter with a Zen Buddhist monk in 1977, over a cup of tea. Returning to his beginnings, Goodman recounts his coming-of-age, from participating the 1960’s U.S. protests and Vietnam-War resistance, to finally settling down in Canada. He describes his role in a supporting, (...) silent vigil around Willard Straight Hall at Cornell University, the night after it had been occupied by protestors, and his later application for Conscientious Objector status, following the U.S. draft lottery in 1969. Mengzi states that our human nature consists of our ability to feel compassion, disdain, respect, and (dis-)approval: all human beings have them. But he also states that we lose these four emotional capacities if we don’t reflect on or attend to them. There is an apparent contradiction in saying that all humans have them, but some have lost them. This essay offers a close reading of Mengzi’s phrase “to lose it” that helps explain away this appearance of contradiction. It is not unusual for the adjective ‘vulnerable’ to be applied to those in receipt of nursing practice without making clear what it is that persons thus described are actually vulnerable to. In this paper I argue that the way nursing has adopted the idea of vulnerability tends to imply that some people are in some way invulnerable. This is conceptually unsustainable and renders the idea of the vulnerable patient meaningless. The paper explores the meaning of vulnerability both in general (...) terms and in the context of nursing practice. It is argued that to be in receipt of nursing is to become, to a greater or lesser extent, more‐than‐ordinary vulnerable. Thus all patients are more‐than‐ordinarily vulnerable and this restricts their potential to flourish. Nurses are well placed to contribute to the flourishing of more‐than‐ordinarily vulnerable persons and my substantive claim is that this ‘protective’ function is indeed a legitimate and fundamental part of the role of nurses. This essay is an introduction to the Routledge Handbook of Philosophy of Colour. Why has the examination of many different aspects of colour been a prominent feature in philosophy, to such an extent that the topic is worthy of a handbook? Here are two related answers. First, colours are exceedingly familiar, seemingly simple features that become enigmatic under scrutiny, and they are difficult to capture in any familiar-sounding, unsophisticated theory. Second, through colour one can confront various problems that span the (...) breadth of philosophy, including problems pertaining to perception, the mind-body relation, the nature of science, scepticism, vagueness, meta-ethics, and aesthetics. Th ere is much controversy surrounding the nature of the relation between fictional individuals and possible individuals. Some have argued that no fictional individual is a possible individual; others have argued that (some) fictional individuals just are (merely) possible individuals. In this paper, I off er further grounds for believing the theory of fictional individuals defended by Amie Thomasson,viz., Artifactualism, by arguing that her view best allows one to make sense of this puzzling relation. More specifically, when we realize that (...) the view allows for an identification of merely possible individuals with fictional individuals, we seethat the utility, and hence the level of credence lent to Artifactualism, is increased. An original study of late Enlightenment aesthetics, poetics, and environmental medicine as overlapping ways of comprehending the dislocations of historical existence lodged in the movements of bodies and minds This book studies later eighteenth-century medicine, aesthetics, and poetics as overlapping forms of knowledge increasingly concerned about the relationship between the geographical movements of persons displaced from home and the physiological or nervous "motions" within their bodies and minds. Looking beyond familiar narratives about medicine and art's shared therapeutic and harmonizing ideals, (...) this book explores Enlightenment and Romantic-era aesthetics and poetics in relation to a central but less well known area of eighteenth-century environmental medicine: pathology. No mere system of diagnosis or classification, philosophical pathology was an art of interpretation, offering sophisticated ways of reading the multiple conditions and causes of disease, however absent from perception, in their palpable, embodied effects. For medical, anthropological, environmental, and literary authors alike, it helped to locate the dislocations of modern mobility when a full view of their causes and conditions remained imperfectly understood or still unfolding. Goodman traces the surprising afterlife of the period's exemplary but unexplained pathology of motion, medical nostalgia, within aesthetic theory and poetics, arguing that nostalgia persisted there not as a named condition but as a set of formal principles and practices, perturbing claims about the harmony, freedom, and free play of the mind. Orthodox Judaism is one of the fastest-growing religious communities in contemporary American life. According to the 2013 Pew Center Survey on American religious life, Orthodox Judaism is poised to surpass all other denominations of Judaism in the United States by 2050. Anyone who wishes to understand more about Judaism in America will need to consider the tenets and practices of Orthodox Judaism: who its adherents are, what they believe in, what motivates them, and to whom they turn for moral, intellectual, (...) and spiritual guidance. Among those spiritual leaders none looms larger than Rabbi Joseph B. Soloveitchik, heir to the legendary Talmudic dynasty of Brisk and a teacher and ordainer of thousands of rabbis during his time as a Talmud teacher at Yeshiva University from the Second World War until the 1980s. Soloveitchik was not only a Talmudic authority but a scholar of Western philosophy. While many books and articles have been written about Soloveitchik's legacy and his influence on American Orthodoxy, few have looked carefully at his disciples in Torah and Talmud study, and even fewer at his Jewish thought and philosophy. This is Thomas Reid's greatest work. It covers far more philosophical ground than the earlier, more popular Inquiry. The Intellectual Powers and its companion volume, Essays on the Active Powers of Man, constitute the fullest, most original presentation of the philosophy of Common Sense. In the process, Reid provides acutely critical discussions of an impressive array of thinkers but especially of David Hume. In Reid's eyes, Hume had driven a deep tendency in modern philosophy to its ultimate conclusions by creating (...) a phantom-world of so-called 'ideas' that sprang from objects of observation; the self was a conglomeration of perceived ideas; and the will as the source of action was nothing but the balance of passionate impulses. -/- Reid's Common Sense philosophy answers these problems by suggesting that sceptics, such as Hume, unavoidably affirm what they purport to deny, namely the existence of a stable external world, of other minds, of the continuity of their own minds, and of their own and other people's ability to ascribe and accept responsibility for actions. At first pass, colour constancy occurs when one sees a thing in one’s environment to have a stable colour despite differences in the way it is illuminated. The phenomenon is intuitively grounded for example in everyday experiences in which something is partly shadowed but, in some sense, looks to be uniformly coloured. After a brief introduction to the colour constancy concept (§0) and the science of colour constancy (§1), my focus is on the significance of colour constancy for two intertwined (...) philosophical issues. The first is colour ontology, where constancy has been used to argue for the objectivity of colour, and in particular for a reductive form of it (see §2). The second is colour constancy’s complicated connection to colour experience and colour epistemology. Colour constancy is a subtle phenomenon: it is situated at the intersection of perceptual experience and judgement; it is influenced by myriad forces within our visual-cognitive systems; and is likely a composite of interestingly disparate phenomena. I approach this suite of issues from the perspective of the given in colour perception (§3). As will become plain, the ontological and epistemic issues are related in important ways. Victor Tadros, in this chapter, draws attention to significant overlap in our practices of providing treatment to irresponsible wrongdoers, on the one hand, and our practices of holding the responsible to account, on the other. Alternately, how little space there is between treatment and holding accountable. This should be surprising. Much of Strawson’s argument presupposes that we have implicit familiarity with the difference, and with how significant it is. We become angry with the responsible; whereas we take a more detached (...) perspective to children, the seriously impaired, or mentally ill, whom we regard as objects of treatment or management. These are supposed to represent two fundamentally distinct forms of engagement. If Tadros is right, this sense of a massive gulf in how it is appropriate to treat the responsible versus the exempt is an illusion. The actual difference is subtle. (shrink)

Many of our deepest disagreements turn on matters of definition. Philosophers discuss the definitions of knowledge, art, truth, and freedom, and social and political questions about personhood, health and disease, marriage and gender are also commonly thought of as turning in part on definitions. This book contributes to our understanding of how we engage with questions and disagreements of this kind. It argues that disputes about matters of definition are not just about the meanings of words or our concepts, and (...) they do not typically involve change of meaning. Instead, it develops a conception of definition on which engaging in an investigation or a discussion helps determine the meanings of our words without changing them; what is determined is the meaning our words had all along. This temporal externalist view—that what happens at the end of our investigation or discussion can play a role in determining what we meant and thought throughout—puts us in a position to see why typical ways we engage with questions of definition make sense, and are not confused or in need of revision. The book develops this style of view in unprecedented detail and shows how it helps make sense not only of definitional disputes, but also of disagreements about matters of taste (such as discussions of whether a particular food is delicious, or a certain film is funny.) Its defencse of temporal externalism includes powerful new criticisms of competing philosophical views about verbal dispute, metalinguistic negotiation, inconsistent concepts, conceptual engineering, and relativism.
