Acts of violence and murder have historically proved difficult to accommodate in standard accounts of the formula of universal law (FUL) version of Kant’s Categorical Imperative (CI). In “Murder and Mayhem,” Barbara Herman offers a distinctive account of the status of these acts that is intended to be appropriately didactic in comparison to accounts like the practical contradiction model. I argue that while Herman’s account is a promising one, the distinction she makes between coercive and non-coercive violence and her response (...) to concerns with the classification of the latter as imperfect duties raise significant questions about the status of some duties. I suggest that we look, instead, to Kant’s treatment of suicide in The Metaphysics of Morals for an account of norms of non-violence and, in particular, to the connection between this duty and concerns with inner freedom and moral health. I argue that we can use this account to inform our general understanding of duties prohibiting killing and violence, and that the resulting account is a promising one. (shrink)

When referring to his first efforts in philosophy, particularly those contained in his Hypothesis Physica Nova and Theoria Motusa, Leibniz would often introduce them with vaguely disparaging remarks, such as “When my philosophy was not yet mature…,” or “Before I became a mathematician….” This is understandable, I would think, in terms of his desire to show how much his thought had progressed since that time, especially in mathematics. But some commentators, on being confronted with the unsystematic style of these early (...) works and the apparent contradictions of the theory of the continuum contained in them, seem to have interpreted Leibniz’s disclaimers as amounting to a complete renunciation of them. L’examen comparatif des trois grands systèmes de gestion des pêches est fondé sur des institutions guidées par la recherche d’un compromis entre critères écologiques et socio-économiques. La situation européenne se situe entre le mode décentralisé aux États-Unis et le régime canadien, le plus enraciné historiquement dans une conduite centralisée. En effet, la gestion des pêcheries, en Europe et en Amérique du Nord, est désormais intégrée à une approche écosystémique.This article focuses on the advantages and limitations of regionalization in fisheries, using the experiences of Europe, the United States, and Canada. Regionalization in European fisheries has encountered several obstacles that have greatly reduced its scope since implemented in 2004. After discussing the historical dimension of the Common Fisheries Policy, the methodological approach draws on neo-institutional economics and research on the socio-systems. The third section is devoted to a comparative approach between three main fisheries management systems in Europe, the United-States and Canada. Since the passage of the Magnuson Act, the U.S. has experimented with advanced forms of decentralization. Canada, on the other hand, has evolved towards a more centralized form of fisheries management. In reviewing these three cases, Europe seems to be somewhere between these other two examples. Decentralized management using markets and rights-based management in principle offers a better allocation of fishing efforts than centralized management because it takes into account the regional or even local nature of the resources exploited and the human populations that depend on them. However, the financial burden related to decentralized fisheries management may be expensive for the institutions involved. The comparative approach of the three major fisheries management systems is based on institutions guided by the search for a compromise between ecological and socio-economic criteria. Indeed, fisheries management in Europe and North American is now integrated into an ecosystems approach. (shrink)

The development of symbolic logic is often presented in terms of a cumulative story of consecutive innovations that led to what is known as modern logic. This narrative hides the difficulties that this new logic faced at first, which shaped its history. Indeed, negative reactions to the emergence of the new logic in the second half of the nineteenth century were numerous and we study here one case, namely logic at Oxford, where one finds Lewis Carroll, a mathematical teacher who (...) promoted symbolic logic, and John Cook Wilson, the Wykeham Professor of Logic who notoriously opposed it. An analysis of their disputes on the topic of logical symbolism shows that their opposition was not as sharp as it might look at first, as Cook Wilson was not so much opposed to the « symbolic » character of logic, but the intrusion of mathematics and what he perceived to be the futility of some of its problems, for logicians and philosophers alike. All editors and translators that I know of render the first part of this passage along the lines of ‘They changed the usual meanings of words‘. Thus Weil and Romilly talk of ‘le sens usuel des mots’,1 Stahl of ‘usitatam vocabulorum significationem’,2 Bloomfield of ‘the accustomed acceptation of names’;3 the most popular modern English translation gives ‘words... had to change their usual meanings’,4 and the best-known modern commentary the phrase in my title – ‘the customary meanings of words were changed’.5 (...) The passage is widely quoted, not only by ancient historians but also by sociologists and philosophers; and one suspects the excitement of this translation to be at least a part-cause of the passage's fame. Comparisons are made with modern propaganda, Orwell's 1984, and so on. But this translation must be wrong; unfortunately for generations of believers, though fortunately for the reputation of Thucydides, who would otherwise be saddled with a nonsensical piece of writing. Neodarwinian ethology, today above all represented by sociobiology, is conceived of by responsible exponents as a descriptive and explanatory theory that cannot include any normative declarations. Still other, indeed notable, authors belonging to the discipline in question, either underhand or frankly employ prescriptive or evaluative judgments, — or they claim (what is not an insight of natural science) that it is impossible to provide a rational foundation for prescriptive or evaluative judgments. (Michael Ruse and Edward O. Wilson even assert (...) the latter without relinquishing the former.) — Several functional explanations of normative validity claims advanced by Michael Ruse, Edward O. Wilson, Donald T. Campbell, Florian von Schilcher and Neil Tennant are designed to show that prescriptive or evaluative judgments cannot be justified. The reasonableness of this move is, however, dubious, because it implies strategies of raising oneself into a privileged status or of rendering the position of oneself immune from criticism by shifting it among the objects of the theory. Then Wilson's concept of 'evolutionary ethics' is thoroughly — and critically — analyzed. The suspicion that Wilson's fallacies in the transition from biological facts to moral norms are of exemplary nature is finally examined on the basis of tenets advanced by Herbert Spencer, Wolfgang Wickler, and Hans Mohr. We cannot talk about the role of philosophy of education in teachers' training programs without examining the relationship between philosophy and educational theories. Even when theoreticians like Kieran Egan, for example, claim that education is a normative discourse that cannot be inferred from "local" empirical psychological research, the role of philosophy seems of utmost importance because philosophy has essentially to do with norms and values. Another way of looking at the "sciences" of education that renews our comprehension of their relationship (...) is by analysing a new cognitive psychological approach named "metacognition" which rests on one's ability to understand one's own cognitive strategies and mechanisms of regulation. The well-known psychologist Adrien Pinard in Quebec has been working on those concepts lately, inspired by Flavell's model of cognitive regulation. This approach is remarkably similar both to Wilson's definition of procedural criteria which he claims educational theory is all about and to the very specific method of philosophy, that of analytical and reflective thought. Philosophy or reflective thought cannot be separated from practice in teacher training since education is not only a matter of pedagogical means but also of attitudes to and relationship with another person. Thus, besides theory and practice, a third parameter should be taken into account in the elaboration of a teacher training program: the meta-practice and theory parameter, or the reflection on one's own practice, which is essentially philosophical. Margaret Wilson, who died last year, has been described as the most eminent English-language historian of early modern philosophy of her generation. She was President of the Leibniz Society of North America for four years, from 1986 to 1990. Within this organization she is remembered both for her contributions to Leibniz-studies and for her attention to and support of younger researchers and her governing role in the Society. Her Harvard Ph.D. dissertation on “Leibniz’s Doctrine of Necessary Truth,” written under (...) the supervision of Morton White, was completed in 1965, and she went on to write a number of papers on Leibniz in the late 1960s and early-to-mid 1970s, including “Leibniz and Materialism,” “Confused Ideas” and “Leibniz’s Dynamics and Contingency in Nature,” returning to Leibniz in the late 1980s and early 1990s with such articles as “Compossibility and Law” and “The Phenomenalisms of Leibniz and Berkeley. ” Over the course of her career, Wilson published two books, her dissertation, which appeared in a series issued by Garland in 1990, and Descartes, published by Routledge and Kegan Paul in 1978, as well as more than thirty papers on seventeenth and eighteenth century philosophy, nearly all of which are included in the recent volume from Princeton University Press, Ideas and Mechanism. She held a number of research awards and honorary fellowships, including a Fellowship in the American Academy of Arts and Sciences to which she was elected in 1992. (shrink)
